This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170. At their October
28, 1999 public hearing, the Planning Commission approved the applicant's request for a Wireless
Communication Facility comprised of 8 antennae attached to a 60 foot monopole with associated
operating equipment located adjacent to the antennae. The Planning Commission approved the
Conditional Use Permit with the following conditions:
1. The cement pad for the operating equipment must be located outside of the side setback
area. The revisions to meet this condition may be approved by the Director of
Community Development.

Property owners affected by this decision may request a change in valuation for property tax
purposes notwithstanding any program of revaluation.
h. Administrative appeals for the various permit Types are discussed below.
The period for administrative appeals is 14 days, starting from the issuance of this Notice of
Decision. The administrative body hearing the appeal is the City Council. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials shall
contain:
1. The name of the appealing party,
2. The address and phone number of the appealing party, and if the appealing party is a
corporation, association or other group, the address and phone number of a contact
person authorized to received notices on the appealing party's behalf, and
3. A statement identifying the decision being appealed and the alleged errors in that
decision. The Notice of Appeal shall state specific errors of fact or errors in application
of the law in the decision being appealed, the harm suffered or anticipated by the
appellant, and the relief sought. The scope of an appeal shall be limited to matters or
issues raised in the Notice of Appeal.

Existing Development
The site is currently occupied by the Bow Lake Transfer Station, a solid waste facility
owned and operated by King County.
Surrounding Land Uses
The surrounding properties are zoned Tukwila Valley South and are generally vacant
parcels. The site is immediately east of Interstate 5.

CONDITIONAL USE CRITERIA
The proposed project must conform with criteria detailed in TMC 18.64.050, (1-5),
concerning Conditional Use Permits:
(1) The proposed use will not be materially detrimental to the public welfare or injurious to the property
or improvements in the vicinity of the proposed use or in the district in which the subject property is
located

will occupy.
The Development Standards for uses in the Tukwila Valley South (TVS) zone include a
maximum height of 115 feet and a minimum setback from side property line of 5 feet.

(3) The proposed development shall be compatible generally with the surrounding land uses in terms of
traffic and pedestrian circulation, building and site design.
As with similar uses, the base station will generate trips during the construction period
and, following the completion of construction, up to 1 trip per month for maintenance.
No other impacts to pedestrian or transportation movements are anticipated. The antennae
will be located on a monopole at the Bow Lake Transfer Station, a solid waste facility
owned and operated by King County. The surrounding properties are primarily vacant

(4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use
Policy Plan
This project must comply with the following Comprehensive Plan policies and meet
necessary Zoning Code regulations.
12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities
where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure and use
of existing structures. The applicant is proposing antennae that will be located on a
previously approved monopole. As indicated above, the monopole is presented at the

No impacts to the transportation system are anticipated. The facility is compatible with other
land uses in its zone. All operating equipment is located an adequate distance from on -site
circulation.
(4) The proposed use shall be in keeping with the goals and policies...
The project will have the necessary electrical services for its operation. The applicant is locating
on a previously approved monopole. Visual impacts are minimized by using a similar mounting
to the other wireless carrier.
(5) All measures have been taken to minimize the possible adverse impacts...
The antennae are being mounted on an existing structure. All operating equipment will be
located in a building and screened behind a slatted fence.

Dear Louis:
Your application on behalf of Airtouch Cellular to attach panel antennae to a proposed 60 foot monopole at
18700 Orillia Rd. has found to be complete on September 20, 1999 for the purposes of meeting state
mandated time requirements. The project has been assigned to me and is tentatively scheduled for a public
hearing before the Planning Commission on October 28, 1999.
The next step is for you to install the notice board on the site within 14 days of the date of this letter. The
sign should be posted in a location that is easily accessible to people using the site. You received
information on how to install the sign with your application packet. If you need another set of those
instructions, you may obtain them at the Department of Community Development (DCD). Also, you must
obtain a laminated copy of the Notice of Application to post on the board. This notice is also available at
DCD. After installing the sign with the laminated notice, you need to return the signed Affidavit of Posting
to our office.
This determination of complete application does not preclude the ability of the City to require that you
submit additional plans or information, if in our estimation such information is necessary to ensure the
project meets the substantive requirements of the City or to complete the review process. I will be

TMC 18.64.030 CRITERIA
The proposed collocation of wireless communications facilities at the Bow Lake Transfer
Station will satisfy the criteria of TMC 18.64.030 as follows:
(1) The existing use of the property is a refuse and garbage transfer station bordering
Interstate 5. Applicant proposes to collocate wireless communication panel
antennas on a yet- to -be- constructed 59' 11" US WEST monopole in .the west
quarter of the property adjacent to Interstate 5. As the proposed area for the
facilities will only occupy approximately •25' by 32' on land that would not
otherwise be developed because of its proximity to an interstate highway, the
subject property and property in the vicinity will not be detrimentally affected.
On the contrary, the proposed improvements will increase the value of the subject
property and directly contribute to the public welfare by enhancing the quality of
wireless communication services in the area, including 911 services.
(2) The proposed use conforms to the height and setback requirements of the
underlying district (Tukwila Valley South ( "TVS ")): specifically, a height
limitation of 115', a front setback of 25'and side and rear setbacks of 5'.
Additionally, the proposed use will conform to the following: Puget Sound Air
Pollution Control Agency standards for odor, dust, smoke and other airborne
pollutants; TMC standards for "Noise "; State and Federal standards for water
quality and hazardous materials; and the State Environmental Policy Act, RCW,
Ch. 43.21C.

As indicated at (1) above, the proposed use will not negatively impact the subject
property and surrounding area, and will be entirely consistent with current
approved uses for the subject property and surrounding properties.
(4) The TVS District is "intended to provide an area of high- intensity regional uses
that include commercial services, offices, light industry, warehousing and retail
uses" (TMC 18.40.010). By enhancing the quality of wireless communication
services to both business and residential users, the proposed use will be in keeping
with the Comprehensive Land Use Policy.

As indicated at (1) and (2) above, the proposed area will only occupy a small
portion of the subject property and all necessary steps will be taken to ensure that
proposed use conforms to Municipal, State and Federal environmental.
