Mark Travers Appeal of Code interpretation and setback variances, File No. L97 -0035 Dear Mr. Kaufman; This is to request reconsideration of your decisions on the above matters and to request an extension of time for Mr. Travers to make a proper request himself.. My wife and I are the owners of the subject property and signed an earnest money agreement with Mr. Travers on May 9, 1997 in which he agreed to buy the property contingent on being able to obtain a building permit. He has expended considerable time and money on this effort. He and his wife are in Europe and have not received your decision yet. He is expected back April 7th. I have no way of reaching him and have had no discussion with him since his original application last June. Since he has put so much effort into it I am willing to go along with him as long as necessary and would appreciate a 30 day extension until April 26, 1998 to allow him a chance to work out another solution. My son Patrick Stark, my agent on the sale, has given me a copy of your decision and I have been checking on the situation with the City. Since the City has sent me no notices of any kind since this application was started, I have had to start from scratch and review the files. I found a survey in the City's file done by Arnett Inc. in July 1997 showing larger dimensions than their report stated. This survey shows the property to be a right triangle, 61.62 feet on the northwest, 57.06 feet on the northeast and 84.07 along the arc on South 133rd Street, making a total size of about 1821 square feet not 1528. Your findings in paragraphs 4 and 5 for both the Variance and the Appeal seem to be based on erroneous measurements. The City's reports and therefore your findings, refer to a sensitive area and class 2 watercourse along the northeast line in S. 131st Street. This is actually just a ditch, which appears to have been dug by the County years ago. The Arnett survey shows the bottom of this ditch is level opposite our property line and a little lower near our southeast and northeast property corners. On Monday evening , March 23rd, after two days of heavy rain there was no flow of water in this ditch. Although this ditch was designated a type 3 (not a type 2) watercourse in the City commissioned Jones & Stokes Watercourse Study and Rating Data Sheets, it does not appear to be a watercourse at all by the 18.06.920 Watercourse definition of the 1997 City Zoning Code. It is evident from your findings there is confusion as to exactly where the parking is proposed. The plans were confusing as to the precise location of a stall, inside or outside parallel to the curb and because the traffic consultant showed a "U" turn in the street, someone seems to have assumed a "U" turn is necessary. Surely a left turn could be prohibited when leaving , as it frequently is on busy streets. A more detailed parking diagram showing 35 -foot curb cuts and parking stalls at the extreme southeast and southwest comers should allow ample room to maneuver entirely on the property. If this won't meet the city's requirements it will be necessary to have access from south 131st street. The neighbor to the west, Mr. Gayther, has a wide driveway. from .South I3Ist across the ditch. I don't have the expertise to address the 0 lot line problem. That will have to wait for Mr. Travers return. Please allow a 30 -day extension so Mr. Travers can work these problems out. The official record is recorded on tape. The hearing opened on Tuesday, February 23, 1998, at 7:00 p.m. in conference room #3 at the Tukwila City Hall. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: JExhibit No. l: File containing the subject citation and letter of appeal, and report to Examiner Exhibit No. 2: Memorandum to Michael Jenkins from Gary Barnett dated February 18, 1998 This hearing is an appeal from provisions and interpretation by the Director of Public Works of TMC 18.56.040(5)(b) regarding maneuvering under the Parking and Loading Ordinance for the City of Tukwila. A further item is approval of three variances: to reduce a front yard setback from 25 feet to 10 feet; to reduce the front yard landscaping from 12.5 feet to 10 feet; and reduce a side yard setback from the required 5 feet to zero lot line. Michael Jenkins, City Planner, City of Tukwila, 6200 Southcenter Boulevard, Tukwila, Washington 98188, stated that the City received from applicant an appeal of the Director of Public Works code interpretation. The City does not support the request by the applicant and believes that the code interpretation was reasonable given the numerous safety concerns based upon the application materials presented. Staff believes the applicant is attempting to utilize public right -of -way to complete required turning and maneuvering movements that violate the code. The determination of the Director is based upon a number of factors including the applicant's own traffic analysis, the site plan, and numerous other factors including posted speed of the road, the angle, and the use of a public right of way to complete required on -site turning movements. If this appeal is denied, the applicant would have to redesign their access to the parcel to maintain all turning movements on the parcel in support of the code. The Public Works Department is interpreting maneuvering and parking to mean something that he interpreted in a different way and that this ordinance is pretty broad and vague. In looking at access off 133rd, the applicant did some title