SUBJECT: Union Tank Works Change of Use
Dear Mr. O'Connell:
I am in receipt of your letter confirming withdrawal of your application for change of nonconforming use. Thank
you for your prompt response.
I appreciate and understand your interest in the way nonconforming uses are regulated under the Tukwila Zoning
Code. Our interpretation of the "change of use" provision of the Code has been confirmed by the City Attorney
following considerable discussion of your specific case. You should also be aware that the City Council
Community Affairs and Parks Committee recently discussed these Code provisions in connection with a related
matter, and requested that the Planning Commission review the provisions. The Committee specifically requested
that the Planning Commission look into, among other things, the question of whether a nonconforming use should
be allowed to change to another nonconforming use. The Planning Commission may begin its review of these
issues as early as their May 1 meeting. This meeting will be held in the City Council chambers at City Hall,
beginning at 7:00 P.M. You may wish to contact Jack Pace at 431 -3670 to inquire about the status of this matter.
Your letter also urges that the question of who will decide change -of -use issues in the future, be decided quickly.
The City Attorney is working on this matter.
Finally, you have requested the return of your application fees and application materials. I am enclosing those
application materials for which we can retain adequate copies. Unfortunately, I am unable to return your
application fee. Such fees are intended to defray a portion of the city's cost in processing applications. In most
cases, as in this case, substantial costs are incurred even if an application is later withdrawn.

Dear Mr. O'Connell:
As I informed you by telephone on March 10, the Board of Adjustment hearing
tentatively scheduled for March 18 has been canceled due to our inability to constitute a
quorum. You informed me at that same time that Bird - Johnson is no longer interested
in the site, so rescheduling a hearing is not necessary. You also indicated that Bird -
Johnson informed you of this on Wednesday, March 5. I would appreciate your written
confirmation that you are withdrawing your application for change of nonconforming
use.
In anticipation of your continued efforts to final a new tenant for your property, I would
like to reiterate my offer to meet with you at such time as you have another potential
tenant identified.

I appreciated the opportunities to talk to you over the past few weeks regarding the request o co
of the.Bird- Johnson Company to lease our property. We were very disappointed when Bird - Johnson °

decided to pursue other opportunities to satisfy their space requirements. 1 appreciate the City's F-

efforts to move the process along, but there were some parts of the process that created frustration
and delay for Union Tank and Bird- Johnson.
The request for additional application information, that went beyond the information
requested in the forms originally given to the parties, was certainly frustrating and a cause of delay.
We also felt, and still feel, that the zoning code should permit a use such as Bird - Johnson to occupy
our facility without the need of going before the Board of Adjustment fora hearing. We believe that
this interpretation of the zoning code is not consistent with the manner in which the uses are
described in the code. This is a matter that we would welcome the opportunity to discuss further
with the City.
Another matter of concem that proved not to be a problem because Bird - Johnson had just
determined that they would not pursue occupancy of our property was the decision to utilize a
hearing examiner rather than the Board of Adjustment. If the City of Tukwila is intending to move
from the Board of Adjustment to a hearing examiner to determine whether a nonconforming use can
be changed, the City should do so in a very prompt fashion. It is certainly not reasonable to ask a
property owner to sit by while the City undertakes a legislative process to modify the zoning code.

We do not know how quickly we can locate another tenant, but we are endeavoring to do so
promptly. Therefore, to the extent the City is going to change the process for nonconforming uses,
we request that you do so expeditiously.
Finally, this letter constitutes written confirmation that we are withdrawing our application for
a change of nonconforming use at our property in Tukwila. To the extent we have not received them
already, we again request the retum of our application fee and the materials that we submitted to the
City in regard to our application. The fee should be retumed because we never went to a hearing,
and no staff report was prepared.

