The proposal by Pacific Fiberlink is to install fiber optic cable throughout the City of v o Tukwila, as part of a larger project through the State of Washington. Attachment A is the w o application for a Shoreline Permit. Attachments B and C are the route for the project and J ► - details of the route that fall within 200 feet of the Mean High Water Mark (MHWM) of w 0 0 the Duwamish/Green River. 2 General Shoreline Regulations (18.44.110) 1. The use is in conformance with the regulations of the underlying district ? 1- O w ~ The project will be located within the right -of -way on several City of Tukwila 2 streets, including East Marginal Way and Interurban Avenue. The project will also be located along West Valley Highway, also known as State Route 181. N ° 0 1 = w w No specific development regulations govern the installation of fiber optic cable. The cable will be located in an existing 4 foot deep trench that is used for other t'-- z utilities that run in Tukwila right -of -way, include the Electric Lightwave w 0 conduits. Any above ground structures to support the project must meet o underlying setback and height limits for facilities or related infrastructure outside z of the right -of -way. Attachment C shows details of the proposal, including the method designed to cross the Duwamish/Green River on the Duwamish Bridge at S. 115th and East Marginal Way S. and crossing the Green River on Interurban near I -405. 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations: Utility easements are allowed throughout all portions of the Shoreline Zone, including the 40 foot River Environment. 3. No structures or accessory facilities shall be located over the river unless such structures protects or promotes the public interest. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit. No disruption of existing vegetation in this river environment is anticipated. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. No discharge of effluent will occur due to proposal. 6. All States and federal water quality regulations shall be strictly complied with N/A 7. The applicant obtained a SEPA Determination of Non - significance, dated May 18, 1998, as indicated in Attachment F. Approval of Flood Control Zone, Land Altering and other Development Permits is required. The applicant has obtained a Street Use Permit for portions of their work within the City of Tukwila that do not fall within the Shoreline Zone. This permit is included as Attachment D. The attached permit did not include any work for portions of their project that occurred within the Shoreline Zone. SHORELINES DESIGN POLICIES All projects in the Shoreline Zone must be consistent with Tukwila's Comprehensive Plan and Shoreline Master Program policies (or King County's Shoreline Master Program if project located north of the 42nd Avenue bridge). In addition, all structures requiring a building permit (except single family development of 4 or fewer lots) located in the Shoreline Zone must undergo design review with the Tukwila Board of Architectural Review (BAR). The BAR's decision is based on design guidelines contained in the Zoning Code (TMC 18.60.050) and'the Tukwila Comprehensive Plan (see DESIGN REVIEW APPLICATION). The SHORELINE MASTER PROGRAM POLICIES and Comprehensive Plan's SHORELINE DESIGN POLICIES are summarized below. Note that more than one category may apply. In some cases, the goal for the use or area is noted to provide context for the design policies. June 4, 1998 Page 2 Stormwater Pollution Prevention Plan (SWPPP) Permit Fees Appeal The most significant requirement of the permit is the implementation of a Stormwater Pollution Prevention Plan. Plan requirements for construction activities are given in Special Condition S9 of the permit. The purpose of a Stormwater Pollution Prevention Plan is to reduce, eliminate, or prevent the pollution of stormwater through the application of Best Management Practices. As a condition of coverage under this permit, the SWPPP must be written and implementation started prior to the commencement of construction activity. State law (RCW 90.48.465) requires that all permittees pay an annual permit fee. If your permit goes into effect during the. State's fiscal year (June 30 - July 1), the initial fees will be prorated to the quarter. Future: yearly billing notices will be mailed to you in August. Permits that terminate during the State's fiscal year will have their fees, prorated. Ecology will not process refunds if the ending balance of the fee account is less than one hundred dollars ($100). If you would like more information, on the fee process, contact Bev Poston, Fee Administrator, Department of Ecology at (360) 407 -6425. The right of way is maintained in such a manner as to be free of underbrush and trees as required by law. This enables the company to maintain security thruugh line of sight marking. Olympic conducts continual maintenance along the right of way. The Pacific Fiber Link Company is in the process of constructing a multi- conduit corridor between Renton, Washington and • Portland, Oregon. The project will cross live Western Washington counties. The conduit will be installed rasing conventional plowing, horizontal boring and directional'drilling methods. A multiple conduit bundle will be buried 48 inches deep with 42 inches of cover. Environmentally sensitive areas will be avoided as much as possible, but where unavoidable special techniques will be employed to maintain integrity. Streams, rivers and wetlands will be directional drilled to avoid adverse impact. Project Route — The route follows the Olympic Pipe Line corridor to be offset from the pipeline some 10 -15 feet from center. The route begins at the Olympic Pipe Line Gauging Station in Renton, proceeds due west 'A mile To the interurban bicycle trail; then south along the trail for 8.3 miles, then southwest along Puget Sound Energy right of way for 2.5 miles, then south 9.2 miles paralleling Interstate 5, them South following the established Olympic Pipe Line Route to Portland. The Columbia River will be directionally drilled for the application of conduit, under the auspices of the Army Corps of Engineers Section 10 permit. Conduit Installation - Conduit Installation will be by three separate methods: direct bury by plowing, directional boring and minimal selective trenching where absolutely necessary. Because the Olympic Pipe Line right of way is well maintained and free of tall Vegetation heavy clearing will not be needed. Roadways and major highways such as I - will be directionally bored. All fishery streams will be bored with adequate set back to prevent any chance of water contamination from drilling mud and spoils. There are areas along the route that may require limited trenching. Soil Disturbance Sequence The installation of this conduit system is typical of industry standards for the application of communications systems: Construction consists of plowing,, limited trenching, back filling, compaction followed by complete restoration: ;Several crew's working simultaneously will carry out the construction and placement of the 1.16 miles of conduit. Additional erosion control methods will be applied such as hydroseeding, mulching and matting, as deemed necessary. On severe slopes and sleep terrain, erosion control structures such as water bars, diversion channels, piping and terraces will be employed, as required. Water will be directed away from the construction and right of way zone along with other disturbed areas to reduce the potential of soil erosion. Temporary work areas used at stream and highway crossings and other special sites will be restored to approximate pre- constriction conditions.