investigation. At the time that this parcel was legally established, there was some thought as to how the access would be preserved. Mr. Travers' interpretation of the code was that parallel parking on the site next to the building met the minimum required standards. A traffic study was then prepared which indicated sight distances and safety of access. A diagram in the study illustrates that the turning movements in any direction would be initiated on site and not completed in the right of way. A vehicle could enter the right of way heading westbound alongside the building with very little turning radius involved; it would be a shallow S- shaped maneuver to get onto the right of way. A U -turn, which is indicated as being a safe maneuver according to the traffic consultant, is also possible. The conclusion in the traffic study clearly says the project site can be safely accessed from S.133rd from the perspective of entering sight distance and from that of turning vehicle paths. There could either be a rolled curb or some sort of barrier so vehicles could not back out onto the roadway. A discussion ensued regarding the angle at which a driver would have to check for approaching traffic, both east and westbound. Mr. Travers stated that the code does not specifically call out a 90 degree attitude for the vehicles in this instance. Patrick Stark, 8826 2nd Avenue S, Seattle, Washington 98108, representing petitioners herein, expressed his confusion over the contradictions between the City and the traffic study. He also questioned whether making a U -turn in mid -block was an illegal act. He also suggested that a sign be posted stating no left turn. Gary Barnett, Senior Engineer, Public Works, City of Tukwila, 6200 Southcenter Boulevard, Tukwila, Washington 98188, responded that a U -turn is illegal mid -block under most motor vehicle codes. He stated that the access from this site is structured as being a U -turn, originating on private property and completing that turn in the traveled right of way. The difficulty here is the driver has to look fully over his shoulder, 180 degrees, to see traffic even to pull out and just move ahead without making a U -turn to go back eastbound. The other difficulty is not coming away from the curb and pulling out into traffic, but crossing a sidewalk and/or shoulder. The more normal direction is approximately 90 degrees to traffic where one is able to turn and look left and right, to see clearly in both directions, not only vehicles but pedestrians. Staff concurs that the site does have a legal access as granted through the deed, but conversely, it must be safe. In most cases it is presumed and expected that a vehicle is starting at a 90 degree position. If the car can be oriented about 90 degrees to the traffic, then the traffic studies show there is adequate sight distance. Regarding the variance portion of the hearing, Mr. Jenkins reported that the zero lot line would be on the northwesterly portion. The northeasterly portion of the building also shows 17 feet 6 inches measured between the external wall and the property line which may or may not include the ordinary high water mark for the Type 2 water course that runs along the property line. The parcel in question is 1,528 square feet and is triangular in shape. In terms of the size and shape in relation to the other parcels in the surrounding area and the zone, it is quite small. There is a limited access on the parcel. The Type 2 water course which is located along the east property line also impacts development proposal. In this Commercial/Light Industrial zone, there is no minimum lot size requirement. The property is affected by the City's sensitive area ordinance that limits the developable area of the parcel, leaving the applicant with Little or no developable area. The proposed use which Mark Travers Appeal of Setback Variance File No.: L97 -0035 March 12, 1998 Page 3 is an office /warehouse is a permitted use in this zone and does support Comprehensive Plan policies towards development of the Interurban corridor. The lot appears to be an artifact of a larger lot that was created through development and realignment of adjacent transportation routes which has limited development possibilities for the parcel; hence its previous undeveloped status. In conclusion, staff supports approval of the three variances requested by this applicant. The adjacent parcel has a few buildings on it and is currently under - developed. It is currently a non- conforming but legal use in the zone. The Examiner inquired if the adjacent neighbor would be constrained by this zero lot line clearance. Mr. Travers responded that it would not necessarily impact that parcel. This applicant is required to put in a • special fire wall and that the exterior siding planned is metal, which would require no or low maintenance. Jim Gayther, 4410 S. 133rd, Tukwila, Washington 98168, adjacent landowner, stated this his main concern is the removal of the vegetation which currently acts as a screen. He was also concerned about the impact of the zero lot line clearance to any future development on his parcel, and objected to the granting of the variance. Jack Pace, Planning Manager, City of Tukwila, 6200 Southcenter Boulevard, Tukwila, Washington 98188, responded that there are many variables to be considered, particularly regarding proposed uses for the building, the materials and construction techniques to be used on the neighboring site. Further discussion ensued