2. Grantee shall have the right of access to the easement to enable Grantee to exercise its rights
hereunder, provided that Grantee shall compensate Grantors for any damage to the property
caused by the exercise of said right of access.

3. Grantors reserve the right to use the easement for any purpose not inconsistent with the rights

4. By accepting the recording of this easement, Grantee agrees to indemnify and hold harmless

caused by the Grantee's exercise of the rights herein granted, provided that Grantee shall not be
responsible to Grantor for any injuries and damages to any person caused by acts or omissions of
Grantors. .
5. This shall be an easement appurtenant, running with the land, for the benefit of the Grantee.
The rights and obligations of the parties shall inure to the benefit of and be binding upon their
respective successors and assigns..
6. 'If the Grantee purchases property containing the easement, creating a merger of title, the easement
shall terminate.

Dear Mr. Sanft:
The Short Subdivision Committee has completed a detailed review of the boundary line
adjustment application you submitted on July 9, 1999. Based upon your submittal, preliminary
approval is granted subject to the conditions stated below.
There are five steps in the coordinated boundary line adjustment and road vacation process:
These steps and their requirements are described as follows:
1. Preliminary Approval
This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Subdivision Committee and approved with conditions. The conditions
imposed are to ensure that the boundary line adjustment is consistent with the City's
policies and regulations.
PRELIMINARY APPROVAL CONDITIONS
Site Survey Requirements
a. The proposed boundary line adjustment, lot consolidation and easement proposals must
include all requested right of way to be vacated (per the City Council action) and
properties, to demonstrate adequate infrastructure and access to all 'lots (S. 144th Street to
S. 147th Street). This is required to satisfy the road vacation conditions. This would
include, but not be limited to the "Eriks" property (King Co. Tax Lot No. 336590- 1650).
b. Submit revised legal descriptions of the three lots to result from the boundary line
adjustment, as shown in the site map submitted on July 7, 1999 (Attachment A). This

should also be shown on a revised plat, with appropriate call outs for existing, new and
deleted lot lines (per Tukwila plat requirements on the application). The description and
plat should also reflect references and dedicated areas used in the Statutory Warranty
Deed submitted with the application.
The submitted "Statutory Warranty Deed" describes 20 ft. of property to be conveyed to
the City which is located adjacent to SR 181 (Interurban Avenue South). It also
references "Together with the Southwesterly 20 feet of said Right -of -Way No. 2." as an
area to be dedicated. The plat and descriptions must identify the location of Right -of-
Way No. 1 and No. 2, and this additional area.

b. Identify all existing easements, public /common utilities and new easements to be
established to accommodate needed common access and utilities between S. 144th St. and
S. 140t Street.. This shall include, but not be limited to the previously identified access g a

Avenue (see attached water and sewer plans (Attachment B) which the Public Works w:.

Owner Signatures
d. All property owners (including easement owners) which are affected by the boundary line
adjustment must have notarized signatures on the application. This includes, but is not
limited to all owners of King Co. Tax Lot No.'s 336590- 1570 -02 and 000280 - 0030 -05
(GT Development). A Property Owner Signature Page for Boundary Line Adjustments is
attached.
Lot consolidations are now proposed. All owners of property being consolidated must
also sign the Property Owner Signature Page for Lot Consolidations (attached).
2. Final Approval
The next step is to submit the necessary boundary line adjustment documents indicated
above and comply with all the conditions of approval. After the documents have been
found to be in order and all of the requirements of the boundary line adjustment have
been met, the Short Subdivision Committee will grant final approval conditioned upon
completing Maule Avenue vacation. The boundary line adjustment may not be recorded
until the vacation is completed' and formal Final Approval is granted.
3. Complete Maule Avenue Vacation
Upon resolving the above concerns and compliance with all other requirements
established by the Tukwila City Council for vacating Maule Avenue, the applicants may
petition the Tukwila City Council to complete the Maule Avenue vacation. Upon

completing the vacation, the boundary line adjustment will be formally approved by the
Short Plat Committee and recording would be authorized.
4. Recording
It is your. responsibility to record the City approved boundary line adjustment documents
with the King County Department of Public Records. The boundary line adjustment is
not complete until the recording occurs and copies of the recorded documents are
provided to the Department of Community Development. You will need to pay the
recorded fees and submit your approved original boundary line adjustment to the King
County Department of Records (206 - 296 - 1570).
After recording, the County returns the recorded original to the City of Tukwila within 4
to 6 weeks, at which time your boundary line adjustment is considered complete. You
can shorten this processing time. by hand - delivering a copy of the recorded boundary line
adjustment to the undersigned.
5. Expiration
Verno" n
Your application for a boundary line adjustment will expire if it has not been recorded
within one year from the date of approval. Upon written request from the applicant prior
to the expiration date, the Short Subdivision Committee is authorized to grant one
extension, not to exceed six months.

hereunder, provided that Grantee shall compensate Grantors for any damage to the property
caused by the exercise of said right of access.
3. Grantors reserve the right to use the easement for any purpose not inconsistent with the rights

4. By accepting the recording of this easement, Grantee agrees to indemnify and hold harmless
Grantors from any and all claims for injuries and damages suffered by any person which may be

Section 1. A public hearing upon the vacation of a portion of Maule Avenue from South 144th
Street to South 147th Street shall be held before the Tukwila City Council in the City Council Chambers
at Tukwila City Hall, 6200 Southcenter Blvd., Tukwila, Washington, on Monday, July 20, 1998, which is
not less than twenty (20) nor more than sixty (60) days from the date of passage of this resolution, at
which time all persons interested in said right -of -way vacation are invited to appear and be heard.
Section 2. The City Clerk is directed to post written notice of pendency of the public hearing in
three public places in the City of Tukwila and in one additional conspicuous place on the right -of -way
sought to be vacated at least twenty (20) days prior to the date set for hearing.
