Dear Mr. Jenkins:
The land use permit for this project (L97-0030 & L97-0031) requires that the monopole
be painted to match the AT&T monopole, nearby. The AT&T monopole has a
galvanized steel finish. This is the basic color which monopoles come in unless another
color is specified. While color was not specified on the project's building permit plans
(D97-0256), the pole which has been ordered for this project is the standard galvanized
steel pole. This pole will match the existing AT&T pole in appearance.

This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the
following project and permit approvals. At their August 28, 1997 hearing, the Planning
Commission approved the applicant's request for a Personal Communications System (PCS)
Base Station, to be located at the Burlington Northern Intermodal Yard, 12400 - 51st Place S.,
with the approved configuration attached to this Notice of Decision and including the following
conditions:
1. At the time of submitting for a Building Permit, the applicant shall provide a detailed plan
showing plans for restoration of the bioswale adjacent to the monopole.

FINDINGS
Vicinity /Site Information
Project Description
The applicant is requesting Conditional Use Permit approval with Design
Review to install a Personal Communication Services (PCS) base station,
comprised of an 80 foot monopole that will support up to four (4) antennae per
array. Each antennae will measure five (5) feet in height, four (4) inches wide
and two (2) inches deep.
Ground equipment will be located adjacent to the monopole in a 20 foot by 40
foot fenced area. Ground cabinets will be used for processing signals, to transfer
power from utilities to operate radio equipment and for increased capacity. A
back -up gas - powered generator will also be provided. The ground equipment
will be 30 inches in width and depth and stand 5 feet 6 inches tall and located on
a 160 square foot concrete pad. Attachment A is the site plan for the proposed
development and Attachment B is the enlarged site plan and elevations.
Existing Development
The site is currently occupied by the Burlington Northern Intermodal Yard.
Surrounding Land Uses
The site is located in the MIC /H zone. Properties adjacent to this site are all
zoned Low Density Residential (LDR). Please note that this application is
required to go through Design Review in addition to Conditional Use Permit
review, as Design Review is required in the MIC /H zone when the proposed
development is within 300 feet of a residential district (TMC 18.38.070).
BACKGROUND
As indicated above, when a proposed development in the MIC /H zone is located
within 300 feet of a residential zone, it must go through Design Review. This
area of the MIC /H zone also has a Building Height Limitation overlay, under
TMC 18.50.020, limiting new development to no more than six (6) stories. As
there is no building code standard to determine the height of a story for
monopoles, staff determined height at 13.5 feet for this application based on an
average of allowed construction types in the MIC /H zone.

' CONDITIONAL USE CRITERIA
The proposed project must conform with criteria detailed in TMC 18.64.050, (1 -5),
concerning Conditional Use Permits:
(1) The proposed use will not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity of the proposed use or in the district in which the
subject property is located.

The applicant has provided a letter from the Airspace Safety Analysis 0 o
Corporation (Attachment C), indicating that it is below FAA height maximum `W LLJ
based on the proximity to Boeing Field. The applicant has included computer

generated photographs ( Attachment D ) showing the proposed location of the

monopole and antennae in relation to the site, as well as view of the project from
surrounding parcels. However, these photos do not include proposed plantings g
that will be located around the project. The leading edge of the project's N a
footprint will be located approximately 200 feet from neighboring properties and I i;
adjacent to an on -site storage building used by Burlington Northern Intermodal z E-
Yard. The proposed antennae and related equipment are telecommunications z E-
equipment that fall within the safety parameters set by the American National o;
Standards Institute (ANSI).

