A. REQUIRED IMPROVEMENTS - Before any final subdivision, short plat, binding site improvement plan or boundary line adjustment is finally approved, the subdivider shall install required improvements and replace or repair any such improvements which are damaged in the development of the subdivision. In lieu of installation of all required improvements, the subdivider may execute and file with the City an agreement guaranteeing completion of such improvements together with any needed replacement or repair. The agreement shall: 1. Specify the period of time within which all work required shall be completed. The time for completion shall not exceed one year from the date of final approval of the subdivision. The agreement may provide for reasonable extensions of time for completion of work. Extensions must be requested, approved by the City Council, and properly secured in advance of the required initial completion date. 2 Require notice by the subdivider to the Public Works Director promptly upon completion of all required improvements. 3. Provide for notice of approval or disapproval by the Public Works Director of the improvement within a reasonable time after receiving notice of completion. 4. Require financial security to be provided by the subdivider pursuant to TMC 17.24.030C. 5. Provide that if the subdivider fails to complete all required work within the period specified, the City may take steps to demand performance of the developer's obligation within a reasonable time not to exceed 90 days from the date of demand. 6. Provide that if the required improvements are not completed within that time, the City may take action to require the subdivider forfeit the financial security. 7. Provide that the City shall be entitled to recover all costs of such action including reasonable attorney's fees. 8. Provide that following recovery of the proceeds of the financial security, those proceeds shall be used to complete the required improvements and pay the costs incurred. 9. Provide that should the proceeds of the financial security be insufficient for completion of the work and payment of the costs, the City shall be entitled to recover the deficiency from the subdivider. B. MAINTENANCE AGREEMENT - Regardless of whether all required improvements are completed prior to final approval of any subdivision of land, as a condition of such approval the subdivider shall execute an agreement to assure successful operation of said improvements. The agreement shall: 1. Require the subdivider to post a bond or other financial security to secure successful operation of all required improvements and full performance of the developer's maintenance obligation. Such financial security shall be effective for a two -year period following approval of installation of all required improvements. 2. Require the subdivider to perform maintenance functions on drainage improvements for a period of time not to exceed two years from approval of their completion or final plat approval, whichever is later. Such maintenance functions shall be specified by the Public Works Director and shall be reasonably related to the burdens which the subdivision will impose on drainage facilities during the time maintenance is required. The City Council may agree to accept and perform maintenance of the improvements, in which case the subdivider's obligation to perform maintenance functions shall terminate. 3. Not relieve the subdivider of liability for the defective condition of any required improvements discovered following the effective term of the security given. 4. Provide a waiver by the subdivider of all claims for damages against any governmental authority which may occur to the adjacent land as a result of construction, drainage and maintenance of the streets and other improvements. C. PERFORMANCE BOND - To assure full performance of the agreements required herein, the subdivider shall provide one or more of the following in a form approved by the City Attorney: 1. A surety bond executed by a surety company authorized to transact business in the State of Washington. 2. An irrevocable letter of credit from a financial institution stating that the money is held for the purpose of development of the stated project. 3. An assignment of account with a financial institution which holds the money in an account until such time the City signs a written release. The assignment of account will allow the City to withdraw the funds in the event the provisions of the agreement are not met. 4. A cash deposit made with the City of Tukwila. D. Amount of Financial Security: The financial security provided shall be 150% of the estimated cost of the improvements to be completed and all related engineering and incidental expenses, final survey monumentation and preparation of reproducible mylar or electronic records in a format approved by Public Works and meeting, current Public Works drawing standards of the "as- built" improvements. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chairman of the Short Subdivision Committee signs your short plat constituting a grant of final approval. Recording It is your responsibility to record the City approved short plat documents first with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. The signature of the Chairman of the Short Subdivision Committee certifies that your short plat is ready for recording. December 17, 2001 CITY OF TUKWILA DEC 2 1 2001 PERMIT CENTER We are purchasing the two back lots of the Olivier short plat. Our scheduled closing date, which is a firm date, is March 30, 2002. It is important that we are able to have the short plat recorded prior to that date. The latest letter from Tukwila to Olivier, dated September 14, 2001, paragraph 1.g states that the common improvements must be constructed or a bond posted in the amount of 150% of the estimated cost of construction as determined by the Director of Public Works prior to the short plat being recorded. Since it is the winter season and an especially wet winter it would be difficult to do the necessary work which involves trenches up to 7 feet deep prior to our deadline, we agreed that the best option would be to bond this work and proceed with the completion of the short plat. We discussed that the amount of the bond would be to itemize all of the tasks necessary to complete the work and get a bid from a contractor as a basis for the amount of the bond. The bond would be 150% of the agreed construction costs. We have to do a considerable amount of work on this project prior to purchasing the lots. Several pages from that manual are referenced and reproduced in this report. The drainage manual defines several levels of drainage review. This site qualifies for a Small Site Drainage Review. The thresholds that determine this level of drainage z review includes the following: (These criteria are shown on page 1 -9 of the drainage 6 manual). This includes the removal of a portion of the existing concrete driveway in the z o. back portion of the lot and the removal of the small shed near the existing house. Finally, the site will clear less than 35% of the parcel area. Counting the new access road and the new houses, the amount of new u_ site clearing for this project will be 29 %. v to The manual requirements for small site drainage review has several options that are to be z ~ evaluated in a preferred order. The