This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170. At their September
24, 1998 public hearing, the Planning Commission approved the applicant's request for an Enhanced
Specialized Mobile Radio (ESMR) Base Station comprised of 6 antennae attached to a monopole with
associated operating equipment located in an adjacent structure. The Planning Commission approved the
Conditional Use Permit with the following conditions:
The painted parking island and two parking spaces to the south of the facility shall be
removed and repainted to accommodate emergency vehicles, to be approved
administratively prior to the approval of a building permit.
The applicant may add up to a total of two additional antennae on the two array
approved in this application. If additional antennae or array are proposed at a later date,
another Conditional Use Permit will be required.

FINDINGS
Vicinity /Site Information
Project Description
The applicant is requesting Conditional Use Permit approval to install an
Enhanced Specialized Mobile Radio (ESMR) Base Station at 15820 Pacific Hwy S.
The applicant is proposing the initial installation of 6 antennae, to be located at a
height of 40 feet on an existing monopole, with the possible addition of 2
additional antennae within the 2 array indicated in their application. Associated
operating equipment will located adjacent to the monopole.
Existing Development
The site is currently occupied by a theater /restaurant complex and a
telecommunications monopole.
Surrounding Land Uses
The surrounding properties are zoned Regional Commercial, Low Density
Residential and High Density Residential. The predominate uses in the area are
commercial to the west and south while single and multi- family are located to
the east. State Route 518 is located to the north.
BACKGROUND
The applicant is requesting co- location of their antennae and operating
equipment at a monopole previously approved for Western Wireless at a
December 11, 1997 hearing under file L97 -0055. The Western Wireless monopole
required Conditional Use Permit and SEPA approval. When originally
approved, the Planning Commission required that the monopole be designed to
accommodate additional telecommunication carriers.
As this application is for new antennae to the previously approved monopole,
this application only requires Conditional Use Permit approval. If the applicant
was proposing a separate support structure in excess of 60 feet in height, SEPA
approval would also be required.
CONDITIONAL USE CRITERIA
The proposed project must conform with criteria detailed in TMC 18.64.050, (1 -5),
concerning Conditional Use Permits:

(1) The proposed use will not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity of the proposed use or in the district in which the
subject property is located.

The applicant has included site plans (Attachments A and B), elevations of the `11-
antennae on the monopole (Attachment C) and computer generated photographs w
(Attachment D) showing the proposed location of the antennae in relation to the
monopole. The facility is telecommunications equipment that fall within the 0 o
safety parameters set by the American National Standards Institute (ANSI). ; w

(2) The proposed use shall meet or exceed the performance standards that are required in the U)
district it will occupy.

The mounting height will be approximately 40 feet. The placement of ground
equipment will require the removal of 4 parking spaces. The applicant is I W
requesting 6 antennae with the possible addition of 2 antennae on the two array z
indicated in their application materials. Both the 6 antennae requested in this z o.
application and the two future antennae appear to be of the same dimensions. w w

(3) The proposed development shall be compatible generally with the surrounding land uses in I-

terms of traffic and pedestrian circulation, building and site design. _

As with similar uses, the base station will generate trips during the construction Z
period and, following the completion of construction, up to 1 trip per month for o
maintenance. The fire department has indicated that the attached plans do not 0 I
adequate access to the monopole and related equipment facilities, unless z
the access area is increased to a minimum of 20 feet on all sides.
No other impacts to pedestrian or transportation movements are anticipated. A
concrete pad and shelter for operating equipment will be constructed. The pad
and shelter will be located west of the operating equipment pad for the
previously approved monopole and will be located behind screened fencing.
(4) The proposed use shall be in keeping zvith the goals and policies of the Comprehensive Land
Use Policy Plan
This project must comply with the following Comprehensive Plan policies and
meet necessary Zoning Code regulations.

