Mullet, Mayor Department of Community Development Steve Lancaster, Director MEMORANDUM November 1, 2004 TO: File, L99 -0035 FM: Carol Lumb, Senior Planner RE: Boundary Line Adjustment and Lot Consolidation L99 -0035 On November 12, 1999, the City of Tukwila approved a Boundary Line Adjustment that reduced the area of parcel 004200-0384 and enlarged tax lots 004200 -0391 and 004200 -0392. A second action included in this BLA was the consolidation of the remainder of parcel 004200 -0384 with parcel 004200 -0385. The BLA /Lot Consolidation was recorded with King County on November 19, 2004 (recording #19991119000130). Attachment 1 is the parcel map and materials recorded with King County. It has come to our attention that when the BLA map was recorded with King County, the lot consolidation was not recognized. The Attachment 2 is a printout from the King County Assessor's Office that illustrates the current configuration of parcels 004200 -0384 and 004200- 0385 and reflects the revised boundary lines for parcels 004200 -0391 and 004200 -0392. As a result of the County's recording /mapping error, it appears that the lot consolidation of parcel 004200 -0384 with parcel 004200 -0385 was not recorded with the result that parcel 004200 -0384 remains a stand alone parcel. The City has no reason to pursue a correction to the unrecorded consolidation and will recognize the lots as they are shown by King County. Z v 0; z RECEIVED CITY OF TI IKWH A OCT 1 5 2004 PERMIT CENTER I am writing in reference to a boundary line adjustment / lot line consolidation that was done for parties Zeiger / Easter / Autio / Riedl under recording #19991119000130 (Exhibit #1). The original intent of the action was to do a boundary line adjustment only. I am asking that the lot line consolidation part of the action be rescinded. The property owned by Zeiger that lay directly to the west of Easter and Autio was to be included as a part of their lots (Exhibit #2). This was accomplished satisfactorily in the process with the boundary line revision. Although it appears papers were signed for a lot consolidation between Zeiger and Riedl (Exhibit #3), it was never the intent of the parties involved. This can be demonstrated by the subsequent actions of the parties as follows: 1) Tax records, including legal descriptions (Exhibit #4, #5) and county plat maps (Exhibit #6), still show 2 separate lots and each party has been paying their separate portions. 2) Riedls listed (Exhibit #7) and sold (Exhibit #8) their house using a legal description that included only their original lot. During the sales process no questions arose regarding lot lines or insurability of title (Exhibit #9). 3) Zeiger listed (Exhibit #10) his lot for sale and only upon the prospective buyer inquiring about building permits did the current dilemma come to light. Some of the confusion and miscommunication may have resulted from the fact that Mike Easter (Exhibit #11) coordinated the project. None of the parties involved have experience in these matters. I am requesting that the lot line consolidation portion of the above referenced action be rescinded and the original lines be restored. Sincerely, C. You will need to pay the recorded fees and submit your approved original documents for recording to the King County Department of Records (206 -296- 1570). Dear Mr. Easter: The proposed boundary line adjustment has been reviewed by the Public Works, Fire and Community Development departments. This is a letter updating the status of the City review and requesting further information. I understand that your group is somewhat frustrated at the pace of review. I can only note that the City's system to fairly handle our permit volume is to review applications and revisions in order of receipt. The need for additional information or revisions increases the number of times a project must go to the end of the line and greatly increases review time. Your permit review process has been summarized below. I thank you for your patience and continued positive approach to resolving permit issues. PROJECT STATUS Date Action April 30, 1999 Application submitted. May 25, 1999 Staff from the Public Works, Fire and Community Development departments meet for an initial review. This is an informal meeting to identify issues of common concern. Substantive review comments are submitted at a later date. More information on the access easement to be created to the east is required (not all easement property owners are party to the application) further provisions for later conversion of the new easterly easement to a public right -of -way (to match the adjacent 20 ft. wide easement on the west) should be considered, and identification of conceptual infrastructure design may be established in the record. May 27, 1999 Mr. Easter and Vernon Umetsu meet to discuss preliminary staff comments, recognizing that actual substantive comments will be provided later. Mr. Easter notes that the easterly easement of concern was mistakenly left out of the "Before" map and that it currently exists. He corrected the application at that time. Other options were also informally discussed. June 30, 1999 The application is established as "complete" for vesting purposes. The original application is the document currently being reviewed. June 22, 1999 Public Works, Fire and Community Development staff meet to review the new easement information. Staff confirms its need for information on the easements, as the City is being asked to modify or delete them (see comments below). INTERDEPARTMENTAL REVIEW COMENTS Please provide the following information for City review of your proposed boundary line adjustment/lot consolidation application. 1. Provide the specific provisions and ownership for all existing easements. Appropriate documentation would be provided by the easement description as recorded with King County or as identified in the title report of each property. (as shown in the title report). Easements shall be cross - referenced on the plat (map). Specific concerns regarding each easement are listed below. The referenced easements are shown in the attached plan. Easterly easement. This easement appears to be owned by several parties who are not represented on this application. The proposed lot consolidation and elimination of the westerly easement could mean that the newly expanded southerly parcel might be, de facto, expanding its reliance on the remaining easterly easement. This would especially be the . case in the event of further land division. The appropriateness of this action can only be evaluated based on a review of the easement document in total. Westerly easement. This easement is proposed to be deleted as unneeded upon consolidation of the two southern-most lots. Review of the easement document in total is needed in order to responsibly demonstrate that all owners are represented in the application and that all functions of the easement are being satisfied. 2. Revise the existing and proposed legal descriptions to incorporate each lot's respective easement and provide a separate easterly easement description for recording (if not already recorded).
