Dear Mr. Knudson:
We have reviewed the additional items you submitted on December 15, 2000 in connection with
the above - referenced applications. Your original SEPA checklist (submitted on September 17,
1999) indicated that you intended to import 1,600 cubic yards of fill for future development on the
site. However, your December 15th submission now limits your proposal to the grading work that
has already occurred. We have the following comments.
SEPA Determination:
A SEPA Determination is required whenever 500 cubic yards of import or export is anticipated.
Given the change in your proposal described above, a SEPA Determination will not be needed at
this time. We have closed your SEPA file and have enclosed a refund of your application fee in
the amount of $325.00.
Reduction in Wetland Buffer:
As you know, there is a Type 2 wetland on your neighbor's parcel, located immediately to the
south of your property. This type of wetland requires a 50 foot buffer, much of which is believed to
lie on your property. The site work you proposed in September, 1999 indicated the need to
reduce the size of the required wetland buffer from 50 feet to 25 feet in width.
Such a reduction in a wetland buffer is processed via a Special Permission application, which you
submitted on December 15th. However, given the change in your proposal, a reduction in the
wetland buffer will not be needed at .this time. We have closed your Special Permission file and
have enclosed a refund of your application fee in the amount of $200.00.
Further Actions
Please be advised that the previous permits issued to you for construction of your home and
associated site work are now officially closed. No additional work will be authorized under either
of those permits. Accordingly, you should be aware of the following basic requirements if, in the
future, you decide to further develop your property:

1. As stated above, under SEPA, there is a 500 cubic yard threshold for the import or export
of material. We believe that you have already imported 500 total cubic yards of material
to your site under previous permits. For example, under Land Altering Permit P93 -0055
you were authorized to import 470 cubic yards of material. Therefore, you may not import
or export any additional material on the site without first obtaining a SEPA Determination.
2. Any proposal involving the removal, deposit or displacement of more than 50 cubic yards
of material will require a Land Altering permit. This also includes the stockpiling of topsoil,
peat, bark and similar materials and /or the clearing of areas larger than 5,000 square feet.
3. No work may occur inside the 50 foot wetland buffer. Any proposal requesting a
reduction in this buffer (to no more than 25 feet) must be processed under a Special
Permission application.

1. Owner will not import new fill material, prior to obtaining applicable
permits from the City. No plan for improvements at this time, as of December
15, 2000.
2. No land alteration, temporary storm pond, swales, or TESC measures
required at this time.
3. Stop work order was issued on May 18, 1999 for land alteration without a
permit.
4. Geotechnical Report (TIR) is not required, until addition site work applied
for.
5. Existing 12" public storm pipe & manholes require a public easement to be
executed.
6. Engineer, Scott Traverso P.E., has made field visits and prepared a Civil
Plan to show current conditions and locate sanitary sewer & storm drainage
systems. A private sanitary sewer system and private easement exist across the
site. A public storm drainage system exists across the South portion of the site.
7. Owner is allowed to place rock along the upper portion of his driveway as
part of his original 1988 permit, for his primary residence. Per Public Works
Director, December 14, 2000.
8. Public Works did not find record of primary residence building permit from
1988.
9. Public Works Inspector will release stop work order based on current
conditions, as of December 15, 2000. The owner agrees to place straw and /or
other erosion control methods, as needed to cover exposed areas.
10. Site has long history of land alterations, utilities construction both private
and public, and City utility work on or near the property.

At your request, we have prepared a Wetland Buffer Enhancement Plan (Figure 1)
for your property located at 14925 58th Avenue S. This plan is intended to protect
and enhance the functions of a Type 2 wetland that is located immediately off -site to
the south of your property. Although Type 2 wetlands in the City of Tukwila generally
require a standard 50 -foot buffer, this buffer can be reduced by as much as 50% with
implementation of a buffer enhancement plan (TMC 18.45.040.C.4). Due to the
degraded condition of the existing buffer, the proposed project requests that the
standard 50 -foot buffer be reduced to 25 feet. It is our opinion that implementation
of the Buffer Enhancement Plan depicted on Figure 1 should increase'the functions
of the wetland and will not result in direct or indirect short-term or long -term impacts
to the wetland.
Enhancement of the buffer will consist primarily of removing the existing non - native
weeds and grasses and replanting the area with a variety of native trees and shrubs.
Implementation of the buffer enhanctement plan should increase the plant species
and structural diversity, thereby increasing the habitat value of the wetland. The
native plantings will also protect the wetland by providing a physical and visual •
screen.
The following elements will be incorporated into the buffer enhancement plan:
. CONSTRUCTION MANAGEMENT
Prior to commencement of any work by contractors in the enhancement area, the
construction limits will be staked and any existing.vegetation to be saved will be
clearly marked. A.pre- construction meeting will be held at the site to review and
discuss all aspects of the project with the selected contractor.

