Future work may require consultation with the National Marine Fisheries Service. PROVISIONS 1. TIMING LIMITATIONS: The project may begin October 15, 1999 and shall be completed by December 31, 1999. 2. NOTIFICATION REQUIREMENT: The permittee or contractor shall notify the Area Habitat Biologist (AHB) listed below of the project start date. Notification shall be received by the AHB at least three working days prior to the start of construction activities. The notification shall include the permittee's name, project location, starting date for work, and the control number for this Hydraulic Project Approval. 3. NOTIFICATION REQUIREMENT: The permittee or contractor shall notify WDFW Enforcement Sergeant/Officer Mike Frame at (425) 775 -1311 at least three working days prior to the start of construction activities. Notification shall include the permittee's name, project location, starting date for work, and the control number for this Hydraulic Project Approval. 4. Work shall be accomplished per plans and specifications entitled, "Boeing Plant 2, Building 2-41 Debris Area, Duwamish Sediment Interim Measure Work Plan", dated February 1, 1999, and per plans entitled "Proposed: To Excavate Sediment With Elevated Lead Concentrations and Backfill With Clean Sand" and submitted to the Washington Department of Fish and Wildlife, except as modified by this Hydraulic Project Approval. These plans reflect design criteria per Chapter 220 -110 WAC. These plans reflect mitigation procedures to significantly reduce or eliminate impacts to fish resources. A copy of these plans shall be available on site during construction. 5. Sandbags or other weights shall be placed no more than one foot apart around the edging of the fabric. All trenches, depressions, or holes created in the beach area shall be backfilled prior to inundation by tidal waters. 6. The clean sand/gravel mix shall be evenly distributed across the excavated area. If the clean material is dry prior to placement, the site shall be monitored the following day to ensure no depressions have been created that would entrap fish. If the height of the excavated area is lower than the surrounding substrate, more sand and gravel shall be added so that it is flush with the surrounding beach. 7. Project activities shall not occur when the project area, including the work corridor, is inundated by tidal waters. 8. Use of equipment on the beach shall be held to a minimum, confined to a single access point, and limited to a 25 -foot work corridor. Construction materials shall not touch the beach outside this work corridor. 9. Bed material shall not be utilized for project construction or fills. 10. Beach area depressions created during project activities shall be reshaped to preproject beach level upon project completion. 11. Eelgrass and kelp shall not be adversely impacted due to any project activities (e.g., barge shall not ground, equipment shall not operate, and other project activities shall not occur in eelgrass and kelp). 12. Removal or destruction of overhanging bankline vegetation shall be limited to that necessary for the construction of the project. 13. Intertidal wetland vascular plants shall not be adversely impacted due to project activities (e.g., barge shall not ground, equipment shall not operate, and other activities shall not occur in intertidal wetland vascular plants). If such vegetation is adversely impacted, it shall be replaced using proven methodology. 14. All natural habitat features on the beach larger than 12 inches in diameter, including trees, stumps, logs, and large rocks, shall be retained on the beach following construction. These habitat features may be moved during construction if necessary. 15. Project activities shall be conducted to minimize siltation of the beach area and bed. 16. If a fish kill occurs or fish are observed in distress, the project activity shall immediately cease and WDFW Habitat Program shall be notified immediately. 17. All debris or deleterious material resulting from construction shall be removed from the beach area and bed and prevented from entering waters of the state. 18. No petroleum products or other deleterious materials shall enter surface waters. 19. Project activities shall not degrade water quality to the detriment of fish life. Additional authorization from other public agencies may be necessary for this project. This HPA shall be available on the job site at all times and all its provisions followed by the permittee and operator(s) performing the work. This HPA does not authorize trespass. The person(s) to whom this HPA is issued may be held liable for any loss or damage to fish life or fish habitat which results from failure to comply with the provisions of this HPA. Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one hundred dollars per day or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment. All HPAs issued pursuant to RCW 75.20.100 or 75.20.160 are subject to additional restrictions, conditions or revocation if the Department of Fish and Wildlife determines that new biological or physical information indicates the need for such action. The permittee has the right pursuant to Chapter 34.04 RCW to appeal such decisions. All HPAs issued pursuant to RCW 75.20.103 may be modified by the Department of Fish and Wildlife due to changed conditions after consultation with the permittee: PROVIDED HOWEVER, that such modifications shall be subject to appeal to the Hydraulic Appeals Board established in RCW 75.20.130. L99 -0027 APPLICANT: The Boeing Company PROJECT LOCATION: 8123 East Marginal Way South (Boeing Plant 2, Building 2 -41) in the Duwamish River mudflat (see Attachment A, Exhibit A). The construction site is located beneath the building's southwest comer, in the intertidal area that it overhangs. EXISTING SITE USE: The general site is used for heavy industrial aircraft development and manufacture. An existing building (Boeing Plant 2, Building 2-41) overhangs the river on wooden piles by approximately 30 to 40 feet as the shoreline varies in location. The shoreline rises approximately five feet above the ordinary high water mark (elev. 4.4 ft. NGVD), on a riprapped river bank. The immediate construction site is beneath the building overhang, adjacent to the riprap river bank. The existing construction site condition is summarized as an unvegetated mudflat. PROJECT DESCRIPTION: The applicant proposes to remove 40 cubic yards of contaminated soil in conformance with the Plant II Consent Order issued by the EPA to Boeing, and pursuant to Federal contaminated site clean-up provisions (see Attachment A, Exhibits B and C). The removed soil would be replaced with clean gravel and sand, and existing contours would be restored. Contaminated soil and associated water will be temporarily held on site while drying. Disposal shall be either into the sewer system with an industrial waste discharge permit or to a hazardous waste disposal facility. The construction would be no greater than 50 ft. by 50 ft., as needed to deploy equipment to vacuum excavate a by 17 foot by 20 foot by three foot deep hole for contaminated soil removal. Construction site access would be from above, through a hole cut into the building floor. Additional information is provided in the attached Shoreline Substantial Development Permit application and its exhibits.. SHORELINE MANAGEMENT PROGRAM PROVISIONS AND REGULATIONS IMPACTS ON (AND CONSISTENCY WITH) SHORELINE POLICIES The proposed contaminated site clean up will remove unhealthy levels of lead contaminants from the natural environment in a manner which an environmental analysis has determined will have no significant adverse impacts (City of Tukwila SEPA file E99- 0014). The most applicable King County Shoreline Master Program provisions are identified below. Shoreline Use Element Goal: Preserve or develop shorelines, adjacent uplands and adjacent water areas in a manner that assures a balance of shoreline uses with minimal adverse effect on the quality of life, water and environment. Objective 3: Where appropriate, land and water uses should be located to restore or enhance the land and water environments. Economic Development Element Objective 3: Shoreline economic development which may have significant or substantial detrimental effect on either land or water environment should be constructed and operated in a manner to minimize these effects. Conservation Element Policy 5.2: Shoreline activities, and developments should be planned, constructed and operated to minimize adverse effects on the natural processes of the shoreline, and should maintain or enhance the quality of air, soil and water on the shoreline. CONSISTENCY WITH KING COUNTY SHORELINE REGULATIONS The project site is designated "URBAN ENVIRONMENT" in the King County Shoreline Master Program. Contaminant removal was determined to be necessary to preserve public health and safety, and is being done pursuant to an Administrative Order on Consent [RCRA Docket No. 1092-01-22 - 3008(h)] issued by the Environmental Protection Agency to the applicant. The State of Washington Dept. of Ecology has determined that it will not require an individual water quality certification and CZM Consistency Response (Kenny, 4/1/99 (attached)). CONCLUSIONS Based on the above information, the proposed contaminant clean -up is determined to be consistent with the applicable Shoreline Master Program Goals, Objectives and Policies, and Shoreline regulations. Mean High Water and Mean Higher High Water Tidal Elevations at any specific location can be found in tidal benchmark data compiled by the United States Department of Commerce, Environmental Science Services Administration, Coast and Geodetic Survey, dated January 24, 1979. This information can be obtained from the Corps of Engineers at (206) 764 -3495. The determination of tidal elevation