Please accept this amendment to the noise variance issued by your office on April 24,
1998. We request that the construction window be changed from a starting date of
September 15, 1998, and an ending date of December 24, 1998 to a new starting date of
August 1, 1998 and a new ending date of May 1, 1999. Approval of this request will not
add additional "noise nights." The 14 nights originally requested remain the same.
The reason for the change is that the City of Seattle, who is funding this project, needed
extra time to secure construction funding. This delayed the project's advertisement date
and pushed the construction schedule into the winter months. The Washington State
Department of Transportation (WSDOT) construction office administering the job •
expressed concern that the delayed construction schedule may require a winter shut -down
pushing the project into the spring of 1999.
Also, please find enclosed mailing address labels for all property owners within 500 feet of
the job site. A 600 foot radius was used to ensure compliance. Your help with this matter

FINDINGS
BACKGROUND
The Washington State Department of Transportation (WSDOT) proposes improvements
to the State Route (SR) 5 / Boeing Access Road interchange to improve the southbound
exit from SR 5. The proposed improvements are to occur on 14 separate nights between
9:00 p.m. on Fridays through 5:00 a.m. Mondays. The anticipated project time line is
between June 15, 1998 through December 24, 1998.
Construction noise between the hours of 7:00 a.m. and 10:00 p.m. is exempt from the
City's Noise Ordinance, Tukwila Municipal Code (TMC) 8.22. Noise generated between
10:00 p.m. and 7:00 p.m., if in excess of allowed levels at receiving properties and
anticipated to last only 14 days maximum, requires a temporary noise variance. TMC
8.22.040 allows a maximum of 70 dBA when both the sound source and the receiving
properties are in an industrial zone. Attachment A is an overhead photograph of the
project area. While the project is located in the right -of -way and is not specifically
zoned, all of the surrounding property is located in the Manufacturing Industrial
Center/Heavy (MIC/H) zone.
SITE / VICINITY INFORMATION
Project description
The scope of the proposed improvements to the SR 5 / Boeing Access Rd. interchange,
listed in Attachment B, includes:
• widening southbound off -ramp
• removing existing westbound only movement
• add a dual left turn lane
• build a new right turn movement
• install signal at ramp terminal
Attachment C is the channelization, paving and site preparation plans for the project.
In their application materials (Attachment B) applicants have indicated that lane
restrictions to close or substantially limit access to the Southbound ramp can only occur
between either 8:00 p.m. and 5:00 a.m. or 7:00 p.m. to 6:00 a.m. These limitations have
been imposed on WSDOT to ensure safety of workers and automobiles. To affect the
improvements indicated above, the applicant's are seeking a temporary noise variance
due to the anticipated noise levels related to the improvement work schedule.
The activities to be performed to affect improvements include:

Attachment D is a list of the anticipated activities and corresponding noise levels. As
indicated, a maximum 90 dBA will occur as a result of saw cutting machines. As
referenced, 70 dBA is the maximum noise allowed to be generated in the MIC zone. To
mitigate the amount of noise generated during the project to affect the improvements, the
applicants will:
• use rubber bed liners on all trucks
• reduce noise levels on backup warning devices
• focus lighting on project and away from residences /oncoming traffic
• removal debris by hand and not machines
• monitor project with 24 hour telephone complaint line
Decision Criteria
TMC 8.22.180 establishes the review process for all noise variances:
"No variance shall be granted pursuant to this chapter until the administrator
has considered the relative interests of the applicant, other owners or possessors
or property likely to be affected by the noise, and the general public...The
administrator may grant a variance, if he finds that:
1. The noise occurring or proposed to occur does not endanger public
health or safety;
2. The applicant demonstrates that the criteria required for a temporary,
technical or economic variance under TMC 8.22.190 are met."