As referenced above, Staff has determined, for the purposes of this application tii co'
only, that a story for monopoles in the MIC /H zone is 13.5 feet. No other ~

development standards apply to this project. The project will also be developed
in and over an existing bioswale that serves this portion of the Intermodal Yard,
represented in Attachment B. The Applicant has proposed enhancing the
bioswale over its entire length, in addition to that disturbed as a result of this
development.
(2) The proposed use shall meet or exceed the performance standards that are required in the
district it will occupy.
(3) The proposed development shall be compatible generally with the surrounding land uses in
terms of traffic and pedestrian circulation, building and site design.
As with similar uses, the PCS system will generate trips during the construction
period and, following the completion of construction, up to 1 trip per month for
maintenance, with no other impacts to pedestrian or transportation movements
anticipated. The facility is compatible with surrounding development as it is
located in an industrial zone and adjacent to an existing cell tower (File No 91-
02).
(4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land
Use Policy Plan

This project must comply with the following Comprehensive Plan policies and
meet necessary Zoning Code regulations.
12.1.34. Actively coordinate project implementation with individual utilities based upon
Tukwila's Comprehensive Plan and development regulations.
The applicant has secured service from Puget Power. The applicant has also
secured telephone services from U.S. West for the site.
12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of
facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure
and use of existing structures. The applicant has included a document called
'Statement of Policy Regarding Antennae Collocation' from AT &T Wireless
(Attachment E). According to the applicant, Sprint Spectrum has tried to
collocate with this carrier on the adjacent monopole, however with costs up to
$100,000 imposed by AT &T, it is not economically feasible to pursue this option.
To minimize visual impacts associated with this project, the applicant has located
the development away from the adjacent residential properties as well as
providing additional vegetative screening. The height of the pole at 80 feet is
also the minimum height necessary for service coverage in this area. The
applicant is required to have the project reviewed under Design Review criteria.
5) All measures have been taken to minimize the possible adverse impacts which the proposed
use may have on the area in which it is located.
The applicant has indicated that the location of the monopole at an industrial use
and the existing and proposed vegetative screen will mitigate adverse impacts of
the project. As the project is also required to go through Design Review,
additional mitigation of adverse impacts will be required. The project was also
reviewed under SEPA , required for telecommunication monopoles in excess of
60 feet.
DESIGN REVIEW CRITERIA
1. Relationship of Structure to Site.
a. The site should be planned to accomplish a desirable transition with streetscape and to
provide for adequate landscaping and pedestrian movement;
b. Parking and service areas should be located, designed and screened to moderate the
visual impact of large paved areas;
c. The height and scale of each building should be considered in relation to the site.
The monopole will be erected within the 81 foot height limit established for this use in
the Conditional Use Permit review process. The applicant has submitted a landscape plan

(Attachment F) showing proposed landscaping will reach 50 to 60 feet in height at
maturity. No on -site pedestrian activity is located near the monopole. No parking will be
required for the development. Much of the height of the monopole will be screened by
existing vegetation from view of surrounding residential properties.
2. Relationship of Structure and Site to Adjoining Area.
a. Harmony on texture, lines and masses is encouraged;
b. Appropriate landscape transition to adjoining properties should be provided;
c. Public buildings and structures should be consistent with the established
neighborhood character;
d. Compatibility of vehicular pedestrian circulation patterns and loading facilities in
terms of safety, efficiency and convenience should be encouraged;
e. Compatibility of on -site vehicular circulation with street circulation should be
encouraged.
Existing and proposed vegetative screening will leave the upper portions of the monopole
visible at intermittent points when viewed from adjacent residential properties. The
visible portion of the monopole, with antennae, have no significant mass. No public
buildings are associated with this project. The proposed 80 foot monopole is
approximately 20 feet shorter than the adjacent monopole, approved under File No. 91-
02. The project is not located within a vehicular or pedestrian route and is purposely
located away from on -site traffic at Burlington Northern Intermodal Yard to avoid
potential conflicts with truck traffic.
3. Landscaping and Site Treatment.
a. Where existing topographic patterns contribute to beauty and utility of a development,
they should be recognized, preserved and enhanced;
b. Grades of walks, parking spaces, terraces and other paved areas should promote
safety and provide an inviting and stable appearance;
c. Landscape treatment should enhance architectural features, strengthen vistas and
important axis, and provide shade;
d. In locations where plants will be susceptible to injury by pedestrian or motor traffic,
mitigating steps should be taken;
e. Where building sites limit planting, the placement of trees or shrubs in paved areas is
encouraged;
f. Screening of service yards, and other places which tend to be unsightly, should be +
accomplished by use of walls, fencing, planting or combination;
g. In areas where general planting will not prosper, other materials such as fences, walls
and pavings of wood, brick, stone or gravel may be used;
h. Exterior lighting, when used should enhance the building design and the adjoining
landscape. Lighting standards and fixtures should be of a design and size compatible
with the building and adjacent area. Lighting should be shielded, and restrained in
design. Excessive brightness and brilliant colors should be avoided.
Attachment F is the Landscape Plan for the project. The applicant has proposed planting
nine - 5 foot leylandi cedar and thirteen (13) photinia fraseri of unstated height. An
automated irrigation system has not been proposed. The applicant has also included
information on shrub / ground cover planting but have not indicated their placement. The

