NOTICE OF HEARING
PROJECT INFORMATION
The City of Tukwila has filed an application to amend the Comprehensive Plan (File
#L99 -0092) and Zoning Code (File # L99 -0093) maps to establish an LDR (Low Density
Residential) designation on .75 acre which is now without zoning, generally located at
the intersection of East Marginal Way and Interurban Avenue South. (Refer to map on
reverse) The Planning Commission has recommended establishing an MIC /L
(Manufacturing Industrial Center /Light) designation.
You are invited to comment on the proposal at a public hearing before the Tukwila City
Council scheduled for:

The City of Tukwila proposes to amend its Comprehensive Plan (File # L99 -0092) and

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Tukwila City Council will hold a public hearing
on Monday, November 20, 2000 beginning at 7 PM in the Council Chambers at Tukwila
City Hall, 6200 Southcenter Blvd., Tukwila, to consider the following:
Changes to the Tukwila Comprehensive Plan and Zoning Code. Applications include:
1) Eliminate overlap with the City of Seattle's Potential Annexation Area
(L99- 0085).
2) Revise boundary with Seattle in vicinity of Boeing Field (L99- 0088).
3) Establish LDR (Low Density Residential) designation for undesignated area at
Interurban Ave. S. and E. Marginal Way (L99 -0092, L99- 0093).
4) Designate two adjacent LDR (Low Density Residential) lots as C /LI (Commercial
Light Industrial) at 4625 S. 134th Pl. (L99 -0094, L99- 0095).
5) Allow 3rd floor office use in NCC (Neighborhood Commercial Center) zone
along Tukwila International Boulevard (L -99 -0086, L99- 0087).
6). Allow office use throughout MIC /L (Manufacturing /Industrial Center- Light)
zone (generally between S. 112' and S. 126th between E. Marginal Way and
Tukwila International Boulevard) independent of industrial use (L2000 -036,
L2000 -037).
7) Revise Transportation Background Report to include changes to Growth
Management Act (L2000 -038).
All interested persons are invited to be present to voice approval, disapproval, or

Administrator McFarland reported the Ci is finalizing the develops greement. The City
signed the development agreement in 19 ° , which exempted....—the property owner from
undergrounding. The cooperation of the prope : • •O - oilld be required to underground the
utilities at this point. Currently, the City cannot legally require undergrounding.
Councilmember Linder said she would appreciate receiving information on the development
proposal to answer citizen's questions.
Mr. Johnson reminded the City the waiver was issued in exchange for 25 feet of right -of -way for
the street. He noted that since the City does not want the property until more development
occurs, the waiver should be terminated.
Administrator McFarland responded to a question from Councilmember Haggerton concerning
current procedures for issuing a waiver to underground utilities and reported the ordinance allows
exemptions on a case -by -case basis, dependent upon circumstances. The City encourages
undergrounding for all projects but in some cases, costs are too prohibitive.
SPECIAL ISSUES:
a. Discussion on Comprehensive Plan Amendments
Associate Planner Rebecca Fox explained the purpose of the review and noted Council may
forward a proposed amendment to the Planning Commission for consideration, change the
amendment, defer the proposed amendment for a year or more, or reject a proposed amendment.
Planner Fox reviewed the criteria Council should consider for each amendment.
Planner Fox briefly described each amendment followed by Council review and decision on the
following proposed amendments:
1.
L99 -0092 — To designate a undesignated area with a Low Density
residential Comprehensive Plan and Zoning code Amendment designation
for undesignated, unzoned area. Council Action: Referred to Planning
Commission.
2. L99 -095 — Establish Commercial Light Industrial Comprehensive Plan
and Zoning Code Amendment designation for two adjacent parcels
currently designated as Low Density Residential. Planner Fox shared a
copy of a map outlining the affected properties. The property owner wants
to redevelop the property. Councilmembers discussed several concerns
with the amendment with respect to adjacent residential impacts, noise,
steep slopes, and proposed use of the property. Council Action: General
agreement by the majority of the Council to send the proposed
amendment to the Planning Commission with some reservations and
with some stipulations regarding no development on steep slopes.
3. L99 -00085 — Proposal to modify part of the (North) Potential Annexation

Area boundary which currently overlaps with the City of Seattle. An
interlocal agreement with Seattle would be required. This would also
result in an amendment to the City's Comprehensive Plan map. Council
Action: Referred to the Planning Commission.
4. L99 -00088 — A North Boundary Adjustment. The amendment would
revise and simplify boundaries with Seattle and King County in the
vicinity of King County Airport (Boeing Field) and to change the
Comprehensive Plan map accordingly. Councilmembers expressed
reservations with releasing property to Seattle and generally agreed to
forward the amendment to the Planning Commission to undergo a review
and public hearing. Director Lancaster said the amendment would also
require an interlocal agreement, which would require Council approval.
Council Action: Referred to the Planning Commission for further study
and public hearing process.
5. L99 -00086 — Amendment proposes to amend the Comprehensive Plan and
Zoning Code to allow office uses on the third story in the Neighborhood
Commercial Ceriter zones. Councilmember Carter preferred rezoning only
the property on Tukwila International Boulevard to NCC and referring the
smaller properties to the Planning Commission for an appropriate zoning
designation, such as an RCC zone. Council Action: Councilmembers
concurred with Councilmember Carter's recommendation and referred
the amendment to the Planning Commission with conditions as
stipulated by Councilmember Carter.
7.
L99 -00036 — Amendment would expand office and allow standalone
offices throughout the NRC/L zone regardless if they are associated or
serve another permitted use. Councilmember Carter said the amendment
has some merit but cautioned about the supply of industrial properties
versus the demand for industrial property. Councilmember Haggerton
commented that he supports the zoning changes as it provides more
flexibility to the City to accommodate changing economics.
Councilmember Linder said she supports forwarding the proposal to the
Planning Commission but requested the Commission pay special attention
to residents on Proverty Hill. Councilmember Simpson asked if rezoning
the property would have an effect on property values if Sound Transit
decides to put commuter rail through the area. Director Lancaster replied
a broader array of land uses designated for a property, the more
competitive the property becomes in the marketplace. Council Action:
Referred to the Planning Commission.
L99 -0003 8 — An amendment to update the existing Transportation
Background Report as required by the Washington Growth Management
Act. Council Action: Referred to the Planning Commission.

