PROJECT BACKGROUND AND DESCRIPTION The applicant originally submitted an incomplete Shoreline application in December, 1998. In early 1999 the City enacted an eighteen -month moratorium on mini - casinos which was not lifted until June, 2000. The Shoreline application was finally deemed complete in January, 2001. Several revisions of the plans have been submitted since that time. The visual impacts of the proposal will be evaluated by the Tukwila Board of Architectural Review during a public hearing tentatively scheduled for August 23, 2001. This review will include building and site design, landscaping and lighting. Based on the applicant's latest plan revisions, the proposal is to convert two existing buildings (an automotive parts store and a manufacturing facility) into a mini - casino (containing a restaurant, lounge and banquet facilities). A new addition to the two existing buildings will result in the creation of one building with a footprint of approximately 15,300 square feet. A portion of the existing manufacturing building will be demolished to remove it from the 40 -foot River Environment. The property's riparian edge will be landscaped. In accordance with the provisions of Tukwila's Shoreline Overlay (TMC 18.44.140(B)(3)) a six -foot fence will screen parking, loading and storage facilities from the river. 2. POLICIES OF THE SMA The site is within the jurisdiction of the City of Tukwila Shoreline Master Plan ( "SMP "). The policies of the SMP are categorized into the following elements: A. The Economic Development Element requires that development be economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. B. The Public Access Element requires that the development provide for public access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses and allow for multiple uses. F. The Conservation Element requires that the river be buffered from the effects of development, where feasible facilities for intensive recreational activities should be provided and scenic views should be protected. G. The Historical /Cultural Element requires areas having historical, cultural, educational or scientific value be protected, restored and made accessible to the public. The proposed project is consistent with the goals and policies of the SMP, especially the protection, enhancement and buffering of natural shoreline resources. The segment of the Green River Trail bordering the western edge of the subject property will be enhanced. The development will not adversely affect existing public access, circulation, recreation or land use along the shoreline. The visual impact of the development on the surrounding area will be evaluated by the Board of Architectural Review during a public hearing to be held August, 2001. There are no known historical or cultural areas of value on the site. 3. TUKWILA SHORELINE REGULATIONS The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay Zone (TMC 18.44): The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. This district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows uses permitted in the underlying zoning district. A portion of the existing manufacturing building will be demolished to remove it from the 40 -foot River Environment. Landscaping has been proposed for the River Environment (running along the eastern 40 feet of the property). The work to be performed in the River and High Impact Environments includes the conversion of two existing buildings (an automotive parts store and a manufacturing facility) into a mini - casino (containing a restaurant, lounge and banquet facilities). A new addition to the two existing buildings will result in the creation of one building with a footprint of approximately 15,300 square feet. Jack Pace Grand Central Casino (L98 -0102) July 27, 2001 Page 3 TMC 18.44.110 - General Shoreline Regulations All uses within the Shoreline Zone must conform to the following general regulations: (1) The use is in conformance with the regulations of the underlying zone district. Response: Grand Central Casino will be located in the Commercial /Light Industrial ( "C /LI ") zone and under Tukwila Ordinance 1917 is an allowable use at that location. (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. (3) Response: No conflicts were identified. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. Response: No structures or accessory facilities shall be located over the river under this permit. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit. Response: The applicant has proposed that the invasive vegetation currently existing in the 40 -foot River Environment (running along the entire eastern property line) be replaced with a variety of trees and groundcover. No trees currently exist in this portion of the site. As a result, the existing low -value habitat will be significantly enhanced. (5) No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. (6) (7) Response: The Green River has a water quality designation of Class A. The project will not discharge effluent into the river. All State and Federal water quality regulations shall be strictly complied with. Response: The project will comply with all State and Federal water quality regulations. Wildlife habitat in and along the river should be protected. Response: In the 40 -foot River Environment, the applicant has proposed a scattered planting of Scarlet Maple, Flowering Ash and Sweet Gum with Kinnikinnick as a groundcover. We believe that an opportunity exists to create a riparian edge of high habitat value which will be protected from public access and buffered from public view. To accomplish this, an evergreen visual buffer should be created on the riverward side of the buildings. