PROJECT DESCRIPTION The proposal is to enlarge the 11th tee at Foster Links Golf Course and to regrade the green approach to improve drainage. 2. POLICIES OF THE SMA The site is within the jurisdiction of the City of Tukwila Shoreline Master Plan ( "SMP "). The policies of the SMP are categorized into the following elements: A. The Economic Development Element requires that development be economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. B. The Public Access Element requires that the development provide for pubic access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Recreational Element requires that recreational opportunities along the river should be preserved and enhanced. E. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses and allow for multiple uses. F. The Conservation Element requires that the river be buffered from the effects of development, where feasible facilities for intensive recreational activities should be provided and scenic views should be protected. G. Jack Pace L2000 -041 July 7, 2000 Page 2 The proposed project is consistent with the goals and policies of the SMP including the preservation and enhancement of recreational opportunities that are compatible with water - dependent uses. It will not adversely affect land use, economic development, public access circulation or recreation along the shoreline. TUKWILA SHORELINE REGULATIONS The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay Zone (TMC 18.44): The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. This district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows uses permitted in the underlying zoning district. A small portion of the 11th Tee reconstruction will occur within the 40 -foot River Environment. However, the riverbank will not be disturbed and no trees will be removed. The work to be performed in the River and High Impact Environments includes the reshaping of existing material for improved challenge of play and uniformity of drainage. Some shrub masses in the Low Impact Environment will be removed and transplanted. The existing (and continued proposed) use of the 11th Tee meets the Shoreline Overlay regulations. TMC 18.44.110 - General Shoreline Regulations All uses within the Shoreline Zone must conform to the following general regulations: (1) The use is in conformance with the regulations of the underlying zone district. Response: Foster Golf Links is located in the Public Recreation Overly zone and is an allowable use in that zone. The 11th Tee of the golf course is located in the Shoreline Overlay zone and is an allowable use in that zone. (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. Response: No new structures or facilities are proposed under this permit. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit. (5) Response: A small portion of the 11th Tee reconstruction will occur in the existing turf area, located within the 40 -foot River Environment. However, the riverbank will not be disturbed and no trees will be removed. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. Response: The Green River has a water quality designation of Class A. The project will not discharge effluent into the river. (6) All State and Federal water quality regulations shall be strictly complied with. Response: All State and Federal water quality regulation will be strictly complied with. (7) Wildlife habitat in and along the river should be protected. (8) (8) Response: The project lies within the Pacific Flyway migration route for various waterfowl. The river is part of a migration route for anadromous fish. The existing wildlife habitat along the riverbank will be protected. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. Response: Best Management Practices (BMP's) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. All necessary permits shall be obtained from Federal, State, County or municipal agencies. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. COMPREHENSIVE PLAN SHORELINE POLICIES The policies of the Comprehensive Plan that affect shoreline development are found in the Shoreline Element. Shoreline Element - Development should minimize impact on important habitat features, protect and restore degraded riverbanks and mitigate unavoidable disturbance of vegetation and habitat. Development should minimize water pollution, provide erosion control and protect water quality. Capital improvement projects and private development should not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. Over -water structures or reinforcement of the riverbank allowed only when it provides long -term public benefit or is essential to a water - dependent use. Development should reflect the river's role in Tukwila history, protect the long -term public use of the river and reflect community traditions. Development should include high - quality site planning, architecture, landscaping, provide for open space and provide a trail for public access along the river (for areas included in the Green River Trail Plan). Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses and encourage efficient use of the land. The project will not impact habitat features in or along the riverbank. Water quality will be protected during project construction through the use of Best Management Practices to prevent erosion and sedimentation. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. No over -water structures are proposed under the permit. The project will enhance of the golf course, which is an existing long- term use of land adjacent to the river. The reconstruction of the 11th Tee and associated landscaping enhances existing public open space and maintaining views of the water. This tee is the only portion of this year's work which falls within the 200 ft shoreline area from the nearby Duwamish River. The tee will be reshaped from existing material for improved challenge of play, uniformity in drainage and more opportunity for season of play. Grading activities will include 232 c.y. of cutting and 190 c.y. of filling (reuse of same material). Some topsoil and sand base will be imported however no export of material from the entire project site is expected. Demolition will include removal of 12100 s.f. of sod, removal of 9 ornamental cherry trees, the transplanting of portions of several large rhododendron masses and demolition of approximately 50s.f. of concrete tee off slabs. The completed work will include sod restoration and the replacement of the two tee off slabs. Net area of impermeable surface will not increase. Work within the 40ft river environment will not be outside of the existing golf turf area. (The eleventh Tee falls within 200 ft Shoreline zone). General Shoreline Regulations (TMC 18.44.110) 1. Public recreational use is a allowed use within zoning and use predates all shoreline regulations. 2. Use complies with goals and policies of the Shoreline Master Program and use predates shoreline regulations. 3. Not applicable as no structures or accessory facilities are involved. 4. Work is within the existing turf area and no work will involved river environment. 5. No effluent will be discharged into river. 6. All State and Federal water quality regulations shall be strictly complied with. 7. Wildlife habitat in and along the river shall be protected. 8. During construction erosion control measures will be in place and the final land forms will be continuously maintained to prevent erosion. 9. All necessary permits shall be obtained from Federal, state, County and/or Municipal agencies. 10. No dredging will occur. 11. No mining will occur. 12. No solid waste disposal will occur. 13. No property transfer will occur. 14. No earthwork will occur within the river channel . 15. No Populus trichocarpa will be removed from the project area within the 200 ft zone.