Subj: Status and Schedule for Comprehensive Plan Amendments

Status:
On April 3, the City Council held a public meeting to hear comments on 5 possible
Comprehensive Plan amendments. These proposed amendments now require a
recommendation from the Council either to forward the amendments to the Planning
Commission for further review, to defer consideration or deny.
At its April 3 meeting, the City Council expressed their wish to consider an additional
amendment to allow office use in the Manufacturing Industrial Center -Light ( MIC/L)
zone. Staff has prepared these materials and is waiting for environmental review of
traffic impacts of additional office in the MIC/L. In addition, the Public Works
Department wants to add another proposed amendment to enable them to update the
Transportation Element of the Comprehensive Plan as required by the State and the Puget
Sound Regional Council.
On June 27, 2000 Community Affairs and Parks (CAP) Committee members were
briefed on the new amendments.
Additional Amendments for Consideration:
Additional amendments proposed for consideration are the following:
• Allow office uses in the Manufacturing/Industrial Center —Light (MIC/L) zone
regardless of whether they are associated with a specific permitted industrial use (File
#L2000 -0036)
Discussion: The MIC/L zone is primarily a light industrial area with warehousing
and manufacturing activities. The proposed amendment would let offices locate
throughout the zone, whether or not they are linked with an existing industrial
activity.
• Update existing Transportation Background Report (File #L2000 -0038)
Discussion: 1998 changes to the Washington Growth Management Act require that
the City of Tukwila update the transportation portion of its Comprehensive Plan to
identify the impacts of major transportation facilities (i.e. the interstate system and
proposed light rail), clarify system needs and coordinate its efforts with the State.

Schedule and Next Steps:
The "new" and "original" proposed amendments are now at different stages of review.
Two "new" proposed amendments require both a public meeting, and recommendation
from the City Council. The "original" 5 amendments need a Council recommendation to
proceed to the next phase of review. It is desirable to bring consideration of both "new"
and "original" proposed amendments to a single, coordinated schedule.
On July 10, there will be a public meeting to hear comments on the two "new"
amendments. We suggest that the Council review and make recommendations about how
to proceed on all 7 proposed amendments at their July 17 meeting. Council members are
reminded to bring their Comprehensive Plan binders to these meetings. Proposed
amendments that require additional review could be forwarded to the Planning
Commission in late summer or early fall, depending on the schedule for the
environmental review, before returning before the Council for a final decision.

OLD BUSINESS:
a. Comprehensive Plan Amendments
Associate Planner Rebecca Fox reviewed each proposed amendment individually and sought
questions from Council and/or citizens upon considering each item. Ms. Fox reminded Council
they do not have to make decisions on these proposed amendments and that City staff wants to
hear what the public has to say about these proposals.
Referring to Exhibit 2 in the staff report, Ms. Fox reviewed Council options after hearing from
the public. Council may reject a proposal, modify and/or defer a proposal or refer a proposal to

Matt Peters, 13552 McAdam Road So., Tukwila., spoke against the proposed amendment as it
would eliminate his view. He spoke against increased noise levels, decreased sleep levels as
well as an increase to traffic and congestion.
Ted Nixon, 10024 SE 240th St., Kent, spoke in favor of the proposed amendment and urged the
City Council to forward this item to the Planning Commission for further consideration.
Jill Peters, 13552 McAdam Road So., Tukwila, wife to prior speaker, also spoke against the
proposed amendment as it would greatly and negatively impact the quality of life near their
residence.
Ion Manea, 13407 — 48th Ave. So., Tukwila, spoke in favor of the proposed amendment. He
stated the nature of the proposed development should be relatively quiet and that the building
will act as a sound barrier between existing residential properties and industrial enterprises to the
east and north. He has a very similar situation with his property that he would like the City to
consider as well. City staff will continue working with Mr. Manea on this issue.

The next item considered was L99- 00085. This request is to modify part of the (North) Potential
Annexation Area boundary which currently overlaps with the City of Seattle. This would also
result in an amendment to the City's Comprehensive Plan map. The location is generally west of
the King County Airport. A draft interlocal agreement with Seattle was also referenced as an
attachment to the staff report. Q

Charlie Harris, Mayor and resident of Normandy Park, noted he has property in South Park c
which is adjacent to the South end of the 14th/16th Avenue Bridge. This is the first time he's 6 v

Michael Jones, 13025 — 41st Ave. So., Tukwila, also spoke against this proposed amendment. Ili =.
He stated to change the zone in that area would be a great disservice to the community. p t—
Dwight McLean, 13015 — 38th Ave. So., Tukwila, spoke against the proposed amendment and
stated other zoning classifications may better meet the City's needs to keep the friendly
residential atmosphere in that area.
Byron Saunders, (address above), agreed with Mr. McLean's statements. He said people in
that area are very proud of their neighborhood and a change in zoning may make residents move
away.
Community Development Director Steve Lancaster noted that at the recent Community Affairs
and Parks Committee meeting, there was a discussion for a potential change not to the
Comprehensive Plan map, but to the types of uses that are permitted in the manufacturing and
industrial center /light designation.
There has been considerable interest in the community in terms of the office market which is
heating up. Additionally, there is an interest in looking at the MIC Light as a possible area to
accommodate that market. The MIC Light area is fairly small and centered primarily in the area
of SR599 and East Marginal Way. One of the issues in that area is a concern that appropriate
buffers are provided between the industrialized area and the residentially designated areas.

