Temporary Noise Variance for SR99 Repair and Repaving Page 2 FINDINGS BACKGROUND M.A. SEGALE, INC. requests a 14 day, "temporary noise variance" to allow night road repair. This night work is part of a larger road repair project on SR99, from S. 132nd Street to the First 1;1 Avenue South Bridge. The City of Seattle and King County have granted conditional approval for noise variances to allow work between 10 p.m. and 7 a.m.. $'t This application differs from the previous variances granted for night road construction in that the contractor (SEGALE) is the applicant instead of the Washington State Dept. of Transportation (WSDOT). Construction activities would be substantively similar: the construction firm would do the work with equivalent equipment and WSDOT supervisors /inspectors would be on -site at all times. WSDOT makes application only when night work variances are required for the construction. WSDOT considered congestion impacts acceptable and granted approval for daytime lane closures to do the work. Work would still occur during the day. VICINITY /SITE INFORMATION 1. Project Description: The applicant's request for a technical variance is shown in attachments A and B. SEGALE proposes to (1) remove existing asphalt, (2) repair the road base and (3) re- asphalt SR99 between the SR599 interchange and the northern City limits. This area is shown in Attachment C. The noisiest equipment used in the three types of activities and their duration are presented below. Sound is less annoying than concrete grinding as asphalt is a softer material (Horner, King County). 85 Machine travels at a maximum 45 ft. /min. If paving noise is begun to be perceived 1/4 mile away, a stationary point would be exposed for about one hour. The maximum noise level would be experienced by a fixed roadside point for some fraction of this hour. Haul trucks — Ground asphalt makes much less noise than the normal mix of earth and rock or concrete chunks. 88 Loading, acceleration and backup signaling would occur with grinding operations. See above. Road Base Repair Grinding to clean out (concrete) road base cracks prior to sealing. The access point from 27th Place SW will have a moderate amount of grinding. — Perceived noise is similar in character to a router, with a much higher volume (Becker, SEGALE). Sound is much more intrusive than a typical 85 dBA noise due to the high pitch. 85 Typically less than 30 minutes (Attachment B:2, par. 2). Multiple cracks in the same area would lengthen the time, as would unanticipated longer stretches to be ground as directed by WSDOT supervisors (Pinard, SEGALE). Almost all cracks have been ground or will be ground during the day (Becker, SEGALE, 7/14/99). Grinding at the 27th Place ramps may take 2 hours. Repaving Steel drum (dynamic) rollers — Much more intrusive than a typical 86 dBA noise due to the impact nature of the sound. 86 A "paving train" consisting of the asphalt paver, a dynamic roller and two drum rollers travels at 45 ft. /min. for an average 3 mile long segment. If paving noise is begun to be perceived 'A mile away, a stationary point would be exposed for about one hour. 1A standard dBA scale is used for the night setting because a day /night differential (Idn) has already been incorporated into the noise standards. Existing Site Development: The project site is a limited access freeway with two lanes in each direction, 10 -12 ft. wide shoulders and a 20 -30 ft. wide, grassed median. 3. Surrounding Land Use: To the west, residential, industrial and commercial uses lie within 100 feet of the freeway on a hillside. Lands to the east are commercial and industrial in nature, extending across the Duwamish Valley to the residential uses along Skyway Ridge, about one mile away. DECISION CRITERIA A "temporary noise variance" may be issued by the D.C.D. Director, acting as the "administrator," pursuant to TMC 8.22.180(B): "...at the reasonable discretion of the administrator." The criteria to grant or deny a temporary noise variance is shown in bold and followed by staff discussion. 1. No variance shall be granted pursuant to this chapter until the administrator has considered the relative interests of the applicant, other owners or possessors or (sic) property likely to be affected by the noise, and the general public. (TMC 8.22.180(C)) City Adopted Noise Standards a. Construction noise is exempt from regulation except between 10 p.m. and 7 a.m. (TMC 8.22.160(4)). During those times, the proposed freeway construction noise impacts on residential receiving districts is limited to 50 dB(A) per TMC 8.22.050(1)2. b. "No sound source specifically exempted from a maximum permissible sound level by this chapter shall be a public nuisance noise or public disturbance noise..." (TMC 18.22.140). This would apply to the proposed roadway construction during non - regulated hours. Noise. Impacts c. Residential areas would tend to be the most affected by a night noise variance as commercial sites tend to be closed between the 10 p.m. and 7 a.m. variance period. Sites 1, 3, 4 and 5 represent typical residential area impact areas. Existing sound levels at these sites were monitored by the applicant and are shown below. 