12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of
facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure
and use of existing structures. The applicant is proposing antennae that will be
located on a previously approved monopole. As indicated above, the monopole
was approved at the December 11, 1997 Planning Commission hearing. To
minimize visual impacts associated with this project, the applicant has indicated
that a similar antennae mounting will be used to match the Western Wireless
antennae mounting. The antennae will also be painted to complement both the
monopole and the existing antennae.
5) All measures have been taken to minimize the possible adverse impacts which the proposed
use may have on the area in which it is located.
The applicant has applied for a co- location on an existing monopole in lieu of
proposing an additional support structure for their antennae. All ground level
operating equipment will be located behind a fenced and gated enclosure.
CONCLUSIONS
Staff makes the following findings and conclusions under the city's Conditional Use
Permit criteria (TMC 18.64.050):
(1) The proposed use will not be materially detrimental to the public welfare...
Potentially hazardous operating equipment is inaccessible to the public. The proposed
antennae will be located on a structure previously approved for wireless facilities. The
associated technology is within federal safety guidelines.
(2) The proposed criteria shall meet or exceed the performance standards...
The applicant is within the allowed height. The equipment shelter is outside of the
required setback area. The reduction of parking spaces to accommodate the shelter will
not bring the facility below its minimum parking requirement of 1 parking space per 4
fixed seats, excluding all service areas in the building. The addition of two antennae in
the future on the two proposed array will not create any additional impacts to this
facility. No other development standards apply.

(3) The proposed development shall be compatible generally with the surrounding...
The reduction and replacement of the striped parking island and 2 parking spots to the
south of the monopole will improve access for emergency vehicles and, based upon
staff review of the minimum parking requirements for this facility, will not reduce their
parking below minimum parking standards. No other impacts to the transportation
system are anticipated. The facility is compatible with other land uses in its zone. All
operating equipment is located an adequate distance from on -site circulation.
(4) The proposed use shall be in keeping with the goals and policies...
The project will have the necessary electrical services for its operation. The applicant is
locating on a previously approved monopole. Visual impacts are minimized by using a
similar mounting to the other wireless carrier.
(5) All measures have been taken to minimize the possible adverse impacts...
The antennae are being mounted on an existing structure. All operating equipment will
be located in a building and screened behind a slatted fence.
RECOMMENDATIONS
Staff recommends approval of the Conditional Use Permit with the following condition:
The painted parking island and two parking spaces to the south of the facility
shall be removed and repainted to accommodate emergency vehicles, to be
approved administratively prior to the approval of a building permit.
The applicant may add up to a total of two additional antennae on the two array
approved in this application. If additional antennae or array are proposed at a
later date, another Conditional Use Permit will be required.

Number L98 -0048, to establish an Enhanced Specialized Mobile Radio (ESMR) Base
Station, comprised of 8 antennae attached to an existing 100 foot monopole, with
an equipment building for associated operating equipment adjacent to Lewis and
Clark Theaters, 15820 Pacific Hwy S.

requirements. The project has been assigned to Michael Jenkins and is tentatively scheduled for a public
hearing before the Planning Commission on September 24, 1998.
The next step is for you to install the notice board on the site within 14 days of the date of this letter. To
ensure that this application receives an expedited hearing on September 24, 1998, the notice board must be
erected and the notice posted by September 3, 1998. You received information on how to install the sign
with your application packet. If you need another set of those instructions, you may obtain them at the
Department of Community Development (DCD). Also, you must obtain a laminated copy of the Notice of
Application to post on the board. This notice is also available at DCD. After installing the sign with the
laminated notice, you need to return the signed Affidavit of Posting to the our office.
This determination of complete application does not preclude the ability of the City to require that you
submit additional plans or information, if in our estimation such information is necessary to ensure the
project meets the substantive requirements of the City or to complete the review process. I will be

PROJECT DESCRIPTION
Nextel Communications (Nextel) seeks to expand its Pacific Northwest Enhanced Specialized
Mobile Radio (ESMR) network to include the proposed Riverton Heights area collocation site.
The proposed site is located at 15820 Pacific Highway South, Tukwila, Washington 98188. The
property is zoned RC — Regional Commercial District and has a RC — Regional Commercial
comprehensive plan designation.
The proposed communications facility would involve the collocation of wireless
telecommunications antennas on an existing 100' monopole currently operated by Western
Wireless. It would include attachment of six directional sector panel antennas at the 40' level on
the monopole and placement of an 11' x 20' prefabricated concrete equipment shelter within an
18' x 30' leased area immediately adjacent to and west of the existing Western Wireless
monopole and lease area. The shelter would be used to house radio transmitters, receivers and
other essential equipment. Mounted on the equipment shelter, would be two (2) receive -only
Global Positioning System (GPS) antennas, which are 2" high x 4" wide x 4" long disks. One of
the GPS antennas would be operational; the second antenna would be for backup purposes. One
test mobile antenna would be mounted on the cable bridge. The test mobile antenna is low gain
and is 4" high x 8" long x 4" wide. It is used for site monitoring and diagnostic purposes only.
A six -foot high chain link fence with privacy slats and topped with three strands of barbed wire
would surround the facility. The facility would be remotely monitored for fire, smoke, intrusion
and AC power failure by Nextel's 24 -hour electronic surveillance system.
The facility may be expanded in the future to include up to two additional directional sector
panel antennas in addition to the six proposed panel antennas, for a total of eight antennas. There
is no anticipated change to the dimensions of the equipment shelter. Expansion of the facility is
not a certainty, but is dependent upon customer demand and /or technological change.
The proposed facility will not interfere with surrounding properties or their uses. Due to its
extremely low power, this facility will not be a source of interference with electronic equipment,
including radios, televisions and telephone transmissions. Non- interference is ensured by the
Federal Communications Commission (F.C.C.) regulation of radio transmissions. The site will
be unmanned and, therefore, will not require water, waste treatment or management of
hazardous waste.
The proposed communications facility will be unnamed and no hazardous materials are to be
utilized or stored at the site. Back -up power supply will consist of gel -type "Non- Spillable" type
batteries located within the equipment shelter. The batteries are an absorbed electrolyte design
that is spill -proof and leak - proof. The electrolyte will not flow from a ruptured or cracked case.
The batteries will provide approximately eight hours of back -up power.
Access to the site would be provided from an existing paved parking area immediately adjacent
to the Western Wireless facility. Minimal traffic would be generated during the construction
phase while the crew is traveling to and from the site. After construction is completed, there
would be approximately one visit per month by a Nextel field engineer for routine maintenance.