is obtained by averaging each day's highest tide at a particular location over a period of 19 years, measured from mean Lower Low water, which equals 0.0 tidal elevation. Mean Lower Low is the 0.0 tidal elevation, determined by averaging each day's lowest tide at a particular location over a period of 19 years. It is the tidal datum for vertical tidal references in the saltwater area. Ordinary High Water Mark or Line means the mark on all lakes, streams and tidal waters, which will be found by examining the beds and banks and ascertaining where the presence and action of waters are so common and usual, and so long continued in all ordinary years, as to mark upon the soil or vegetation a character distinct from that of the abutting upland, provided that in any area where the ordinary high water mark cannot be found, the ordinary high water mark adjoining saltwater shall be the line of mean higher high tide and the ordinary high water mark adjoining fresh water shall be the line of mean high water. Shorelands or shoreland areas means those lands extending landward for two hundred feet in all directions as measured on a horizontal plane from the ordinary high water mark; floodways and contiguous floodplain areas landward two hundred feet from such floodways; and all wetlands and river deltas associated with the streams, lakes, and tidal waters which are subject to the provisions of 90.58 RCW. Shorelines means all water areas of the state, including reservoirs, and their associated wetlands, together with the lands underlying them, except stream segments upstream of the point where mean annual flow is less than 20 cubic feet per second, and lakes less than 20 acres in size. Wetlands means areas that are inundated or saturated by surface water or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. This action targets the site of a former pile of debris located beneath the pile- supported portion of Building 2 -41, which is cantilevered over the Duwamish River. This action will precede the proposed remedy for the entire Duwamish Sediment Other Area (DSOA) which includes dredging 3 ft of sediment within the DSOA and backfilling with clean cap material. The proposed remedy for the DSOA is detailed in the Focused Corrective Measures Study that is currently under review by the US Environmental Protection Agency (EPA). This IM Work Plan has been prepared to be consistent with the requirements of the Administrative Order on Consent (Order) issued by EPA to Boeing under the authority of Section 3008(h) of the Resource Conservation and Recovery Act (RCRA) of 1976, as amended, 42 USC 6928(h). This Order [RCRA Docket No 1092- 01- 22- 3008)h)] became effective on January 18, 1994. 1.1 RATIONALE This proposed action targets an area of elevated lead concentrations found under Plant 2 Building 2 -41 in the Duwamish Sediment Other Area (DSOA). Pentec will be the overall manager for the project. Pentec will be the design and construction engineer and will have responsibility for work planning and design, coordinating efforts of the interim measure contractor, managing and overseeing interim measure construction, documenting construction progress and compliance with quality assurance requirements, and preparation of a completion report. 1.3.3 Interim Measure Construction Subcontractor The IM construction subcontractor will be responsible for site ,preparation, excavation and material handling, deployment of runoff control measures, procurement and placement of backfill, moisture reduction of recovered sediment, worker health and safety, and personnel and equipment decontamination. The IM construction subcontractor will report directly to the on -site construction engineer. 2.0 DESCRIPTION OF PROJECT AREA In the summer of 1998, Boeing located an isolated pile of debris under the pile- supported portion of Building 2 -41 that is cantilevered over the Duwamish River (Figures 1 and 2). Boeing removed the debris in August 1998 in order to minimize impacts to design and implementation of the proposed remedy for the DSOA. The debris that was removed from the site included chunks of metal, broken timbers, and battery cases. Because there were battery cases in the debris, Boeing proceeded to evaluate the potential for elevated lead concentrations in the sediment that was left in place and conducted a focused sediment sampling program in the area. Ten locations in the vicinity of the former debris pile were sampled (Figure 2). At these locations, 3 -ft deep composite sediment cores were collected and analyzed for total and leachable (via Toxicity Characteristic Leachate Procedure [TCLP]) metals. A 3 -ft depth is consistent with the remedial action proposed for the entire DSOA. Results of these analyses are provided in Appendix Tables 2 and 3. Elevated concentrations of total and leachable lead were found at several of the sampling locations (Figure 3). These results indicate lead