2This assumes that the freeway is an "industrial" "District of Sound Source." A commercial district is limited to 47 dB(A) while a residential source is limited to 45 dB(A) (TMC 8.22.150(1)). No other adjustments per 8.22.150(2) or (3) seem to be appropriate. EPA thresholds of health based noise impact guidelines were recognized and incorporated into the "Tukwila Comprehensive Plan Environmental Impact Statement" (October, 1995:pg.47) as follows: 55 or less Levels are generally acceptable; no noise impact is generally associated with these levels. 55 -65 dB(A) Adverse noise impacts exist; this measurement represents the lowest level possible without adverse significant impact. 65 -70 dB(A) Significant noise impacts exist; allowable only in unusual cases where lower levels are not possible. over 70 dB(A) Levels of unacceptability for public health and welfare considerations. e. In general, residential buildings with single pane glass windows readily reduce outside sound by 20 dB(A). Residences with double pane glass can reduce sound levels by 25 dBA. This would mean occasional estimated interior sound levels as follows: 3 Monitoring sites have direct line of sight access to the road, except for Site 4, which sits atop a high, vertical bank above the road. 4 Attachment B:4 -5. The overwhelming majority of area residences were built prior to 1984, before the requirement for double pane windows. g. Activities not occurring at night with a variance would be shifted to the day, when construction noise is exempt and when occupants are more likely to be outside and exposed to unhealthy sound levels. The duration of daytime construction impact may be shortened with the variance. h. The City of Tukwila has granted two technical noise variances to WSDOT for night road work in 1994 and 1997 (L94 -0068 and L96 -0080 respectively). Estimated sound levels at a significantly greater number of residences were similar to those projected here. Noise education of supervisory personnel was required and extensive mitigation provisions aided in minimizing noise impacts (Farrar, WSDOT and Horner, King County). No noise complaints were received. 5 The Difference between DCD Staff and SEGALE Sound Level Estimates A commonly accepted rate of noise attenuation due to terrain with visually blocking objects is 6 dBA for each doubling of the distance from the sound source, measured at 15 meters (50 feet). At this rate, receiving residential properties located 100 feet away would experience maximum 78 to 82 dBA for some portion of an hour (see 1.e). Elevated structures with a direct line of site would not experience significant terrain based attenuation. Noise readings were submitted for such sites by the applicant. Sites of higher sensitivity to night noise impacts would include Site 1 (Harmony Gardens Care Center), Site 3 (Riverside Apartments), Site 4 (single family residential area) and Site 5 (single family residential area). The applicant estimates maximum sound levels at residential receiving properties at 78 to 82 dBA, based on an 8 -10 dBA reduction for each doubling of distance from the sound generator, and has applied this factor to all cases. This would result in outdoor sound levels of 74 to 78 dBA at sites 1,3, 4 and 5. The difference between DCD and SEGALE estimates of terrain effects may be due to a SEGALE assumption that monitored sound increases by semi - trucks were generated at 88 dBA (Attachment B:4 -5). This maximum sound level for semi - trucks occurs at initial acceleration. The applicant asserts that congestion will be reduced and commerce less affected if night work is authorized (Attachment B:7). J• Daytime lane closures would occur for this construction with or without the variance. WSDOT determined the resulting congestion to be acceptable and authorized the closures. The lane closures may be for a shorter number of days if the variance is granted. 2. The noise occurring or proposed to occur does not endanger public health or safety; (TMC 8.22.180(C)(1)) a. The anticipated maximum sound levels exceed the EPA guidelines for avoiding significant human health impacts for outside areas, based on a comparison between lc and ld. However, EPA guidelines indicate interior noise to be acceptable for short periods (see l f and 1d). b. It is explicitly recognized that higher sound levels are a health hazard and that some individuals are more sensitive to noise impacts than others. It may be appropriate for the applicant to mitigate noise impacts on sensitive individuals to a greater extent than is done for the general public, when the basic 50 dB(A) night time noise standard is exceeded and considering EPA noise impact guidelines. c. In general, a change of 10 dB(A) reflects a doubling of the perceived sound level. d. Not granting a variance would require all construction occur between 7 a.m. and 10 p.m. for a possibly longer duration. e. Previously required education, monitoring and extensive mitigation provisions have played a significant role in protecting public health and safety according to WSDOT (Farrar) and