TMC 8.22.190 describes a Temporary Variance as:
"The administrator may grant a temporary variance, not to exceed 14 days, for
any activity, use, process or equipment which the administrator determines, in
accordance with rules and regulations, does not annoy a substantial number of
the people and does not endanger public health or safety."
The project site is surrounded by industrial uses in an industrial zone. Under TMC 8.22,
70 dBA is the maximum noise allowed. As indicated in Attachment D, the listed
activities will exceed the maximum allowed 70 dBA by up to 20 dBA on 14 separate, not
consecutive, nights over a 192 day period from June 15 through December 24, 1998.
The closest residential zone and uses in the City of Tukwila are located approximately
2,000 feet from the project site. Adjacent residential uses in the City of Seattle are also
located approximately 2,000 feet from the project site. TMC 8.22.050 requires a 10 dBA
reduction in nighttime noise when the receiving property is in a residential district. The
maximum allowed dBA during 10:00 p.m. and 7:00 a.m. when noise is received at
residential properties and generated on industrial property is 50 dBA.
Applicants have also indicated that noise levels will diminish at approximately 6 dBA
with the doubling of distance from the noise generator. Using this calculation, the 90
dBA maximum noise generated by saw cutters will dissipate entirely at 1500 feet from
the project site. As the referenced, the closest residential property in Tukwila is located
outside the likely noise field.
CONCLUSIONS
1. A temporary noise variance is required for the 14 days of night time activities that
exceed the 70 dBA limit in the MIC zone
2. A list of mitigating activities will be enacted that directly correspond to noise
generators
3. The noise generated during the evening hours will most likely dissipate before
being registered at nearby residential properties
RECOMMENDATION
Approval of the request for a 14 day temporary variance, to extend from June 15, 1998
through December 24, 1998

Technical Noise Variance Application
The Washington State Department of Transportation (WSDOT) is planning to improve
the SR 5 / Boeing Access Road interchange. Currently, southbound traffic exiting from
SR 5 has the sole option of westbound travel on the Boeing Access Road. The proposed
project will widen the southbound off-ramp, remove the existing westbound only
movement, add a new dual left turn pocket (eastbound movement), build a new "free"
right turn movement (westbound) and install a new signal at the ramp terminal. This new
signal will be interconnected with the existing signal at SR 900 (Martin Luther King Jr.
Way) and will coordinate with the existing signal at E. Marginal Way S. The widening
will occur soon after the ramp comes off the mainline, to provide adequate storage for the
signal queue, and will continue as a two lane ramp up to the terminal where it becomes a
two lane left turn pocket with a free right turn at the intersection with the Boeing Access
Road. Attached you will find an aerial and a listing of the property owners with mailing
labels.
The job requires night work which will allow the ramp to be open to traffic a maximum
amount of time during construction. The WSDOT is planning to close the ramp
completely for two weekends.. On the first weekend the existing ramp terminal will be
removed and rebuilt. On the second weekend the entire ramp will be overlayed and
permanent striping will be applied. In order to perform all of the work required, the
contractor must work throughout the night during these weekend closures. The closures
will occur from 9:00 PM Friday to 5:00 AM Monday.

SR 5 is a high volume highway and traffic restrictions . will be necessary. Work will occur $
in narrow area's within and adjacent to the travel lanes, presenting a danger to the public O
and project workers: Lane restrictions are needed for the movement of equipment and
materials and to allow enough room for equipment and workers to perform the work. For
public safety, lane restrictions on SR 5 are only allowed between 8:00 PM to 5:00 AM and
7:00 PM to 6 :00 AM depending on location and day of the week. It is therefore necessary
to perform this work at night.
Equipment to be used may include, but is not limited to, a small crane, diesel generators,
chipping guns, compressors, dump trucks, paving machines, rollers, light plants, arrow
boards, concrete trucks, saw cutting machine, front end loader, backhoe, trenching •
machine, and flat bed trucks.
Noise levels diminish with distance. A 6 dBA noise level drop off will occur with the
doubling of distance from a noise source. For example, a noise level of 70 dBA measured
at 50 feet would be 64 dBA at 100 feet, 58 dBA at 200 feet, and 52 dBA at 400 feet.
Sound also decreases if an object interferes with the receiver's line of sight to the noise
source. This attenuation depends on the relative elevations of the source and the receiver
and the height and location of the intervening object.