two - tiered year -round vegetative screening is designed to screen the development as
much as possible from off -site residential uses. Much of the view from adjacent
properties is already screened by the existing landscaping. The applicant will locate the
development on and adjacent to an existing bioswale, which they have indicated will be
restored following project completion. The location of the development is generally
located away from vehicular traffic by existing curbs and distance from traffic areas. The
only lighting associated with the tower may be a FAA required red beacon. The
monopole is removed from general public access and will be fenced for safety and
security.
4. Building Design.
a. Architectural style is not restricted, evaluation of a project should be based on quality
of its design and relationship to its surroundings;
b. Buildings should be to appropriate scale and in harmony with permanent neighboring
developments;
c. Building components such as windows, doors, eaves, and parapets should have good
proportions and relationship to one another. Building components and ancillary parts
shall be consistent with anticipated life of the structure;
d. Colors should be harmonious, with bright or brilliant colors used only for accent;
e. Mechanical equipment or other utility hardware on roof, ground or buildings should
be screened from view;
f. Exterior lighting should be part of the architectural concept. Fixtures, standards, and
all exposed accessories should be harmonious with building design;
g. Monotony of design in single or multiple buildings projects should be avoided. Variety
of detail, form and siting should be used to provide visual interest.
Much of the criteria in this section are not applicable with the exception of color and
mounting of the antennae. The applicant has provided 2 computer photo simulations
(Attachment G) showing both a light and dark color for the monopole. The applicant has
also proposed mounting the antennae on a single bar, perpendicular to the monopole.
S. Miscellaneous Structures and Street Furniture.
a. Miscellaneous structures and street furniture should be designed to be part of the
architectural concept of design and landscape. Materials should be compatible with
buildings, scale should be appropriate, colors should be in harmony with buildings and
surroundings, and proportions should be to scale;
b. Lighting in connection with miscellaneous structures and street furniture should meet
the guidelines applicable to site, landscape and buildings.
Other than the associate ground equipment, there will be no other
miscellaneous structures.

CONCLUSIONS
The Planning Commission, pursuant to Tukwila Municipal Code (TMC) Section
18.108.040, hereby makes the following findings and conclusions first under the city's
Conditional Use Permit criteria (TMC 18.64.050) and then followed by the city's Design
Review criteria (TMC 18.60.050)

month for scheduled maintenance. No other impacts to transportation system are
anticipated. The facility is compatible with other land uses in its zone. All operating
equipment is located in locked cabinets. Vegetative screening is appropriate.
Therefore, all conditions are satisfied.

The project will have the necessary electrical services for its operation. The applicant is
unable to share infrastructure with AT&T. Visual impacts are minimized by painting
the monopole and by using simplified mounting to reduce visual clutter. Therefore,
conditions have been satisfied.
(5) All measures have been taken to minimize the possible adverse impacts...
In addition to painting the monopole to blend with surroundings, vegetative screening
that will, at maturity, cover 2/3 of the height of the monopole. The project was
reviewed under SEPA, with a Determination of non - significance. Therefore, all
conditions have been satisfied.

project. The development will be screened by existing and proposed vegetation. Therefore,
criteria is addressed and satisfactorily met.