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. Landscaping will consist of a variety of trees, shrubs and groundcover along 40 -foot River Environment. All necessary permits shall be obtained from Federal, State, County or municipal agencies. Response: Responsibility of the applicant. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. w w' U 0:. Z 1— Response: The proposed project will be located within the River Environment, Low Impact Environment and High Impact Environment. The proposed use at the site is allowed in the High Impact Environment. 4. COMPREHENSIVE PLAN SHORELINE POLICIES The policies of the Comprehensive Plan that affect shoreline development are found in the Shoreline Element. Shoreline Element Development should minimize impact on important habitat features, protect and restore degraded riverbanks and mitigate unavoidable disturbance of vegetation and habitat. Development should minimize water pollution, provide erosion control and protect water quality. Capital improvement projects and private development should not endanger public health, safety, welfare or the capacity of the river to provide Tong -term community benefits. Jack Pace Grand Central Casino (L98 -0102) July 27, 2001 Page 5 Over -water structures or reinforcement of the riverbank allowed only when it provides Tong -term public benefit or is essential to a water - dependent use. • Development should reflect the river's role in Tukwila history, protect the Tong -term public use of the river and reflect community traditions. Development should include high - quality site planning, architecture, landscaping, provide for open space and provide a trail for public access along the river (for areas included in the Green River Trail Plan). ▪ Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses and encourage efficient use of the land. The project will protect and improve the habitat value of the riverbank. Water quality will be protected during project construction through the use of Best Management Practices to prevent erosion and sedimentation. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. No over -water structures are proposed under the permit. The site plan, architecture and landscaping of the proposed development will be evaluated by the Board of Architectural Review during a public hearing tentatively scheduled for August 23, 2001. As part of the City- approved Green River Trail program, the trail leaves the river at a point north of the Foster Links Golf Course and runs parallel to interurban Avenue in a southerly direction. The trail rejoins the river at a point south of the Riverside Casino. The proposed development is located immediately north of the Riverside Casino. Due to the nature of previous development and the river's distance from the existing trail, no public access or views of the water exist or will be created on the site of the proposed development. 5. SEPA A Determination of Non - Significance was issued on July 10, 2001 and posted on July 12, 2001. The comment period expired on July 27, 2001 without receipt of any comments. 6. RECOMMENDATION Staff recommends approval of the Shoreline Substantial Development Permit with the following conditions: a. A variety of exterior evergreen landscaping (minimum 6 feet in height) is to be placed along the eastern perimeter of the casino building to create a visual buffer. This landscaping should then continue northward along the proposed fence and existing shop building. b. Additional vegetation is to be planted from the location of the site buildings riverward to restore the riparian edge, incorporating a diversity of native, low maintenance trees and shrubs (both as to species type and planting size) that are appropriate to a riparian habitat. Examples of trees include, but are not limited to, the following: Tsuga heterophylla (Western Hemlock), Thuja plicatam (Western Red Cedar), Alnus oregona (Red Alder) and Acer circinatum (Vine Maple). There are a few concerns regarding the trip generation that I would like the traffic engineer, Christopher Brown & Associates, to address. Data used in developing the trip generation rate was based on a single site study of another Silver Dollar Casino that is half the size of the proposed facility. However, the TIA stated that the two facilities are comparable in size. 1 disagree. Because the building size for the SeaTac casino was used to develop a trip generation rate, the full gross square footage of the proposed facility should also be used when figuring the peak hour trips. In other words, the banquet room and office space should not be considered 'ancillary' using the proposed methodology for trip generation. There is another Silver Dollar Casino located in Tacoma, which may be more comparable in size. If not, another casino may be similar enough to study to provide more accurate data supporting the local trip generation rate. Studying only the 4-6 pm hour time frame is adequate for my needs. The reason I'm requesting further data be gathered is the much higher rates found in the Trip Generation Manual for both CasinoNideo Lottery Establishments and High- Turnover Sit Down Restaurants, both which are somewhat reflective of the type of proposed facility. would also like to see the actual rate being used and how it was determined. This needs to be included in the report in a clear manner. There is a lot of supporting data but no clear justification for the inbound and outbound rates. Are the rates based on square footage? Are they based on patrons per hour and an estimated vehicle occupancy rate? Those questions need to be answered. Credit can be given for the existing peak hour trips generated by the current use of the building