Nextel and ESMR
Nextel is the largest domestic operator of ESMR systems in the United States. ESMR is an
advanced form of wireless communications, which offers a combination of features and services
not previously available from cellular telephone or other wireless communications companies.
The integrated digital communications system combines a digital cellular phone, group
communication, a two -way radio, and an alphanumeric pager and voice mail in one handset. • z

Like cellular telephone calls, ESMR calls are handed off from one facility to another as the caller 6
moves through the area. This allows for reuse of a finite number of frequencies at low power v o
levels. co o

Need and Purpose for the Proposed Facility • I

Nextel is continuing to build out its Pacific Northwest ESMR network, in compliance with the
requirements of its FCC license. The need for a new site is dictated by market demand, capacity,
coverage requirements for a particular geographic area, and the radio frequency hand -off from N a
one site to another in order to achieve the objective of seamless communications coverage. Once I
the need for a new ESMR site in a particular geographic area has been established, Nextel's z
system engineers identify a target area, or "search ring," in which to locate the facility. z g

The required site location and antenna height is determined by a propagation study. This study o
evaluates the expected radio - frequency (RF) signal from the proposed site at a given location and p co
height. The RF signal must be strong enough to provide adequate coverage within the desired
coverage area. _ 0

The selection and design of a specific ESMR site is further refined by considering local z;
topographic and geographic factors, tree canopy, buildings, mountains, water bodies, the ability o u).
to mitigate the antenna support structure's visual impact, compatibility of the facility with i= 0
existing land uses, and the ability to negotiate a mutually beneficial lease with a landlord. z
Because ESMR signals must travel in an unobstructed path from the facility to the user, the
presence of any one or all of these can negatively influence the quality of transmissions and
reception. The height and location of each Nextel site is, therefore, based upon the ability of the
site to effectively function despite those obstacles. In addition, Federal Aviation Administration
requirements regulate the height of an antenna support structure near or on major airport
facilities.
The purpose of the proposed Riverton Heights area facility is to provide in- vehicle coverage of
Highway 99 between 146 °i Street and 160 °t Street and coverage on Highway 518 from 154 °i west
to the Airport Access Freeway. The proposed facility would "hand off' calls to Nextel sites
which exist in South Seattle to the north, Bryn Mawr to the east and SeaTac to the south. It is
crucial for Nextel to have adequate coverage in the Riverton Heights area in order to serve
customers in compliance with its Federal Communications Commission (FCC) license
obligations.

Nextel Communications believes that the request for a Conditional Use Permit to collocate a
communications facility on an existing monopole satisfies the following criteria as specified in
TMC 18.64.030:

