The applicant has obtained approval of the septic system from the Health Department. I have given you the original copy of that approval. Additionally, the applicant's cover letter mentions certain circumstances which required modifications to the boundary lines. Please review and advise if this package is ready for approval by the Short Subdivision Committee. If so, I will route a copy to the Fire Department for final approval. In addition the King County Health Department letter and letter of sewer availability letter from ValVue Sewer District. A change in the boundary line ( from 170 feet deep to 175 feet deep ) has been made to conform to the 10 foot rear yard set back from the back of the secondary garage. In addition, the health department requires that the entire drainfield is located on the subject property that it serves. Therefore we have revised the lot line in order to incorporate the existing drainfield on Parcel «A» The remainder of the application has remained in tact. Based upon your submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the boundary line adjustment process: Preliminary Approval, Final Approval and Recording. These three steps and their requirements are described as follows: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure that the boundary line adjustment is consistent with the City's policies and regulations. PRELIMINARY APPROVAL CONDITIONS General a. The cover page of the Boundary Line Adjustment document must be resubmitted. The copy provided with your application does not reflect the legal descriptions before and after the boundary line adjustment. Please note: any legal descriptions must be shown on this page. rather than referencing an attachment. You may use the attached copy or create your own document (so long as you duplicate the form and allow adequate margins for recording purposes). The legal descriptions shall be prepared by a licensed land surveyor or title officer. Access b. Easement roads over 150 feet in length shall have a turn around built to Fire Department standards (TMC 17.20.030(C)(5)(d)). please revise the plan to reflect this requirement. Parcel Boundaries c. The boundary line between Parcels "A" and `B" does not provide for sufficient setback from the rear garage on Parcel "A ". The rear setback requirement in this zone (Low - Density Residential) is 10 feet per TMC 18.10.060. Based on the map submitted with your application, the distance from the boundary line to the rear garage on Parcel "A" appears to be only 5 feet 5 inches in length. Please revise the pla to reflect this requirement. Site Survey Requirements d. The map submitted with the application is not in a recordable form. Please resubmit a site survey as described in the application checklist which is consistent with all of the conditions of approval stated in this letter. The site survey must have adequate margins meeting King County recording requirements. According to the rules of the King County Recorder's Office, a one -inch margin must be kept clear along the sides and bottom of any page to be recorded. The top of the first page of any document to be recorded must retain a three -inch clear margin, while the top of any subsequent pages must retain a one -inch clear margin. e. Please verify with the King County Recorder's Office the maximum permitted size for the site survey to be recorded. It is our understanding that the maximum size is 18" by 22" if recorded at the Condominium Desk of the Recorder's Office. g. The site survey shall be stamped and signed and shall include the name, address and phone number of the professional land surveyor (per TMC 17.08.030(A)(2)). Distances on the site survey must be shown using a standard decimal (engineer) scale. A "North" arrow must also be included. h. The septic drain field must be located by a land surveyor on the site survey. i. Final Approval The next step is to submit the necessary boundary line adjustment documents indicated above and comply with all the conditions of approval. After the documents have been found to be in order and all of the requirements of the boundary line adjustment have been met, the Short Subdivision Committee will grant final approval. 3. Recording It is your responsibility to record the City approved boundary line adjustment documents with the King County Department of Public Records. The boundary line adjustment is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. You will need to pay the recorded fees and submit your approved original boundary line adjustment to the King County Department of Records (206- 296 - 1570). After recording, the County returns the recorded original to the City of Tukwila within 4 to 6 weeks, at which time your boundary line adjustment is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded boundary line adjustment to the undersigned. SHORT PLAT INFORMATION You have indicated that a short plat application will be submitted for this property in the near future. As a courtesy, we are providing you with the following, preliminary information. Although it is not a definitive listing of requirements, you may wish to review and consider this s \ Ms. Sharon Mann July 2, 1998 Page 4 information before submitting your short plat application. Access As we have discussed, a short plat application will necessitate additional easement requirements per Chapter 17.20 of the Tukwila Municipal Code. Some of these requirements are as follows: 1. Easement roads cannot exceed 200 feet in length nor serve more than four lots (TMC 17.20.030(C)(5)(d)). Easement roads over 150 feet in length shall have a turn around built to Fire Department standards (TMC 17.20.030(C)(5)(d)). Width requirements for the roadway, if it extends beyond 20 feet, will increase from 20 feet to a public right of way width of 40 feet (with a paved width of 26 feet) (TMC 17.20.030(C)(6)(a). This means that the second garage shown on Parcel "A" and the shed shown on Parcel `B" are in within the boundary of the area that this access easement and turnaround would encompass. Utilities Future development of Parcel `B" will require proof of water availability and compliance with City Ordinance 1692 — Fire Hydrants (see attached). The Real Property or its address is commonly known as 4811 S. 146TH, SEATTLE, Washington 98168. In addition, Grantor unconditionally and irrevocably assigns to Trustee all of Grantor's right, title, and interest in and to the Income (including all rents) from the Property, SUBJECT HOWEVER to the right, power and authority hereinafter given to Lender to collect and apply such Income. The word "Indebtedness" means all principal and Interest payable under the Note and any amounts expended or advanced by Lender to discharge obligations of Grantor or expenses Incurred by Trustee or Lender to enforce obligations of Grantor under this Deed of Trust, together with Interest on such amounts as provided In this Deed of Trust. The word "Note" means the note or credit agreement dated 05 -16 -1989 In the principal amount of 539,000.00 from Borrower to Lender, together with all renewals, extensions, modifications, refinancings, and substitutions for the note or agreement. The currently scheduled final payment of principal and Interest on the Note will be due on or before 05 -15 -2004. Personal Property. The words "Personal Property" mean all equipment, fixtures, and other articles of personal property owned by Grantor, now or subsequently attached or affixed to the Real Property, together with all accessions, parts, and additions to, all replacements of, and all substitutions for any of such property, and together with all proceeds (including insurance proceeds and refunds of premiums) from any sale or other disposition of such property. The words "Related Documents" mean and include any promissory notes, loan agreements, guaranties, security agreements, and all other documents executed in connection with this Deed of Trust or the Indebtedness, whether now or hereafter existing.