but no trip credit can be used for 'existing' trips from the Riverside Inn. If required, drainage review becomes an integral part of the overall permit review process. This section describes when and what type of drainage review is required for a proposed project and how to determine which drainage requirements apply. Construct or modify: To install a new drainage pipe/ditch or make improvements to an existing drainage pipe/ditch (for purposes other than routine maintenance, repair, or emergency modifications, and excluding driveway culverts installed as part of single family residential building permits) that either serves to concentrate previously unconcentrated surface and storm water runoff or serves to increase, decrease, and/or redirect the conveyance of surface and storm water runoff. Critical Drainage Area: An area where the Department of Natural Resources (DNR) has determined that additional drainage controls (beyond those in this manual) are needed to address a severe flooding, drainage, and/or erosion condition which poses an imminent likelihood of harm to the welfare and safety of the surrounding community. Critical Drainage Areas (CDAs) are formally adopted by administrative rule under the procedures specified in KCC 2.98. When CDAs are adopted, they are inserted in Reference Section 3 of this manual and their requirements are implemented through Special Requirement #1 (see Section 1.3.1). 1998 Surface Water Design Manual 1 -3 ° 9/1/98 SECTION 1.1 DRAINAGE REVIES - High -use site: A commercial or industrial site that (1) has an expected average daily traffic (ADT) count equal to or greater than 100 vehicles per 1,000 square feet of gross building area; (2) is subject to petroleum storage or transfer in excess of 1,500 gallons per year, not including delivered heating oil; or (3) is subject to use, storage, or maintenance of a fleet of 25 or more diesel vehicles that are over 10 tons net weight (trucks, buses, trains, heavy equipment, etc.). Also included is any road intersection with a measured ADT count of 25,000 vehicles or more on the main roadway and 15,000 vehicles or more on any intersecting roadway, excluding projects proposing primarily pedestrian or bicycle use improvements. Natural discharge area: An onsite area tributary to a single natural discharge location. Natural discharge location: The location where runoff leaves the project site under existing site conditions. New impervious surface: The addition of a hard or compacted surface such as roofs, pavement, gravel, or dirt, or the addition of a more compacted surface such as the paving of pre- existing dirt or gravel. Landslide Hazard Drainage Areas: Specially mapped areas where the County has determined that overland flows from new projects will pose a significant threat to health and safety because of their close proximity to SAO - defined landslide hazard areas that are on slopes greater than 15% (a delineation of the known SAO landslide hazard areas can be found in King County's Sensitive Areas Map Folio). Such areas are delineated on the-Landslide Hazard Drainage Areas Map adopted with this manual (see map pocket on inside of back cover). Pollution - generating impervious surface (PGIS): Those impervious surfaces considered to be a significant source of pollutants in stormwater runoff. Such surfaces include those which are subject to vehicular use or storage of erodible or leachable materials, wastes, or chemicals, and which receive direct rainfall or the run -on or blow -in of rainfall (for more details, see page 1 -50). Metal roofs are also considered to be PGIS unless they are treated to prevent leaching. Project site: That portion of a property or properties subject to proposed project improvements including those required by this manual. Redevelopment project: A project that proposes to add, replace, and/or alter impervious surface (for purposes other than routine maintenance, resurfacing, regrading, or repair) on a site that is already substantially developed (i.e., has 35% or more of existing impervious surface coverage). The following examples illustrate the application of this definition. The cost thresholds in this manual are considered to be in 1998 dollars and may be adjusted on an annual basis using the local consumer price index (CPI). 6 Contiguous pollution- generating impervious surface (PGIS) means a discrete patch of PGIS that is all together as opposed to being separated in different locations on the project site. The intent is to identify those redevelopment projects that are replacing and/or adding enough impervious surface in one location to allow for opportune installation of a water quality treatment facility. However, for some types of projects the scope of requirements applied is narrowed to allow more efficient, customized review. Each of the following four drainage review types tailors the review process and application of drainage requirements to a project's size, location, type of development, and anticipated impacts to the local and regional surface water system: • Small Site Drainage Review, Section 1.1.2.1 (p. 1 -9) • Targeted Drainage Review, Section 1.1.2.2 (p. 1 -10) • Full Drainage Review, Section 1.1.2.3 (p. 1 -13) • Large Site Drainage Review, Section 1.1.2.4 (p. 1 -13). Each project requires only one of the above drainage review types, with the single exception that a project which qualifies for Small Site Drainage Review may also require Targeted Drainage Review. Figure 1.1.2.A can be used to_determine.which.drainage review type would be required. This may entail consulting the more detailed thresholds for each review type specified in the above - referenced sections. The current use of the property is manufacturing, with a commercial use on the south side and city maintenance shops on the north side. This would not seem to be an area that could be developed into recreation or public uses. 3. The location of the existing buildings that will be retained do not contribute to shoreline enhancement. In addition, there are prohibitions against any modifications within 40' of the shoreline, plus mandates to retain all existing vegetation along the river bank area. The structure will be remodeled to provide viewing of the river from inside the building, which will not require physical work to be done along the river. 