The project falls in the Commercial /Light Industrial Zone, right -of -way, and v o
the Low Density Residential zones. No specific development regulations govern o
the installation of fiber optic cable. However, any above ground structures to w w
support the project must meet underlying setback and height limits. 1--
2. The use does not conflict with the goals and policies of the shoreline master Y
program or the provisions of the Shoreline Act and shoreline regulations: 1-

Attachments C and D show details of the proposal, including the method designed
to cross the Duwamish/Green River. The following are Shoreline Master Plan
Policies that pertain to this development:
1. Determine and consider the visual impact that the commercial /industrial
development will have on the surrounding area
2. Shoreline activities identified as being appropriate shoreline uses should be
planned for and encouraged.
a. Short-term economic gain or convenience in develops should be
evaluated in relationship to long -term and potential impairments to the
desirable biological and aesthetic features of the river and shoreline.
b. Preference will be given to those activities which protect and enhance the
desirable features of the river, depend on a shoreline locations, and/or
provide public access to the shoreline.

c. Aesthetic considerations should be encouraged when contemplating a
new development, redevelopment of existing facilities or for general
enhancement of shoreline areas.
The following are Comprehensive Plan Policies that pertain to the proposed
development that occurs in the Shoreline Zone:
• Capital improvement projects and private development are designed, located
and managed in a manner which does not endanger public health, safety,
welfare or capacity of river to provide long -term community benefits. (Policy
5.11.1)
• When overwater structures or structural reinforcement of the riverbank is
proposed, it is necessary for a significant long -term public benefit or water
dependent use (Policy 5.3.3)
As presented, the applicants have proposed a method of crossing the Duwamish
River that is in controversy with the above referenced Comprehensive Plan and
Shoreline Master Plan policies.
3. No structures or accessory facilities shall be located over the river unless such
structures protects or promotes the public interest.

There shall be no disruption of existing trees or vegetation within the river
environment unless necessary for public safety or flood control, or if allowed as
part of an approved shoreline substantial development permit.
No disruption of existing vegetation in this river environment is anticipated, If
any removal of vegetation is required for this project, approval of a Tree Permit
(TMC 18.54) will be required .
S. No effluent shall be discharged into the Green River which exceeds the water
quality classification as established by the State for the adjacent portion of the
river.
No discharge of effluent will occur due to proposal.
6. All States and federal water quality regulations shall be strictly complied with

14. Landfilling is prohibited within the river channel, unless such landfill is
determined by the Planning Commission to protect or promote the public
interest.

15. Notwithstanding any provisions of the Code to the contrary, removal of any
cottonwood tree within the river environment, or the low impact environment,
which tree is 12 inches or greater in diameter as measured 4.5 feet above grade,
shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations.
No removal of vegetation is proposed for this project.
Specific Shoreline Regulations - low impact environment (18.44.150)
The installation of underground fiber optic cable is not specifically governed or regulated,
however other similar types of infrastructure are allowed. This portion of the code also
requires that `utility easements where necessary shall be landscaped with live ground
cover or natural grass cover ".
DECISION
Approval of the application with one condition:
1. To meet the referenced Comprehensive Plan and Shoreline Master Plan policies,
the plan shall be revised to eliminate the proposed aerial crossing. The applicant
shall obtain approval of the Washington State Department of Transportation to
use their bridge crossing the Green River until other facilities crossing at 48th Ave
S. are built by the City of Tukwila or other agencies.

V. SHORELINES DESIGN POLICIES
All projects in the Shoreline Zone must be consistent with Tukwila's Comprehensive Plan and
Shoreline Master Program policies (or King County's Shoreline Master Program if project located
north of the 42nd Avenue bridge). In addition, all structures requiring a building permit (except
single family development of 4. or fewer lots) located in the Shoreline Zone must undergo design
review with the Tukwila Board of Architectural Review (BAR). The BAR's decision is based on design
guidelines contained in the Zoning Code (TMC 18.60.050) and the Tukwila Comprehensive Plan (see
DESIGN REVIEW APPLICATION).
The SHORELINE MASTER PROGRAM POLICIES and Comprehensive Plan's SHORELINE
DESIGN POLICIES are summarized below. Note that more than one category may apply. In some
cases, the goal for the use or area is noted to provide context for the design policies.
NOTE: a) If your project requires a building permit you must meet additional criteria
in DESIGN REVIEW APPLICATION.
b) If your project requires a variance, you must meet additional criteria in

