Box 3999 MS 46 -87 Seattle, Washington 98124 -2499 Re: Illegal Wall Sign at 9725 East Marginal Way South (Boeing 9 -101 Building) Dear Mr. Taller: On June 19th, Liz Warman faxed us a letter requesting that Boeing's variance request (L98 -0020) be postponed. On June 23rd, Jack Pace and Deb Ritter met with you, Liz Warman and Gerald Bresslour to discuss the sign options available to Boeing. One of these options was a Special Permission Sign Permit which would allow a 500 s.f. wall sign. On July 9th, Trade Marx Sign Company contacted Deb Ritter and advised that Boeing would be applying for a Special Permission Sign. The design of the proposed sign was 500 s.f. in size. We have been in regular contact with Trade Marx since that time to learn the status of Boeing's proposed sign application. To date, we have not received a sign application from either Trade Marx or Boeing. Deb spoke with Eileen of Trade Marx yesterday. Eileen indicated that she is still waiting for Boeing's final approval of the proposal and payment of the associated permit fees. Over the past few months we have delayed taking further action in anticipation of your sign application submittal. We are happy to respond to any questions you may have regarding the requirements for this type of application. However, if we do not receive the required sign application materials by September 9th, we will be forced to refer the file to Code Enforcement. WHY IS THIS VARIANCE BEING REQUESTED? To add the New BOEING logo alongside the existing lettered BOEING sign. The logo is 335 SF, as calculated by constructing a polygon around the logo using right angles. The original BOEING sign is 6' x 52'- 6 1/4 "', for a square footage of 315. Combined the sign will occupy 650 square feet on an exposed building face of 81,945 SF in which the total building square footage is 1,112, 432 SF. 7. DOES YOUR REQUEST MEET THE VARIANCE CRITERIA? A. The variance as approved shall not constitute a grant of special privilege which is inconsistent with the intent of this sign code, nor contravenes the limitation on use of property specified by zoning classification in which the property is located. In chapter 19.32 Regulations Based On Land Use Categories, VI - COMMERCIAL ZONES 19.32.140. The area of all signs on an exposed building face for each business shall be as provided in Table 1. Table 1 allows for a Permitted Area of the Sign - Square Feet of 150 SF (maximum) for a building with an Exposed Building Face over 5000 SF. The intent of the sign code is to provide guidelines so that the streets of Tukwila may appear orderly and minimize clutter and distraction. The sign Boeing wishes to keep on its building is using 650 SF on an exposed building face of 81,945 SF. The sign is taking .79% of the exposed building face. With the intent of the sign code in mind the proposed sign provides an orderly and attractive addition to the streets of Tukwila in relation to the size of the building. B. That the variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. Due to the size of the Boeing Developmental Center (total plant size is 3,381,000 SF of building space on 162+ acres). Boeing is requesting one sign the total size of 650 SF for the site. That the granting of the variance will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and in the zone in which to subject property is located. The requested sign is set back 160 feet from the public way (E. Marginal Way S) and surrounded on all sides by an 8 foot high cyclone fence on private property that is manned 24 hours a day by Boeing security and is not open to the public. The aesthetic impacts are a visual enhancement in this MIC/H - Manufacturing Industrial Center/Heavy Industrial Zoning Designation by the 467174E/NW' City of Tukwila. D. That the special conditions and circumstances prompting the variance request do not result from the actions of the applicant. The 9 -101 building that the sign will be displayed on is 1,112,423 SF with an exposed East building face of 81,945 SF. The East annex to the building was added in 1986, to reach its existing square footage. Due to size of the exposed East face, to put a sign the size that is allowed for a 5000 SF and over retail space (150 SF) would be impractical and not meet the actual intent of the code in regard to its orderly appearance in the City of Tukwila. The sign code does not take into account an industrial building that is larger than most retail stores that the sign code was established for. Therefore we are requesting a sign variance that is more in accord to the size of our industrial building. E. That the variance as granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. To meet the strict code regulations set forth by the size limitations (150 SF) for the requested sign for this size of building. The scale of the plans is at the discretion of the applicant, however, the scale must be accurate and content legible.
