Construction would occur between July 1, 1999 and October 15, 1999. Two previous "technical noise variances" to allow similar extensive road construction at night in this immediate area were previously granted in 1994 and 1997. Noise levels at receiving properties were higher than estimated in this variance application and were allowed to occur for over four months. No noise complaints were received. Construction noise is exempt from regulation between 7:30 A.M. and 10 P.M.' but otherwise regulated by TMC 8.22. The proposed construction noise would occur during regulated hours and exceed the allowed noise level of 50 dB(A) by 2 to 15 dB(A) at exterior areas.2. Construction could only occur during regulated hours with a noise variance from the Director of the Department of Community Development'. The requested "temporary variance" is a ministerial decision not requiring a public hearing'. VICINITY /SITE INFORMATION 1. Project Description: The applicant's request for a technical variance is shown in attachments A, B and C. WSDOT proposes to repave, reconstruct and add various safety improvements to three access ramps at the I -5 /SR -518 freeway interchange. Ramp work will be almost all confined by steep earth banks or concrete walls, as the ramps pass under various freeway sections. Construction would require a weekend closure of the B -line ramp and nightly closures of the B and G line ramps between July 1, 1999 and October 15, 1999. Work at the B -line and G -line ramps are expected to generate worst case noise levels of 90 dBA @ 50 feet (Attachment B). This construction noise would encroach into the night period when such noise is subject to maximum sound levels of 50 dBA (op. cite.). Maximum sound levels at residential receiving properties are estimated at 52 -60 dBA for 'TMC 8.22.160(4). 2Assumes that SR -518 is an "industrial" area and recognizes all receiving areas as residential. Existing Site Development: The access ramps are existing one and two lane underpasses which descend from the at grade road to below grade segments. 3. Surrounding Land Use: Affected area land use is largely defined by the quadrants created by the freeway interchange. Commercial uses dominate the northwest and southeast, while single and multi - family residences dominate the southwest and northeast o:2 00 cn w J= -' DECISION CRITERIA wo A "temporary noise variance" may be issued by the D.C.D. Director, acting as the g "administrator," pursuant to TMC 8.22.180(B): "...at the reasonable discretion of the u. <` administrator." The criteria to grant or deny a temporary noise variance is shown in bold and = w followed by staff discussion. 1- zI-. 1. No variance shall be granted pursuant to this chapter until the administrator has w o considered the relative interests of the applicant, other owners or possessors or (sic) property likely to be affected by the noise, and the general public. (TMC 0 to 8.22.180(C)) ;o I w W. Z — z a. Construction noise is exempt from regulation except between 10 p.m. and 7 a.m. v �. During those times, the proposed freeway construction noise impacts on 1 0:, residential receiving districts is limited to 50 dB(A) per TMC 8.22.050(1)5. b. "No sound source specifically exempted from a maximum permissible sound level by this chapter shall be a public nuisance noise or public disturbance noise..." (TMC 18.22.140). This applies to the proposed freeway construction during non- regulated hours. Noise Standards Noise Impacts c. EPA thresholds of acceptable noise were recognized and incorporated into the "Tukwila Comprehensive Plan Environmental Impact Statement" (October, 1995:pg.47) as follows: 55 or less Levels are generally acceptable; no noise impact is generally associated with these levels. 5This assumes that the freeway is an "industrial" "District of Sound Source." A commercial district is limited to 47 dB(A) while a residential source is limited to 45 dB(A) (TMC 8.22.150(1)). No other adjustments per 8.22.150(2) or (3) seem to be appropriate. \ \TUK2 \SYS\ HOME \VERNON \99 \WSDTVAR \WSDTVAR.DOC L99 -0026: WSDOT Temporary Noise v ariance for I -5 /SR -518 Access Ramp Improvements Page 4 55 -65 dB(A) Adverse noise impacts exist; this measurement represents the lowest level possible without adverse significant impact. 65 -70 dB(A) Significant noise impacts exist; allowable only in unusual cases where lower levels are not possible. over 70 dB(A) Levels of unacceptability for public health and welfare considerations. d. In general, residential buildings with single pane glass windows readily reduce outside noise by 20 dB(A). Residences with double pane glass can reduce noise levels by 25 dBA. This would mean occasional maximum noise levels as follows: On -site Receiving Area Crystal Springs Neighborhood Macadam Road Neighborhood Outside Noise Level. 52 -60 dB(A) 55 -65 dBA Inside noise level with single pane windows (20 dB(A) reduction). 32-40 dB(A) 35 -45 dBA Inside noise level with double pane windows (25 dB(A) reduction). 27 -35 dB(A) 30 -40 dBA c. The overwhelming majority of area residences were built prior to 1984, before the requirement for double pane windows. d. Maximum noise levels, if attained, would last for some fraction of an hour, 2 -3 times per night, based on similar road construction practices. e. The proposed construction noise is exempt during the day. These noise levels would impact receiving properties equally during the day, when residents are more likely to be outside f. The City of Tukwila has granted two technical noise variances issued (L94 -0068 and L96- 0080). Estimated noise levels at residential receiving sites were much higher than projected here. No noise complaints were received. Congestion Impacts g. The construction would require significant lane closures resulting in significant and dramatic traffic congestion. Late night closure would minimize congestion impacts. h. The noise occurring or proposed to occur does not endanger public health or safety; (TMC 8.22.180(C)(1)) z The anticipated maximum noise levels are below the EPA guidelines for avoiding , `11-: significant human health impacts, as shown in a comparison of Finding l c and l d. It is explicitly recognized that higher noise levels are a health hazard and that W o some individuals are