The City's definition of "yard" is as follows: "Yard" means a required open space unoccupied and unobstructed by any structure or portion of a structure from 30 inches above the general ground level of the graded lot upward. This definition does not conflict with Mr. Schroeter's plan to incorporate the 2' into the private access road required to develop the rear portion of his short plat. He has compromised by moving the paved surface south 2 feet for about half of the length of your lot. As this solution meets the City's Subdivision and Zoning Code requirements for short plats we intend to grant final approval to the plat. We wish to thank you for filing the two easements and we want to state our position in regard to the revised plat plan. The side yard easement does not allow you the right to pave over the two foot section. To clarify, the easements were filed to satisfy your obligations pursuant to the Residential Real Estate Purchase and Sale Agreement dated January 14, 1998. No question exists that the 15 foot easement for ingress and egress may be paved. However, existence of the two foot sideyard easement . in addition to the fifteen foot easement clearly indicates that a different use was contemplated for the two foot section. To find otherwise fails to give efl'ect to the two foot easement. It is our position, based on the understanding manifest in the original purchase and sale agreement, that the two foot easement grants to my client the nonexclusive right to use a yard of some sort, presumably grass c,.avered. This precludes paving over the two foot section. Thus, my client's only objection to yo'Ar revised plat application is the passing of the proposed access road over the two foot easement. With regard to Addendum "B" of the Purchase and Sale Agreement, 1 fail to see how my clients actions to protect their property interest qualifies as inhibiting the plat process or approval. My clients' only demand is that their rightful property interest be respected. We do not be li ave that item two of Addendum "8" requires them to relinquish their property interest. Therefore, mail such time as the plat plan acknowledges their property interest, my clients will continue to object to the plan. Please contact me if you wish to discuss this matter further. Mr. & Mrs. Mike Gilbert, The sideyard easement which your attorney prepared and which was recorded specifically allows for ingress and egress. It does not preclude paving. In fact the City of Tukwila ordinance requires paving to certain specifications for access roads abutting city streets. As you can see from the redraft of the plans the road has been pushed to the South to give you more unpaved area to the front side of your home. This was done in goodwill with no requirement to do so. You have now ruined any thought of goodwill. Furthermore, Addendum `B" of the Purchase & Sale agreement dated January 14th, 1998 between buyer Barbara Currie and seller Richard L. Schroeter states that the buyer ( yourself) agrees to in no way inhibit the plat process or approval. The above action has indeed inhibited that approval. I demand that you receipt a letter to Jack Pace no later than Monday June 12t at 5:oop.m. withdrawing your objections in addition to an executed joint use agreement for your use of the ingress and egress right of way. My wife Barbara Currie purchased our home back in February 1998. In the purchase and sales agreement there was an addendum that was written into the purchase and sales agreement that stated that the seller (Richard Schroeter) would provide us a 2 foot easement for a side yard on the South property line along with a 15 foot easement for ingress and egress over the North 15 feet of Parcel B (see attached addendum `B "). It has just recently been brought to my attention that neither easement has been filed. We have been working with the realtor (Sharon Mann), who represents Richard Schroeter, to resolve these issues. I just met with her last night and found out nothing has been done in regards to the filing of these easements. Actually what Sharon offered to me last night, at least what I understood, was that after the City of Tukwila and Fire Department signed off on the short plat of the property, that Mr. Schroeter would then provide us with the 2 foot easement for our side yard. However, I intend to insist on performance of the purchase and sales agreement terms, as these easements should have been filed in February 1998, when the sale closed. To this end we are now retaining a real estate attorney to insure the easements are filed before entering into any agreements with Mr. Schroeter. I- w, z �o z �. ww The Short Subdivision Committee has completed review of your short plat application (No. L99- D o 0015), and based on the submittal, preliminary approval is granted subject to the conditions stated ‘c-.) N. below. =V' u. ~O, .z UN o . z There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the City's policies and regulations. Utilities and Access a. Water, sewer and storm drainage shall be installed as shown on the permit D99 -0155. As- built plans shall be provided to the Public Works Department. Show the new drainage easement on the face of the plat (see attached redlines). b. The 20 foot access .road easement shall be constructed as shown on D99 -0155 to meet Public Works and Fire Department standards. Fire Protection c. Final Approval The next step is to comply with the conditions of approval and install the required site improvements. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chairman of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording It is your responsibility to record the City approved short plat documents with the King County Department of Records. GUARANTEE CONDITIONS AND STIPULATIONS 1. Definition of Terms The following terms when used in the Guarantee Crean: (a) the "Assured ": the party or parties named as the Assured in this Guarantee, or on a supplemental writing executed by the Company. (b) "land": the land described or referred to in Schedule (AXC) or in Part 2. and improvements affixed thereto which by law constitute real property. No Duty to Defend or Prosecute. Further. if requested by any authorized representative of the Company, the Assured shall grant its permission, in wnting, for any authorized representative of the Company to examine, inspect and copy all records, books. ledgers. checks, correspondence and memoranda in the custody or control of a third party. which reasonably pertain to the loss or damage. All infomation designated as confidential by the Assured provided to the Company pursuant to this Section shall not be disclosed to others unless, in the reasonable judgment of the Company. it is necessary in the administration of the claim. Options to Pay or Otherwise Settle Claims: Termination of Liability. In case of a claim under this Guarantee, the Company shall have the following additional options: (a) To Pay or Tender Payment of the Amount of Liability or to Purchase the Indebtedness. The Company shall have the option to pay or settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder, the Company shall have the option to purchase the indebtedness secured by said mortgage or said lien for the arnount owing thereon. together with any costs, reasonable attorneys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Such purchase. payment or tender of payment of the full amount of the Guarantee shall terminate all liability of the Company hereunder. If requested by the Company, the Assured shall transfer to the Company all rights and remedies against any person or property necessary to order to perfect this right of subrogation.