Existing and proposed vegetative screening will adequately limit visibility of the antennae and
monopole. The proposed monopole is shorter than the previously approved adjacent monopole.
The project will not impact pedestrian or vehicular movement. Therefore, criteria is addressed
and satisfactorily met.
(3) Landscaping and Site Treatment.
The landscaping for the project is appropriate in its design and screening, however height of the
photinia fraseri should be indicated. Manual landscape irrigation may be allowed for uses in this

RECOMMENDATIONS
Staff recommends approval of the Conditional Use Permit and Design Review
applications, with the following conditions.
1. At the time of submitting for a Building Permit, the applicant provides a detailed

2. The color of the monopole shall be the lighter color as depicted in Attachment G
to this report.
3. A revised landscaping plan with non - deciduous trees that are a minimum of 10

PROJECT INFORMATION
The Walter Group, on behalf of Sprint Spectrum, has filed an application for a
Conditional Use Permit and Design Review, Numbers L97 -0030 and L97 -0031, to
construct a Personal Communication System (PCS) Base Station, comprised of an
80 foot monopole, with up to 12 antennae and operating equipment at 12400 - 51st
Place S. You are invited to comment on the project at the public hearing scheduled for
August 28, 1997 at 7:00 p.m. before the Planning Commission. The hearing will take
place at City Hall in City Council chambers, 6200 Southcenter Blvd. To confirm the time
and date before the hearing, call the Department of Community Development at 431 -
3670. For further information on this proposal, contact Michael Jenkins at 431 -3685 or

Accompanying this cover letter, please find an envelope containing two more sets of
mailing labels for the property in question.
Please also find a letter from ASAC ("Airspace Safety Analysis Corporation") which
indicates that FAA safety lighting will not be required for the proposed monopole. In a
number of different places the application materials state that the safety lighting may be
required; this letter from ASAC confirms that such lighting will not be required.

Site ID# /Name: SETA - 008 -07 /Tukwila
Airspace Safety Analysis Corporation (ASAC) has conducted an aeronautical study on June 2,
1997 for Sprint PCS. The study was to determine a proposed structure's effect, if any, on
navigable airspace. ASAC's study is conducted in accordance with Part 77 of the Federal
Aviation Regulations, FAR (14 C.F.R. Subchapter E, Part 77) and Part 17 of the Federal
Communications Commission, FCC Rules and Regulations (47 C.F.R. Part 17). The proposed
construction site is located in the Seattle, Washington MTA. The NAD 83 site coordinates are
Latitude 47° 29' 25.00" North, Longitude 122° 16' 25.00" West. The site has a surface
elevation of 25 feet above mean sea level (MSL), the structure has a proposed height of 85 feet
above ground level (AGL), which includes the additional height of any antennas, etc. This gives
an overall structure height above mean sea level of 110 feet AMSL.
For regulatory compliance purposes, the nearest landing surface, the approach end of Runway
31L at Boeing Field /King County International Airport is located 10,595 feet or 1.74 nautical
miles on a True Bearing of 335.72 degrees from the proposed site. The runway elevation at this
point is 17 feet AMSL. The airport reference point (ARP) at this public use, instrumented
airport is located 16,090 feet or 2.65 nautical miles on a True Bearing of 334.20 degrees from
the proposed site.
FAR Part 77 prescribes various airspace surfaces and slopes established at and around airports.
Part 77.13 prescribes slopes and surfaces which, if exceeded, require the sponsor of the structure
to provide the Federal Aviation Administration with Notice of Proposed Construction. FCC
Rules Part 17 also specifies this requirement. Additionally, Part 77 Subpart C prescribes various
airspace surfaces and slopes which, if any exceeded, require the FAA to provide public notice
inviting comments prior to issuing a determination. Subpart C also prescribes surfaces and
slopes which, if exceeded, would identify the proposed structure as a Hazard to navigable
airspace.

not exceed any FAR Part 77 or FCC Part 17 notice requirement surface. Therefore, FAA Notice

the proposed 85 feet AGL (110 feet AMSL) structure will be approved at this site upon
completion of the FAA's aeronautical study.

