We have received a request from Gary Barnett of your staff that we modify the reciprocal access easement which serves the four parcels making up this site. The access agreement was originally established to provide for fire department access to each lot. Gary's request is that the easement be extended to the south property line to provide for future access to a potential frontage road that might connect this site to a controlled intersection further south. We would prefer not to modify our reciprocal access easement at this time. We fully support the concept of Gary's request and we are willing to commit to re- writing the easement to incorporate ti to access to the south when the lots to the south are developed and a controlled intersection is created. At this time, however, we do not know enough about where to locate the access to justify re- writing the easement. Most likely, any easement description which we write now will have to be modified to fit future parameters anyway. We request that you approve the Boundary Line Adjustment with the reciprocal access agreement as it is currently written. You may use this letter as your record of our commitment to create the access to the south when it becomes viable. Please contact us promptly if this letter is in any way unacceptable to you. We look forward to receiving approval of our Boundary Line Adjustment application in the next few days. We would prefer not to modify our reciprocal access easement at this time. We fully support the concept of Gary's request and we are willing to commit to re- writing the easement to incorporate the access to the south when the lots to the south are developed and a controlled intersection is created. At this time, however, we do not know enough about where to locate the access to justify re- writing the easement. Most likely, any easement description which we write now will have to be modified to fit future parameters anyway. It is possible that minor adjustments in these parking counts (plus /minus 1 or 2 stalls) may result as the site plan is finalized or from changes during construction. The lot lines have been designed to meet parking requirements even if minor adjustments occur. The legal descriptions for the four lots include existing easements and any new easements that are required to meet City of Tukwila standards for legal lots. A Utility Easement is required for the water main loop which is serving all three buildings. That easement will be written and recorded when we have the as -built dimensions for the water line. We will also provide a Use Agreement for the loading bays at Building A, at such time as any of the buildings come into separate ownership. The use agreement will insure that each building meets TMC 18.56.060, regarding loading space requirements. We look forward to working with your office to efficiently proceed with the approval of this permit. Per City of Tukwila requirements, these boundary line adjustments must be recorded prior to any construction permits being issued on this project.