regarding the location of a parking stall inside the building, as well as the tandem stalls indicated parallel to the street. Betty Gully, 13017 Macadam Road S, Tukwila, Washington 98168, a resident in the area, stated her concerns regarding the necessity of granting variances. She stated that City codes and City planning studied these spaces that need to be saved, and when one variance is granted a precedent is set and eventually everything is mitigated away. Brian Shelton, City Engineer, Public Works, City of Tukwila, 6200 Southcenter Boulevard, Tukwila, Washington 98188, stated that future street improvements and access to the property are considerations to be taken into account. Mr. Travers responded that it is the present circumstances under which this variance is requested. Progress occurs all the time and there are all sorts of existing circumstances that come up that no engineer would like to deal with in the present or in the future. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. CONCLUSIONS & DECISION Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: z ~ • w; g • J U. U O. 1. The appellant, Mark Travers for Ben and Darryl Stark, filed an appeal of an administrative LU determination that barred developing parking that required maneuvering on the public right -of -way. 2 u- w O; g Q. d:. • w, z� o 4. The south property line, the 133rd frontage, is approximately 78.42 feet long. The northeast angled w property line is approximately 52.78 feet in length. The northwest angled property line is 2 D approximately 57.92 feet in length. o O Di The parcel is approximately 1,528 square feet or 0.03 acres in area. w U: U. 6'. z US O z 2. The subject property is located at 4350 South 133rd Street in the City of Tukwila. 3. The parcel is a triangular shaped parcel. It has frontage along S. 133rd Street, an open public street. It also has a frontage along S. 131st Street. The parcel apparently does not have access to S. 131st Street due to a water course which is designated a sensitive area. 6. The record reveals that the parcel is a remainder parcel created when a street was aligned across a larger parcel segregating the subject site from the much larger parcel. It appears that the then owners did reserve "the right of reasonable access to Relocated South 133rd Street" when the right of way was conveyed. The development proposal is the subject of a separate public hearing to determine whether a series of variances from the setback requirements are appropriate. 8. It appears that the proposal requires two parking stalls for the proposed building. 9. The record reveals that the full nature of the proposed parking was not clearly understood from the plans that were submitted for the proposal. The floor plans reveal a parking stall located immediately parallel to the street frontage along S. 133rd Street and another area that appears to be interior to the building labeled "8' X 20' STALL." (A second floor plan shows this as "9' X 20' STALL. ") It would appear that this stall was interior or under the building and contained within the building footprint. 10. The City through Ross A. Earnst, P.E. determined that the parking stall located adjacent to S. 133rd did not comply with the provisions of Tukwila Municipal Code (TMC) Section 15.56.040(5)(b). 11. TMC 15.56.040(5)(b) states: Turning and maneuvering space shall be located entirely on private property unless specifically approve by the Public Works Director and the Board of Architectural Review. Mark Travers Appeal of Setback Variance File No.: L97 -0035 March 12, 1998 Page 5 (c) 015.56.040(5) All parking spaces shall be internally accessible to one another without reentering adjoining public streets. 12. During the course of the two hearings, it became clear that there was a misunderstanding of some aspects of the proposed plans, particularly the location of the two required parking stalls. Questions were raised regarding the access to the "interior" stall and its access since it did not appear to meet maneuvering requirements either. It was then noted that this was not the proposed required, second parking stall. Instead it was noted that the two required stalls were both aligned immediately adjacent to S. 133rd. 13. The two stalls located along S. 133rd Street can best be described as two parking spaces that might be found on a street which allowed parallel parking; that is, the two stalls are aligned with the curb line. One or both of them would require the normal parallel parking maneuvers which entail pulling forward or adjacent to already parked vehicles and backing and turning to maneuver the vehicle into the space adjacent to the curb line. In this case, the stalls themselves are not located on the public street. They are located on the private parcel but immediately interior to the normal "curb" line. So vehicles would stop on S. 133rd, a public street, and proceed to maneuver into the off - street parking stalls. 14. The City maintains that this type of maneuvering on the public street is prohibited by the noted Code provisions. In addition to the prohibition, the City also maintains that such parking would not give a driver leaving one of these spaces a clear view up and down (west and east) the street as would a parking stall that had its access from a more normal driveway set at 90 degrees to the street. 