Currently allowed in MIC Heavy is steel mills and fabrication; airplane manufacturing; etc. The
MIC Light eliminates the heavier, noisier, vibration - inducing kinds of uses, such as heavy metal
fabrication plants, etc. Both allow office uses, yet they must be in conjunction with another
permitted use.
Discussions continued regarding MIC Heavy and MIC Light zoning designations. This
information tends to "ducktail" [sic] with the issues at hand and should be considered soon.
Ms. Hernandez noted the Council, at one time, expressed concern about more pawn shops being
allowed in the NCC. She wondered if this would be a good time to again consider the issue. Mr.
Lancaster said it could be reviewed at this time if Council so desired. There was consensus
among Council to have Mr. Lancaster add that item to his "list."

facilities, transitional homes for prisoners, pre - release centers, limited security detention facilities
and similar land uses.
Joanne McManus, 5610 So. 133rd, Tukwila, spoke in favor of the moratorium. She is in favor
of protecting everyone in the community and not putting them in any additional danger.
Margaret Bratcher, 13003 — 56th Ave. So., Tukwila, from the Foster Point Neighborhood, also
spoke in favor of the moratorium and protecting the citizens of the City.
7:56 p.m. Mayor Mullet closed the public hearing.
Council Discussion/Deliberation:
There was Council consensus to continue the moratorium and to remand the item to staff for
further work. Staff will also consider ways to implement changes to the Comprehensive Plan
and/or Zoning Code to accommodate these types of land uses.

Associate Planner Rebecca Fox reviewed each proposed amendment individually and sought
questions from Council and/or citizens upon considering each item. Ms. Fox reminded Council
they do not have to make decisions on these proposed amendments and that City staff wants to
hear what the public has to say about these proposals.
Referring to Exhibit 2 in the staff report, Ms. Fox reviewed Council options after hearing from
the public. Council may reject a proposal, modify and/or defer a proposal or refer a proposal to
the Planning Commission for further review. As Council reviews the items under consideration,

Council President Jim Haggerton called the Committee of The Whole Meeting
to order and led the audience in the Pledge of Allegiance.

Al Spencer, Internal Operations Manager, gave a brief summary of the
operating instructions on the Council Chambers microphones.
Steve Lancaster explained that the Council held a public meeting on April 7,
1997 and heard presentations from both staff and applicants. Many community
members commented on the proposals at that time. It is now within the
Council's purview on how to proceed from this point regarding further input
on the Comprehensive Plan/Zoning Code amendments.
Councilmembers were in agreement that further public comments would be
welcomed as long as the comments were kept to a minimum.
Lancaster clarified that at this point in the process, the Council is charged with
deciding if a proposed amendment is consistent with the current
Comprehensive Plan policies, and whether it should be: 1) dropped from
further consideration; 2) deferred for one or more years; or, 3) forwarded
directly to the Planning Commission for further review.
In response to a question posed by Councilmember Hernandez, Lancaster
stated that the Council is not limited to the three options noted above. They
. can take action on one or more tonight. Others could be processed according
to the Council's internal procedures, which would include referral to a
subcommittee of the Council. However, the Planning Commission must
review prior to the Council taking any final action to approve any of the
proposed amendments.

Comprehensive Plan/Zoning Code amendment #1: Extend the current
building height exception area to permit potential development of up to 10
stories at 15820 Pacific Highway South
Michael Aippersbach, Post Office Box 95429, Seattle, Wa., 95429, commented
on behalf of Sterling Realty Organization (SRO -Lewis & Clark). He said his
client did not propose the building height exception area amendment without
consideration of the impacts of neighboring properties. Unfortunately, their
knowledge of the changes of the August 15, 1995 Draft Comprehensive Plan
did not surface until just before they were informed of the approaching
submittal deadline for proposed amendments to the adopted Plan. From that
point they simply rushed to complete the submittal. He's requesting to have
the setback distance issue for structures above three stories discussed with the
Planning Commission. Placing the issue on the Planning Commission's
agenda simply allows a reasonable time period for discussions between SRO,
the neighbors and the Planning Commission before action is taken.
Council President Haggerton announced that two additional letters have been
received regarding the six proposed Comp Plan/Zoning Code amendments
since the last Council meeting: one from Secure Capital and the other from
Michael Aippersbach & Associates.
Kathy Solter, Property Manager, Sunnydale Apartments, main objections to
amendment #1 is the blockage of light to the apartments and condominiums.
She urged the Council to adhere to the staff recommendations and reject these
proposals. .. .
Diane Rogel, 3810 South 158th Street (Laural Estates), said the proposals do
not reflect the spirit of the neighborhood.
Comprehensive Plan/Zoning Code amendment #2: Change LDR (Low
Density Residential to MDR (Medium Density Residential) to construct a
32 -unit condominium project between Pacific Highway South and 40th
Avenue South at 38th Avenue extended.
Gary Greer, representing Secure Capital, Post Office Box 25127, Seattle, Wa.,
98125, commented that he still believes that a residential townhouse
condominium development is the best development solution for all involved.
Greer submitted modifications to his application that address most of the
concerns raised in the public meeting held on April 7th. He urge the Council
to forward his application with modifications to the Planning Commission.