Applicant's Analysis of Design Review Guidelines and Policies
with respect to an
Application to Place a PCS Support Structure at the Burlington Northern Intermodal Yard
for Sprint Spectrum
To provide PCS or "personal communications service" to the surrounding area,
Sprint Spectrum proposes to place an 80' monopole at the Burlington Northern
Intermodal Yard. PCS licenses were auctioned off by the Federal Communications
Commission (the "FCC ") to respond to growing consumer demand for the convenience
and safety of wireless communications. Sprint Spectrum ( "Sprint ") is pleased to bring to
Washington a state -of- the -art alternative to incumbent cellular telephone companies.
The Burlington Northern intermodal yard is located in a heavy industrial zone,
height limit of six stories (or 81'), next to the railroad and I -5. The intermodal yard
serves as a point for transferring shipping containers from trucks to railcars. As a
consequence, the area experiences relatively heavy truck traffic and associated industrial
uses.
Approximately 250' to the east of the proposed site, across 51st Place South in
Allentown, the zoning changes to single family. A substantial amount of vegetative
screening separates the proposed facility and Allentown. The proposed facility is
screened to the south and south -west by a tall bank of dense evergreens along 51st Place
South which were planted to screen the intermodal yard from the residential area.
Approximately 100' to the south -west of the proposed site is an existing 100' monopole
owned by AT &T. Being direct competitors, AT &T is unwilling to lease space to Sprint
under commercially reasonable terms (see discussion below under "Design Review
Policies based on Comprehensive Plan "). The AT &T site is screened from the residential
area by a tall bank of deciduous trees. This screening will also contribute to screening
Sprint's proposed installation.
To the north and west of the proposed site there are a significant number of
naturally occurring trees both on and off of the Burlington Northern property.
Consequently, views from these directions of the 100' AT &T monopole area are
intermittent. To ensure that Sprint's 80' facility is effectively screened from Allentown,
Sprint will also add vegetative screening around the north -west and south -west sides of
the proposed facility. This screening is proposed to consist of 50' to 60' Leylandyii
Cedar and 20' Photina (an evergreen shrub whose new foliage is red). This will leave
only the top 20' to 30' of the proposed facility within the potential view of Allentown.
Please see the accompanying photographs which have been altered to depict
approximately how the proposed facility will appear. Please also note that these
depictions do not include the vegetative screening to be maintained by Sprint (depicting
trees in a realistic manner is difficult and they were left out for the sake of clarity). It
should also be noted that the areas to the east of the proposed site are only visible from
the railyard and I -5 and do not represent areas which could be characterized as having
view sensitivity.
Following is a point -by -point analysis of the Design Review Guidelines as
outlined by the City's application materials.

visible on an intermittent basis from the adjoining residential area and, even then, it will
only be visible at distances greater than the length of a football field. The 20 to 30 feet of
the slender monopole and the skeletal antenna mount which will be visible above the
proposed vegetative screen will not be massive objects which could dominate the visual
landscape.

in an intensively used industrial area. The small 20 by 40 foot area at the base of the
tower will be fenced for safety and security.

important axes, and provide shade.
The proposed bi -level landscaping is designed to screen the base of the facility
and as much of the monopole as is possible. It is far enough from neighboring properties
that no shade will be provided to neighbors. When viewed from the residential area of

travels. The proposed landscaping may contribute to softening views of this high -use
travel corridor.

At the time that this application was prepared, Sprint was still waiting to hear
from the Federal Aviation Administration ( "FAA ",) regarding whether or not a red beacon
light will be required to be placed at the top of this monopole. Otherwise, there will be
no lighting.
D. Building Design
The guidelines under this heading do not apply to this project. The proposed
facility has a utilitarian purpose which greatly constrains the project's design. The
monopole is proposed to be a flat non - reflective steel gray and the antennas mounted to
the top of it will be similarly colored. The base of the facility and 50' to 60' of the
monopole will be effectively screened by the landscaping which was discussed above.

