The attached boundary line adjustment is a conversion of Tract D, a private access tract
for Lots 12 and 13, to an easement over the easterly 20 feet of Lot 12. The easement
contains the same restrictions and requirements of the original Tract D, that is that it is for
private access and utilities that shall be maintained by the owners of Lots 12 and 13.
The Fire Department and the Public Works Director have each approved the proposal.

Yes.
right now the easements go with the tract. When the tract goes away, will the easements automatically
go to each lot?
No, this BLA is converting the tracts (common private owner ship in homeowners association.) to
easements (private property reserved for common use for utilities, public ped and vehicular access. )
Right now the maintenance on the tracts is the homeowner associations responsibility. Are you
suggesting the homeowner association will maintain parts of these lots when they become private
property? Or is each lot responsible for the maintenance on that lot's property? This is not spelled out
anywhere.
Tract D as originally approved was to be maintained by owners of Tots 12 and 13.
Tract C as orginally approved was to be maintained by the Juntion homeowners association.
Both these situations are not to change. The Easement Note says: "Easements are hereby reserved
over under and upon Tracts C and D of the Plat of The Junction, Vol >.. for the purpose of and subject to
the responsiblities for said tracts contained in said plat. " I will send you a copy of the Plat as it was
recorded.
Please let me know if you think any of the wording should be changed on the note. Thanks Moira

10. EASEMENTS & RESERVATIONS AS SET FORTH ON THE FACT OF THE PLAT:
An easement is hereby reserved for and granted to any public utility
and their respective successors and assigns under and upon the front
ten (10) feet parallel with and adjoining the street frontage of all
the lots and tracts in which to install. lay. construct. renew.
operate and maintain underground pipe. conduit. cables. wires, water