preferred option is infiltration for roof downspout drains and driveways. A couple of the requirements for the use of infiltration is that the soils must be medium or coarse sands. The soils in this area are mapped as an Alderwood series soil. Essentially, the soils are too fine to qualify for total site infiltration. The soils can be categorized as loamy sand or silt. They are not the medium sands that are recommended in the manual for infiltration applications. Additionally, it is anticipated that there is a high water table in this area, generally due to a restrictive layer of dense soils that are relatively shallow. In the event that infiltration is not available, the drainage manual allows for other alternatives. If the lots are over 22000 SF, then splash blocks or dispersal trenches are an option. The splash blocks require a minimum discharge travel length of 50 ft. before reaching a property line. The size of these lots do not allow for this option. Another option is a perforated tightline drainage connection. This requires the availability of a direct connection to the drainage system within the street or other approved drainage system. This option is available to this site due to the proposed drainage system and the existing ditch along the frontage road. As such, the engineering plans show the detail and suggested location for the perforated tightline connection. This connection includes a 10 ft. long by 2 ft. wide rock - filled trencJi with an outlet piped connection to the street drainage system. The manual states that the objective is to gain some infiltration benefit during the dryer periods of the year with the understanding that there will be overflow discharges to the street drainage system during the wet periods when the water tables are high and soils are saturated. W =' O • ~ Z r"h DOWNSTREAM DRAINAGE The property and the surrounding area is within the Gilliam Creek Drainage Sub -basin of the Lower Green River Drainage Basin. There are no wetlands or other sensitive areas on the site. The site is totally developed, with an existing house within the front portion of the site and a detached large garage in the rear portion of the site. There is a network of concrete driveways that extend along the western portion of the site. The site is landscaped as a large residential lot with sporadic trees, lawn and shrubbery. Some if the trees will need to be cut for the new joint driveway, but the majority of the existing trees will remain. The existing site sheet flows to the east and onto the existing large residential lot. The new proposed project will include an asphalt surfaced joint use driveway for the new lots. This driveway will have a wedge curb to control the drainage runoff and direct it into a new catch basin within the low east end of the turn- around. The new houses will have a piped connection to this catch basin also. The catch basin will have an outlet pipe that carries the runoff to the existing roadside ditch at the northeast corner of the site. This ditch is a grass lined ditch that is approx. 18" deep. It currently receives the runoff from an asphalt gutter along the south side of S. 150th St., east of the property. This gutter ends at the middle of the site frontage, where the ditch begins. This ditch flows to the east for approx. 15' past the property and drains into a 12" culvert that continues to the east within the shoulder. Past the next lot, there is a type 1 catch basin that receives this water and turns it to the northeast and across S. 150t St. to an existing type 1 catch basin within the north shoulder. The drainage then continues easterly along the north shoulder within a series of four - type 1 catch basins and connecting 12' piping. There are several asphalt berms and swales within the shoulder that direct the street runoff into the catch basins. There is no drainage system on the south side of the street all along this portion of the street. At 41st Pl. S., a private street to the north, there is a type 2 catch basin that is approx. 5 ft. deep. This has a grated lid and is at the east side of the intersection. The piping continues easterly to a new catch basin at the end of a new sidewalk curb return from 42nd Ave. S. There are new type 1 catch basins on both sides of S. 150t St. at this point, as there are new sidewalk curb returns on both side. The drainage piping is directed to the south at this point, to a catch basin at the new gutter line within 42nd Ave. S. This junction is approx. 800 ft. downstream of the site. There is a type 2 catch basin in the center of the southbound lane of 42nd Ave. S. This appears to be a main drainage corridor. The lids were not opened as they were all locked, and traffic was quite heavy. The type 2 catch basins and storm drain main piping continue southerly within the center of the southbound lane of 42nd Ave. S. This pattern continues across S. 152nd St. and again across S. 154th St. After crossing S. 154th St., the creek crossing for Gilliam Creek is intersected. The drainage system discharges into the Creek. This point is approx. 2200 ft. downstream from the site. The downstream drainage system is primarily confined within a piping network. The catch basins are frequent and show no signs of overtopping. The downstream system appears capable to accept the runoff from this project. Single family residential and small subdivision projects' requiring drainage review may qualify to use this appendix to meet the flow control, water quality, and erosion and sediment control requirements of the Surface Water Design Manual (SWDM). Drainage review is required for any permit application that: 1. Adds 5,000 square feet' or more of new impervious surface, OR 2. Proposes to construct or modify a drainage pipe/ditch that is 12 inches or more in size/depth, or receives surface and storm water runoff from a drainage pipe/ditch that is 12 inches or more in size/depth, OR 3. Contains or is adjacent to a floodplain, stream, lake, wetland, or closed depression, or another sensitive area as defined by the Sensitive Areas Ordinance (codified in KCC 2IA.24), excluding seismic, coal mining, and volcanic hazard areas, OR 4. Is located within a Landslide Hazard Drainage Area' and adds 2,000 square feet or more of new impervious surface, OR 5. Is located within a Critical Drainage Area,' OR 6. Is located within the rural zoned area of a basin plan or community plans where drainage requirements are applied through KCC 16.82.150(C) to projects that clear more than 7,000 square feet or 35% of the project site, whichever is greater. Single family residential and small subdivision projects may address the SWDM flow control, water quality, and erosion control requirements by using the Best Management Practices (BMPs) outlined in this appendix6 IF the project: 1. Adds no more than 10,000 square feet of total impervious surface to a threshold discharge area, AND 2. Clears less than 2 acres or 35% of the site, whichever is greater. (Note: An open space tract or easement may be required to protect uncleared areas. Some areas of King County have more stringent clearing limitations.) Many projects that qualify for Small Site Drainage Review can completely meet drainage requirements using the BMPs outlined in this Appendix! Other small site projects may require use of a combination of these BMPs and professional engineering design.
