The i- v A. The Economic Development Element requires that development be c, economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. z 1. PROJECT DESCRIPTION The proposal is to widen the existing Interurban Avenue South bridge approximately 16 feet to provide an HOV -only, northbound left-turn lane onto the 1-405 southbound on -ramp. In addition, a new pedestrian bridge will be added over the Green River with approximately 1,900 linear feet of new trail to be added to the Interurban Trail System. 2. POLICIES OF THE SMA policies of the SMP are categorized into the following elements: B. The Public Access Element requires that the development provide for pubic access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Recreational Element requires that recreational opportunities along the river should be preserved and enhanced. E. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses and allow for multiple uses. F. The Conservation Element requires that the river be buffered from the effects of development, where feasible facilities for intensive recreational activities should be provided and scenic views should be protected. G. It will not adversely affect land use, economic development, public access circulation or recreation along the shoreline. Widening of the Interurban Avenue South Bridge will reduce automobile congestion, making it economically advantageous to the community. The extension and completion of the Interurban Trail Systems between Fort Dent Way and S.W. Grady Way will maximize shoreline use by improving public access and enhancing the trail system. The trail improvements will create multiple, additional opportunities for passive recreational activities along the shoreline. Project - related landscaping will protect and enhance the river. The visual quality of the shoreline environment will be enhanced through the design and placement of trail and bridge improvements. There are no historic structures on the site. 3. TUKWILA SHORELINE REGULATIONS The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay Zone (TMC 18.44): The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. This district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows uses permitted in the underlying zoning district. Disturbed areas of the riverbank will be seeded. The area surrounding the trail extension will be extensively landscaped with such plants as Raywood Ash, Douglas Fir, Western Red Cedar, California Wax Myrtle, Smooth Sumac, White Rockrose, Oregon Grape and Boston Ivy. The uses proposed for the River Environment are the widening of the Interurban Avenue South Bridge and the creation of a pedestrian bridge connecting trail segments ending at Fort Dent Way and S.W. Grady Way. This trail extends into the Low Impact and High Impact Environments. All of the proposed uses meet the Shoreline Overlay regulations. TMC 18.44.110 - General Shoreline Regulations All uses within the Shoreline Zone must conform to the following general regulations: (1) The use is in conformance with the regulations of the underlying zone district. Jack Pace L98 -0009 July 7, 1998 Page 3 Response: The Interurban Avenue South bridge, pedestrian bridge and associated trail are all located in the Shoreline Overlay zone and are allowable uses in that zone. There is no underlying zone district for the bridge as it is a right -of -way (to which zoning does not extend). The property along the northeast side of the Interurban Avenue South bridge (on north bank of the river) is zoned Regional Commercial /Mixed Use (RCMU) and the property along the southeast side of the bridge (on south bank of the river) is zoned Commercial /Light Industrial (C /LI). Public trails are a permitted use in the RCMU. There is no underlying zone district for the pedestrian bridge as it is a right -of -way over the river (to which only the Shoreline Overlay zone applies). (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. (3) Response: No conflicts were identified. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. Response: The proposed widening of the Interurban Avenue South bridge promotes the public interest by reducing automobile congestion at that intersection. This is accomplished by creating an additional lane to allow the HOV's turning onto the southbound 1-405 on -ramp to bypass the general purpose traffic queued in the existing northbound left-turn lane. The benefit of a pedestrian bridge is the extension and completion of a missing link in the Interurban Trail System between Fort Dent Way and S.W. Grady Way. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit. Response: Bridges are approved structures within the river environment's 40 -foot wide management zone (TMC 18.44.130(f)). Disruption of existing trees and vegetation within this environment will be necessary to allow construction activities in connection with the proposal. Additionally, under TMC 18.54.050(2)(f) the construction and maintenance of streets and utilities within City- approved rights -of -way and easements do not require a Tree Clearing Permit and are exempt from the application of that chapter of the Tukwila Municipal Code if located within the Shoreline zone. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. (5) Response: The Green River has a water quality designation of Class A. The project will not discharge effluent into the river. (6) All State and Federal water quality regulations shall be strictly complied with. :ti Jack Pace L98 -0009 July 7, 1998 Page 4 Response: The project will require Joint Aquatic Resource Permits from the U.S. Army Corps of Engineers, State Department of Ecology, State Department of Fish and Wildlife and State Department of Natural Resources. These agencies will enforce their own water quality regulations. (7) Wildlife habitat in and along the river should be protected. Response: The project lies within the Pacific Flyway migration route for various waterfowl. The river is part of a migration route for anadromous fish. The existing wildlife habitat along the riverbank consists of brush, grasses and blackberries and is of low habitat value. Some of this vegetation will be removed for the construction of pile supported piers (two piers for the pedestrian bridge and two piers for the Interurban Avenue South bridge). After construction completion, rip rap will be placed around the foot of each pier to prevent erosion. Any remaining areas disturbed by pier placement will be relatively small in size and will be hydroseeded. Additionally, approximately 28 trees will be removed to permit widening of the Interurban Avenue bridge. The majority of this area is within the High Impact Environment with approximately 60 feet within the Low Impact Environment. Initially, this area will be regraded and hydroseeded. The area will then be planted with shrubs (or if possible, trees) to provide visual screening for the proposed restaurant on the adjacent property. The plantings will be the responsibility of the restaurant as part of its permit requirements. The area surrounding the pedestrian trail extension will be extensively landscaped with such plants as Raywood Ash, Douglas Fir, Western Red Cedar, California Wax Myrtle, Smooth Sumac, White Rockrose, Oregon Grape and Boston Ivy. (8) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. (9) Response: Best Management Practices (BMP's) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. Upon completion of construction, slopes will be seeded with standard erosion control grasses and protected from erosion until the grasses are established. If necessary, additional erosion control measures (e.g., fiber matting) will be included as part of the project. All necessary permits shall be obtained from Federal, State, County or municipal agencies. Response: Responsibility of the applicant. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Response: Under TMC 18.54.050(2)(f) the construction and maintenance of streets and utilities within City- approved rights -of -way and easements do not require a Tree Clearing Jack Pace L98 -0009 July 7, 1998 Page 5 Permit and are exempt from the application of that chapter of the Tukwila Municipal Code if located within the Shoreline zone. 18.44.130 Specific Shoreline Regulations - High Impact Environment All uses in the underlying zoning district shall be allowed in the high impact environment. Response: The project site is located within the River Environment and the Low Impact Environment. Existing uses within the High Impact Environment will not be changed. 4. COMPREHENSIVE PLAN SHORELINE POLICIES The policies of the Comprehensive Plan that affect shoreline development are found in the Shoreline Element. Shoreline Element Development should minimize impact on important habitat features, protect and restore degraded river banks and mitigate unavoidable disturbance of vegetation and habitat. Development should minimize water pollution, provide erosion control and protect water quality. • Capital improvement projects and private development should not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. Over -water structures or reinforcement of the river bank allowed only when it provides long -term public benefit or is essential to a water - dependent use. ▪ Development should reflect the river's role in Tukwila history, protect the Tong -term public use of the river and reflect community traditions. Development should include high - quality site planning, architecture, landscaping, provide for open space and provide a trail for public access along the river (for areas included in the Green River Trail Plan). Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses and encourage efficient use of the land. The existing habitat along the riverbank is of low habitat value. A portion of this will be removed during construction and will be reseeded (and in some areas, landscaped) at completion. Water quality will be protected during project construction through the use of Best Management Practices to prevent erosion and sedimentation. The proposed project includes over -water structures which will relieve traffic congestion, increase public access to the shoreline and protect the Tong -term public use of the river. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. Agencies with Jurisdiction: None. Summary of Primary Impacts: Earth The riverbank at this location is steep, containing slopes which are approximately 67 %. A layer of fill exists over the site consisting of silt, sand, gravel and cobbles and ranging from 2 to 12 feet in thickness. Below the fill layer, soft to medium stiff clayey silt is present (only along the north side of the river) with a maximum thickness of 26 feet. Dense silty sand exists below this silt layer on the north side of the river and also beneath the fill layer on the south side of the river. The sand layer varies from 65 to 110 feet in thickness. Weathered sandstone and siltstone lies below the sand layer but only on the north side of the river. Structural fill will be required in the following amounts: 2,000 cubic yards of gravel and topsoil for both the pedestrian bridge and new trail segment