King County (Horner) staff who administer noise provisions. Typical WSDOT contract provisions for working under a City of Tukwila noise variance are shown in Attachment D. 3. The "...activity, use, process or equipment...in accordance with rules and regulations, the does not annoy a substantial number or the people and does not endanger public health or safety." (TMC 8.22.18.22.180(C)(2) and 190(B)) Please see response to Criteria No. 2. The balance between the relative interests of the applicant, other property owners and the general public seem to be served by granting the variance given the following: a. maximum noise levels will be significantly reduced indoors to a noise level which EPA guidelines indicate are acceptable for a short period (58 to 62 dBA per Finding 2a. b. it is reasonable that the public would take refuge indoors from short term, unhealthy noise impacts during the 10 p.m. to 7 a.m. variance period, and c. not granting the variance would still subject the receiving properties to the same level of noise impact between 7 a.m. and 10 p.m., when residents and businesses would have more people outside and exposed to very unhealthy noise impacts, but the duration may increase. B. The noise occurring with the variance is not anticipated to significantly endanger public health and safety, based on estimated indoor noise levels at the receiving properties based on EPA estimates of significant noise levels, the previous conditionally approved, variances not resulting in complaints and the proposed conditions of approval. DETERMINATION Based on the above Findings and Conclusions, the proposed 14 day, temporary noise variance is APPROVED subject to the following conditions. Conditions in italics have been proposed by the applicant.' 1. All residents and businesses within 500 ft. of the project site or receiving 65 dBA, shall be mailed notice of construction with pertinent information, as approved by the Director, at least one week prior to the first night of construction. Notice shall be submitted to the Director at least 3 days prior to being printed. 2. An advertised 24 hour complaint hot line shall be established and have immediate connection to a WSDOT on -site inspector who has been instructed on this variance, attended the noise mitigation class specified in Condition 13 and has the authority to respond to complaints. Response shall include authority to evaluate the level of impact, take equipment out of service, and otherwise resolve the complaint (see Condition No. 17). 3. Maximum noise levels shall be as presented, +1- 2 dBA. 4. All equipment shall be tested to ensure that maximum noise thresholds and characteristics incorporated in the noise analysis are as anticipated. 6 Additional applicant proposed conditions are shown in Attachment B, pg. 6 -7. Night construction activities shall be periodically monitored to ensure that the identified maximum sound levels are not exceeded and are of a duration as represented in the above findings. 6. All trucks performing export haul shall have rubber bed liners except those carrying ground up asphalt. 7. All use of impact tools and impulse tools shall be restricted except for grinders, and pneumatic rollers as described in the application and this decision. 8. All backup warning devices shall be the least intrusive ambient sensitive type or the contractor may use a back -up observer in lieu of backup warning devices as allowed in WAC Ch. 296-155-610(2)(e). 9. All material spilled on the roadway shall be removed by hand methods or sweeping. No scraping type equipment shall be used 10. Residential areas shall be shielded from stationary equipment, such as air compressors, generators, and light plants. Other stationary machinery for off road use, such as cranes shall use double mufflers where practicable. 11. The contractor shall for all mobile equipment use noise blankets, skirts or other means available to mitigate noise that does not reasonably interfere with the engine operation. 12. The contractor shall not use compression brakes. 13. The contractor's supervisory personnel and on -site WSDOT directing contractor work, shall attend a noise mitigation class sponsored by WSDOT. 14. Subsequently, these supervisors shall present noise mitigation methods to other contractor personnel at safety meetings or through other means of instruction. No work authorized by this variance may begin until this attendance requirement is met. 15. All complaints shall be forwarded to the Director as soon as possible the following day. 16. All complaints shall be resolved within 24 hours of WSDOT receipt, based on the provisions of this variance. City staff shall be available to assist in resolution. 17. Complaint resolution shall include, but not be limited to: a. site visits and monitoring, b. withdrawal of equipment not satisfying the identified maximum noise levels or characteristics and c. offering to move the residents to a City approved facility. A list of facilities shall be submitted for City approval prior to night -time construction. Facilities shall be safe, clean, and have general equivalence to a residence. Receipt of 6 or more complaints within a 48 hour period shall justify modifying or revoking the provisions of this variance. 