4.The proposed changes to the property will be a great improvement to the existing manufacturing use. Paving and landscaping, along with the exterior changes to the building, will enhance this area tremendously. 5. As stated in 3. above, there are restrictions against development within 40' of the river bank. Converting to an assembly use in lieu of a manufacturing use will increase the public's awareness of the river's presence in this location, which is an improvement over the existing conditions. 7. This restaurant/cardroom will be open 20 hours per day, which will allow increased exposure of the river to the public. 8. Since no modifications are allowed or will be proposed for this property, there should be no impairment to the biological features of the river and its shoreline. PUBLIC ACCESS ELEMENT 1. The work on this project will be tenant improvement to an existing building. 2. This project will not be proposing any modifications to the existing area along the water's edge, due to the requirement of the city to restrict any construction activity within 40' of the shoreline. It is proposed to retain the shoreline area in its existing condition without enhancement or modification. 3. The trail is existing and has been relocated to parallel Interurban Avenue as it passes by this site and the Riverside Casino to the south. It is proposed to retain this improvement without modification, as it is connected at both ends to the existing system. CIRCULATION ELEMENT 1. No roadways are proposed adjacent to the shoreline as part of this proposal. 2. Parking is proposed to be located in areas already being utilized for vehicle storage on the site, and is located more than 60' from the shoreline. 3. Public transportation serves the site along Interurban Avenue. No modifications to the system are being considered. 4. No railroad property is included with this project. RECREATIONAL ELEMENT There are no publicly owned recreational uses immediately adjacent to the site, although Foster Golf Course is located across the river from the property. This will preserve the existing conditions of the water's edge. All development to take place as part of this project will be oriented away from the water to avoid activity that could be potentially detrimental to the river environment. COMPREHENSIVE PLAN SHORELINE DESIGN POLICIES ALL SHORELINE DEVELOPMENT 1. No modifications are proposed for the riverbank or areas immediately adjacent to the water's edge. 2. By limiting development activity in the 40' from the water's edge there should be no adverse impact on the riverbank. 3. There should be no disturbance of the vegetation or habitat along the river's edge. 4. The parking and storm drainage systems are existing for this site. It is proposed to install an oil -water separator catch basin in place of an existing catch basin to improve water quality. In addition, the area currently used for parking and vehicular circulation is being reduced and will be replaced with landscaping, which will also be an improvement to the water quality on this site. 5. The work on this site will be tenant improvement to the existing building. The new finish floor elevation will be constructed at elevation 22.15', which is 12" above the level of the base flood elevation. Improving the site drainage by repaving the parking areas will also help to control drainage flow. 6. This project should be an improvement to the community, and will pose no adverse impacts on public safety, health or welfare, or inhibit benefits of the river to the community. 7. This project minimizes impacts to habitat, vegetation,access, recreation, historical resources and flood control by restricting improvements to existing buildings and systems. 8. No modifications to the riverbank is proposed, and no over -water structures will be constructed. 9. No unique historic /archaeological features are believed to be present on or around this site. PROJECT OVERVIEW The project site is located in the City of Tukwila, on the southeast corner of the intersection of Interurban Avenue and South 140th Street (see Figure 1). The total property encompasses 2.01 acres. The site and surrounding area have been developed and are situated in a commercial/industrial zone. The rear of the site abuts the Duwamish River at approximately mile marker 10.7. The property is currently occupied by an automotive parts store and products manufacturing business. There is very little existing on-site vegetation except immediately adjacent to the River. The site is quite flat with no visible slope and is generally about 2 feet above the ordinary high water elevation of the river. The site is almost entirely covered by buildings surrounded by paved and gravel parking and storage areas. On-site improvements will include relocating a public road (South 140th Street) approximately 40 feet to the north. Existing utilities will be retained. Stormwater management will include a vault for water quality control. When completed, the site will house a restaurant and card room. Copies of two letters to the client that summarize