We must have miscommunicated in our earlier conversation. When you said that you had reduced the sign size I understood you to mean that the total sign area was now within the 400 square feet granted by the special permission increase. If that was the case I agreed that we could handle the sign content change as an administrative amendment to the file. I see from your memo that you are still requesting an increase in allowable sign area from 400 to 490 square feet. If you wish to move the readerboard signs to the south elevation and count them as one sign with the "Cinema" sign you will have to calculate the area as shown on the attachment to this letter. You will also have to reapply for special permission as we cannot make such a substantial change after the notice of decision has been issued. We are proposing the removal of the marquee signage on the east elevation of the building and adding marquee signage under the canopy on the south elevation. This project has received Planning Commission approval for 400 SF of wall signage. We are seeking to ammend the Planning Commission approval with an additional 100 SF of wall signage. Wall sign area of 6% or 500 SF maximum is allowed with Planning Commission approval. Approval is based on fagade square footage and building setback. Our building elevation is 10,000+ SF making the proposed signage 4% of the elevation. The combined area of the proposed signage is 490 SF as illustrated on attached drawings. The front fagade of the building is positioned 380 feet from South 180`h Street. The revised signage would have very little impact on the design of the building. It will be part of the Parkway Supercenter redevelopment on the site of the former Pavilion Mall. Background Information The building design was approved by the Board of Architectural Review on January 8, 1998 with the condition that staff work with the applicant to bring the signage into compliance with the sign code. A readerboard sign proposed for the west building elevation meets the size requirements of the sign code. The "Cinema" sign proposed for the south building elevation is the subject of the sign area increase request. The drawings submitted show the proposed sign at approximately 300 square feet, but the applicant is asking for approval of an increase to 400 square feet to allow for variation in fabrication and installation of the sign. A sign permit documenting the actual size of the sign will be required prior to installation of the sign. Decision Criteria TMC 19.32.140(A) allows the permitted sign area to be "increased by 50% for each doubling of the required minimum setback...but in no case shall sign area exceed that permitted in TMC 19.32.150 ". TMC 19.32.150 allows up to "a maximum of 6% of the exposed building face... ". The Act III building is setback approximately 360 feet from South 180th Street, 24 times the 15 foot minimum setback requirement for the TUC zone. The building facade totals approximately 10,600 square feet. The allowed sign area, given the square footage of the south elevation, is 150 square feet. Since the building is setback 24 times farther than the minimum setback required for this zone, the 6% limitation would apply. Therefore, the maximum possible sign area increase under the code would be to 636 square feet. CONCLUSIONS The proposed sign more than meets the setback requirement for the special permission sign area increase. The increase that the applicant has proposed, from 150 to 400 square feet, while substantial is still well under the 6% limitation. The south elevation of the building is large enough so that the sign would not overwhelm the architecture. We feel that the scale of the sign needs to relate to the scale of the building. We are hereby requesting an increase in signage footage from 150 square feet to 400 square feet. The south facade is approximately 10,600 SF. A 400 square foot sign is only 3.7% of building facade and is well below the maximum allowable 6 %. Additionally, the proposed Theatre is sited 360 feet plus from South 180th Street. The required setback is 15' -0 ". If we are allowed to increase the sign footage by 50% for every doubling of the setback, we exceed 500 square feet maxim allowable at approx. 90 feet from the property line.