E. Miscellaneous Structures and Street Furniture
The base of the proposed facility will consist of five or six refrigerator sized metal
equipment cabinets (30" by 30" by 5'6" tall) painted a light cream color and a tank of
natural gas which will provide back -up power. This equipment will sit inside of a fenced
area 20 by 40 feet. As discussed above, this ground area will be effectively screened from
adjacent residential properties by landscaping.
III. DESIGN REVIEW POLICIES based on Comprehensive Plan
J. Public Facilities/Utilities /Streets
The only policies relevant to this proposal are as follows:
2. Where technically feasible, the utility or agency should consolidate its facilities
with others and minimize visual impacts of facilities.
3. Sharing of cellular communications towers, poles, antennae, trenches, easements
and substation sites in encouraged.
These policies require a discussion of collocation and the site selection process.
While it may be technically feasible to collocate this facility on the neighboring
AT &T monopole, it is, unfortunately, the policy of AT &T to ask for terms which are not
commercially reasonable. Sprint is a new competitor threatening the incumbent carriers'
positions; asking the carriers to share facilities is akin to asking Burger King or
McDonaIds to share facilities with the up- and - coming Subway.
The accompanying "Statement of Policy Regarding Antenna Collocation" from
AT &T spells out AT &T's demands. Essentially, if an "immediate, equitable" swap (a
one - for -one exchange of collocation sites in areas which are considered comparable in
terms of zoning difficulty) is not available, then AT &T demands $100,000 per year for a
lease with only a two year term and subject to a number of other restrictions regarding use
of utility easements. The typical rent for locating on an existing tower runs between
$6000.00 and $12,000.00 per year (depending on local real estate conditions) for a lease
with a term of 10 to 25 years.
AT &T's rental demand is approximately ten times the market rate (without even
taking into account the short term of the lease and the other restrictions placed upon it)
and is clearly meant to be uneconomic. Along these lines it is instructive to read the
bottom paragraph of page two of the "Statement of Policy Regarding Antenna
Collocation." Addressing the circumstances of a swap which becomes one -sided (i.e.
Sprint and AT &T "swap" collocation sites and do not pay one another any money. Then
Sprint leaves AT &T's tower before AT &T is ready to leave Sprint's tower. The
question: How much rent would AT &T then begin to pay for the remainder of the lease
term on Sprint's tower ?) AT &T states that the rent for the remainder of the term for the
remaining carrier would be $10,000.00 per year, not $100,000.00 per year.
Because AT &T's system is basically complete, the opportunities for an immediate
and equitable swap of comparable sites are few. In fact, there is only one site of Sprint's

which AT &T is interested in and the corresponding AT &T site has already been chosen.
Consequently, collocation is not an option at this location.
Sprint has, however, made it a policy to build all of Sprint's antenna support
structures with sufficient excess structural capacity to accommodate at least one future
collocator. Sprint has already established commercially reasonable master lease
agreements with Airtouch, GTE PCS, and Western Wireless. Should one of these carriers
or another carrier wish to collocate at this site, it will be available and will thereby serve
to reduce the need for additional antenna support structures in this vicinity.
Apart from the question of collocation, a number of other locations were
considered for the proposed facility. The nearby Boeing Employee Credit Union building
is certainly tall and massive enough to make an excellent and unobtrusive location for any
number of wireless carriers. Unfortunately, the property owner, notwithstanding
advances made by a number of carriers, is uninterested in leasing roof space. There are
no other large buildings in the area which could serve as a tall enough platform.
A number of alternative locations for a monopole were considered near the
intersection of Interurban Avenue and I -5. The Hill Investment Company owns a
warehouse (now used as a furniture store) at 13400 Interurban Avenue South. This site
was close to residential uses and was also immediately next to the Duwamish river. Due
to proximity to the river, this site would have required the construction of a massive pier
system to support the monopole (five six foot diameter steel and cement piers sunk to a
depth of greater than 50 feet) and it would have required literally ever type of land use
application which the City of Tukwila offers. In addition, the southerly location of the
site was less than ideal from a coverage perspective and the monopole would have had to
have been 100 feet tall. The Texaco sign on the north side of the intersection of I -5 and
Interurban Avenue South was also considered. The Texaco sign, however, was neither
strong nor tall enough to serve as an appropriate location (in addition, impending City
regulations regarding the height limit in this area and non - conforming signs will result in
a further reduction of this sign's height). Other land owners to the south of Allentown
were approached as well, but in the end Burlington Northern emerged as the only willing
landowner in an appropriately zoned area.