NOTICE OF HEARING CANCELLATION
March 10, 1997
RE: Union Tank Public Hearing
To whom it may concern:
About a week ago we mailed you a notice of a public hearing to be conducted by
the Board of Adjustment on March 18, 1997. This notice is to inform you that
due to a lack of a quorum, that meeting has been canceled.
The hearing will be rescheduled as soon as possible. We will mail you a new
notice of hearing two weeks prior to the hearing date. In the meantime, the files
are still available for your review at the Department of Community Development
and we will continue to accept your written comments.
It will be appreciated if you spread the word of this cancellation to anyone you
know that may be planning to attend the hearing. If you have any questions,

After reading the letter from Cairncross and Hempelmann written by Donald E.
Marcy to Michael R. Kenyon about Union Tank Works leasing the property at 12065
44th Place South to Bird - Johnson, I feel strongly the property should not be leased!
The kind of work Bird - Johnson does, does not conform to the existing non-
conforming code. Propellers are made differently from tanks. Tank manufacturing did
not fit into our neighborhood, and this proposed use does not either!

The noise that comes from a machine shop and propeller operation 24 hours a day w 0
could be even noisier than the company claims it will be. Also, nothing has been said g
about the emissions being put out when any grinding is done. Both the noise and the L
dirt/dust/filings worsen our neighborhood's livability. We are already impacted by the D. c�
business there. Adding to it any more would be very bad! I-- _;

After many years of use that have occurred on the property at 12065 44th Place LL �:
South, the soil in and around the building is contaminated with heavy metals, materials z;
and solvents. I would hate to see the contamination continue and keep seeping into our v 1
Eco System. The city and county are spending thousands of dollars along 42nd Ave at . p
the river building up the banks and making fish habitat. I would hate for more heavy Z
material contaminates to run into that river from the proposed business.
I believe the permits and applications that Union Tank Works and Bird - Johnson
filed should be held up or refused until they file an environmental impact statement and
let the EPA do a study of the property. The building does not meet federal EPA
standards, and should be made to do so before it can be used for more business.
We have already seen the impact of large trucks going into this property. They
already are a terror to neighbors. The trucks are too large, too long, and are a threat to
children, walkers, and small cars.
Union Tank Works was very noisy, and disturbed neighbors when they went to
two shifts. Proposing that Bird Johnson have THREE shifts makes me think I'll never be
able to sleep at night. I truly believe this proposal increases the noise and pollution even
from Union Tank Works' operation.
We live in our neighborhood, and don't want to put up with a business we believe
will contribute even more noise and pollution and traffic than what was there before. We
urge you to DENY this application.

FINDINGS
BACKGROUND
1
1. Project Description: The subject property was rezoned in ecember 1995 from
Heavy Industrial (M -2) to Low Density Residential (LDR). As a result, the
existing industrial businesses (Pacific Joist/Seaport Fabrication and Union Tank
Works) became legal non - conforming uses.
The applicant now wishes to lease the property to Bird- Johnson, a company that
manufactures boat propellers. The application is made pursuant to TMC
18.70.040(5) (zoning) to -seekf 'pproval of change of a non - conforming use (Joist
Fabrication) to another non - conforming use 6ropeller f anufacturing).
2. Existing Development: The 2.7 acre site has a triangular shape and is enclosed
on two sides by a chain link fence with wood slats. The third side is enclosed
with the slatted fence and the front of the main building. There are nine buildings
on the site containing roughly 45,500 square feet
). The 59 parking spaces are located on the south third of the site.
3. Surrounding Land Use: The surrounding properties are zoned LDR, and are
either developed or platted for single family homes. AA exception is a small
industrial building located east of 44th Place South near the north end of the site
(OTHER EXCEPTIONS ?)
4. Terrain: The site is level.
5. Vegetation: The existing vegetation consists of perimeter landscaping, mostly on
the east and south sides.
Access: The site has frontage on 44th Place South and 46th Ave South. Gates
to the site are located at the intersection of those streets and at the south end
of the site on 44th Place with a roll up door (or two ? ?) on its east side. Access to
the main building is also available directly from 44th.
DECISION CRITERIA

The Board decision is guided by TMC 18.70.040(5) which states:
"If no structural alterations are made, any non - conforming uses of a structure or
structure and premises may be changed to another nonconforming use, provided that
the Board of Adjustment, by making findings in the specific case, shall find that the
proposed use is more appropriate to the zone than the existing nonconforming
use. In permitting such change, the Board of Adjustment may require appropriate
conditions and safeguards in accord with the provisions of this title" (emphasis added).

