No specific development regulations govern o the installation of fiber optic cable. The use does not conflict with the goals and policies of the shoreline master Y program or the provisions of the Shoreline Act and shoreline regulations: 1- z Attachments C and D show details of the proposal, including the method designed to cross the Duwamish/Green River. The following are Shoreline Master Plan Policies that pertain to this development: 1. Determine and consider the visual impact that the commercial /industrial development will have on the surrounding area 2. Shoreline activities identified as being appropriate shoreline uses should be planned for and encouraged. a. Short-term economic gain or convenience in develops should be evaluated in relationship to long -term and potential impairments to the desirable biological and aesthetic features of the river and shoreline. b. Aesthetic considerations should be encouraged when contemplating a new development, redevelopment of existing facilities or for general enhancement of shoreline areas. The following are Comprehensive Plan Policies that pertain to the proposed development that occurs in the Shoreline Zone: • Capital improvement projects and private development are designed, located and managed in a manner which does not endanger public health, safety, welfare or capacity of river to provide long -term community benefits. (Policy 5.11.1) • When overwater structures or structural reinforcement of the riverbank is proposed, it is necessary for a significant long -term public benefit or water dependent use (Policy 5.3.3) As presented, the applicants have proposed a method of crossing the Duwamish River that is in controversy with the above referenced Comprehensive Plan and Shoreline Master Plan policies. 3. No structures or accessory facilities shall be located over the river unless such structures protects or promotes the public interest. N/A There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit. No disruption of existing vegetation in this river environment is anticipated, If any removal of vegetation is required for this project, approval of a Tree Permit (TMC 18.54) will be required . S. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. No discharge of effluent will occur due to proposal. 6. Landfilling is prohibited within the river channel, unless such landfill is determined by the Planning Commission to protect or promote the public interest. N/A 15. Notwithstanding any provisions of the Code to the contrary, removal of any cottonwood tree within the river environment, or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. No removal of vegetation is proposed for this project. Specific Shoreline Regulations - low impact environment (18.44.150) The installation of underground fiber optic cable is not specifically governed or regulated, however other similar types of infrastructure are allowed. This portion of the code also requires that `utility easements where necessary shall be landscaped with live ground cover or natural grass cover ". DECISION Approval of the application with one condition: 1. To meet the referenced Comprehensive Plan and Shoreline Master Plan policies, the plan shall be revised to eliminate the proposed aerial crossing. The applicant shall obtain approval of the Washington State Department of Transportation to use their bridge crossing the Green River until other facilities crossing at 48th Ave S. are built by the City of Tukwila or other agencies. SHORELINES DESIGN POLICIES All projects in the Shoreline Zone must be consistent with Tukwila's Comprehensive Plan and Shoreline Master Program policies (or King County's Shoreline Master Program if project located north of the 42nd Avenue bridge). In addition, all structures requiring a building permit (except single family development of 4. or fewer lots) located in the Shoreline Zone must undergo design review with the Tukwila Board of Architectural Review (BAR). The BAR's decision is based on design guidelines contained in the Zoning Code (TMC 18.60.050) and the Tukwila Comprehensive Plan (see DESIGN REVIEW APPLICATION). The SHORELINE MASTER PROGRAM POLICIES and Comprehensive Plan's SHORELINE DESIGN POLICIES are summarized below. Note that more than one category may apply. In some cases, the goal for the use or area is noted to provide context for the design policies. I also have a suggested course of action for our consideration. Here goes: ELI contacted Development services to secure a permit to put their existing temporary overhead fiber optic line underground and thus take their overhead line on Interurban out of service. This would be consistent with their franchaise agreement. The City has granted an extension to ELI to complete this work by October 31, 1998 (Ross Earnst letter to John McCullough of 2.13.98). The ELI representative who contacted development services (first Greg V. for a franchaise permit and then myself as it was not a routine request, but a mile or so of new, non - franchaised alignment) is Bob Knight. I have spoken and met with Bob regarding his proposed alignment, methods etc. They involve new conduits under I -5 along Interurban and then east along the 56th Ave. South, crossing the RR tracks into Renton. Recognising the Interurban corridor is congested, staff says their is no spare conduit, I asked Bob to consider other routes. I advised him of the Ctiy's bridge plans regarding the BNSF yard. That's the end of the FYI info coordination. Now the suggestion: ELI and I have identified an alternative route from their new facility at the Gateway Center /Shepard Ambulance building that is much less invasive, less costly to ELI and may provide a revenue to the City. The alternative route would be from Gateway Center, along green river trail, span river and south on S. 130th.Pl, to RR track crossing and then to Renton. Much shorter, little traffic disprution, less "stuff like fiber optic" in a congested corridor (I- 5 /Interuban) The impetus for this new non franchaised route is the City requirement to "get off the overhead power poles" in Interurban by October, 1998. The City has several options to assist ELI meet their obligations: Approve their proposed Interurban /56th route Require an alternative route to avoid problems with number 1. a) Allow ELI to use trail corridor and span river on a temporary basis b) Design necessary conduits on the BN bridge and charge ELI a fee for use of the bridge. Temporary river span would be removed when BN bridge becomes available. Either option requires a franchaise amendment as neither route is part of the current franchaise agreement. The City needs to respond to ELI permit application for number one or direct them to evaluate option number 2 and submit application for same if they desire.