and 280 cubic yards of fill for the Interurban Avenue South bridge. An erosion control plan will be employed during construction. • Air Dust and exhaust emissions will be generated during construction, with watering as necessary to control dust. • Water The bridge widening and construction of the pedestrian bridge will occur over the Green River which has a Class A water quality designation. Permanent bridge pier supports for the widening of the Interurban Avenue bridge will be located above the ordinary high -water mark, but within the 100 year floodplain. Abutments for the pedestrian bridge will be located outside the 100 year floodplain but within 200 feet of the river. Portions of the Interurban Avenue bridge approach roads will be within 200 feet of the river. Construction within the River Environment will meet the requirements of the State Department of Ecology. Trail stormwater runoff will sheet flow into surrounding areas and will eventually reach the Green River. Stormwater from the bridge widening will be collected into the existing storm drainage system for the roadway. King County Surface Water Design Standards will be used for the design of any new or modified surface water drainage facilities for the project. The project will increase the amount of impervious surface area which may increase road runoff. This stormwater runoff could include pollutants such as oil, grease, suspended and settleable sediments, metals, organic compounds and oxygen consuming substances. Plants Blackberry, brush and various grasses are currently found along the riverbank. Some of this vegetation will be removed for the construction of pile supported piers (two piers for the pedestrian bridge and 4 piers for the Interurban Avenue South bridge). The area will be regraded and hydroseeded and then planted with shrubs (or if possible, trees) to provide visual screening for the proposed restaurant on the adjacent property. The plantings will be the responsibility of the restaurant as part of its permit requirements. The area surrounding the pedestrian trail extension will be landscaped with such plants as Raywood Ash, Douglas Fir, Western Red Cedar, California Way Myrtle, Smooth Sumac, White Rockrose, Oregon Grape and Boston Ivy. • Animals Northwest Chinook Salmon are found in the Duwamish River and may be listed as a threatened species in 1999. The river is part of a migration route for anadromous fish. The site is located within the Pacific Flyway, a migration path for various waterfowl. Construction within the Ordinary High Water Mark will meet the requirements of the State Department of Fish and Wildlife. • Energy /Natural Resources Lighting for the Interurban Avenue bridge will be electric. The widening of the Interurban Avenue bridge will permit the addition of an HOV bypass lane. This lane has the potential to promote fuel economy by reducing the time cars spend in queues and lessening congestion. The pedestrian trail (which will also be used by bicycles) may reduce fuel consumption by increasing the number of people bicycling to work. • Environmental Health Noise generated by construction equipment will occur on a short term basis. The hours of construction will comply with the City's noise ordinance. • Land /Shoreline Use The site is in the Shoreline Overlay Zone and the current King County Shoreline Master Program designation of the site is Urban. Interurban Avenue South is classified as a principal arterial. There is no underlying zone district for this ? Fort Dent Park is a major recreational park with several types of sports fields. A portion of the trail construction relies on the progress of an adjacent development. Grady Way, Southcenter Boulevard, Interstate 405, West Valley Highway, Fort Dent Way and Monster Road. No new roads will be built as part of the project. The proposed widening of the Interurban Avenue South bridge will reduce automobile congestion. This will be accomplished by creating an additional lane to allow HOV's turning onto the southbound 1-405 on -ramp to bypass the general purpose traffic queued in the existing northbound left -turn lane. This proposed project would widen the Interurban Avenue Bridge over the Green River to provide an HOV -only northbound left -turn lane onto the 1-405 southbound on -ramp and related utility modifications / connections. The proposal also would construct a new pedestrian bridge over the Green River, and would lengthen the Interurban Trail from Fort Dent Way to SW Grady Way adding approximately 1,900 feet of new trail to the Interurban Trail system (this addition with another planned segment connecting to it would complete this part of the trail system). The widening project lies within the limited access area of the 1-405 Green River Interchange. Interurban Avenue is classified as a Principal Arterial within the City of Tukwila. One proposed benefit of the widening is to provide a travel time savings to HOVs turning onto the southbound on -ramp to 1 -405. There is an HOV bypass lane on the ramp, but northbound HOVs on Interurban Avenue back up into the northbound left-turn queue with general purpose traffic during peak periods. This project would allow HOVs to bypass this queue. A second proposed benefit of the project is to extend the Interurban Trail from Fort Dent Way to SW Grady Way, part of the Interurban Trail system. This would complete a missing link in the Interurban Trail. A portion of the trail construction relies on progress of an adjacent development. It is assumed that the development will construct the trail work