The purpose statement of the LDR zone (TMC 18.10.010) states:
"This district implements the Low Density Residential Comprehensive Plan designation,
which allows a maximum of 6.7 dwelling units per net acre. It is intended to provide low
density family residential areas together with a full range of urban infrastructure
services in order to maintain stable residential neighborhoods, and to prevent
intrusions by incompatible land uses" (emphasis added).

In the packet the applicant provides information about three uses. The proposed use is
Bird - Johnson, previous users included Union Tank Works and Pacific Joists /Seaport
Fabrication. Union Tank substantially shut down their operations before the property
was rezoned, and thus, never was a non - conforming use. Pacific Joists was using the
site in December 1995 when the rezone occurred and at that time became non-
conforming. As the Board's criteria calls for a comparason between the proposed use
and the previous non - conforming use, Union Tank does not factor into the following
discussion.
Land Use - Perhaps overstating the obvious, single family uses are more compatible
with single family uses than with manufacturing uses. Lot size, building massing, use
characteristics, aesthetics and external impacts of the two are quite different. By
zoning the property single family, the City has determined that the appropriate long
term use of this site is not manufacturing. No changes to the general land use pattern
has been proposed.
Parking - Parking is allowed as accessory to permitted uses in the LDR zone. The
parking at the site differs from the typical single family parking in that it is contained in a
large concentrated area. There are 59 spaces on the site. No analysis has been
provided to demonstrate how the parking provided compares to the parking required. In
addition, we don't have precise numbers on square footage of use (office /mfg mix) to
accurately determine the required parking. However, based on the site plan we have
estimated required parking to be roughly 60 spaces. (Mfg = 1 space /1,000 s.f. building
area = 35,500/1000 = 35. 5 spaces. Office = 2.5 spaces /1,000 s.f. building area =
9985/1000 x 2.5 = 24.9).
On- street parking may also occur. On site visits on March 6th and 7th, 1997, a semi
tractor trailer was observed to be parked on 44th Place South near the site entrance.
Light and Glare - Single family uses are more sensitive to light and glare than
industrial uses. The applicant has indicated there will be no change in external lighting.
The applicant did not address impact of Tight and glare from vehicles. The applicant

indicates the previous use (Pacific Joists) had 4 -6 employees making the midnight shift Kos", KY

Noise - Likewise* single family uses are sensitive to nois , grid Tukwilalioise

information on noise generated by the previous user. We have checked with the City's
code enforcement officer and found no noise complaints filed for this site. The
applicant has indicated that the noise generated by the propeller and machine shops
will range between 65 -80 dB maximum. The city's noise ordinance (TMC 8.22) does
not allow noise received by the residential properties to exceed 60 dB(A) during the day
and 50 dB(A) during the night. There are minor increases allowed for short term noise.
Auto and Truck Traffic - In addition to noise ,pollution and glare, vehicular traffic
can be detrimental to single family homes increased safety hazard and congestion.
The number of a oyees indicated are very similar. Pacific Joists indicates there were
-36 employees during the week day and 4 -12 on the weekends. The proposed
user, Bird - Johnson, indicates they will have 32 employees during the week. They do
not indicate how many employees will be at the site on weekends.
Regarding trucks, the applicant has indicated there were 15 -22 trips a week for 2 -3 axle
trucks and 5 -8 trips per week for semi truck trailers for a total of 22 - 28 trucks per
week. Proposed are 10 trips for 2 -3 axle trucks, 2 trips for semi truck trailers and 8
small trucks for a total of 20 trucks per week .
Storm Water Runoff - This site has significantly greater percentage of impervious
surface area and potential for runoff generation than single family uses. No changes
are proposed to impervious surface area.
Vegetation - Single family homes generally have a greater amount of landscaping than
industrial properties. No changes to landscaping are proposed.
Exposure To Environmental Health Hazards - There is one complaint on file about
an asbestos covered tank on the site. Upon inspection it was determined the material
covering the tank was not asbestos and the case was closed. No evidence has been
provided to suggest the-level of impacts, if any.
Aesthetics - The massing, materials, design and colors of the building are not typical of
residential areas, nor is the chain Zink fence with wood slats and three strandof barbed
wire. The only change indicated by the applicant is the painting of a sign on the
building. There is already a freestanding sign on site. It is not clear in reviewing the
sign ordinance that a sign would be allowed on the building. No specific proposal for
signage has been submitted for review.
Air Emissions - The applicant notes the previous use resulted in minor dust
emissions though the vents and the facility passed inspections by Washington Industrial