some of the important points from these meetings have been included in this report. RETENTION /DETENTION ANALYSIS & DESIGN Two of the three existing buildings on -site are within the 40 -foot setback line. These buildings will be extensively remodeled, retaining that portion of the footprint outside the 40 -foot setback region. As a result, the aggregate building footprint will be reduced. The finished floor elevations of the on -site buildings will be raised to an elevation 1 -foot above the 100 -year flood stage (see Figure 2). The King County Soils Atlas classifies the site as Urban -type soils (see Figure 3). This indicates that little of the precipitation that currently falls on the site infiltrates. Rather, it collects on -site and sheet flows into the Duwamish River, just to the east. The proposed site grading includes landscaped parking areas and a 40 -foot setback from the ordinary high water mark. These proposed features will actually reduce the total impervious surface on the site. Because the existing gravel is hard- packed, it is considered to be impervious surface for modeling purposes. Thus, post - development runoff will actually be less than current levels. Because of this, no stormwater detention storage is necessary. For a summary of pervious and impervious areas in the existing and developed conditions, see Drainage Calculations section, pages 3/6 & 4/6. A baffled stormwater retention vault is proposed to provide water quality treatment. This vault will be sized per the 1998 King County Surface Water Design Manual requirements (see Figure 4). The outlet from the vault will empty into the river. Because of the necessary depth of the vault, the outlet will be constructed at an elevation that will be submerged at certain times. To mitigate this, we could propose to add 1440 square feet and connect the two front buildings. The bulk of this addition falls beyond the 100' setback from the river, which has less impact than the first 100'. This would allow up to 11865 • square feet of building area. It may also be necessary to demo the third storage building to help gain approval from the city. Per my, understanding of the shoreline codes, the city has the primary responsibility to determine the conditions necessary for shoreline development. Their recommendation then goes to the A.O.E. for concurrence. If we can get an indication of support from the city, this would help with the D.O.E. review, Also, D.O.E. is not set up to review projects in advance of an application, so getting an advance review may be difficult. If you concur with this concept, I'll run it past the city as drawn or as modified by you. The moritorium for casinos has been lifted, but the city almost decided to disallow them outright. The position of the city now is to allow projects that are more upscale than the typical existing casino. They also want to discourage "Landmark" projects - ones that draw undue attention to the site. This to set the stage for the comments that carne from the meeting. There are 4 major issues to be resolved, two more than we thought we had at the start of the meeting. 1. The Maule Avenue .vacation has to be completed I believe this is underway with the city, and requires no more attention from us, but we should keep an eye on the progress to be sure it keeps moving towards final approval. At this time it is not a hinderance to the project, 2. The shoreline determination may have an impact on the existing building The use of the project is changing, so an outright grandfathering of the project is not necessarily automatic. The shoreline development standards requires that no activity be undertaken in the first 40' from the normal high water line of the river. It was suggested that we consider demolishing a portion of the building and landscape the area to be compatable with riverfront development standards. Meetings need to be scheduled between the engineer and various county/state officials to secure their input so that a direction can be decided. 3. The proposed building exterior, t� be blunt, cannot be supported by staff in the report made to the Board of Architectural Review, the group that decides the fate of the Design Review. They would prefer something more upscale or elegant. Department of Ecology officials announced the fine Monday. In March, the agency ordered Luciano's to shut down the casino because it conflicts with the state's Shoreline Management Act. The 1972 law protects the state's shorelines and public access to them by favoring water - related uses. The casino is likely to remain open, at least in the short term. "Everything Luciano's is doing is 100 percent legal and the City of Tacoma has confirmed that," said attorney Mickey Gendler, who represents Luciano's owner Dan Hilger. "There's no violation. We're going to appeal it, and we're going to win." Hilger referred questions to Gendler. The waterfront casino opened in December and is licensed for 13 house - banked card tables. The Tacoma City Council banned new casinos last fall, but gave Luciano's and two other minicasinos elsewhere in town five years to operate. The state fine surprised Gary Pedersen, the city's building and land -use services manager. "They didn't let us know," he said. "The City of Tacoma's position is the same. They are a legal use and gambling is accessory to the prime use of the property, which is restaurant." Luciano's status as the first non - tribal waterfront minicasino in Washington makes it a test case for the Ecology Department's oversight of the Shoreline Management Act. The law requires local governments to create shoreline master plans, or regulations, that support state law. Ecology officials insist