prior to this project's schedule. If the development falls behind schedule, a temporary trail connection may be constructed. Some standard BMPs for sediment control are silt fences and straw bale dams. A temporary erosion and sediment control (TESC) plan would be prepared, and would require approval by the City of Tukwila prior to construction. Upon completion of construction, slopes would be seeded with standard erosion control grasses, and protected from erosion until the grasses are established. If necessary, additional erosion control measures (e.g., fiber matting) would be included as part of the project. The project would be designed to minimize settlement of the trail after construction. . If yes, please describe and attach available plans. The bridge widening and construction of a new pedestrian bridge would occur over the Green River. Permanent bridge pier supports for the Interurban Ave bridge widening will be located above the ordinary high -water mark, but within the 100 -year floodplain. The bridge would be constructed across the river, and portions of the bridge approach roads would be within 200 feet of the river. Roadways adjacent to the shoreline should be designed primarily for slow- moving traffic that would provide for recreational activities. 2. Parking facilities should be located upland with provisions for adding pedestrian access to the shoreline. 3. Public transportation should be designated to facilitate access to and along the shoreline. 4. Publicly owned recreational uses should be enhanced and, when feasible, enlarged. a. The public should have first option to buy shoreland as it becomes available for sale, based on an acquisition plan with clear public intent. b. The opportunity for sport fishing in the river should be enhanced. 2. Recreational uses should be incorporated with other shoreline activities. 3. Those unique or fragile areas of the shoreline which cannot be maintained in a natural condition under human uses should be designed and maintained as open space for passive forms of recreation. 4. Views of the shoreline and water from shoreline and upland areas should be preserved and enhanced. • a. New shoreline development should not significantly obstruct views of the shoreline or the water. b. Enhancement of views shall not be construed to mean excessive removal of vegetation. E. SHORELINE USE ELEMENT 1. Shoreline activities identified as being appropriate shoreline uses should be planned for and encouraged. a. Short-term economic gain or convenience in developments should be evaluated in relationship to long -term and potential impairments to the desirable biological and aesthetic features of the river and its shoreline. b. Preference will be given to those activities which protect and enhance the desirable features of the river, depend on a shoreline location, and /or provide public access to the shoreline. c. Shorelines particularly suited for a specific and appropriate use or activity should be planned for and designated. d. Multiple use of shorelines should be planned for locations where integration of compatible uses is feasible. 2. Relocation of those activities identified as being inappropriate should be planned for and encouraged. 3. Aesthetic considerations should be encouraged when contemplating a new development, redevelopment of existing facilities or for general enhancement of shoreline areas. 4. Planning, zoning, capital improvements and other policy and regulatory standards should not tend to increase the density or intensity of activities on the shoreline. F. CONSERVATION ELEMENT 1. Determine and consider the visual impact a commercial /industrial development will have on the surrounding area. 2. Develop regulations requiring the maintenance of a buffer of permanent vegetation between developed areas and associated water bodies to improve the aesthetic qualities of the river, retard surface run -off, maintain constant water temperature and reduce siltation. 3. Promote linear shoreline access, especially pedestrian and other non - motorized types, in the areas close to population centers; such areas would also serve as buffer between water and developed areas. Develop regulations for site coverage, building height, set -backs and density to insure visual access to water, promote interesting development and prevent encroachment over water. 5. Evaluate the effect of proposed recreational developments on environmental quality and natural resources of an area. 7. Develop standards for preservation and enhancement of scenic views and vistas. 8. Outfalls and surface run -offs should be controlled to minimize adverse effects on the river. 9. Open space should be distributed along the river. G. HISTORICAL/CULTURAL ELEMENT 1. Protect and restore areas having historical, cultural educational or scientific values. 2. Access to such sites should be made available to the general public. 3. Visitors should be provided with clear identification and interpretation of historical /cultural sites. 4. Public and private cooperation should be encouraged in site preparation and protection. 5. Suspected significant sites should be retained. 6. Newly discovered sites should be kept free from other intrusions until their value is determined. COMPREHENSIVE PLAN SHORELINE DESIGN POLICIES A. ALL SHORELINE DEVELOPMENT 1. The development minimizes impacts on wildlife & significant vegetation, sandbars, wetlands, watercourses, and other important habitat features are maintained through the proper location, construction, management of shoreline uses (5.9.1). 2.
