The storm drain is described as being "...in a state of massive deterioration ". A repair now will allow the construction company to reline the existing pipe and avoid the need to excavate in the shoreline, which would be required if the current pipe fails and a new line must be installed. The project is located at 111011 Pacific Hwy South, Section 4, Township 23, Range 4. Exceptions for normal repair are permitted from the Shoreline Management Act and SEPA under the following citations: WAC 173 -27 -040 (2) (b) Normal maintenance or repair of existing structures or developments, including damage by accident, fire or elements. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully established condition. Normal repair mains to restore a development to a state comparable to its original condition... WAC 193 -11 -800 (3) Repair, remodeling and maintenance activities. The repair remodeling, maintenance or minor alteration of existing public or private structures, facilities or equipment, including utilities involving no material expansion. (emphasis added) The request is consistent with both the City's Comprehensive Plan, Shoreline Master Program and with the State Shoreline Management Act, as noted in the WAC citation above. Repair of the storm drain line before the line breaks will minimize the pollutants that enter the river, protect from erosion and degradation of the river bank. The site is located in an area annexed to the City in 1988 and still currently subject to the King County Shoreline Master Program. Goals and policies of that Program with which the proposed project is consistent are as follows: 5. Resources should be managed to enhance the environment with minimal adverse effect. Policy 2 Shoreline activities and developments should be planed, constructed and operated to minimize adverse effects on the natural processes of the shoreline, and should maintain or enhance the quality of air, soil and water on the shoreline. Policy 4 Any structure or activity in or near the water should be constructed in such a way that it will minimized adverse physical or chemical effects on water quality, vegetation, fish, shellfish or wildlife. Replacement of the storm drainage pipe before the pipe fails will allow the deteriorated pipe to be fixed without excavation near the shoreline. Re: Emergency Storm Drain Repair - 11011 Pacific Highway South Request for Exemption of Shoreline Permit, SEPA Review Dear Sir, Scoccolo Construction, Inc. has been retained by Mr. Archie Carrossino and his agent / son, Mr. Doug Carrossino to perform emergency storm drain repairs on private property as referenced above. The City of Tukwila utilizes this system and the storm drain outfall into the Duwamish River on this property as part of their storm drainage system for a portion of Pacific Highway South. Our firm has recently video taped the underground system. and has found that the last eighty feet of existing 24" storm drain pipe was constructed using metal pipe. The pipe is in a state of massive deterioration. It is just a matter of time before it fails and the storm drainage outfall and entire system backs up and is unusable without a massive and expensive repair project which will entail extensive excavation at the river edge. Scoccolo Construction, Inc. recently completed the East Marginal Way Improvement Project for the City of Tukwila. As a portion of that 6 million dollar project, an existing 24" storm drain outfall into the Duwamish, in the vicinity of Mac's Smokehouse, was relined with 18" heat fused HDPE plastic pipe. We were able to reline the existing pipe using construction methods that did not allow any excavation or disturbance within one hundred feet of the river bank. This was accomplished by heat fusing the pipe together to the full one hundred foot length on the shore and capping one end so it floats, placing the pipe in the river at the proper tide secured to a boat in the river, and winching the new pipe through the existing 24" pipe from a catch basin installed 100 feet from the river bank. We secured a HDPA Permit from the Department of Fisheries prior to work, receiving their permit and encouragement for our process. The critical aspect of this process is that the existing oufall has not yet failed so that the smaller diameter pipe can be winched through the existing pipe without blockage and therefore not require excavation. Enclosed, please review our plan for the repair of the oufall as detailed above. I have spoken with Ms. Alice Kelly with D.O.E. about this project and our construction methods. Based on telephone conversations with her, she states that she will support the exemption. Mr. Bill Schneider with the Department of Fish & Wildlife has stated he will grant a HDPA Permit in a timely manner after the exemption of the Shoreline Permit and SEPA Review. I have spoken with Mr. Bob Giberson with the City of Tukwilla Public Works who understands the critical nature of the repairs and supports the methods of construction and the project as a whole. Mr. Carrosino has not requested any City funds to repair their joint outfall. As a responsible property owner he understands that repairs undertaken prior to failure makes good economic sense, and in this case good environmental sense also.