Tukwila residential neighborhoods closest to the project location are approximately 1800
to 2000 feet to the east of the proposed project. (Residences located within Seattle are
approximately 1700 to 2500 feet from the project. A noise variance application is being
tendered to the City of Seattle as well.) Analysis and projected worst case nighttime
construction noise levels for residences closest to the project are as follows: Four
residences are found on 47th Ave. S. (south of S. Ryan Way). A forested hill blocks the .
line of sight between this residential area and the project site, which is approximately 2000
feet away. Project related noises will usually be imperceptible to residences in this area.
Occasional project related noises might be barely perceptible (45 - 50 dBA)to an exterior
receiver in this neighborhood. 47`x' Ave. S. is also found north of S. Ryan Way. There are
approximately 8 - 10 residences on the west side of 47th Ave. S., which is closest to the
project site. These residences are 2000 to 2200 feet from the project location. A forested
hillside, Martin Luther King Jr. Way, SR 5, and numerous warehouses and industrial
buildings separate this neighborhood from the project location. Distance, line of sight
interruption, and the forested hillside will combine to provide 37 - 50 dBA of attenuation
to project activity noise levels. Worst case project generated peak noise levels to this
residential area are expected to be 45 - 53 dBA as perceived by an exterior receiver in this
neighborhood.
As a measure to mitigate noise, our contractor will perform the work under the following
conditions :
• All trucks performing export haul shall have rubber bed liners between the hours of
10:00 PM to 7:00 AM;
All backup warning devices shall be the least intrusive ambient sensitive type or the
contractor may use a backup observer in lieu of backup warning devices as allowed by
WAC 296 - 155 -610 (2) (e);
Lighting and other stationary equipment such as generators, air compressors, or any
other similar equipment used for nighttime work shall be directed away from on
coming traffic and residences.
• Any material or debris that spill on the pavement shall be removed by hand or by
sweeping. The contractor shall employ no scraping type equipment or activity to clean
pavement surfaces.
• The WSDOT will periodically monitor project related noise levels at residential sites.
Periodic written reports will be submitted to the City of Tukwila. WSDOT will
provide and monitor a 24 hour complaint line. The complaint line telephone number
will be distributed to area residents.
• The Construction Project Engineer (PE) will be alerted of all complaints. The PE will
evaluate the complaint and the monitoring measurements and take appropriate

the job, or a work stoppage to develop an acceptable procedure.
To ensure the reasonable safety and convenience of the public, we ask for a temporary
noise variance from the requirements of Tukwila Municipal Code Chapter 8.22.180(b).
The project is schedules to be advertised on April 13, 1998 with the earliest start date of
June 15, 1998, and ending construction by September 15, 1998. We are requesting one
14 night variance to be used throughout the construction project.

Technical Noise Variance Application
The Washington State Department of Transportation (WSDOT) is planning to improve
the SR 5 / Boeing Access Road interchange. Currently, southbound traffic exiting from
SR 5 has the sole option of westbound travel on the Boeing Access Road. The proposed
project will widen the southbound off - ramp, remove the existing westbound only
movement, add a new dual left turn pocket (eastbound movement), build a new "free"
right turn movement (westbound) and install a new signal at the ramp terminal. This new
signal will be interconnected with the existing signal at SR 900 (Martin Luther King Jr.
Way) and will coordinate with the existing signal at E. Marginal Way S. The widening
will occur soon after the ramp comes off the mainline, to provide adequate storage for the
signal queue, and will continue as a two lane ramp up to the terminal where it becomes a
two lane left turn pocket with a free right turn at the intersection with the Boeing Access
Road. Attached you will find a vicinity map and plan sheets.
The job requires night work which will allow the ramp to be open to traffic a maximum
amount of time during construction. The WSDOT is planning to close the ramp
completely for two weekends. On the first weekend the existing ramp terminal will be
removed and rebuilt. On the second weekend the entire ramp will be overlayed and
permanent striping will be applied. In order to perform all of the work required, the
contractor must work throughout the night during these weekend closures. The closures
will occur from 9 :00 PM Friday to 5:00 AM Monday.
Work to be performed at night includes:

