ACTION SATISFIES THE SHORT PLAT COMMITTEE DECISION CRITERIA
(BELOW):
1. Create legal building sites with respect to zoning and health regulations;
2. Establish access to a public road for each segregated parcel;
3. If adjacent to another municipality or King County, take into consideration the subdivision standards
of that jurisdiction, as well as the requirements of this code;
4. Make adequate provision for drainageways, streets, alleys, other public ways, water supplies and
sanitary wastes as deemed necessary;
5. Comply with Chapter 17.20, Design Standards for the Subdivision of Land, and Chapters 17.24
and Chapter 17.28, Minimum Standards for Residential Subdivision Design and Minimum
Standards for CommerciaVIndustrial Subdivision Design, respectively;
6. Actions by the applicant to get a boundary line adjustment or short subdivision shall not result in
the inability to derive reasonable economic use of the property or create an undevelopable lot under
Section 18.45.115, unless that lot is to be dedicated for exclusive use as open space or common
tract.
The proposed 2 lot short plat will provide for a separate vacant building site for
placement of a single family home to be moved to site which satisfies the MDR
zoning for use and lot sizes.
Both parcels will access by private road to the public road of 142 Street South.
Existing driveway surface will be provided with all weather surface material to
required width sloped to natural contour of existing driveway (included design) with
utility easement. There will be sewer easement for the east side for access to Lot A.
Per preliminary meeting and information a single family home can be placed on the
newly created vacant lot without further design decisions. The owner owns a single
family home that will be moved to the site when short plat is completed.
The existing duplex will remain on Lot B.

Dear Mr. Smith:
This letter is a follow -up to recent discussions regarding our denial letter dated November 19,
1998. Upon review of the circumstances involved with this file, we will continue the processing of
your short plat application. We have assigned a new file number (L98 -0097) which is referenced
above. The balance of this letter provides the information you will need to provide before the
short plat request can be finalized.
The Short Plat Subdivision Committee has completed a detailed review of the short plat
application you submitted on behalf of your client, J. Mark Nickels, Based on your submittal,
preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the short plat process: Preliminary Approval, Final Approval and
Recording. These three steps and their requirements are described as follows:
1, Preliminary Approval
PRELIMINARY APPROVAL CONDITIONS
General
a. A cover page for the short plat document must be submitted and reflect the format of the
sample cover sheet (copy enclosed). This cover page must show the legal description
before and after the short plat. Please note: any legal descriptions must be shown on
this page. rather than referencing an attachment. You may use the attached copy or
create your own document (so long as you duplicate the form and allow adequate
margins for recording purposes). The legal descriptions shall be prepared by a licensed
land surveyor or title officer.
b. All required common improvements must be constructed by the owner of the property (J.
Mark Nickels) and must be accepted by the city or a bond posted by the owner for
construction of same, prior to the short plat being filed (TMC 17.08.080). Said bond shall

This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Plat Committee and approved with conditions. The conditions imposed are
to ensure that the short plat is consistent with the City's policies and regulations.

be in an amount equal to 150% of the estimated cost of complete construction of such
improvements as determined by the Director of Public Works.
Site Survey Requirements ~ W

c. The 8 -1/2" x 14" survey which you provided must be adjusted slightly to appear in a -J 0
recordable form (these requirements appear below). Please resubmit the site survey so
that it is consistent with all of the conditions of approval stated in this letter. w =

Th e site survey must have adequate margins meeting King County recording co w
requirements. According to the rules of King County Recorder's Office, a one -inch w O
margin must be kept clear along the sides and bottom of any page to be recorded. The
top of the first page of any document to be recorded must retain a three -inch clear margin,
while the top of any subsequent pages must retain a one -inch clear margin. co =a

d. The easement for ingress, egress and utilities shall serve both Lots A and B. A portion of w O

this easement will be located on Lot B (to serve Lot A) and a portion of the easement will ?
be located on Lot A (to serve Lot B). This easement will extend in a southerly direction to U

outh 142nd Street. The paved portion of the access road must be 20 feet in width and O