It was the consensus of the Council to forward the proposed Comprehensive
Plan/Zoning Code amendments to the Special Meeting fdllowing tonight's
Committee of The Whole meeting.
Council President Haggerton pointed out the numerous meetings /discussions,
as chronicled in the agenda packet, that have been held regarding this issue.
City Administrator McFarland explained that the stipulation in the 99 -year.
ground lease with the South Central School District was that when the property
ceased to be part of public use, it would revert back to the District. Therefore,
as long as the City intends to use it for public purposes, it will remain in our
ownership for the duration of the 99 -year ground lease.
A discussion ensued with most of the councilmembers favoring a complete
demolition of the building while others suggested demolishing all except the
enclosed.area of the gymnasium. Some Councilmembers thought it might be
feasible to open the four walls of the gym and use it as a covered shelter for
recreational purposes.
Council President Haggerton reminded the Council that this issue will also be
on the agenda for discussion at the joint Council /School Board meeting
scheduled for May 6th.
After a lengthy discussion, it was the consensus of the Council to have staff
provide ,them with rough parameters of costs associated with various options,
including total demolishing verses saving the gym portion of the old
community center.

Alan Doerschel,.Finance Director, clarified that there are $7Q,000 in
unanticipated 1996 Real Estate Excise Tax revenues, plus an additional
$103,000 in unanticipated 1997 revenues. The 1996 revenues are within the
Estimated Beginning Fund Balance of the 301 Fund. Actual 1997 revenues so
far this year are $146,000 with only $160,000 estimated in the 301.317.340
revenue•budget for the full year. If the 1996 additional revenues of $70,000
are combined with the additional anticipated 1997 revenues, there may be as
much as $173,000 to be utilized for TCC Phase II and/or other park and trail
projects.

Doerschel said it should be pointed out that since there's a shortfall of
approximately $66,000 in the TCC Phase II account, the 301 Fund would be an
appropriate place to utilize funding to make up the shortfall. He cautioned
the Council, however; that out of.the total $173,000, it may be necessary to
offset other revenue shortfalls such as sales tax.
MOVED BY HERNANDEZ, SECONDED BY EKBERG, TO MOVE
$66,000 FROM THE 301 FUND TO THE PHASE II COMMUNITY
CENTER ACCOUNT SO THAT ADDITIVE ALTERNATES NUMBER
ONE (SHELTER) AND NUMBER THREE (TWO COURTS) CAN BE
INCLUDED WITH THE AWARD OF THE BASE BID TO GOLF

Councilmember Mullet stated that this item had been discussed at the April
22nd Utilities Committee meeting and the Committee recommended a formal
motion authorizing application for grant funding.

Since this property was thought to be right -of -way when the Comprehensive Plan and Zoning Code were
adopted in 1995, it received no designation. There is no development proposal; the property is being
designated because all property is required to have designation. The property was low density residential
under King County prior to annexation to Tukwila.

Access to the site is possible only via a right turn from Interurban Avenue South driving
south. These roadways cut the site off from the residential neighborhood to the east, and the
nearby industrial uses as well.
DISCUSSION
Background
The property is a triangular "island ", formed at the intersection of Interurban: Avenue. South
and East Marginal Way. SR 599 and the East Marginal Way South bridge are immediately
to the west. At the time of annexation from King County, the property was inaccurately
shown on maps as "Public Right-of-Way." As "public land ", the property received no
initial zoning designation by Tukwila. It was only learned that the property was privately -
owned when an individual requested zoning information for the property. By default, the
property is now considered Low Density Residential (LDR) per TMC 18.08.020. Prior to
annexation into Tukwila, the King County designation was SR, single family residential.
The quantity of public streets and roadways and their associated traffic and noise impacts
combined with the site's limited access greatly lessens its potential for residential or
commercial use. The MIC(Manufacturing/Light. Industrial) designation seems the
appropriate choice.
Significance/Consistency with the Comprehensive Plan
Designating the site MIC(Manufacturing Industrial Center/Light Industrial) continues the
MIC/L(Manufacturing Industrial Center/Light) and/or MIC/H(Manufacturing Industrial
Center/Heavy) already on two sides on two sides of the subject property. This is consistent
with the existing Comprehensive Plan policies for the area.
Impacts
No adverse impacts identified to date.
Alternatives
The City Council's threshold alternatives include the following:

FINDINGS
The proposal is to designate the 0.76 acre site as "LDR" (Low Density Residential) in
the Comprehensive Plan and on the City Zoning Map. The property is a triangular
"island" formed by the intersection of East Marginal Way and Interurban Avenue South.
The site is vacant and vegetated, sloping toward SR -599. Site access is possible only
via a right turn from Interurban Avenue South, driving south. Adjacent roadways isolate

the site from the residential neighborhood to the east as well as nearby industrial uses.
Surrounding land uses are as follows:
North: Industrial
South: SR -500 and East Marginal Way bridge

The site currently lies in the path of a proposed alignment alternative for Sound Transit's
Light Rail, known as the "E -4 ". In this option, the train would run in a north -south
direction, along the western half of the site. The train would be elevated and would
require at least 12 feet of right -of -way. The impacts of the E -4 option will be discussed
at a community meeting on February 24th. After a formal presentation in April, Sound
Transit will either approve or reject the proposal.