19. Take any alternative measures that the Director may prescribe to mitigate noise impacts per TMC 18.22.190(A), based on the provisions of this variance. A. Segale, Inc. to work nights on the above - referenced project (the "Project "). The Project extends from South 138th Street in Tukwila, along SR 99 to South Holden Street in the City of Seattle. Attached is a Vicinity Map. We have delineated jurisdictional lines on the map to show how the Project extends through and near each of the City of Tukwila, King County and the City of Seattle. The Project is located as follows: • Entirely within the City of Tukwila from the Begin Project point to the intersection of Highways 99 and 599; then ✓ Within the City of Tukwila, along the City's westerly boundary and adjacent to King County from that point until the northerly boundary of Tukwila; then ✓ Entirely within King County until approximately the 14th Ave South overpass; and then ✓ Entirely within the City of Seattle until the End of Project point. Our scope of work along the Project corridor includes asphalt grinding for bridge ends and intersections, crack sealing in locations as designated by the WSDOT during the course of the Project, and asphalt pavement overlay with related incidental work (e.g. guardrail removal). - START DATE: We would like to commence work on July 6, 1999. WORK HOURS: Our night shift will be from 7:00 PM until 6:00 AM. Description of Work. Our work will be completed in two stages: (1) grinding and crack sealing; and (2) paving and related work. Although from a non - construction standpoint, it might be preferable to accomplish grinding during the earlier hours of the night shift and utilize the remainder of the shift to complete paving operations, this approach is neither practical nor safe. Grinding. We believe the necessary grinding work for the entire Project can be accomplished in 14 consecutive working days or less. We understand that the City of Tukwila may require that we provide 14 days advance notice of our intended after hours work to adjacent property owners. If this requirement will indeed be imposed, we will begin our work on the north end of the Project and proceed southerly to the Begin Project point identified on the Vicinity Map. Because of the length of time consumed in completing the grinding work, there will likely be an approximate 2 -week gap between the conclusion of grinding work in any area and the commencement of paving and related work in that area. Background Ambient Noise Levels. The work area is not far from SeaTac International Airport and a sizeable highway intersection within an historically heavily traveled commercial corridor of regional significance. Background ambient noise levels are not insignificant. We believe distance and vegetation will provide attenuation to the public along the Project corridor. Specifically, along the east and west edges of SR 99 in the area between S 133d St and S 130th St, noise impacts to many residences are attenuated by topography (residences are elevated above the roadway on the west and located below the roadway down a slope away from the roadway to the east). At the intersection of SR 99 with 33rd Ave S and S. 1334 St, however, topographic, distance and vegetative attenuation is limited. Mitigation Measures Proposed. We proposed the following measures to minimize impacts: 1. Lighting used for nighttime work shall, wherever possible, be directed away from oncoming traffic and residences or shielded; 2. All backup warning devices shall be the least intrusive ambient sensitive type or the Contractor may use a backup observer in lieu of backup warning devices as allowed by WAC 296- 155- 610(2) (e); 3. During pavement removal, all material spilled on the roadway shall be removed by hand methods or with a power sweeper. No scraping type equipment shall be used; 4. Residential areas shall be shielded from stationary equipment, such as air compressors, generators and light plant. The Contractor shall not use compression brakes; 6. In the event of complaints from adjacent residents, a temporary noise barrier will be used to shield the affected area from noise emanating from the work; and 7. A 24 -hour M. A. Segale, Inc. complaint number and a list of designated contact persons shall be provided to the Environmental Health Division for the purpose of forwarding complaints. We will also notify affected residential property owners by letter or leaflet distribution. Notice would be provided at least one week before work begins. A copy of the proposed notice is attached for your review and comment. We would appreciate the City's input and assistance in identifying residential receptors and their addresses for the purpose of providing notice. It is our belief that operating during night time hours will enhance public safety and promote commerce by, among other things, reducing traffic congestion and related impacts which typically result from daytime lane closures associated with our work. From our perspective