concentrations in sediment that warrant action within an approximately rectangular area having horizontal dimensions of roughly 17 ft by 20 ft (Figure 3). The alternatives and the resulting evaluation are summarized below: No action: A "no action" alternative was determined not to be reasonable because of the potential for the hot spot constituents to migrate and because existing conditions could complicate waste segregation during implementation of the proposed remedy for the DSOA. Capping: A capping alternative was not selected because it would not be consistent with the proposed remedy for the DSOA. Removal: A removal alternative was selected because it eliminates the potential for migration prior to the implementation of the proposed remedy for the DSOA and because it will simplify waste segregation during the proposed remedy. 4.0 SCOPE OF WORK 4.1 HEALTH AND SAFETY PLANS OSHA /WISHA- compliant, site - specific Health and Safety Plans (HASP) covering all personnel will be prepared. U. ui U =`: 0 1". z 4.3 PLANS AND SPECIFICATIONS 4.3.1 Mobilization and Site Preparation Site preparation will include staking the limits of the excavation area, concrete saw cutting an approximately 24 -inch square access hole in the floor of the 2 -41 Building directly above the excavation area, potential removal of some sub -floor timbers for worker access, delivery of roll -off boxes, portable water storage tanks, and electric sump pumps. Additionally, an absorbent pad boom will be placed on flat areas surrounding the excavation limits, and a silt curtain will be installed around the excavation area, keyed into the sediment, and fixed to piling. Site preparation will also include initial establishment of exclusion zones, consistent with requirements of the HASP. Modified Level D PPE will be required inside all exclusion zones. A small decontamination station will be set up adjacent to each exclusion zone which will include PPE, a decontamination tub, brushes, disposal bin for used PPE, first aid kit, and other supplies. February 1. 1999 00301\ 002\ 105\im\imworkplanrev4_r.doc:cjw page 8 Interim Measure Work Plan Pentec 4.3.2 Removal Sediment will be removed in the 17 -ft by 20 -ft area shown on Figure 3 to a depth of 3 ft below existing grade. Removal efforts will be performed when the tide (Seattle) is at +2 ft mean lower low water (MLLW) or lower. Depending on the month, this may require that work be performed at night. Other than the need for lighting equipment, night work would not adversely impact the ability to successfully complete this work. A vac -truck will be stationed within the building and will ' reach underlying sediment through the access hole using a smooth -wall, 6- inch - diameter vacuum tube with flex tubing at its end. Laborers will direct the tube and move sediment to it with hand tools. A submersible pump will be installed in the excavation and will pump ponded water, if any, upward through the floor to temporary holding tanks staged within the building and then transferred to temporary storage tanks located outside of the building. Removal of excess water will minimize water in the vac -truck and limit migration of suspended solids from the removal area. Debris (metal chunks, broken timbers, battery casings, etc.) will be removed by hand and manually transported to roll -off boxes. Excavation rates are anticipated in the 2 to 4 cubic yards (cy) per hour range. Impacted sediment will be removed to the limits specified by the supervising engineer. If more than one day is required to remove the sediment, the affected area will be covered with a geotextile fabric and weighted down with equally spaced sandbags, bricks, or equivalent. Weights will be spaced at a maximum distance of 3 ft. Until the area is backfilled, geotextile will be placed each day before the removal area becomes covered with water. 4.3.3 Backfill Backfill will consist of clean sand or pea gravel obtained from the nearby Lone Star Northwest plant. Backfill will be placed through the access hole in the floor and will be distributed within the excavation and finish graded by laborers with hand tools. The backfill will be analyzed to confirm that it is below SQS (WAC 173 -204) concentrations. 4.3.4 Moisture Reduction Elimination of free water from the removed sediment will be necessary in order to condition the material for landfill disposal (e.g., meet Paint Filter Test criteria). Free water (supernatant) that collects on the surface will be decanted and stored in the temporary water storage tanks. After decanting the accessible free water, cement kiln dust (CKD) or flyash will be added and mixed with the sediment to further dry the material. Mixing will be done with the bucket of a rubber -tired backhoe. The drying agent will be transported to the site via a pneumatic tanker truck and will be discharged directly into the mixing tank. The mixing tank will be covered with plastic during placement of the drying agent to minimize airborne dust. Once the sediment has been sufficiently dried, it will be transferred from the mixing tanks to roll -off boxes. Roll -off boxes will be lined with plastic sheeting, which will also be placed under the roll -off boxes to capture any spillage. 