DEVELOPMENT
Cornell Comprehensive Sanction Center (13400 Interurban Ave. S.) - Cornell Companies, Inc. has
notified DCD of its intention to seek permits for a "Comprehensive Sanction Center." Cornell's stated
intent is to convert the former Greenbaum Furniture building into a facility housing certain federal
prisoners, under contract to the federal government. If determined to be a "corrections facility," this
proposal would be considered by the City Council under an Unclassified Use Permit process. A pre -
application conference has been scheduled for February.17, at the applicant's request.
Group Health (12401 East Marginal Way) - Staff held a public information meeting for the two
building Group Health R &D project at 12401 East Marginal Way. About eight neighborhood residents
attended, asked questions and submitted comments on the project. Also present were Bob Fadden,
Group Health's architect, and Eileen DeArrnon, Sabey's representative. Neighborhood concerns
include light and glare, noise, parking, traffic and buffering. The BAR hearing has been tentatively
scheduled for February 24th, but is likely to be delayed until March as the applicant has not completed
all of the studies necessary for the City to make a SEPA determination. As of Thursday, the traffic
consultant is estimating completion of his report on February 18.
OTHER
' Sound'Transit E -4 Community Meeting - Sound Transit has tentatively scheduled a community
meeting on the E -4 option for February'24. We have impressed upon them the need to have good,
detailed information on the E -4 option and its potential impacts so that community members have
something real to review. Some of the information we want them to have may not be available in time,
so we have discussed the possibility of delaying the meeting for a week or two. We need to close the
loop on this possibility early next week.
In related news, Michelle Giguere reported Friday that the president's budget includes only $35 million
for Sound Transit. This is significantly less than they were expecting.
Tukwila/Seattle PAA and 14th Avenue Bridge - Received a revised version of the proposed agreement
from King County, which should reflect' the comments of all parties on the previous version. This
revised version is under review, and final versions of the boundary adjustment maps are being
prepared.

This site could be designated either light industrial or commercial. In 1997, a light
industrial (MIC /L) designation was proposed and rejected by the City Council. The
current proposal implements the "residential" designation, which was recommended at
that time.
111. COMPREHENSIVE PLAN /ZONING CODE AMENDMENT CRITERIA
A. COMPREHENSIVE PLAN AMENDMENT (TMC 18.80.010)
In addition to the requirements for complete application, the applicant needs to provide the
following:
1. A detailed statement of what is proposed and why;
The proposal is to designate approximately .76 acre as Comprehensive Plan
designation LDR —Low Density Residential. The property, located at the intersection
of East Marginal Way and Interurban Avenue South would also receive the
corresponding LDR —Low Density Residential zoning.
The property is a triangular "island" at the intersection of Interurban Avenue South
and East Marginal Way. SR 599 and the East Marginal Way South bridge are
immediately to the west. At the time of annexation from King County, the property
was inaccurately shown on maps as "Public right -of- way." As "public land," the
property received no initial zoning designation by Tukwila. Once this was
discovered in 1996, MIC /L designation was requested. This was rejected by the
City Council, which favored the LDR designation. By default, the property is now
considered Low Density Residential (LDR) per TMC 18.08.020. Prior to
annexation into Tukwila, the King County designation was SR, single family
residential. The current requested map change would formally implement the
recommended LDR designation.
2.A statement of the anticipated impacts of the change, including the
geographic area affected and the issues presented by the proposed
change;
Few, if any impacts are expected from the proposed map change. The property is
unofficially LDR at this point. The quantity of public roadways and their
associated traffic and noise, in conjunction with the site's limited access, greatly
lessens the site's potential for any type of development, including residential.

WASHINGTON, AMENDING THE CITY'S 1995 ZONING CODE (TMC
CHAPTER 18), AS ADOPTED BY ORDINANCE NO. 1758, TO
ESTABLISH MIC /L ZONING WITH CERTAIN CONDITIONS; PERMIT
OFFICES IN THE MIC /L; ALLOW OFFICE ABOVE THE THIRD FLOOR
IN THE NCC ZONE ALONG TUICWILA INTERNATIONAL BOULEVARD;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE
DATE.
WHEREAS, Tukwila's Comprehensive Plan and development regulations may be reviewed and
updated as appropriate; and
WHEREAS, the City of Tukwila Planning Commission, after having received and studied staff
analysis and comments from members of the public, has recommended the adoption of certain
amendments; and
WHEREAS, the City Council held a public hearing on the proposed amendments on November 20,
2000, and held other public hearings after proper notice as indicated below:
1. After due public notice the City Council held public meetings on April 3, 2000 and July 10,
2000 to receive public comments, and a public hearing on November 20, 2000 to receive public
testimony related to amendments to the Comprehensive Plan and Zoning Code;
2. Notice of the public meetings were published and mailed in the Hazelnut; notices of the
public meeting were mailed to surrounding residents, businesses and owners; sites were posted, and
notices of the public hearing were mailed and published in The Seattle Tines; and