STATEMENT OF POLICY
REGARDING
ANTENNA COLLOCATION
POLICY
AT &T Wireless Services (Washington District) has received numerous requests for collocation
of facilities by competitors who are new to the Washington market. AT &T Wireless Services
has invested over a decade in the development of a proprietary system of antenna facilities. This
existing system is quite attractive to a number of competitors who are faced with the daunting
prospects of constructing a system, equal in quality and scope, in a much shorter period of time.
While we have no obligation to make it easier for our competitors to build their business, we do
have an obligation to continue to develop our own system to better serve our customers, and we
do recognize that we all have the obligation to develop antenna sites wisely and responsibly.
Therefore, in certain circumstances, we have in the past, and will in the future allow other users
to locate on existing facilities or jointly develop antenna facilities. We have a long standing
policy, currently in effect with the existing wireless communications providers, of collocating
facilities where immediate, equitable swaps are available. ATTWS is actively pursuing
locations statewide and recognizes the advantages, in terms of time and ease of obtaining land
use permits, afforded by locating on an existing facility. Therefore, all requests for collocation
will receive consideration according to the following priorities:
1. Requests from affiliated entities
2. Requests from non- competitive users (emergency services, etc.).
3. Requests from competitors with immediate opportunity for site reciprocation where the
reciprocal site is located in the same or adjacent land use jurisdiction
4. Requests from competitors with immediate opportunity for site reciprocation where the
reciprocal site is not located in the same or adjacent land use jurisdiction
5. Requests from competitors offering financial remuneration.
Collocations will be accomplished according to the following guidelines:
' 1. There must be significant siting benefits to ATTWS and its customers
2. There must be significant benefit for the community
3. ATTWS must ensure that its future capacity needs for that location are reserved
4. In no event will competitive users be allowed access to shelters owned and occupied by
AT &T Wireless Services.
5. AT &T Wireless Services will make no representations regarding rights to real property
involving leasehold estates or access and utility easements. Collocating parties will, with
certain exemptions, be required to obtain stand -alone leases and easements from the property
owner.
6. In the event that a collocation is granted with no site reciprocation, maximum length of
tenancy will be two years.

If the results of the final analysis are positive, agreements will be diligently prepared and
- executed according to the terms listed below.
TERMS
Ilan equitable, mutually acceptable, reciprocal collocation agreement is negotiated, all terms and
conditions, including rent and fees will be considered offsetting and no compensation will be due
either party and all review fees shall be refunded or credited back. The parties will execute
mutually agreeable leases, subleases, easements or licenses as appropriate and will cooperate to
the extent necessary in the application and acquisition of land use permits. The terms of the
collocation agreements shall be identical. If, for any reason other than by the actions of the other
party, one party vacates a site offered as compensation on a site swap, rent shall be due on the
remaining site in the amount of $10,000 per year. The term shall be considered the remainder of
the then current lease term, with a minimum term of one year. If a site is vacated for reasons
necessitated by the actions, conduct or default of the tower owner, an alternate, mutually

acceptable trade site shall be identified within 60 days or the collocation shall be considered
canceled and all antennae shall be removed from the respective towers at the end of the 60 day
period.
If no equitable, mutually agreeable collocation agreement can be made, the parties will execute a
revocable tower license agreement. This agreement shall have a maximum term of two years
with no renewal options. If, at any time during the two year license agreement, an acceptable
trade is identified, the license will be replaced with a collocation agreement as specified above.
No rents paid for prior periods shall be refundable, but pre -paid rents shall be prorated and
credited or refunded upon completion of construction at the reciprocal site.
FEES
All fees shall be paid as above specified. Rent for an unreciprocated collocation shall be
$100,000 per year, payable in advance.