Lot Access
its thickness shall consist of 2 inches of asphalt on 4 inches of 5/8 minus crushed rock. w w
e. The access road shall be sloped a maximum of 15% and any turning radii shall be a t 0
minimum of 5 feet. Per TMC 17.20.030(C)(5)(d), private access roads cannot exceed z
200 feet in length. Those private access roads 150 feet or greater in length shall have a v co —
turnaround built to Fire Department standards. A vertical clearance of 13.5 feet shall be o = '
required for fire truck access along the length of the access road. z
f. The face of the short plat shall contain a statement that Lot A shall be fully responsible for
the maintenance of the 20 foot wide access road.
Sewer
g. The 5 -foot sanitary sewer easement (shown on the plan stamped by Ellisport
Engineering) must be increased to be a minimum of 10 feet in width. This 10 foot
easement must be shown on the site survey.
h. The note referencing a "new 6 -inch side sewer" is not a sanitary sewer but rather a
private sewer main extension and will require a structure at the property line. Please
contact the Val Vue Sewer District at 206 - 242 -3236 for more information regarding this
requirement.
Water
As there is no fire hydrant within 250 feet of all building sites, the developer shall either
install a fire hydrant capable of a 1000 gallon per minute flow OR the future houses will be
required to provide interior sprinklers, to be approved by the Fire Department. This,
condition must appear on the face of the short plat.

The water main located at South 142nd Street has been identified as deficient for future
area service. The applicant shall execute a Water Proportional Share Agreement (copy
attached). This document will be recorded with the short plat.
k. If a future house on Lot A uses interior sprinklers, a 1 -inch water meter will be required.
Storm Drainage
As a condition of short plat approval, a storm drainage system shall be installed to pick up
drainage from the access road and the roof downspouts of any future structure. This
storm drainage system shall be tight lined to the existing storm drainage system in South
142nd Street. An additional storm drainage stub -out shall be installed for the existing
structure on Lot B.
Expiration
m. Your application for a short plat will expire if it has not been recorded within one year from
the date of approval. Upon written request from the applicant prior to the expiration date,
the Short Subdivision Committee is authorized to grant one extension, not to exceed six
months.
2. Final Approval
The next step is to submit the necessary short plat documents indicated above and
comply with all the conditions of approval. After the documents have been found to be in
order and all of the requirements of the short plat have been met, the Short Subdivision
Committee will grant final approval.
3. Recording
It is your responsibility to record the City approved short plat documents with the King
County Department of Public Records. The short plat is not complete until the recording
occurs and copies of the recorded documents are provided to the Department of
Community Development. You will need to pay the recorded fees and submit your
approved original short plat to the King County Department of Records (206- 296 - 1570).
After recording, the County returns the recorded original to the City of Tukwila within 4 to
6 weeks, at which time your short plat is considered complete. You can shorten this
processing time by hand - delivering a copy of the recorded short plat to the undersigned.
Additional Comments
As a courtesy, we are providing you with additional, preliminary information. Although it is not a
definitive list, you may wish to review and consider this information. A Miscellaneous Permit
Application will be required for all required common improvements. We have enclosed the permit
application and the requirements checklist for your reference. Please be advised that the 10 -foot
sanitary sewer easement must also appear on this application site plan.

1. On your proposed site plan, Lot A has been configured as a flag lot. Per TMC 17.20.0 0(F)(1),
flag lots are prohibited.
2. The property is located in the MDR (Medium Density Residential) Zone. The minimum I size in
this zone is 8,000 square feet. With the elimination of the flag portion of Lot A, the lo is only
6,192 square feet in size. If the rear property line of Lot B is moved 10 feet to the south, the size
of Lot A is only 7,052 square feet in size.

gations hereunder shall cease and terminate six (61 months after the effective date hereof or when the policy or policies
committed for shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault
of the Company. This Commitment shall not be valid or binding until countersigned by an authorized officer or agent.

countersigned by an authorized officer or agent of the Company, all in accordance with its By-Laws. This Commitment

Conditions and Stipulations
1, The term "mortgage;' when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect. lien. encumbrance, adverse claim or other
matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown
in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing. the Company shall be
relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company
is prejudiced by failure to so disclose such knowledge. If the proposed Insurt'd shall disclose such knowledge to
the Compary, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance,
adverse claim or other matter, the Company at its option may amend Schedule 13 of this Commitment accordingly,
but such an'endment shall not relieve the Company from liability previously Incurred pursuant to paragraph 3 of
these Condit ions and Stipulations.
3. Liability of the Comoanv under this Commitment shall be only to the named proposed Insured and such parties
included under the definition of Insured in the form of policy or policies committed for and only for actual Toss
incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof. or (b) to

covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the