in completing numerous construction projects over the years, the impacts of daytime construction work on high volume roadways far outweigh the noise impacts of performing the same work at night. The time frame for review of this request is very short. While we are hopeful that the City, like the other jurisdictions involved, will be able to provide noise variances to assist us in accomplishing our work at night, we understand that it is also possible that the City may take the position that a variance for grinding work in some of the areas identified on page 1 of this letter is not wise. Although from a non - construction standpoint, it might be preferable to accomplish grinding during the earlier hours of the night shift and utilize the remainder of the shift to complete paving operations, this approach is neither practical nor safe. To ensure proper supervision and traffic control, grinding will be completed first and once this activity is finished, we will move through the Project and complete paving and other related work. Grinding and Crack Sealing. We believe the necessary grinding and crack- sealing work for the entire Project can be accomplished in 14 consecutive working days or less. We understand that the City of Tukwila may require that we provide more than one week's advance notice of our intended after hours work to adjacent property owners. If this requirement will indeed be imposed, we will begin our work on the north end of the Project and proceed southerly to the Begin Project point identified on the Vicinity Map. This is a mere line of sight prediction and assumes no attenuation or acceleration. Ambient readings were obtained outdoors, in the afternoon, w o;' when local truck traffic, deliveries, construction activities, metro buses and other activities 2 D' were ongoing. The purpose of taking readings at this time was to evaluate the amount of i co t attenuation that could be expected during our nighttime work. Ambient noise level readings ' 0 ; ranged from 53 -77dBA at the residences and commercial locations, depending upon traffic. w w Readings were taken at six (6) locations as depicted on the attached map. - _ 0, 1. Harmony Gardens Care Center, 10010 Des Moines Memorial Drive. v N 0 Sound Level Readings Site is located north of the subject area. There is a direct line of sight from the roadway, approximately 100' away and down slope, to the point where readings were taken. Ambient afternoon, non -peak noise levels were 64 dBA at the lowest. Readings of 70, 76 and 77 dBA were recorded when cars, trucks and semis passed by on SR 99 in the southbound lanes. Although there is an upslope from the roadway, there is a steep wall immediately adjacent to the roadway and dense vegetation at the building site. Noise levels expected in this location, based entirely on line of sight and distance would be in the range of 88 dBA for semis. Therefore, topography and vegetation are providing an additional 10 dBA of attenuation. 2. Wetland Mitigation Parcel Site is located immediately adjacent to and south of. Harmony Gardens, at the intersection of 17th Place S and Des Moines Memorial Drive. The site is several hundred feet deep extending back from the roadway. It is relatively flat close to the roadway; however, as you move through the parcel to the point where it reaches Des Moines Memorial Drive, tall trees are present, especially adjacent to the eastern edge of parcel, against a steep slope. Mr. Vernon Umetsu SR 99 Project Noise Variance — City of Tukwila July 7, 1999 Page 5 of 7 • located about 200' from the Harmony Gardens measuring point, were 52 dBA. 3. 10300 103`d Place (Riverside Apartments - located across SR 99 from Turning Basin No. 3) Site is located within the subject area, approximately 100' away from the roadway and approximately 50' above it. It is immediately adjacent to the City of Seattle Transmission Line Easement. Ambient noise levels at the top of the steep slope down to the roadway were 54- 60dBA. A passing semi and a passenger vehicle with a high base -range radio raised the noise level readings to 70 and 76 dBA. Readings taken at the apartment building itself, located on a terrace 100' east from the first set of readings at this site, were 66 dBA. Noise levels expected in this location, based entirely on line of sight and distance would be in the range of 88 dBA for semis. Therefore, topography and vegetation are providing an additional 10 dBA of attenuation. 4. North Terminus of 26th Ave South Site is located adjacent to the City of Seattle Transmission Line Easement and there is a direct line of sight to the roadway. Background readings at the residence at 10830, approximately 225' from the roadway, were 68 dBA. This residence is located at the top of a steep slope extending up from the roadway and there is minimal to no vegetation to provide noise attenuation. Readings across the street at 10803 were 62 -64 dBA. Noise levels expected in these locations, based entirely on line of sight and distance would be in the range of 74 dBA for semis. Therefore, topography and vegetation are providing an additional 6 -10 dBA of attenuation. 