The Planning Commission approved their screening proposal with the following conditions: 1. All shrubbery shall be a minimum of three feet in height at installation, to ensure compliance with TMC 18.52.040 (b) 2. All shrubbery shall be evergreen. 3. All shrubbery shall be permanently maintained by TCI or their representatives, to ensure compliance with TMC 18.52.040 (b). 4. The applicant must comply with TMC 18.52.040(c). 5. The applicant must paint all cabinets to ensure they blend with their surroundings. The Planning Commission also indicated that staff could review these applications until a code revision was passed that relieved the commission of this responsibility. We will be working with the City Attorney to start this process. If you have other applications, please contact us and we will proceed with the direction that the Planning Commission has provided. Rants, Mayor Department of Community Development Steve Lancaster, Director MEMORANDUM TO: Planning Commission FROM: Michael Jenkins DATE: March 18, 1999 RE: L99 -0022, Screening of above - ground power cabinets for TCI Cablevision BACKGROUND TCI has applied for a Franchise Utility permit for upgrades to their existing infrastructure. These permits are Type 1 permits under TMC 18.104.010, reviewed and approved by the Director of Public Works. The cabinets are used to regulate the supply of electric power. Specifications of the pedestals and cabinets for this system are included as Attachments A and B. TMC 13.08.090, which governs the installation of utility equipment, requires approval by the Planning Commission of all site screening for above ground cabinet installations. These facilities are exempt from other provisions of TMC 13.08, which require underground installation of certain types of utility infrastructure. TCI has proposed that the cabinets will be screened with "2 -4 small shrub type bushes ", to be installed where no appropriate landscaping exists and 2 -3 weeks after the installation of the cabinets. Attachment C is a color photocopy showing an example of the proposed landscaping. There will be up to 18 installations by TCI under the utility permit. A map showing the cabinet locations is included as Attachment D. Attachment E -1 is a spreadsheet giving specifics about the proposed cabinet locations with Attachments E -2 through E -19 are schematic drawings indicating where the cabinets will be sited. STANDARDS No specific standards provide staff with guidance or criteria regarding the amount of screening, required species, landscape plan specifications or other such standards. TMC 18.52.040 provides general landscape and screening requirements for new developments that may have practical applications with this project. A cursory review was completed on 3/10/99 and the following items need to be addressed. 1. Your 36" x 44" Fiber Optic Run plan shows a crossing of the Duwamish River at 58th Ave S and Interurban Ave S. Please clarify how the crossing is to be made. TMC 18.44 requires a shoreline permit for any work within 200' of the ordinary high water mark both sides of the river and /or an amount which exceeds $2,500.00 for work. Please contact Jack Pace, Senior Planner - Community Development Department, at (206) 431 -3670 to coordinate the shoreline permit or to determine if your project is exempt. 2. In addition, please submit full -size plan sheets due to the illegible, clouded notations in green, otherwise clarify the notations. 3. As you know, the approvals are required as part of TCI's Cablevision's Franchise Utility Permit Application. Tukwila Municipal Code 13.08.090 (F) requires all above ground cabinet installations to be approved by the Planning Commission for related its site screening. The Planning Commission has 3 options on this project. The Planning Commission may approve the request with the screening you have indicated in your February 4, 1999 submittal, approve the request with conditions or deny the request. A denial would most likely result in the finding that the power cabinets must be contained in an underground vault. If you chose to be at the meeting to provide information, the Planning Commission will begin the meeting at 7:00 p.m. Your issue will most likely occur during the Director's briefing portion, as no formal hearing is required.