7. Offices including, but not limited to, software development and similar uses, financial

9. Studios, television, microwave, cellular or observation stations and towers.

TRANSPORTATION - RELATED POLICIES; ESTABLISH MIC /L ZONING WITH

ALLOW OFFICE AS 'A CONDITIONAL USE IN MIC /L; PROVIDING FOR
SEVERABILITY; AND,ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Tukwila's Comprehensive Plan and development regulations are to be reviewed and
updated as appropriate; and
WHEREAS, the City of Tukwila Planning Commission, after having received and studied staff analysis
and comments from members of the public, has recommended the adoption of the certain amendments; and
WHEREAS, the City Council held a public hearing on the proposed amendments on November 20,
2000, and held other public hearings after proper notice as indicated below:
1. After due public notice the City Council held.public meetings on April 3, 2000 and July 10,
2000 to receive public comments, and a public hearing on November 20, 2000 to receive public testimony
related to amendments to the•Comprehensive Plan and Zoning Code;
2. Notice of the public meetings were published and mailed in the Hazelnut; notices of the public
meeting were mailed to surrounding residents, businesses and owners; sites were posted; and notices of the
public hearing were mailed and published in The Seattle Times; and
WHEREAS, the City Council, after due consideration, believes that certain amendments to the City's
Comprehensive Plan and development regulations are necessary;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Amend the Tukwila 1995 Comprehensive Plan Land Use Map Legend, as adopted by
Ordinance No. 1757, to read as follows:
Manufacturing /Industrial Center —Light Industrial: A major employment area containing distributive,
light manufacturing and limited office uses, with supportive commercial and office uses. (See
Manufacturing /Industrial Center element in Plan text.)
Section 2. Amend the Tukwila 1995 Comprehensive Plan Transportation Corridor Chapter, as adopted
by Ordinance No. 1757, to read as follows:
Policy 8.5.7: Encourage two- to four -story buildings within the Neighborhood Commercial Centers to
emphasize their importance and desired activity level, limiting commercial uses to two lower levels, except in
Urban Renewal areas.
Section 3. Amend the Tukwila 1995 Comprehensive Plan Transportation Chapter, as adopted by
Ordinance No. 1757, to read as follows:
Policy 13.3.1: Use the following LOS standards to guide City improvement and development approval
decisions:
• The Tukwila Urban Center area LOS average is not to exceed E.
• The East Marginal industrial and manufacturing corridor LOS average is not to exceed E.
• The Interurban Avenue corridor LOS average is not to exceed E.
• The Pacific HIghway corridor LOS average is not to exceed D mitigated.

to the excessive amounts of cars.

b. Amend City Contract 98 -052 with Ragsdale Koch Altman 2nd Amendment
Mr. McFarland noted the original contract amount of $100,000.00 remains the same for 2001.
Additionally, this amendment allows an additional $13,000.00 to be paid to Ragsdale at the rate of
$125.00 per hour, for services rendered in November and December of 2000. Finally, Mr. McFarland
noted Mr. Ragsdales time with the City will most likely wane during this year.
Fenton moved; Haggerton seconded; a second amendment to City Contract Number 98 -052,
with Ragsdale Koch Altman, LLC, by amending the Scope of Services and extending the
duration of the contract through December 31, 2001; including an additional amendment
allowing retroactive work pay at the rate of $125.00 per hour, for work performed during
November and December, 2000.
The motion carried 7 -0.
REPORTS:
a. Mayor
Mayor Mullet will attend the Sound Transit meeting, in Tacoma, on February 8; as well as a
Suburban Cities Association meeting. Next, Mr. Mullet invited Council to the Employees
Appreciation Banquet on Saturday, February 24, at the DoubleTree Suites, from 5:45 to Midnight.
Bob Baker will accept and forward RSVP's to appropriate staff.
b. City Council
Councilmember Duffle thanked those responsible for a wonderful Council retreat and reiterated
earlier complaints about the number of crows in Tukwila.
Councilmember Carter referred to the recent Council retreat as great. She attended the January 24
Tukwila Cares Network meeting; the February 2 Tukwila School District Public Relations Advisory
Committee meeting; and will attend the February 8 PSRC Transportation Policy Board meeting.
Councilmember Hernandez attended the January 24 Foster Community Club meeting; the February
1 Hotel General Managers meeting and an Equity & Diversity Committee meeting. She will attend
the February 8 Hotel Advisory Committee meeting. Ms. Hernandez also spoke highly of the timing
for the Council Retreat followed by a 5th Monday in the month. This provided time for each member
to recoup without having to come back to a Council meeting on a Monday evening, following a two -
day retreat Saturday and Sunday).
Councilmember Haggerton stated the Council retreat was very enjoyable; and the environment
allowed Councilmembers to be very productive. He attended a February 1 meeting with two other
ACC officials, at the request of the State Auditor's Office. This meeting was an exit interview, after
having gone through the auditing process, at the request of interested citizens. The exit interview
letter from the Auditor's Office, which Haggerton is very pleased with, will be ready for publication
February 9. Mr. Haggerton noted he'll attend a February 8 Sound Transit meeting, in Tacoma.
Councilmember Linder noted time was well spent at the recent Council retreat. She noted the value

of such retreats as well as their importance. She will attend the Suburban Cities Association meeting
on February 8, along with other members of the Council.
Councilmember Fenton was also appreciative of the recent retreat. He will attend a February 6
Chamber /Tukwila Governmental Affairs Luncheon. He then reported an item which came before the
Finance & Safety Committee tonight - the emergent need for signatures on a purchase order for parts
necessary to repair the breathing apparatus on each of the City's fire trucks. The amount of the
expenditure (approved by the Committee) is $23,800.00. In addition to an apparent need for the
repairs (water inside one of the apparatus'), approximately 80 percent of all fire stations within the
State will face similar expenditure needs as new State regulations deem current equipment as below
par and not meeting minimum requirements.
Councilmember Simpson appreciated the good retreat. He will attend the February 6 Chamber of
Commerce /Tukwila Governmental Affairs luncheon.
c. Staff
City Administrator McFarland provided Council with an update on City efforts to conserve energy
as directed by Governor Locke. Public Works Director Jim Morrow has been appointed to oversee
such efforts by City staff.
Next, Mr. McFarland set an Economic Development retreat with Council to review contents of the
recently submitted report. Chosen was the date of February 22, 2001, at the Museum of Flight. This
will be a catered, lunch meeting set to last approximate 5 to 6 hours.
d. City Attorney
City Attorney Bob Noe noted the Deja vu Claim for Damages has resulted in a Motion for Summary
Judgment on February 9. Additionally, the Hemmerling Motion for Summary Judgment has been set
for Friday, April 16, 2001. Both items will be heard before King County Superior Court judges.
MISCELLANEOUS:

Councilmember Haggerton shared a poster of his granddaughter, Taylor. She has been selected poster
child for the Make A Wish Foundation for 2001. Living with Leukemia, Taylor benefited from the
Make a Wish Foundation when the organization sent her to the Swiss Alps where the movie The
Sound of Music was created and filmed. There she was able to realize her dream of dancing high atop
the Alps.