Safety and Health Agency (WISHA) and the Puget Sound Air Pollution Control Agency
(PSAPCA). The applicant does not indicate the dates or the nature of the inspections.
They indicate with the.new use there will be no emissions associated with Department
of Ecology guidelines. This statement does not tell us what those emissions are
associated with Ecology guidelines nor what other emissions will result.
, CONCLUSIONS
Land Use - There are no significant changes to make the land use of the site more or
less compatible with the single family neighborhood. Improved land use compatibility
would be achieved if a portion of the site is converted to single family use.
Parking - With no apparant excess of parking spaces, it does not appear there is an
opportunity to reduce the impact of parking by eliminating spaces. The impact of
parking could be reduced by eliminating a large bank of spaces and dispersing them
throughout the nooks and crannies of the site.
Parking and idling of vehicles and staging and moving of materials on the street would
be detrimental to the adjacent homes.
Light and Glare - There are no significant changes to make the light and glare more or
less compatible with the single family neighborhood.
Noise - Lacking evidence from the applicant, cannot determine if the proposed use
would exceed the previous use. However, > use of the site is subject to the provisions
of the noise ordinance which already has determined acceptable noise for residential
areas. The proposed use cannot exceed those standards and thus by definition
requires the use to be compatible with the residential use. o��,✓

noticeable difference between the previous and proposed use.
Storm Water Run Off -.No impacts or improvements are proposed. The recommended
conditions to convert a portion of the parking area to a single family lot and to add
landscaping around the permiter will reduce the amount of impervious surface area.
Vegetation - A condition requiring additional landscaping will help soften the
appearance of the industrial use by improving the aesthetics and providing
environmental benefits such as noise attenuation and reducing dust levels.
Air Emissions - We do not have any information to base a conclusion (AND SO ? ?).
Exposure to Environmental Health Hazards - No evidence has been provided.on this
issue. (HOW DO WE DEAL WITH THIS ? ? ?)
Aesthetics - Since the sign ordinance allowances are based on zone district and land
use, whatever signs are permitted will by definition be compatible with the single family
neighbors. Significant improvement can be obtained if the fence is setback and
landscaping is provided between the street and the fence.
Summary of Conclusions: Based on the information at hand, while the proposed use
does not appear to be any less compatible with the single family zone. It also does not
appear to be any more compatible. As proposed, the application cannot be approved.
Our recommendation includes conditions that, if met, would result in the new use being
more compatible with the residential neighborhood than was the previous use.
RECOMMENDATIONS
The Planning Department recommends approval of the proposed project with the
following conditions. The intent of the conditions is to ensure the proposal is more
compatible with the LDR zone.
1. The site area shall be reduced by 6,500 square feet in favor of creating a new
single family lot on which no industrial related uses are permitted.
A. A boundary line adjustment shall be completed which results in a 50' x
130' lot beginning at the southeast corner of Lot 33. This adjusted Lot 33
shall become a single family lot. i fv:t ' F ,
B. The entrance to the site from 44th Place shall be eliminated. No new
access points will be allowed unless found necessary to accomplish
condition 1.F below.
C. Any asphalt, curb, gutter or other improvements on the adjusted Lot 33
shall be removed and properly disposed.
A 6 foot high solid wood fence shall be erected between the Union Tank
Works site and the adjusted Lot 33.
The owner shall record a legal instrument which guarantees Lot 33 is no
longer a part of the Union Tank site and has no legal non - conforming use
status.
F. The parking removed to comply with this condition (about 20 spaces) shall
be relocated elsewhere on site, provided parking shall not exceed the
minimum required for the use.