Response: The proposed use will not be materially detrimental to the public welfare.
The facility would operate at 806 to 821 and 851 to 866 Megahertz (MHz).
Transmissions would be low power (average of 50 watts per channel) with a
maximum of twenty channels per antenna. As such, the transmissions would be an
average of less than 1% of the Federal Communications Commission (FCC) and the
American National Standards Institute (ANSI) standard set forth in IEEE /ANSI
C95.1 -1992, of 567.3 microwatts per square centimeter. In addition, due to its
extremely low power, this facility would not be a source of interference with
electronic equipment, including radios, televisions and telephone transmissions. The
proposed tower would be secured by a chain -link fence, and therefore, would limit
potential contact by unauthorized individuals. In addition, the associated radio
equipment would be placed within an 11' x 20' shelter.
The proposed project would not be injurious to the property or improvements in the
vicinity of the proposed use or in the district in which the subject property is situated.
The proposed project would be located within a Regional Commercial (RC) District.
According to Chapter 18.24.010 of the City of Tukwila Zoning Code, the Regional
Commercial (RC) District is "...intended to provide for areas characterized by
commercial services, offices, lodging, entertainment, and retail activities with
associated warehousing, and accessory light industrial uses, along a transportation
corridor and intended for high- intensity regional uses... ". The proposed facility is an
expansion of Nextel Communication's Pacific Northwest Enhanced Specialized
Mobile Radio (ESMR) network intended to provide a wireless commercial service to
the public. The proposed facility would not interfere with surrounding properties in
the vicinity or their uses. The facility is low power, does not produce frequent traffic
and does not generate noise. The facility will utilize an existing monopole already
approved by the City of Tukwila and is located immediately adjacent to the Highway
518 Corridor. The proposed site location is surrounded by properties with the same
zoning designation, Regional Commercial (RC). The following specifies the adjacent
uses:
North: State Highway 518.
South: Theater, Bowling Center and associated parking.
East: State Highway 518 Corridor.
West: Pacific Highway South (Highway 99) and parking.

uses in terms of traffic and pedestrian circulation, building and site design. z f'
Response: The proposed project is compatible with the surrounding land uses in
terms of traffic and pedestrian circulation. The site would be unmanned, and
therefore, would not create frequent vehicle or pedestrian traffic. After construction
is completed, there would be approximately one visit per month by a Nextel field
engineer for routine maintenance. In addition, the proposed project is compatible
generally with the surrounding land uses in terms of building and site design. The
antennas will be mounted on an existing monopole and have been designed to blend
in with the commercial nature of the area. The proposed antennas are proposed at the
minimum height necessary to meet the radio coverage objectives for this facility. The
proposed radio equipment would be placed within an 11' x 20' shelter surrounded by
a chain -link fence with privacy slats to further reduce visibility.

4. The proposed use shall be in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan.
Response: The need and demand for this facility is discussed in detail on page 2 of

The proposed project is an expansion of the Nextel Communications Pacific w o
Northwest Enhanced Specialized Mobile Radio (ESMR) network. The purpose of the
proposed site is to provide a commercial service (wireless coverage) to the public
traveling through and within the surrounding area. The proposed coverage would be = a
provided for Nextel subscribers using wireless phone service within their vehicles or z F-
on foot (in- building coverage). Nextel's service will support the desired high quality F. p.
economic environment for the area. The two -way radio feature has been especially w w
important to businesses that rely on dispatch services, such as warehousing and n o
distribution uses. Having this high- quality wireless service available to businesses in p 92.
Tukwila, as well as their suppliers and customers, strengthens the Transportation ° u

Corridor, enhancing the area as good place to locate a business. The proposed project v
would be in keeping with the goals and policies of the Comprehensive Land Use w o

Further, the following Comprehensive Land Use Policy Plan applies to Utilities as o '—

12.1.34 General Policies. Actively coordinate project implementation with
individual utilities based upon Tukwila's Comprehensive Plan and development
regulations.
12.1.35 General Policies. Encourage utilities to consolidate facilities and
minimize visual impacts of facilities where technically feasible.
The proposed project would utilize existing electrical and telephone services provided
by Seattle City Light and U.S. West respectively. Nextel Communications
encourages facility collocation and will locate its antennas on an existing monopole
currently operated by Western Wireless in order to reduce visual impact without
compromising the radio coverage objectives. The proposed radio equipment would
be placed within an 11' x 20' shelter surrounded by a chain -link fence with privacy
slats to further reduce visual impact to the area.

5. All measures shall be taken to minimize the possible adverse impacts that the proposed
use may have on the area in which it is located.
Response: The location for the proposed tower has been selected in an effort to pose
the least amount of impact to the existing regional commercial nature of the area. The
proposed facility will make use of an existing monopole for antenna attachment at a
minimum height necessary to meet the radio coverage objectives. Utilization of an
existing monopole will eliminate the need for an additional monopole in the area and
reduce the visual impact for adjacent uses. Equipment associated with the use will be
in a secured area and screened from the view of adjacent uses.