15. The applicant's traffic engineer disputes the sight clearance issue maintaining that it would be reasonable and safe. CONCLUSIONS: 1. The appellant has the burden of demonstrating that the decision was either in error, or was otherwise contrary to law or constitutional provisions, or was arbitrary and capricious (Section 4- 3011(B)(1)(b). The appellant has failed to demonstrate that the action of the City should be modified or reversed. The decision is affirmed. 2. Arbitrary and capricious action has been defined as willful and unreasoning action in disregard of the facts and circumstances. A decision, when exercised honestly and upon due consideration of the facts and circumstances, is not arbitrary or capricious (Northern Pacific Transport Co, v Washington Utilities and Transportation Commission, 69 Wn. 2d 472, 478 (1966). 3. An action is likewise clearly erroneous when, although there is evidence to support it, the reviewing body, on the entire evidence, is left with the definite and firm conviction that a mistake has been committed. (Ancheta v Daly, 77 Wn. 2d 255, 259 (1969). 4. The appellant has failed to demonstrate that the decision was founded upon anything but a fair review of the Code provision as it pertains to the proposed parking. The appellant has failed to demonstrate with cogent evidence that a mistake was made. 5. It does not appear that either side understood all of the issues involved in this application and how City law affected it. The plans are not clear as to the location of the second required stall. Unless approved by the Public Works Director, parking and the maneuvering necessary to access the parking must be completely off the public right -of -way. It must be contained on the principal lot. The two parking stalls located along the frontage adjacent or nearly adjacent to the property line do not satisfy the Code requirements. If one of the stalls is in use, maneuvering will occur on the street. It is not even clear that one stall can be accessed without some maneuvering occurring on the right -of -way. 7. It is not clear that the use of these stalls would be as safe as if they were configured as required with maneuvering on the parcel. Since the safety of the access is fairly debatable, it cannot be shown that a mistake was made. If one is to err on one side or the other, going with the City determination provides a margin of safety inherent in keeping maneuvering off of the arterial street. 8. Since the burden of demonstrating error is on the appellant, this office can reach no other conclusion but that staff made the correct determination. The decision below must be affirmed. DECISION: The appeal is denied. VARIANCE 1. The applicants, Ben and Darryl Stark, filed an application for three variances from setback and landscape requirements to construct a combination office and warehouse building. 2. The subject property is located at 4350 South 133rd Street in the City of Tukwila. 3. The parcel is a triangular shaped parcel. It has frontage along S. 133rd Street, an open public street. It also has a frontage along S. 131st Street. The parcel apparently does not have access to S. 131st Street due to a water course which is designated a sensitive area. 4. The south property line, the 133rd frontage, is approximately 78.42 feet long. The northeast angled property line is approximately 52.78 feet in length. The northwest angled property line is approximately 57.92 feet in length. 5. The parcel is approximately 1,528 square feet or 0.03 acres in area. 6. Tukwila Municipal Code (TMC) 18.30.080 requires a 25 foot front yard setback. The applicant has requested that it be reduced to 10 feet. 8. TMC 18.30.080 also requires 12.5 feet of landscaping along the frontage. The applicant has asked that this be reduced to 10 feet. The property is located in the Commercial/Light Industrial (C/LI) zone. 2 J 12. The applicant proposes developing a two -story, 992 square foot building. N a. Iw 13. The subject site is vacant and relatively level. z = 1--. i— O: 14. The surrounding properties are similarly zoned C/LI. z IIJ g ui 15. Variances for adjacent developments were approved to allow the placement of utility vaults in the v required front yards. '0 -' 16. The Comprehensive Plan designates the area in which the subject site is located for commercial and F=.. v, industrial uses. u- r- - z 17. If the variances are not approved, the applicant would be left with a very small developable footprint. v - 18. Staff was not sure what, if any, additional development requirements might be imposed on the adjacent z parcel if the zero setback were approved. Approval of a zero setback would place the applicant's building directly on the common property line. A zero setback could require cooperation from the adjacent property owner for maintenance and construction although it may be possible to work around these constraints. A Type 2 water course along the northeast property line requires a 35 foot buffer from the Ordinary High Water Mark (OHWM) and a 15 foot setback requirement from the buffer's edge. A separate request to reduce the 35 foot buffer to 17.5 feet and reduce the 15 foot setback to zero (0.0) is subject to review by the Director of Community Development. That review has not been completed. Staff has assumed the buffer reductions will be approved. . 19. The adjacent property owner objected to the approval of the variance for the zero setback adjacent to his parcel. 20. The project requires two parking stalls. A separate administrative determination found that the proposed parking stalls did not meet the code. The stalls necessitated maneuvering on the public right- of -way which is prohibited. 