SPECIAL PRESENTATION:
a. Tukwila Community School Collaboration Winter Camp
Jesse Richardson, Alder Hendrickson, and Shannon Fisher presented different aspects of the recent
Tukwila Community Schools Collaboration Winter Camp ( "camp. ") The camp was organized with
the help of the City of Tukwila, Casey Family Program, Puget Sound Educational Service District,
Tukwila School District., and Department of Social and Health Services. It was operated for eight
days (December 20 - January 2); and served 330 kids. The camp was staffed by 50 temporary
workers, plus Community Center staff, volunteers, and School District workers. A slide show
exhibited some of the programs not normally done in school, such as drama and field trips, computer
practice, visits from fire and police, and board games.
Council member Duffie asked if this program would be continued. The response was that if funding
were provided, the program would expand to all five Tukwila schools for before and after school
programs.
b. Cascade Park Acquisition
Rick Still, Parks & Recreation Assistant Director, displayed a map of the project, and how it could be
developed. The park, at 37th between S. 144th- 142nd, has ten parcels. Mr. Still emphasized that

community input has been sought to ensure park safety. Next, he introduced Sharon Mann of ReMax,
who said the plan for the park had begun in August, and she has successfully obtained for the City all
but two of the parcels, which are currently in process.
Bruce Fletcher, Parks & Recreation Director, noted a community meeting will be held to obtain
additional input from neighbors in the affected area.
Jack Hendricks, neighboring citizen, expressed concern over the lack of parking spaces for the
proposed park. The issue was referred to the Community Affairs and Parks Committee.
CITIZEN COMMENT /CORRESPONDENCE:
Bill Arthur 18000 Andover Park West Suite 200, Tukwila., representing the Highway 99 Action
Committee, thanked the Council for the City's part in the Committee's success. He distributed the
Committee's monthly newsletter and presented an award to Joan Hernandez for her part in helping
clean up the highway.
Margaret Bratcher 13003 56th Avenue South, Tukwila, reported that graffiti artists have again
defaced the columns under I -5 , and have now expanded to the actual sides of the freeway. She
expressed concern for kids' safety in climbing up to I -5 to paint. Her telephone contact with
Department of Transportation was fruitless; and she was referred back to Tukwila officials.
Steve Snyder, Owner - Silver Dollar Casino -14027 Interurban South, Tukwila., said trees
planted along Interurban as part of the street improvement are blocking his signs. This issue was
(again) sent to the Community and Parks Committee.
Councilmember Duffle introduced members of a new Youth Council he helped organize. He was
inspired by the teen representatives at the National League of Cities Conference. Six of the teens
spoke, as did Foster High School Principal Gary Moab. Several students expressed hope they could
bring issues forward to the City Council of which they may be unaware.
PUBLIC HEARING :
Local Law Enforcement Block Grant (LLEBG) Fund Use
Council President Hernandez opened the public hearing.
Rosa Krows explained the ($34, 553.00) funds from this grant help support the Domestic Violence
Advocate. Tukwila's crime has decreased in recent years, thus the grant amount has also declined.
No public comment was received.

Steve Lancaster, Director of Community Development, presented two proposed amendments
remaining (unresolved) from the original list of seven. The first issue involves a triangle piece of land
(L99 -0092) which is zoned LDR. The property owner has requested a rezone to MIC/L. Mr.
Lancaster and staff suggest a compromise. He noted that if the City is careful about using a contract
rezone, it could also allow the owner to apply for a MIC/L use through a conditional use review. One
requirement for such a review is that a use be compatible with surrounding uses. Council agreed this
should come back as an ordinance allowing the contract rezone.
Holiday Park
The Planning Commission recommended denial of Holiday Park's request to change from LDR to
C/LI. Mr. Lancaster noted the Planning Commission did not have some information from the
developer which could have influenced their decision. Though the Council recognized the proposal
had some merit, they did not feel it was strong enough to override their reluctance to make special
allowance for a single property. They felt it would be appropriate to defer consideration of this item
to the Comprehensive Planning process slated for 2002.
Concerns listed by Councilmembers Fenton and Carter included having no guarantee the current
owners would retain ownership; and, once zoning was changed, a new owner could decide on
something very incompatible with neighbors.
Councilmember Haggerton also spoke against the change since the Council denied that opportunity
to other applicants. In recommending deferral of this item to the Comprehensive Plan process,
Council also wanted other properties who had requested zoning changes to be included in discussion
at that time.
b. Gilliam Creek Basin Stormwater Management Plan
Ryan Larson, Senior Engineer, Surface Water, introduced the Plan. The Plan studied Gilliam Creek,
and recommended actions to be taken to improve some problems found in the basin. The problems
are so great that utilizing only current funding, the City could never afford to do all the projects
required to clean and repair the basin.
There is bank erosion and creek bed scouring, as well as sediment accumulation in different parts of
the creek basin. The problems are so great that the City could never afford to do the projects required
to clean and repair the basin. 20 projects are recommended to improve water quality.
Councilmember Haggerton expressed concern with the effect of SeaTac Airport property runoff
which enters the Creek. Ms. Carter noted staff will need to be creative to find funding for the
projects, and expressed confidence that they will be able to do so.
Councilmember Fenton asked what the highest priority was. Mr. Larson replied it was to build a
regional in- stream detention pond, scheduled for 2003. Council recommended moving adoption of
the Plan to a Regular Meeting.