A wetland consultant will supervise plan implementation during construction to
ensure that specifications of the enhancement plan are met Any modifications to
the design that•may be necessary due to unforeseen site conditions will be jointly
approved by the City of Tukwila and the wetland consultant prior to their •
implementation.
MONITORING METHODOLOGY
The monitoring program will be conducted twice a year for a period of three years,
with annual reports submitted to the City of Tukwila.
Vegetation
Permanent vegetation sampling points or transects will be established at selected
locations within the enhancement area to incorporate all of the representative plant
communities. The same monitoring locations will be re- visited each year with a
record kept of all plant species found. Vegetation will be recorded on the basis of
relative percent cover of the dominant species within the vegetative strata. All
monitoring will be conducted by a qualified consultant.

Photo- points will be established from which photographs will be taken throughout the
monitoring period. These photographs will document general appearance and i 0
progress in plant community establishment in the enhancement area. Review of the o
photos over time will provide a semi - quantitative representation of success of the w z,
planting plan. S

Monitoring and photo -point locations will be shown and described in the first
monitoring report.
Wildlife
Wildlife species that are readily observable (either by direct or indirect means) will be
identified and recorded in the enhancement area. Direct observations include actual
sightings, while indirect observations include tracks, scat, nests, song, or other
indicative signs.
Water Quality and Hydrology,
During each monitoring event, an assessment will be made of the water regime
within the enhancement area to ensure that proper hydrological conditions exist.
General observations will be made of the extent and depth of soil saturation or
inundation.
Water quality will be assessed qualitatively, unless it is evident there is a serious.
problem. In such an event, water quality samples will be taken and analyzed in a
laboratory for suspected parameters. Qualitative assessments of water quality include:

. 1. oil sheen or other surface films,
2. abnormal color of water or odor,
• 3. stressed or dead vegetation or aquatic fauna, and
4. turbidity.

SUCCESS CRITERIA
Success of plant establishment within the enhancement area will be evaluated on
the basis of both percent survival and percent cover of desirable species.
Undesirable species include exotic and invasive species such as Scot's broom,
Himalayan and evergreen blackberry, reed canarygrass, morning glory, and
Japanese knotweed. For the planted trees and shrubs, success will be based on at
least an 85% survival rate, or at least 50% cover of equivalent recolonized native
species, by the end of the three -year monitoring period.
• Exotic and invasive plant species will be maintained at levels below 20% total cover.
Removal of these species will occur immediately following the monitoring event in
which they surpass the above maximum coverage. Removal will occur by hand
whenever possible.
MAINTENANCE (M) AND CONTINGENCY (C)
Established performance standards for the project will be compared to the "
monitoring results in order to judge the success of the'enhancement project: "
Contingency will include the items listed below and would be implemented if these
performance standards are not met. Maintenance and remedial action on the site
will be implemented immediately upon completion of the monitoring event (unless
• otherwise specifically indicated below).
• replace dead plants with the same species or a substitute species that meets

regime, poor plant stock, disease, shade /sun conditions, wildlife damage,

enhancement area would only be implemented if other measures failed or

The checklist is applicable to the request for a reduction in wetland buffer width
from 50' to 25'.
3. Application for Land Altering Permit:
Coordination with your Public Works Department has produced a complete set of
existing As -built plans of the subject site. Including all Tax lot #s referenced to in
the SEPA check list.
This research has reveled an existing storm sewer line on the South property line
with City of Tukwila marking stakes that does not have a recorded easement. The
City should indicate the legality of this line and endeavor to properly record it.
This may be contributing to the Wetlands as a manmade condition illegally
constructed.
Deadline
As I commented previously, you did not sent me the copy of the 18 Oct letter
until 4 Dec 2000. In the 18 Oct meeting it was agreed that Mr. Knudson could
complete any grading and landscaping with respect to his residence and the parcel
it occupies. A legal permit was issued by the City for the land altering permit on
the parcel to the South ( #1157200394) in 1993, Permit # P93 -0055.
Field research indicates that this original fill is in the same location as permitted.
The additional fill material placed in this area was to be used as topsoil for Mr.
Knudson's residence when it was issued a stopwork order in 5/99.
This topsoil material has since be spread out over the permitted area and has
established some vegetation growth to prevent erosion.
In my discussions with Public Works it would appear that the best course of
action would be not to disturb the existing vegetation and add straw mulch over
the sparse area lacking a good growth of ground cover.

