V. u'O .ill Z • • Uc Staff Report to the Planning Commission L2000 -085 XM Radio —11030 East Marginal Way South Page 3 of 6 FINDINGS Vicinity /Site Information Project Description XM Radio is requesting Conditional Use Permit approval to install a wireless telecommunication facility at an existing 125 -foot monopole, which is located at 11030 East Marginal Way South. The proposal is to install one antenna and place associated operating equipment adjacent to the monopole in an already fenced enclosure. Existing Development There is an existing125 -foot tall monopole and equipment building on the site. The site is currently zoned Manufacturing Industrial Center/Heavy (MIC/H) and is occupied by Seattle Police Athletic Association. Surrounding Land Uses Surrounding land uses include a firing range, automobile repair shops, heavy equipment sales /service, warehouse /distribution centers. A city of Seattle Transmission Line /Cedar River pipeline easement is located on the south side of the subject site. BACKGROUND The applicant is requesting to co- locate an antenna on an existing monopole, which was approved under L98 -0018. The existing monopole was approved by the Planning Commission in May 1998. The existing site is zoned MIC/H and the maximum permitted height in that zoning district is 125 feet. The existing monopole is 125 feet high and the top of the new antenna will be at a height of 115'9". .f+,`i'i::.•.ft..Hi ?. }.s`ar'i Staff Report to the Planning Commission L2000 -085 XM Radio —11030 East Marginal Way South Page 4 of 6 CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment C. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans, elevations, and computer generated photographs showing the proposed location of the antenna in relation to the monopole. The facility shall comply with all federal standards related to radio frequency emissions. The proposed antennae will be located on a structure approved for wireless facilities. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the Manufacturing Industrial Center/Heavy (MIC/H) zone include a maximum height of 125 feet and the following setbacks: First Front: 20' Second Front: 10' Side Setbacks: 0' The top of the proposed antenna will be at the height of 115'9 ". As indicated earlier in the background section of this report, the existing monopole was approved in 1998. The ground equipment is proposed to be placed adjacent to the monopole and meets all setback requirements. The equipment is approximately six feet high. Wood slats are proposed to be installed in the existing chain link fence to make it sight obscuring. No other development standards in this zone apply to this application. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction Staff Report to the Planning Commission L2000 -085 XM Radio —11030 East Marginal Way South Page 5 of 6 period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. Since it is an existing monopole and the proposal is to attach antennae on it, the impacts to surrounding land uses will not be any different than the existing development. The operating equipment will be placed inside the existing chain link fence. Applicant shall install slats in the chain link fence in order to make it sight obscuring. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. .12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The application is for co- location on an existing monopole. The color of the proposed antenna must be similar to the existing monopole. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a co- location on an existing monopole in lieu of proposing an additional support structure for their antennae. All ground level operating equipment will be located behind a fenced and gated enclosure. In 1998, at the time of original application for the construction of the monopole, staff was informed that an Osprey Nest was sighted on one of the adjacent Seattle City Light transmission structures. At that time it was determined that the monopole was located outside the 440 -yard area and thus the project was exempt from submittal of timing plan to Department of Fish and Wildlife. CONCLUSIONS 1.
