This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170. At their
December 14, 2000 public hearing, the Planning Commission approved the applicant's request
for installation of a wireless telecommunication facility, consisting of antennae and operating
equipment mounted on the roof of an existing hotel, which is located at 16038 West Valley
Highway.

Sprint PCS is requesting Conditional Use Permit approval to install a wireless 2
telecommunication facility on the roof of the Marriott hotel, which is located at 10638 g'
West Valley Highway. The facility comprises of antennae that are proposed to be N
screened by an enclosure. The equipment is proposed to be located in an existing w
mechanical penthouse. z =

The existing site is developed with a 90' high hotel building. The telecommunication w w
facility is proposed on the roof of the existing building. The subject site is zoned Tukwila v
Urban Center (TUC). u- p'.
Existing Development
Surrounding Land Uses
The subject site is bounded to the West by the West Valley Highway and to the East by a
public recreation thoroughfare and Burlington Northern train tracks. Embassy Suites
Hotel is located immediately north of the subject site. There is a gas station on the south
side of the subject site.
BACKGROUND
The proposed wireless communication facility comprises of roof top antennae with
accompanying equipment cabinets. The antennae are proposed to be screened by a wall
that is architecturally consistent with the building in order to minimize visibility of
antennae. The associated equipment is proposed to be installed in an existing mechanical
penthouse.

CONDITIONAL USE CRITERIA
The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning
Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff
report as Attachment D. Staff makes the following findings under the city's Conditional Use
Permit criteria (TMC 18.64.050):
(1) The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity of the proposed use or in the
district in which the subject property is situated.
The applicant has included site plans; elevations of the antennae; and computer generated
photographs showing the proposed antennae and associated equipment in relation to the
existing building and surrounding development. The existing building is 90'2" high. The
top of the antennas and the screen wall will be 100' high. The subject site is zoned TUC.
The facility shall comply with all federal standards related to radio frequency emissions.
(2) The proposed use shall meet or exceed the performance standards that are required
in the district it will occupy.
The Development Standards for uses in the TUC zone are:
Maximum height:
Setbacks:

Side and rear: 10'
The top of the proposed antennae and screen wall will be 100' and thus meet the
maximum height requirements. As proposed the project also meets all setback
requirements.
A 9'9" high wall that will be architecturally consistent with the existing building will
screen the proposed antennae.
No other development standards in this zone apply to this application.
(3) The proposed development shall be compatible generally with the surrounding land
uses in terms of traffic and pedestrian circulation, building and site design.

As with similar uses, the proposed facility will generate trips during the construction
period and, following the completion of construction, up to 1 trip per month for
maintenance. No other impacts to pedestrian or transportation movements are
anticipated. No new building or structure is proposed. Instead the project is to install
antennae on rooftop of an existing building.
(4) The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan
This project must comply with the following Comprehensive Plan policies and meet
necessary Zoning Code regulations.
12.1.36. Encourage utilities to consolidate facilities and minimize visual
impacts of facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure and use
of existing structures. The applicant is proposing antennae that will be located on an
existing building. The screen wall will be designed to match the existing building.
5) All measures have been taken to minimize the possible adverse impacts, which the
proposed use may have on the area in which it is located.
The applicant has applied for a location on an existing building in lieu of proposing an
additional support structure for their antennae. Providing screen walls that are
architecturally consistent with the existing building around the proposed antennae will
minimize the aesthetic impact. The facility will meet all federal standards related to radio
frequency emissions.
CONCLUSIONS
1. The proposal to install additional antennae on an existing building will not be materially
detrimental to the public welfare or injurious to the property or improvements in the
vicinity.
2. The proposed project meets the performance standards that are required in TUC zone.
3. The proposed project is compatible with the surrounding land uses in terms of traffic and
pedestrian circulation, building and site design.

4. The proposed project is in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan.
5. The radio frequency emissions are regulated by Federal Communication Commission and
this project must meet all their requirements. The design of screen wall is consistent with
the design of the existing building. If approved as proposed, it can be stated that all
measures have been taken to minimize the possible adverse impacts this project may have
on the area in which it is located.
RECOMMENDATIONS
Staff recommends approval of the Conditional Use Permit.

E. Conditional use permit criteria — TMC 18.64.030
1. The proposed use will not be materially detrimental to the public welfare or injurious
to the property or improvements in the vicinity of the proposed use in the district in
which the subject property is situated.
The proposed antennas will be located on an existing commercial building in the
TUC zone. Surrounding properties are commercial. The antennas will be mounted
atop the existing penthouse and concealed by a building facade. The antennas are a
minor addition to the existing building and will not be accessible or detrimental to the
public welfare. Locating on an existing structure eliminates the need to build a new
tower. The structures will be painted in colors and tones to match the surrounding
architecture. The proposed facility will appear as an integral part of the site.
2. The proposed use shall comply with all development standards that are required in the
district it will occupy.
The proposed use will comply with all development standards for the TUC zone by
remaining under the 115 ft. height limit. Other development standards are indicated -
and adhered to in the site plans.
3. The proposed development shall be compatible generally with the surrounding land
uses in terms of traffic and pedestrian circulation, building and site design.
The antennas will placed in a building facade and appear as natural extensions to the
architecture of the building. Traffic will only be mildly affected during construction
and will only have one site visit per month.
4. The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan.
The proposed use is consistent with the goals and policies of the Comprehensive Land
Use Policy Plan.
12.1.36 Encourage utilities to consolidate facilities and minimize visual impacts
of facilities where technically feasible.
The antennas are located in a commercial zone and on an existing building to
eliminate the need for a new tower. Adequate public service and utilities are
provided for the community and the facility is designed in a manner that minimizes
adverse impacts to the neighborhood.
5. All measures shall be taken to minimize the possible adverse impacts, which the
proposed use may have on the area in which it is located.