that Luciano's casino violates not only the state law but the city regulations. The problem came when Luciano's made the switch from restaurant and lounge to restaurant, lounge and casino, agency officials said. "We would have had to take the same action if they'd turned the building into a dress shop," said Gale Blomstrom, the agency's Southwest Washington shorelands and environmental assistance program manager. "Neither use is water - oriented, as defined by the city's shoreline regulations, and neither use maintains or increases public access to the shoreline." The order and fine can be appealed to the state Shoreline Hearings Board. "We'll look into it," she said. The commission usually avoids land -use disputes, she said. "Normally, we try to stay out of any zoning laws because zoning is up to the local jurisdiction," she said. This is the first time a casino conflicted with the Shoreline Management Act, she said. Luciano's critic Carol Sloman, chairwoman of the North End Neighborhood Council, was glad to hear that the Ecology Department had fined the casino. "A cardroom should not be operating at any location on the Ruston Way waterfront," she said. Like other communities, the Council is responding to recent changes in state law by seeking time to explore its options regarding the siting of mini casinos and other gambling establishments. This action affects your permit applications because they are still incomplete. I have enclosed the "vesting" section of our Zoning Code. The City is considering ways to allow you to continue working on some elements of your proposed project despite the moratorium: For example, you may continue to work to resolve the issues around the Maule Avenue vacation, file for a lot consolidation for the site, and conduct the traffic and parking studies. Of course the Council may adopt regulations that prohibit your intended development, so all work during the moratorium period would be at your own risk and not vest you with any rights for a gambling use. In order to be complete, the following must be submitted to the permit center: a. As your site plan is dependent on the land in the Maule Avenue right -of -way, review of your project cannot proceed until the Public Works Director determines that you have met the conditions of the "agreement for the exchange and use of real property." This means that the construction required as part of that agreement must be completed prior to beginning this project. I believe that you have corresponded with Bob Giberson from the PW Department about this issue. b. In order for you to obtain building permits you must consolidate the four lots that make up your site by applying and receiving approval for a BLA/Lot Consolidation from Tukwila. Please submit an application to start this process. c. Tukwila does not have a standard for the number of parking spaces required for a casino use. You have approximately 3,900 square feet of casino /card room use in building A that will likely require more parking than the restaurant standard you have used. Please submit a parking study that addresses the parking requirements for casino /card rooms in this area. I understand that you have agreed to complete a traffic study to determine mitigation fees per Tukwila's Concurrency Ordinance. Similarly, I met with the developers and the architect for the above casino to review such items as project scale, access and so on. Indeed, I even started to assess the use of the zip code addresses of clients as a means of defining the trip distribution. However, on a close examination.of new expected trip generation versus trip generation in former days, namely pre - January 1998, it appears that the new usage, while generating larger daily traffic volumes, produces smaller p.m. peak hour volumes. Given this unusual outcome it would seem to me that there is no need for a traffic study, per se. It goes without saying that while I would look forward to the challenge of such an impact analysis with this kind of land use it would serve no useful SEPA related purpose. Briefly, the former use, I 'recall it as the Riverside Inn, was a 650 seat capacity restaurant with an attendant bar /dance floor. For its traffic generation I would suggest that it complies with the Institute of Transportation Engineer's (ITE) Land Use Code 832 which includes facilities with bars that also serve both lunch and dinner. Trip production, defined in the 6th edition of the Trip Generation Manual for LUC 832, Mich- Turnover (Sit -Down) Restaurant is noted below in Table I. These would typically depart the site in the p.m. peak hour and, accordingly, reduce the basis of the prior land use trip count. Assuming the displaced business are light manufacturing in nature, certainly not a poor assumption considering activities such as auto re- build, then ITE LUC 110, General Light Industrial, would apply. The p.m. peak hour trip data for this use is shown in Table V. Indeed, there is a small reduction in the peak hour traffic, about (278 -265) 13 trips per hour so that fundamentally your new facility is a traffic mitigation measure. This is not to mean your daily traffic is less. Rather, with your peak hour beginning after about 7:00 p.m. and continuing through the night 1 would expect your "daily traffic" to be much larger. However, in the context of traffic impacts, the new use is a betterment since it reduces the peak hour loading. This leads to the next issue. Since the proposed development reduces the p.m. peak hour volume there is little reason to conduct a traffic study, per se. Indeed, as a traffic mitigation measure I would suggest you request that a traffic study not be a requirement of your building application.