Per your meeting with the Planning and Public Works Departments on October 18th, you agreed
to provide the following: 1) an application packet for a reduced wetland buffer; 2) revisions to your
existing SEPA application checklist; and 3) an application packet for a land altering permit. These
items are necessary to resolve your existing violation for site work performed without a land
altering permit.
As stated in our October 18, 2000 letter to you, your submittal is to include the following:
1. Special Permission Application for a Wetland Buffer Reduction:
On October 18th you were provided with an application packet which formalizes the items
referenced in our July 11, 2000 letter to you. These items are either highlighted in yellow
on the application checklist table or flagged in the packet, as follows:
N, a. Application Form, Application Checklist and Affidavit of Ownership (please
\ execute Affidavit in the presence of a notary).
' b. Permit fee of $200.00.
c.
A written description of the project and verification that the subject wetland should
be classified as a Type 2. Please include your written request to reduce the
wetland buffer by 50% (from 50 feet to 25 feet in width) and responses to the
applicable decision criteria (see TMC 18.45.040(C)(4), attached).
d. Two copies of a .dimensioned and scaled site plan showing all existing
improvements (buildings, parking areas, walkways, planting areas), property lines
and sensitive areas (including their buffers and setbacks).
Two copies of a Buffer Enhancement Plan demonstrating that the proposed buffer
reduction will not result in direct or indirect short -term or long -term adverse impact
to the sensitive area.
Please make a copy of this letter available to your wetland consultant as soon as possible.

2. Revisions to SEPA Checklist:
Please revise the responses on your SEPA checklist (originally submitted on September 17,
1999). The answers on the checklist should reflect existing conditions on the site. You should
also describe your short and long term development proposals for the site. The information
provided in the checklist must also include references to your application for a land altering permit.
A SEPA Determination will not be issued until your application for a wetland buffer reduction has
been processed (see Item #1, above). If you have any questions regarding revisions to your
SEPA checklist, please contact Deborah Ritter at 206 -431 -3663.
3. Application for Land Altering Permit:
Please coordinate with Dave McPherson of the Public Works Department (206 -433 -0179)
regarding the application requirements for a land altering permit. The land altering permit will not
be issued until a SEPA Determination has been made by the Director of Community Development
(see Item #2, above).
Deadline
All of the materials listed in Items 1 through 3 above must be deemed complete by the Planning
and Public Works Department on or before December 15, 2000. In our October 18th letter to you,
we recommended that you submit your documentation, in its entirety, on or before Friday,
December 1st.
As of December 4th, we have yet to receive any inquiries from you or your consultants regarding
the contents of our October 18th letter. Please be advised that if your submittal is found to be
incomplete and /or does not respond to our stated requirements by December 15th, your
violation will be immediately reinstated and the matter turned over to Code Enforcement.

NOTES
I . Clear and grub buffer area between silt fence and buffer boundary. Remove all
roots of existing vegetation.
2. Prior to planting, place 12" of imported, weed -free, organic topsoil over entire
buffer area between silt fence and buffer boundary.
3. Locate trees a minimum of 8' from the centerline of the existing storm drainage
line. Line to be located and staked in the field prior to plant layout. Modify
locations of trees, as necessary to maintain the 8' distance between the storm line
and the new tree plantings. Landscape architect to review layout prior to plant
installation.
4. Install plants directly into newly - placed topsoil. Add hydrated polymer to backfill
per manufacturer's specification (Soilmoist or ecluivalent).
5. Contractor to install a temporary above - ground irrigation system capable of
watering all new plantings at a rate of 1/2" twice weekly between June I and
October I for a minimum of two growing seasons, as directed by owner.
6. Landscape architect to review plant material and layout prior to installation.
7. Fertilize new plantings with an 8- month, slow - release fertilizer for woody plants.
Apply fertilizer after backfili, prior to application of mulch.
8. Single stake all new tree plantings.
9. Apply a 3" deep layer of mulch (in a 36" ring for trees and a 24" ring for shrubs)
to all new plantings. Mulch to be medium course bark mulch.
I O. Seed all disturbed ground with I O# /acre white clover (Trifolium repens) upon
completion of planting. Do not seed within shrub groupings.