SR 5 is a high volume highway and traffic restrictions will be necessary. Work will occur
in narrow areas within and adjacent to the travel lanes, presenting a danger to the public
and project workers. Lane restrictions are needed for the movement of equipment and
materials and to allow enough room for equipment and workers to perform the work. For
public safety, lane restrictions on SR 5 are only allowed between 8:00 PM to 5 :00 AM and
7:00 PM to 6 :00 AM depending on location and day of the week. It is therefore necessary
to perform this work at night.
Equipment to be used may include, but is not limited to, a small crane, diesel generators,
chipping guns, compressors, dump trucks, paving machines, rollers, light plants, arrow
boards, concrete trucks, saw cutting machine, front end loader, backhoe, trenching
machine, and flat bed trucks.
Noise levels diminish with distance. A 6 dBA noise level drop oil: will occur with the
doubling of distance from a noise source. For example, a noise level of 70 dBA measured
at 50 feet would be 64 dBA at 100 feet, 58 dBA at 200 feet, and 52 dBA at 400 feet.
Sound also decreases if an object interferes with the receiver's line of sight to the noise
source. This attenuation depends on the relative elevations of the source and the receiver
and the height and location of the intervening object.

Tukwila residential neighborhoods closest to the project location are approximately 1800
to 2000 feet to the east of the proposed project. (Residences located within Seattle are
approximately 1700 to 2500 feet from the project. A noise variance application is being
tendered to the City of Seattle as well.) Analysis and projected worst case nighttime
construction noise levels for residences closest to the project are as follows: Four
residences are found on 47th Ave. S. (south of S. Ryan Way). A forested hill blocks the
line of sight between this residential area and the project site, which is approximately 2000
feet away. Project related noises will usually be imperceptible to residences in this area.
Occasional project related noises might be barely perceptible (45 - 50 dBA)to an exterior
receiver in this neighborhood. 47th Ave. S. is also found north of S. Ryan Way. There are
approximately 8 - 10 residences on the west side of 47th Ave. S., which is closest to the
project site. These residences are 2000 to 2200 feet from the project location. A forested
hillside, Martin Luther King Jr. Way, SR 5, and numerous warehouses and industrial
buildings separate this neighborhood from the project location. Distance, line of sight
interruption, and the forested hillside will combine to provide 37 - 50 dBA of attenuation
to project activity noise levels. Worst case project generated peak noise levels to this
residential area are expected to be 45 - 53 dBA as perceived by an exterior receiver in this
neighborhood.
As a measure to mitigate noise, our contractor will perform the work under the following
conditions :
• All trucks performing export haul shall have rubber bed liners between the hours of
10 :00 PM to 7:00 AM;
• All backup warning devices shall be the least intrusive ambient sensitive type or the
contractor may use a backup observer in lieu of backup warning devices as allowed by
WAC 296 -155 -610 (2) (e);
• Lighting and other stationary equipment such as generators, air compressors, or any
other similar equipment used for nighttime work shall be directed away from on
coming traffic and residences.
• Any material or debris that spill on the pavement shall be removed by hand or by
sweeping. The contractor shall employ no scraping type equipment or activity to clean
pavement surfaces.
• The WSDOT will periodically monitor project related noise levels at residential sites.
Periodic written reports will be submitted to the City of Tukwila. WSDOT will
provide and monitor a 24 hour complaint line. The complaint line telephone number
will be distributed to area residents.
• The Construction Project Engineer (PE) will be alerted of all complaints. The PE will
evaluate the complaint and the monitoring measurements and take appropriate

measures, which will include further mitigation activities, removal of equipment from
the job, or a work stoppage to develop an acceptable procedure.
To ensure the reasonable safety and convenience of the public, we ask for a temporary
noise variance from the requirements of Tukwila Municipal Code Chapter 8.22.180(b).