Councilmember Duffle announced a tree planting ceremony for Martin Luther King Day, at the
Community Center. He also announced a study circle to discuss racism will begin this Thursday,
January 11, at 4:00 p.m. at Tukwila Elementary. This will be open to everyone. It is expected to run
four or five weeks, depending on the will of the group.
Councilmember Hernandez reviewed the last Equity and Diversity meeting. She also discussed
Committee meeting times. After some discussion, Council agreed to keep the same basic schedule for
as in 2000.
Councilmember Haggerton expressed discontent with the new name of the DoubleTree Inn; which
is now entitled the Red Lion Hotel - Seattle Airport.
Councilmember Linder reported on the meeting she attended this evening. The Part 150 group is
comprised of airport users and businesses, with only four resident representatives. The group is
narrowing down the focus of the Part 150 study, and it is important for Tukwila that our interests are
represented. She also announced that due to a new work schedule, she will need to withdraw from her
position on the Joint Recommendation Committee for CDBG.
8:44 p.m. Council agreed to go into executive session for 30 minutes, to discuss labor issues and
potential litigation, following a 10- minute break.

City Engineer Brian Shelton commented the Transportation Improvement Board has committed to
nearly $1.1 million dollars in funding for this project. In addition, FASTCAST has committed
another $4.5 million dollars. Both amounts will greatly decrease the shortfall experienced by
Tukwila.

Discussion of the proposed 2001 budget and proposed 2001 -2006 CEP took place between Council
and key staff including City Clerk Jane Cantu, Parks & Recreation Director Bruce Fletcher and
Police Chief Keith Haines.
Areas covered included Administrative Services Department, Parks and Recreation, Police
Department, Parks Land Acquisition, Finance Department. Proposed changes were suggested to the
document as Council reviewed each page.
NEW BUSINESS:
Purchase of Property Associated with Tukwila Village Project
City Administrator John McFarland introduced and explained the proposed purchase and sale
agreement between the City and McConkey Development Company, Inc. The sale includes the
Newporter, Graves House and Fantasy Site. In a cover memo from Mr. McConkey, notice was made

the Newporter was vacated on October 31 with all tenants being successfully relocated. Asbestos
abatement began on November 1. Demolition is scheduled immediately after permits are issued.

agreements between the City of Tukwila and McConkey Development Company, Inc., in the
amount of $2,250,000.00, for the purchase of the Newporter, Graves House and Fantasy Site.

At the time of annexation from King County, the property was inaccurately shown on the maps Z
as "Public Right -of- Way." As "public land," the property was proposed for MIC/L H O
(Manufacturing - Industrial Center/Light) Comprehensive Plan and zoning designation. In March, w 1-:
1997 the City Council rejected the proposed amendment with the MIC/L designation, saying that

Low Density Residential (LDR) was more appropriate. This situation will now be corrected with 0 v_�
the current proposal to adopt the Low Density Residential (LDR) designation. Prior to o F-

Planning Commission review is required for Comprehensive Plan and Zoning Code i= H
amendments. The Planning Commission may recommend approval, recommend approval with
conditions or recommend denial of the amendment based on a clear compliance with the criteria
which follow. The Planning Commission's recommendation will be forwarded to the City
Council, which will make the final decision.

REVIEW CRITERIA
1) Describe how the issue is addressed in the Comprehensive Plan. If the issue is not
adequately addressed, is there a need for it?
As stated above, the property has neither zoning nor Comprehensive Plan designation.
The Washington Growth Management Act requires that property be designated for
specific land uses.
(2) Impacts
LDR designation is not expected to create new impacts since the property, is already
considered LDR by default. An LDR designation would extend the zoning currently in
place to the north and east of the site. Existing site impacts, such as the adjacent public
roadways (with their associated traffic and noise) as well as the site's size, shape and
limited access, already reduces the site's potential for development. No. non - conforming

uses will be created as a result of the LDR designation. The proposed change is not
expected to affect the Capital Improvement Plan, Comprehensive Plan policies, City
zoning regulations or City functional plans. The Growth Management Act requires that
property be designated for specific land uses.
Is the proposed change the best means for meeting the identified public need? What
other options are there for meeting the identified public need?
TMMC 18.08.020 states that all lands which do not have zoning and Comprehensive Plan
classifications shall be subject to the restrictions and regulations of the LDR district.
Accordingly, the property has been considered LDR by default. The LDR designation is
a continuation of the zoning currently in place to the north and east of the site. Although
the site could be designated as light industrial or commercial, a proposal for light
industrial designation ( "MIC/L ") was rejected by the Council in 1997.
(4) Will the proposed change result in a net benefit to the community? If not, what type
of benefit can be expected and why?
Little change, if any is expected from the LDR designation. However, by designating the site as
LDR, the Comprehensive Plan and City Zoning Map will be amended (in compliance with the
Growth Management Act).
CONCLUSIONS
The Planning Commission, pursuant to Tukwila Municipal Code (TMC) Chapter 2.36.030
hereby makes the following conclusions.
This property requires specific Comprehensive Plan and Zoning Code designations since none
are currently in place. The City Council rejected an MIC /L designation in 1997, in favor of the
LDR designation. The LDR designation is consistent with the wishes of the City Council, and
and is consistent with the LDR zoning to the north and east of the site.
RECOMMENDATION
Staff recommends approval of the proposal to amend the Comprehensive Plan Map and Zoning
Map in order to designate Low Density Residential.