install a wireless communication facility, comprised of antennae and associated

The Department of Community Development received your Conditional use application on October
11, 2000 for Sprint PCS to install rooftop antennae on an existing hotel located at the above
referenced address.
Based on a review of your application for submittal requirements for Conditional Use Permit,
your application is deemed complete as of November 8, 2000. A notice of land use application
will be distributed within 14 days of this date. The next step is for you to install the notice board
on the site within 14 days of the date of this letter. You received information on how to install the
sign with your application packet. If you need another set of those instructions, you may obtain

1. The antennae are proposed to be screened by a new enclosure. However it is not clear if the
equipment is proposed in an existing penthouse or an another penthouse is proposed at that
location. Please clarify if new penthouse is proposed.
2. The antennae are proposed to be screened by a prefab stealth- screening wall. The proposed
screen wall must be consistent with the existing building. Please submit materials and colors
board sample to verify that the proposed materials are consistent with the existing building.
Upon receipt of above listed information, the City will inform you within 14 days if any additional
information is required to further process your application. This application will expire if we do not
receive the additional information within ninety (90) days of the date of this letter unless an
extension is granted pursuant to Section 18.105.070(E).
This determination of complete application does not preclude the ability of the City to require that
you submit additional plans or information, if such information is necessary to ensure the project

Project Description
Sprint PCS seeks to expand its Pacific Northwest PCS network in the Tukwila area to include this
proposed site in Tukwila. This proposed wireless communication facility site is a rooftop antenna Z
site with accompanying equipment cabinets. The property is zoned Tukwila Urban Center (TUC)
and is a Conditional Use. . ;F- w
The proposed facility will not interfere with the surrounding properties or their uses. Due to its 6 v
extremely low power use, this facility will not be a source of interference with other nearby U O
electronic equipment including radios, televisions and telephone transmissions. Non - interference cn o
is insured by the Federal Communications Commission (FCC) regulation of radio transmissions. w =

The required site location and antenna height are determined by a propagation study. This study U
evaluates the expected radio frequency (RF) signal from the proposed site at a given location and p 1—
height. The RF signal must be strong enough to provide adequate coverage within the desired Z
coverage area.
The selection and design of a specific PCS site is further refined by considering local
topographies and geographic factors, tree canopy, buildings, mountains, water bodies and the
ability to mitigate the antenna support structure's visual impact. Also considered is the
compatibility of the facility with existing land uses and the ability to negotiate a mutually beneficial
lease with a landlord. The height and location of each Sprint site is, therefore, based upon the
ability of the site to effectively function despite these obstacles. The purpose of the proposed site
is to provide coverage for the local area.
Compatibility with Surrounding Area
The proposed facility is compatible with and will have a minimal impact on abutting properties and
the adjacent neighborhood. The facility will not require public facilities such as water and sewer
and is electronically monitored to reduce the impact of public safety services. As a result of the
network's automated design the facility will not generate a significant amount of additional traffic
or impact the surrounding road. Communications services offered by this proposed PCS facility
includes emergency and delivery services. Also, area residents would utilize this wireless
communications facility as they conduct their daily business.
Minimizing Hazards and Nuisances

The proposed facility is a passive use in the respect that the operation is fully automated and no
activities will take place that will produce airborne odors, vibrations, heat, glare, or hazardous
wastes. The site will be electronically monitored and unmanned and require only infrequent visits
by maintenance personnel. The facility will not require water or wastewater facilities and will not
contribute additional stormwater runoff or cause erosion affecting other properties. The proposed
use is low level in keeping with the overall low- density residential developments in the area.

A PROFESSIONAL SERVICE CORPORATION
The Marriott Hotel is the proposed site for a Personal Communication System
(PCS) base station. The Marriott is a commercial use consistent with the TUC
designation in the Tukwila Comprehensive Plan. The attached map shows exact
locations and the uses of the properties.
In basic terms, the Marriott site is bounded to the West by the West Valley
Highway and to the East by a public recreation thoroughfare and Burlington Northern
train tracks. The use to the North is commercial in the TUC (Embassy Suites Hotel) and
also commercial to the South (Union 76 gas station). Across the West Valley Highway
are Marriott's own Residence Inn (commercial), and the Best Western Hotel
(commercial). Between the two commercial uses are lone residential site and a 100 -ft.
to 150 -ft. of creek frontage.