4.3.5 Transportation and Disposal (T &D) The recovered material will be disposed of in accordance with applicable state and federal regulations. Boeing will be responsible for all waste profiling, transportation and disposal, including any liquids or debris generated during sediment removal and related decontamination activities. It is anticipated that approximately 40 cy of sediment will be removed. The wet unit weight of this material is estimated to be approximately 105 pounds per cubic foot. A 30 percent weight increase is anticipated from the addition of a drying agent. Therefore, the total disposal weight is estimated to be approximately 74 tons. 4.3.6 Decontamination Decontamination will be required for the vac -truck tank, submersible pumps, mixing hoe bucket, any reusable tanks, hand tools, and hard surfaces. PPE, vacuum tubes, and waterlines will be disposed of in the roll -off boxes. The decontamination will be done in /over the mixing tanks. The equipment will be scraped to remove the gross residue and then pressure washed. Solid residue will be placed in the roll -off boxes along with decontamination brushes, PPE, and absorbent booms. Rinsate from decontamination activities will be transferred to the temporary storage tank(s) and disposed of along with other liquids generated by the project. The construction site is located beneath the building's southwest corner, in the intertidal area that it overhangs. EXISTING SITE USE: The general site is used for heavy industrial aircraft development and manufacture. An existing building (Boeing Plant 2, Building 2 -41) overhangs the river on wooden piles by approximately 30 to 40 feet as the shoreline varies in location. The shoreline rises approximately five feet above the ordinary high water mark (elev. 4.4 ft. NGVD), on a riprapped river bank. The immediate construction site is beneath the building overhang, adjacent to the riprap river bank. The existing construction site condition is summarized as an unvegetated mudflat. PROJECT DESCRIPTION: The applicant proposes to remove 40 cubic yards of contaminated soil in conformance with the Plant II Consent Order issued by the EPA to Boeing, and pursuant to Federal contaminated site clean-up provisions (see Attachment A, Exhibits B and C). The removed soil would be replaced with clean gravel and sand, and existing contours would be restored. Contaminated soil and associated water will be temporarily held on site while drying. Disposal shall be either into the sewer system with an industrial waste discharge permit or to a hazardous waste disposal facility. The construction would be no greater than 50 ft. by 50 ft., as needed to deploy equipment to vacuum excavate a by 17 foot by 20 foot by three foot deep hole for contaminated soil removal. Construction site access would be from above, through a hole cut into the building floor. Additional information is provided in the attached Shoreline Substantial Development Permit application and its exhibits.. SHORELINE MANAGEMENT PROGRAM PROVISIONS AND REGULATIONS IMPACTS ON (AND CONSISTENCY WITH) SHORELINE POLICIES The proposed contaminated site clean up will remove unhealthy levels of lead contaminants from the natural environment in a manner which an environmental analysis has determined will have no significant adverse impacts (City of Tukwila SEPA file E99- 0014). The most applicable King County Shoreline Master Program provisions are identified below. Shoreline Use Element Goal: Preserve or develop shorelines, adjacent uplands and adjacent water areas in a manner that assures a balance of shoreline uses with minimal adverse effect on the quality of life, water and environment. Objective 3: Where appropriate, land and water uses should be located to restore or enhance the land and water environments. Economic Development Element Objective 3: Shoreline economic development which may have significant or substantial detrimental effect on either land or water environment should be constructed and operated in a manner to minimize these effects. Conservation Element Policy 5.2: Shoreline activities, and developments should be planned, constructed and operated to minimize adverse effects on the natural processes of the shoreline, and should maintain or enhance the quality of air, soil and water on the shoreline. CONSISTENCY WITH KING COUNTY SHORELINE REGULATIONS The project site is designated "URBAN ENVIRONMENT" in the King County Shoreline Master Program. This area is approximately 17 feet by 20 feet to a depth of 3 feet. The sediment will be removed using a vacuum -truck with a smooth -wall, 6- inch - diameter vacuum tube.