street right -of -way.
3. Except where not feasible because of building, circulation or parking location, the
perimeter fence along the street frontages shall be setback a minimum of seven
feet. The area between the right -of -way and fence shall be landscaped with
trees (1.5" caliper for deciduous and 6 -8 feet tall for confers) a maximum of 30'
o.c., 4' tall shrubs at 4' o.c. and live ground cover (1 gallon) 12" o.c. The
landscape plan shall be prepared by a licensed landscape architect and
approved by the DCD Director.
A parking analysis shall be provided. If there is an excel of parking, the number
-- of spaces shall be reduced to the minimum necessary to meet the parking
ordinance. The reduction of spaces shall be done in a manner that allows the
greatest amount of increase of landscaping pursuant to condition 3 above.

Enclosed please find the additional information submitted by our client, Union Tank
Works, Inc., in response to your February 25, 1997 letter. It remains our opinion that Byrd-
Johnson's tenancy of the Union Tank Works' property constitutes the same type of use which
previously occurred on the property. Because no structural alterations are being made to the site,
and because Byrd - Johnson will conduct the same type of use, we believe that a hearing before
the Board of Adjustment is not required.
During the past two years, Union Tanks Works, Inc. and Pacific Joists, Inc. have
occupied the Union Tank Works property. Union Tank Works was involved in the
manufacturing of items such as pressure vessels, commercial ice machines and submarines.
Pacific Joists was involved in manufacturing of building joists. Byrd - Johnson, the prospective
tenant for the Union Tank Works property, manufactures boat propellers. Detailed descriptions
of the Union Tank Works, Pacific Joists and Byrd - Johnson operations are included in the
attached materials.
It is our opinion that Union Tank Works' and Pacific Joists' use of the property falls
within two use categories set forth in Tukwila Municipal Code (TMC) 18.34.020(27) and (28).
Those code sections provide:

I wanted to follow up with you in writing to provide further information concerning the
hearing on Bird- Johnson's proposed use of the Union Tank Works property. As I
indicated in our conversation, the first available date for a special hearing before the
city's Board of Adjustment (BOA) will be March 18, 1997. This is the earliest date that
adequate public notice, as prescribed in Tukwila Municipal Code (TMC) 18.104.160,
can be provided. Please be aware that we are still trying to confirm availability of BOA
members for March 18.
In order for staff to effectively evaluate Bird - Johnson's request to use the Union Tank
Works property, specific information about use(s) as it/they have operated during the
past 24 months is required, as well as information on the proposed use as it will operate
in the future. Understanding the history of the use of this property will provide a
framework for assessing any impacts that the proposed use will have on the
surrounding properties. The information that needs to be provided for the previous 24
months and the proposed use includes:
• Hours of operation
• Number of employees
• Number of employee vehicle trips per day at peak a.m. and p.m. times
• Number and nature of other vehicle trips per day at peak a.m. and p.m. times
• Amount of noise generated at different times of the day and night, as received at
neighboring properties, indicated in decibels (dBA), if available
• Type, nature and frequency of air emissions

Our firm acts as City Attorney for the City of Tukwila_ This letter is in respinse to the
two documents identified above.
Interpretation on Change of Use
TMC 18.06.865 defines "Use" as "[t]he nature of the occupancy, the type of activity, or
the character and form of improvements to which land is devoted or may be devoted."
In order to make a conclusive determination if a change of use will occur, the i;+ apartment
of Community Development needs additional information regarding the nature, type, character,
and form of the proposed use and the use(s) that have been on the site over the past 2.4 months.
At a minimum, this information needs to include floor plans, site plans, identification •4o: processes
and equipment involved, and clear articulation of the nature of the operations.
In Donald Marcy's January 30, 1997 letter, it is asserted that there is no chi nge of use
proposed for the Union Tank Works site. Based on the information submitted, it appears to the
Department of Community Development that the proposal does constitute a change of use as
defined in TMC 18.06.865 and is also a change from either category of use under TMC
18.34.020(27) or (28) (Manufacturing using previously prepared metals) to the use under TMC
18.34.020(26) (Manufacturing of boats or other transportation vehicles and equip= at).