21. A separate administrative appeal was heard in conjunction with this request for variance relief. That appeal was denied. The denial could mean that the project be redesigned to accommodate parking in some other location. CONCLUSIONS: 1. Variances may be granted when the property generally satisfies all the conditions described in part below: a. The approval will not constitute a special privilege inconsistent with the limitations on other property in the vicinity; Mark Travers Appeal of Setback Variance File No.: L97 -0035 March 12, 1998 Page 8 z , b. The applicant suffers undue hardship caused by special circumstances such as: the size, shape, topography, or location where code enforcement would deprive the owner of rights and � w privileges enjoyed by others similarly situated; o: g J U• c. The granting of the variance would not materially harm either the public welfare or other U o. property in the vicinity; ' w w J H, d. The approval will not adversely affect the implementation of the Comprehensive Plan; and CO u-' w0 e. The approval is necessary for the preservation and enjoyment of a substantial property right. g' J The applicant's property appears ripe for the front yard setback and landscaping variances requested. N d The variance from a zero setback on the northwest is inappropriate. H w z z H;. 2. As noted above, variances have been issued for the placement of vaults in the front yard setbacks on Z O: nearby property. In addition, the unique character of the subject site indicates that similar variances w w would need similar justifications. A special privilege is not being granted. .2 m U� 3. The parcel begins as a fairly small parcel and is then further constrained by its triangular shape and the 'p Co C2` location of a protected water course. At the meeting, applicant was informed by the Planning Division of several issues concerning development of the site and the need for a variance from several standards. Applicant was informed of the following issues that are the basis of their application: • Site has a sensitive area (watercourse) • SEPA checklist would be required where work occurs in a watercourse • Minimum setback requirements, maximum building height, minimum parking and minimum landscaping requirements The city's Urban Environmentalist assessed the watercourse for this application and determined that the watercourse has a Type 2 rating on the embankment interior to the lot. This rating was determined by review and application of Tukwila's 1990 Watercourse Rating Data Sheets. The property is located in the Commercial /Light Industrial (C /LI) zone and the proposed use is permitted in this zone. Two separate variances were granted for adjacent developments at 4385 S. 133rd in 1986 under Case 86 -V -36, to allow placement of utility vaults in a required front yard setback area. (2) The variance is necessary because of special circumstances relating to size, shape, topography, location or surrounding of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. Attachment D is a copy of a warranty deed approved by the State of Washington Department of Highways dated March 13,1964 creating a limited access point on S. 133rd to this parcel. The parcel is generally flat, although there is a type 2 watercourse located along the east property line. The watercourse runs in a generally north -south direction and affects other properties in the area. Attachment E is a map created by staff that shows the developable area based on strict application of the city's zoning code. There are no development standards in the C /LI zone that pertain to minimum lot size. As previously indicated, surrounding properties are of a more uniform shape and size to accommodate development. The property is affected by the city's Sensitive Area Ordinance (TMC 18.45) that limits the developable area of the parcel, as referenced in Attachment E. This applicant is concurrently appealing a code interpretation requiring all turning movements to be maintained on the parcel, under TMC 18.56.040(5)(b). Attachment A includes a 10 foot by 45 foot drive sited parallel to the building and includes a parking space. The parking space is needed to give the project its required two parking spaces. If the code interpretation is upheld, staff will have concerns about safe access to the parcel if any required parking is located off -site. The site plan may have to be altered to ensure safe access pending the outcome of an appeal of a code interpretation by the Director of Public Works. (4) The authorization of such variance will not adversely affect the implementation of the Comprehensive Land Use Policy Plan. Comprehensive Plan Policy 8.3.1 provides direction towards the development of the Interurban Corridor where the subject property is located. This policy states that the city shall "Develop the north section as an area of regional commercial or light industrial uses... ". The proposed use, which includes office and storage, is a permitted use in the C /LI zone. Properties immediately adjacent to the subject parcel are currently underdeveloped in this zone. (5) The granting of such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by the owners of other properties in the same zone or vicinity. The 1,528 sq. ft lot, created by the establishment of a right -of -way as represented in the Attachment C, is a remnant of a previous, larger lot. The lot is one of the smallest within the City of Tukwila. The