EXEMPTION FROM SHORELINE MANAGEMENT ACT
SUBSTANTIAL DEVELOPMENT PERMIT REQUIREMENT

Dear Mr. Taller,
This letter is to notify you that the proposal by Boeing to undertake emergency repair of a
sinkhole in an asphalt parking area near 9725 East Marginal Way South in Tukwila is
exempt from the requirement of a substantial development permit because the
development falls under WAC 173 -14 -040 (d) Emergency construction necessary to
protect property from damage by the elements. Erosion due to stormwater runoff is
posing a potential hazard to automotive traffic because of the loss of subgrade and
subbase supporting a paved slab.
The repair is part of the work covered by City of Tukwila Miscellaneous permit number
MI97 -0006. No adverse impacts on the Green River are expected and the proposed
development is consistent with the Policies of the Shoreline Managment Act and the,King
County Shoreline Master Program.

Management Act permit because our project is for emergency repair of subgrade and
subbase supporting asphalt parking area and bulkhead integrity from a sinkhole
developing from rainwater runoff .