Application to the Board of Adjustment
The Department of Community Development cannot schedule you for a Board of
Adjustment hearing on the issue of changing from one nonconforming use to another
nonconforming use until it first makes a determination on whether the proposed use does
constitute a change of use. As indicated above, additional information is needed before that
determination can be made.
The additional information necessary for the Department of Community Development to
make a determination on whether there is a change of use is also the same information that will
be necessary for the Board of Adjustment, in the event the Department of Community
Development determines that there will be a change of use, to consider as it determines whether
a proposed use is more appropriate than the existing use for the LDR zone in which the site is
located.
Because there is insufficient information at this time for the Department of Cammunity
Development to determine whether the proposed use is a change of use, your application is
incomplete. As a consequence, the Department of Community Development cannot schedule the
proposal to be heard by the Board of Adjustment at its March meeting.
Your application should be resubmitted with the additional information requested to the
Department of Community Development, attention John Jimmerson.

In the January 30, 1997, letter from Donald Marcy, it is asserted that there is no
change of use proposed for the Union Tank Works site. Based on the
information submitted, it appears to us that the proposal does constitute a
change of use from either TMC 18.34.020(27) or (28) (Manufacturing using
previously prepared metals) to TMC 18.34.020(26) (Manufacturing of boats or
other transportation vehicles and equipment).
However, in order to make a conclusive determination as to whether the
posal represents a change of one non - conforming use to another, we need
information establishing the nature, scope and extent of the use at the
site for the previous twenty -four (24) months and for the proposed use. At a
minimum this information needs to include floor plans, site plans, identification of
processes and equipment involved and clear articulation of the operations.
Application to Board of Adjustment
he Board of Adjustment hearing�en tti' issue of changing
one non - conforming use to another prior to a determination is made on whether
the proposal constitutes a change of use in the first place. There are two
reasons for this assertion. First, pursuant to HB( ?) 1724, the City is allowed
only one public hearing on a proposal. Given your challenge on the change of
use interpretation, we must reserve the public hearing in the event the
interpretation is appealed. At such time, both issues can be addressed at the
same public hearing.
Second, the detailed information needed to determine if there is a change of use
is also needed for the application to allow the Board of Adjustment to determine
if the proposal use is more appropriate than the previous use for the LDR zone in
which the site is located.

to your application received by the City of Tukwila on February 4, 1997.
After review of the application and materials submitted, the City Planning Department is
unable to determine whether the proposed use of the property at 12065 - 44th Place South,
Tukwila, Washington is a change in the non - conforming use historically operating at that location.
In order to make a determination as to whether the proposed use is a change in the
nonconforming use, the City needs specific information establishing the nature, scope and extent
of the use at the site for the previous twenty -four months and specific information indicating the
nature, scope and extent of the proposed use. "Use" is defined in the Tukwila Municipal Code
as "the nature of the occupancy, the type of activity, or the character and form of improvements
to which land is devoted or may be devoted." TMC 18.06.865
We understand that it is your position that the proposed use is not a chaLge in the
nonconforming use at the property, Without the additional information, however, the City cannot
make a determination on that threshold issue. The information is critical because if the proposed
use is a change in the nonconforming use, the application is subject to review by the Board of
Adjustment. If not, then there is no Board of Adjustment review. See TMC 18.70.!40.