5. Brick House Visible from SR 99 Site is located at 11232 26th Avenue South. This is a brick residence located upslope from the roadway at the southerly terminus of 26th Avenue South. Background readings taken with the consent of the resident, at the fence line closest to the roadway, were 62 -75 dBA. The resident commented that it is always very noisy at their home, which they purchased almost 30 years ago. She mentioned that at that time there was no mention made of plans to expand the use of Marginal Way to its current extent. She appreciated our interest and disclosure. Based on line of sight attenuation alone, readings should have been in the range of 84 dBA, or even higher based on the fact that the building is located up slope in a direct line from the roadway. Therefore, even at this very close location, vegetation and topography are providing an additional 8 -10 dBA of attenuation. Residence Cad 11416 26th Avenue South The site is a brick residence located midway between site #5 and the intrersection of S 116th Way and 26th Avenue South. Ambient noise level readings at the driveway were 62 -65 dBA (higher when semis passed on SR 99 below). The site is located more than 150' uphill from the roadway, behind dense trees. Along 26th Avenue South (elevated above the terrace which is the site of the house), readings were 53 -60 dBA. Across the street from this house are the Riverside Apartments, which include a multi -story structure facing 26th Avenue South. Although the upper level unit have an almost direct line of sight to SR 99, noise from SR 99 is attenuated due to the terrace former by 26`'' Ave South and by the second terrace former by the residence lot. We believe construction activity noise emanating from our work will be essenti ally imperceptible to most receptors, due to distance, topography and vegetation attenuation and ambient noise. It should be noted that noise from overhead aircraft was measured throughout the study area with consistent readings of 85 -88 dBA. Noise from the proposed construction work in Tukwila's jurisdiction, even if completed un- attenuated and experienced at 50 feet from the sound source, would be comparable to the noise experienced when an airplane passes overhead. Mitigation Measures Proposed. We proposed the following measures to minimize impacts: 1. Lighting used for nighttime work shall, wherever possible, be directed away from oncoming traffic and residences or shielded; 2. All backup warning devices shall be the least intrusive ambient sensitive type or the Contractor may use a backup observer in lieu of backup warning devices as allowed by WAC 296- 155- 610(2)(e); 3. During pavement removal, all material spilled on the roadway shall be removed by hand methods or with a power sweeper. No scraping type equipment shall be used; 4. Residential areas shall be shielded from stationary equipment, such as air compressors, generators and light plant. The Contractor will use means available to mitigate noise from mobile equipment to the extent such measures do not unreasonably interfere with the operation of the equipment;' 5. The Contractor shall not use compression brakes; 4 Rubber bed liners for trucks are not proposed or feasible. The notification shall include the addresses of residences within 152 meters of the proposed work. Failure of the Contractor to perform all obligations under this Special Provision will result in the suspension of all night work. 15 The Contractor shall be responsible to obtain any variances to perform work 16 outside the project limits or within the project limits in addition to the 17 variance already obtained by the Contracting Agency. A copy of the 18 variance obtained by the Contracting Agency is available at the project 19 construction office. 20 21 Other noise mitigation measures may be required, and it is understood that 22 the Contractor is responsible for devising methods that comply with all 23 ordinances. Compliance with the above noise mitigation measures shall not 24 be considered a warranty that the equipment or the activity will comply with 25 all local regulations. _ 26 27 The Contracting Agency will periodically monitor nighttime construction 28 noise levels and will provide the City of Tukwila and the Contractor with 29 periodic reports of the noise monitoring results. The Engineer will evaluate 41 the complaint and the monitoring measurements and take appropriate action 42 based on the above criteria. Upon receiving two or more substantiated 43 complaints, the Contracting Agency will accomplish testing in the bedrooms 44 of affected residents. If measurements are above 52 dBA during night 45 construction, then the contractor will be required to take further mitigation 46 measures such as, but not limited to insulation of the windows, providing 47 motel accommodations, or installing temporary noise walls. Noise impacts of this work are anticipated to be less than those associated with the grinding operations. Lane restrictions and closures will be used to control the work area and protect our workers during our night shift, from 7:00 PM to 6:00 AM, Monday - Friday.