more sensitive to noise impacts than others. It may be g J appropriate for the applicant to mitigate noise impacts on sensitive individuals to u 4 a greater extent than is done for the general public, when the basic 50 dB(A) noise I 0 standard is exceeded. Z x i- O b. In general, a change of 10 dB(A) reflects a doubling of the perceived sound level. z I - c. The alternative of daytime construction (when the proposed freeway construction 0 N'. noise is exempt) would shift the noise levels from the night to the day, when .0 f-' occupants at receiving sites are more likely to be outside and be more likely to = w perceive significant impacts. The impacts of extreme traffic congestion may also I- spill over to residential and commercial areas. • z w 0— d. Staff conditions to monitor and implement mitigation programs as needed have o i been reviewed with the applicant. They have been accepted and incorporated into z the construction documents. CONCLUSIONS A. The balance between the relative interests of the applicant, other property owners and the general public seem to be served by granting the variance given the following: a. maximum noise levels will be significantly reduced indoors to an acceptable EPA noise level and be of a short duration and b. not granting the variance would still subject the receiving properties to the same level of noise impact between 7 a.m. and 10 p.m., result in an extreme level of congestion between those hours, and the applicant has committed to a system of 24 hour complaint resolution. B. The noise occurring with the variance is not anticipated to significantly endanger public health and safety, based on estimated noise levels at the receiving properties, EPA \ \TUK2\SYS\ HOME \VERNON \99 \WSDTVAR \WSDTVAR.DOC L99 -0026: WSDOT Temporary Noise variance for I -5 /SR -518 Access Ramp Improvements Page 6 estimates of significant noise levels, the applicant's previous ability to avoid noise complaints and the proposed conditions of approval. C. The above findings do not indicate an available, practical means to prevent, abate, or control the noise level below what is proposed. z ~w DETERMINATION _1 o tn° co w J = APPROVED subject to the following conditions: F' N a_ cu 1. All residents and businesses within 500 ft. of the project site shall be mailed notice of 2 construction with pertinent information, as approved by the Director, at least two weeks � a prior to the first night of construction. All equipment shall be tested to ensure that maximum noise thresholds and characteristics 0 I Z Based on the above Findings and Conclusions, the proposed 14 day, temporary noise variance is incorporated in the noise analysis are as anticipated. 5. Night construction activities shall be periodically monitored to ensure that the identified maximum sound levels are not exceeded and are of a short duration. 6. All jack hammering will be done during day -time hours, except for chipping hammers whose noise is rapidly attenuated. 7. All complaints shall be forwarded to the Director as soon as possible the following day. 7. All complaints shall be resolved within 24 hours of WSDOT receipt, based on the provisions of this variance. City staff shall be available to assist in resolution. 8. Complaint resolution shall include, but not be limited to: a. site visits and monitoring, b. withdrawal of equipment not satisfying the identified maximum noise levels or characteristics and c. offering to move the residents to a City approved facility. A list of facilities shall be submitted for City approval prior to night -time construction. Receipt of 10 or more complaints within a 48 hour period shall justify modifying or revoking the provisions of this variance. 10. Take any alternative measures that the Director may prescribe to mitigate noise impacts per TMC 18.22.190(A), based on the provisions of this variance. Ramp Paving Projected Noise Levels OL 3058 Per our phone conversation of March 26, 1999, I offer the following noise level projections that will result from nighttime work relative to the subject project. The projected noise levels are worst case peak levels (90dBA a 50 ft.) and will be the exception rather than the rule. Residences at Crystal Springs Park area: 52 - 60 dBA (exterior). Distance attenuation, site geometry, and interruption of line of site between receivers and noise source will mitigate much of the planned nighttime construction activity related noise. Residences along Macadam Rd. South: 55 - 65dBA (exterior). Again, distance attenuation, site geometry, and interruption of line of sight between receiver and noise source will be mitigation influences. The existing geometry, alignment and striping on the ramp will not be changes. Additional Work will include saw cutting, planing, installation of geotextile fabric, signing, guardrail, and miscellaneous traffic items. The B -line ramp constitutes the majority of work for the entire project. G -Line Ramp - NB SR 5 to WB SR 518 The existing left shoulder will be excavated and replaced with full depth asphalt concrete pavement and the full width of the ramp will be overlayed with Asphalt Concrete Pavement (ACP) for a portion of the ramp. The existing geometry, alignment and striping will not be changed. This work will also include sawcutting, planing, crack sealing, and miscellaneous traffic items. LS -Line - EB SR 518 to NB SR 405 Existing guardrail will be repaired and brought up to current design standards from Station 5 +892 to 6 +165. We estimate that no more than 15 nights will be necessary to perform the work, 12 nights for the B -line ramp and 3 nights for the G -line ramp. We expect that allowable night time ramp closure hours will be from 8:00 PM to 5:00 AM. The types of construction equipment used for the night time work may include, but is not limited to, backhoes, dump trucks, asphalt cutting saws, and pavers. The WSDOT respectfully requests that the City of Tukwila consider and grant a noise variance for 15 days from the constraints of Chapter 8.22.050 (A) per the provisions of Chapter 8.22.180 and 8.22.190 of the Tukwila Municipal Code. The advertisement date for this project is May 17, 1999. We estimate that the earliest start date will be July 1, 1999, and the latest ending date will be October 15, 1999.