Property owner names and addresses can be obtained from the King County Department of Assessment
located on the 7th floor of the King County Administration Building, Room 700, 500 Fourth Avenue,
Seattle. To compile the information required:
• Obtain the assessor's map(s) which contain(s) your property and all neighboring properties within
500 feet (See example diagram). You may use the maps on file in the Assessor's Office or purchase
a set from the King County Department of Public Works Map Counter on the 9th floor of the
Administration Building. Purchased maps must be ordered several hours in advance of the time you

We represent Union Tank Works, Inc. who owns property in Tukwila that has been used 0

for many years as a heavy industrial steel fabrication facility. Our client manufactured large steel o
tanks there for many years. That heavy industrial use has been made non - conforming by
Tukwila's adoption of single family zoning for the property. At this time, our client desires to
lease the facility to another company engaged in similar heavy industrial steel fabrication. The
proposed lessee is Bird - Johnson Company, who manufactures propellers for large ships. We
have discussed this change in tenants with Jack Pace of the Tukwila Planning Department and
we have met with him at Bird - Johnson's current facility in Ballard so that he could view the
facility.
PERMIT CENTER
Section 18.70.040(5) provides in part that if no structural alterations are made, any
nonconforming use of a structure may be changed to another nonconforming use provided that
the Board of Adjustment finds that the proposed use is more appropriate than the existing
nonconforming use. A copy of that section is attached to this letter.
Mr. Pace has suggested that this provision requires that Union Tank Works and Bird -
Johnson go through a public hearing before the Board of Adjustment to determine whether Bird -
Johnson may occupy the Union Tank premises. We believe this is an incorrect interpretation of
§ 18.70.040; and that Bird - Johnson should be permitted to move into the facility without review
by the Board of Adjustment. The reason is that Bird - Johnson's use of the property is the same

type of use that has occurred on the property for many years. Bird - Johnson's proposed move
onto the property is not a change to another nonconforming use.
Section 18.34.020 of the TMC lists the permitted uses in the heavy industrial district in
the City of Tukwila. This section states that, "The following uses are permitted outright within
the Heavy Industrial District,..." Section 18.34.020 then proceeds to list 59 permitted uses. The
uses conducted at this site for many years are covered by the uses described in § 18.34.020(27)
and § 18.34.020(28):
(27) Manufacturing, processing and/or assembling of previously
manufactured metals, such as iron and steel fabrication; steel production by
electric arc melting, argon oxygen refining, and consumable electrode melting;
and similar heavy industrial uses;
(28) Manufacturing, processing and/or assembling previously prepared
metals including, but not limited to, stamping, dyeing, shearing or punching of
metal, engraving, galvanizing and hand- forging;
Bird - Johnson Company's use of the site will be covered by the same two uses, § 18.34.020(27)
and § 18.34.020(28).
It does not matter whether propellers or tanks are being fabricated at the site, the uses are
the same as described in the Tukwila Municipal Code. The code does not distinguish between
propellers, tanks, or other products. Rather, the code describes the type of use. Therefore, there
is no change to another use such that a hearing before the Board of Adjustment is required.
Rather, Bird - Johnson Company should be able to simply occupy the facility.

Thank you for your letter of December 24, 1996 to Michael Jenkins concerning the issuance of
a Business License for your company. We appreciate understanding the nature of the business
that you will be conducting at the Union Tank property, located at 12065 - 44th Place S. While
this property is zoned Low Density Residential, the non - conforming use for the property for the
manufacture of marine propulsion systems as you described appears consistent with the
previous non - conforming use conducted by Union Tank, allowed under Tukwila Municipal Code
(TMC) section 18.70.040
As outlined in TMC 18.70.040 (5), when no changes are made to a structure where a non-
conforming use occurs, the change to another non - conforming use may be made, contingent
on a finding by the city's Board of Adjustment that the new use is more appropriate that the
former non - conforming use. I have enclosed a copy of this code section for your reference.
While a business license has been issued for operations at that site, to ensure that your
company is in compliance with city requirements a hearing before the Board is required.
I am enclosing a Special Permission application for this process. This is a Type 3 process,
requiring a hearing before the Board of Adjustment. I have also included a sheet that outlines
the Type 3 process. Please note that your application will not require a review under the State
Environmental Policy Act (SEPA), allowing the matter to be heard sooner than if such a review
is required. As I mentioned, the hearing is tentatively scheduled for March 4, 1997, which is the
first date available following a review of this matter by staff. To ensure that this date is
maintained, please provide all information requested as part of the application by February 4,
1997, or earlier if possible.

fabricated in accordance to customer design and specification, and by contract or purchase order on a one -off
basis. The UTW customer base was made up from the petroleum, and pulp & paper industries. UTW also E

fabricated a production line of commercial ice machines for a local refrigeration company. UTWs' finished -±

product was fabricated from plate, structural shapes; i.e., angles, beams, channels, pipe, tubing, formed by z �!