Dear Mr. Larsen:
Your application for a Substantial Shoreline Development Permit with SEPA checklist, as
referenced, has been determined to be complete on July 28, 1998 for the purposes of
meeting state mandated time requirements.
The next step is for you to install the notice board on the site within 14 days of the date of
this letter. You received information on how to install the sign with your application packet.
If you need another set of those instructions, you may obtain them at the Department of
Community Development (DCD). As we discussed, 2 notice boards will be required, one
near the Trail and one near Boeing Employees Credit Union.
Also, you must obtain laminated copies of the Notice of Application to post on the boards.
These notices are also available at DCD. After installing the signs with .the laminated
notices, you need to return the Affidavit of Posting to the our office.
This determination of complete application does not preclude the ability of the City to
require that you submit additional plans or information, if in our estimation such information
is necessary to ensure the project meets the substantive requirements of the City or to

Thank you for the materials and background on this project. At the present time,
DCD has not received a Shoreline Permit application from ELI for the proposed
work. The only open Shoreline Permit application for fiber optic work is for the
Pacific Fiberlink project (L98- 0036), slated to run along East Marginal Way
through Interurban / West Valley and picked up along the Interurban Trail
through Kent.
ELI did have a Shoreline Permit application with SEPA (L93 -0037 / 0038) which
was approved for the area around the East Marginal Bridge crossing the
Duwamish near S. 115th. This application as approved in April, 1994. If any of
the work proposed by ELI falls within 200 feet of the Mean High Water Mark and
is in excess of $2,500, a Shoreline Permit with SEPA application is required.

All projects in the Shoreline Zone must be consistent with Tukwila's Comprehensive Plan and
Shoreline Master Program policies (or King County's Shoreline Master Program if project located
north of the 42nd Avenue bridge). In addition, all structures requiring a building permit (except
single family development of 4. or fewer lots) located in the Shoreline Zone must undergo design
review with the Tukwila Board of Architectural Review (BAR). The BAR's decision is based on design
guidelines contained in the Zoning Code (TMC 18.60.050) and the Tukwila Comprehensive Plan (see
DESIGN REVIEW APPLICATION).
The SHORELINE MASTER PROGRAM POLICIES and Comprehensive Plan's SHORELINE
DESIGN POLICIES are summarized below. Note that more than one category may apply. In some
cases, the goal for the use or area is noted to provide context for the design policies.
NOTE: a) If your project requires a building permit you must meet additional criteria
in DESIGN REVIEW APPLICATION.
b) If your project requires a variance, you must meet additional criteria in
VARIANCE PERMIT APPLICATION.
c) If your project requires a conditional use permit, you must meet additional
criteria in CONDITIONAL USE PERMIT APPLICATION.
TUKWILA SHORELINE MASTER PROGRAM POLICIES (King County shoreline policies follow)
A. ECONOMIC DEVELOPMENT ELEMENT
1. CommerciaVindustrial development along the shorelines should not favor outside interests at
the expense of the local population.
2. Locate commerciaVdevelopment in areas with low potential for recreation or other
public uses.
3. Preference should be given to commercial /industrial development that will provide an
opportunity for a substantial number of people to enjoy the shoreline.