Pacific Joist/Seaport Fabrication was in the metal fabrication business. Their work was structural
fabrication with emphasis on large commercial and industrial building component parts with one of their
specialties being roof joists. The joists were designed and used to support roof systems on large span
buildings. The finished physical size of the roof joists were frequently 4 ft — 5 ft high, and 40 ft — 60 ft in
length. In addition to the roof joists, Pacific Joist fabricated building columns, platforms, stairs, railings and
other miscellaneous building components. The fabrication was structural by design and their orders were
custom; and awarded, through a successful bid process, as large sub - contracts or purchase orders on
major building projects. Their customers were large general contractors. Pacific Joists' fabrication
process included steel plate, beams, pipe, tubing, structural shapes assembled by various welding types.
This finished structural fabrication was manufactured and assembled in accordance with drawings and
specifications by cutting, sawing, forming, drilling, punching, welding, painting, etc. to complete their
fabrication. Their fabrication components were large in quantity, size and length and were trucked by semi
trucks to N.W. Washington construction job sites.

Bird- Johnson Company has been manufacturing marine propulsion equipment in the
United States since the late fifties. \ e have plants in Walpole, Massachusetts and
Pascagoula, Mississippi. In 1986, Bird - Johnson purchased Coolidge Propeller and fIDF
Propeller and began manufacturing and repairing propulsion equipment in the Seattle
area. In 1989, Bird - Johnson closed the Coolidge Propeller site on Fairview Avenue and
relocated the machine shop to our Port�Facility at 4100 West Marginal Way SW. The
HDF facility is located in Ballard on 1 hil th Avenue and is primarily our propeller shop.
In general our work is broken into two' categories. The first is repair work and the second
is manufacturing. The repair work includes shafting components, machinery and
propellers. In each of these cases the v ork may include machining, welding and
assembly of existing equipment. The Materials are steel, bronze and stainless steel. The
shafting can be up to forty feet in lengti and the propellers can be over twenty feet in
diameter.
The manufacturing of this type of equipment includes the purchase of the raw material
which we would machine and finish. The raw material for a shaft is a forging. The
propeller requires the manufacture of alpattern to be used in the molding of a casting.
The castings and forgings are done by outside vendors and would be delivered to the site.
The propellers are machined and ground with minor casting defects being welded. The
shafting is machined and either weld cljadded with stainless steel or bronze liners are
shrunk on to the shaft. We have just completed and delivered the third shipset of shafting
and propellers for the new. Washington State Ferries being built at Todd Shipyard.

Thank you for taking time to meet with Bill O'Connell and myself on Thursday, December 19,
1996.
Bird- Johnson Company applied for and was granted a Business License for its occupancy of
12065 - 44th Place S., Tukwila, Washington for its heavy manufacturing use of a facility commonly
known as the Union Tank property. We understand that historical uses of this property include
occupancy by Union Tank Works for steel fabrication, primarily the construction of pressure vessels,
with two shifts a day on a regular basis and during peak times a 20 hour a day operation six days a
week. Pacific Joist subsequently occupied the property working three shifts a day, six days a week
performing structural steel fabrication with an emphasis on large commercial and industrial building
roof joists. Most recently the property was occupied by Division Five for the fabrication of steel plate,
pipes, structural shapes, tubing, etc.
Needless to say, the multiple shifts involved in the steel fabrication process create more noise
than is customary in a residential neighborhood.
Bird - Johnson Company's use will also involve multiple shifts and primarily involves the
manufacture and repair of marine propulsion systems primarily shafts and propellers.