Subject: ELI Interurban undergounding alternatives

Gentlemen, this note is intended to share some info that I have on an issue
that is within several areas of responsibility. I also have a suggested course
of action for our consideration. Here goes:
ELI contacted Development services to secure a permit to put their existing
temporary overhead fiber optic line underground and thus take their overhead
line on Interurban out of service. This would be consistent with their
franchaise agreement. The City has granted an extension to ELI to complete
this work by October 31, 1998 (Ross Earnst letter to John McCullough of
2.13.98).
The ELI representative who contacted development services (first Greg V. for a
franchaise permit and then myself as it was not a routine request, but a mile
or so of new, non - franchaised alignment) is Bob Knight. I have spoken and met
with Bob regarding his proposed alignment, methods etc. They involve new
conduits under I -5 along Interurban and then east along the 56th Ave. South,
crossing the RR tracks into Renton.
Recognising the Interurban corridor is congested, staff says their is no spare
conduit, I asked Bob to consider other routes. I advised him of the Ctiy's
bridge plans regarding the BNSF yard.
That's the end of the FYI info coordination. Now the suggestion:
ELI and I have identified an alternative route from their new facility at the
Gateway Center /Shepard Ambulance building that is much less invasive, less
costly to ELI and may provide a revenue to the City.
The alternative route would be from Gateway Center, along green river trail,
span river and south on S. 130th.Pl, to RR track crossing and then to Renton.
Much shorter, little traffic disprution, less "stuff like fiber optic" in a
congested corridor (I- 5 /Interuban)
The impetus for this new non franchaised route is the City requirement to "get
off the overhead power poles" in Interurban by October, 1998. The City has
several options to assist ELI meet their obligations:
Approve their proposed Interurban /56th route
Require an alternative route to avoid problems with number 1.
a) Allow ELI to use trail corridor and span river on a temporary basis
b) Design necessary conduits on the BN bridge and charge ELI a fee for
use of the bridge. Temporary river span would be removed when BN
bridge becomes available.
Either option requires a franchaise amendment as neither route is part of the
current franchaise agreement.
The City needs to respond to ELI permit application for number one or direct
them to evaluate option number 2 and submit application for same if they
desire. For ELI to evaluate option 2, they will need to know a cost for the BN
bridge crossing.
WHAT IS THE CITY PREFERENCE REGARDING THESE OPTIONS? WHAT FEE OR COST WOULD BE
ASSOCIATED WITH THE BN BRIDGE CROSSING?

1 have reviewed your letter requesting extension of the temporary waiver for overhead service on
Interurban Avenue South. 1 am also aware of your efforts to complete permitting for the alternate route
for this service and your need to revise those plans to accommodate a new switching office at Gateway
Corporate Park.
Based on this review and your demonstrated progress towards removing the overhead service on
Interurban Avenue South,1 hereby grant you an extension to your existing waiver which shall remain in
effect from January 1st 1998 through October 31, 1998, inclusive in accordance with Section 3.D. of
your Franchise (Tukwila Ordinance No. 1764).
Pleas provide the City Engineer, Brian Shelton, with the appropriate plans and documentation so his
staff can process the Franchise Utility Permit for your conversion work along interurban Avenue South
from Gateway Drive to the 1 -405 right -of -way. Be aware that we do not anticipate that you will conduct
any surface trenching for the installation of services on those portions of Interurban which have been
recently reconstructed. We also anticipate that you will avail yourself of any City-owned conduit for
these recently improved sections of Interurban Avenue South per Section 3.1. of your Franchise as
specified in Tukwila Ordinance No. 1764.

Enclosed is a permit application for our proposed installation that will enable us to remove the
overhead fiber cable existing on Interurban Avenue per our previous agreement with the City.
The work proposed includes a temporary overhead crossing of the Duwamish River as
recommended by Gary Barnett of the City Engineer's office. Our plan is to re -route this cable in
the proposed 48th Avenue bridge, when constructed, then remove the temporary river crossing.
As part of the application ELI is aware that there will be temporary disruption of traffic along
S. 130th Place where we plan an underground installation. Traffic route revision and scheduling
will be discussed with the City prior to start of construction by our contractor, Standard Utility
Contractors Our tentative construction window is anticipated to be between August and October
of this year. Traffic revisions on S. 130th Place should be required for three to five days.
Traffic re- routing should be required for the underground conduit system installation only.
The placement of the fiber cable in the conduit will require minor flagging to assist motorists.
We are also in the process of preparing a application for a Shorelines Substantial Development
Permit to be submitted to the City. Eclipse Engineering is preparing the Shorelines application on
behalf of ELI. Please call if you need further information or you would like to drive the proposed

This permit is valid for 90 calendar days from the date of approval as shown below. The applicant shall
comply with all State and local laws or ordinances. The applicant shall save the City harmless from any and all
damages which may accrue to any person or property because of this installation or the maintenance thereof.
Work performed under this permit shall adhere to the following:
1. 24 hours prior to construction, the contractor shall notify City Inspector Greg Villanueva at 433 -0179.
2. 'Prior to construction, all utilities in the vicinity shall be field located. NOTE: For City of Tukwila
utility locates, call One -Call at 1 -800- 424 -5555.
3. Detours within the public right-of-way shall be in accordance with the current edition of the Manual
on Uniform Traffic Control Devices. A traffic control plan shall be submitted for prior approval if
requested by the City Inspector.
For work within a public street, no open cut is allowed unless specifically approved.
The utility contractor shall carry a minimum of $1,000,000 liability insurance (personal injury,
property damage), and be licensed in the State of Washington to carry out this kind of work.