lot appears to be an artifact of a larger lot, created through the development and re- alignment of adjacent transportation routes. The size of the lot, coupled with the shape and other manmade and natural features, severely limits development possibilities. Surrounding Land Uses All of the properties surrounding the subject parcel are zoned C /LI BACKGROUND On August 20,1997 the applicant submitted a Site Plan (Attachment B) for a proposed two -story office /warehouse building. The proposal included frontal access to the building from S. 133rd St. While the parcel also fronts another street, S. 131st Street, this frontage is located along a Type Two watercourse, as defined in the City's Sensitive Area Ordinance (TMC 18.45). The crossing of the watercourse would negatively impact a watercourse that contained salmonid fingerlings and would also interrupt an existing buffer through the crossing of the watercourse. In addition, part of the parcel frontage along S. 133rd includes a limited access easement by the Washington State Department of Transportation (WSDOT). The August 20,1997 site plan was reviewed by the Public Works Department. As indicated in Attachment C, a letter was sent to the applicant on September 17, 1997 requiring that a traffic analysis be submitted to ensure that the proposed access was safe. The study supported applicant's proposed access from S. 133d, given the posted speed on this route, the site's distance from an adjacent freeway off -ramp and the sight distance afforded to east and west traffic. Accordingly, the applicant submitted a revised site plan on October 9,1997 (Attachment F). This plan was revised from the August 20 submittal to include a 10 foot by 45 foot maneuvering area and an additional parking space within the maneuvering area. Staff reviewed the October 9,1997 site plan and determined that the proposal did not meet the requirements under Tukwila Municipal Code (TMC) 18.56.040(5)(b). This code interpretation was made by Ross Earnst, Director of Public Works (Attachment G). Under TMC 18.104.010, an appeal of a code interpretation is made to the City's Hearing Examiner. APPEAL REQUEST Attachment H is a letter dated December 2,1997 requesting an appeal of the Director of Public Works code interpretation. In their request for an appeal, the applicant has submitted an analysis addressing "driveway entering site distance" and "site vehicle turning path" hand - labeled as Exhibit B to their request. While this December 1, 1997 analysis was not submitted to City staff as part of the original materials to be considered by the Public Works Department, the conclusions are still not supported by staff. This analysis also includes a previously undisclosed chart labeled "Passenger Vehicle Exiting Site ". The City cannot support the request and believes that the interpretation was reasonable given the safety concerns based on the application materials presented by the applicant and staff's review. As indicated on their plans and through their appeal materials, the applicant is still attempting to utilize public right -of -way to complete required turning and maneuvering movements that violate the intent of TMC 18.56.040(5)(b). The applicant has failed to provide staff, either as part of their application or any subsequent materials, adequate justification to support their conclusions that the decision by the Director of Public Works was not valid. Adjacent parcels enjoy the same zoning, however this particular parcel is unique because of it's triangular shape with the hypotenuse and adjacent side subject to the 25 foot front yard setback, which combined with the side yard setback of 5 feet conspires to leave the owner with about 125 sq.ft. of buildable area. Historically the subject parcel was part of lot 3 which is now separated by a Right of Way. 3. The granting of the proposed variance would not be detrimental to the health safety and welfare of the public. The only private landowner is to the West. The required setback to the West is 5 feet and the proposed setback to the West is 5 feet. There are no views to speak of in this area. The access proposed is from the North along a minor dead end right of way, which will minimize any traffic impacts. 4. The proposed project complies with the comprehensive plan and in some instances strongly supports it. E., Director MEMORANDUM TO: Michael Jenkins, Associate Planner FROM: Gary Barnett, P.E., Senior Engineer - Development / DATE: February 18, 1998 SUBJECT: Mark Travers' Appeal of Access Restrictions at 4350 South 133rd Street (File No. L97 -0035) The Public Works Department has reviewed the appeal letter from Mr. Travers and the attached sight distance study prepared by Transportation Consultants Northwest. The Public Works Department recommends that access to this parcel be modified to comply with City Code provisions. The appellant's information does not provide compelling evidence that safe access is available to the site. The Public Works Department has previously evaluated the site access for this parcel. Based upon a variety of safety and right -of -way use requirements, the Public Works Department denied the applicant's request for variance. We continue to recommend that the proposed access be revised to meet City Code criteria for the following reasons: 1. Vehicular safety is compromised as discussed below. 2. Pedestrian safety is compromised due to poor sight lines from the U- turning vehicle. Pedestrians expect cars entering the roadway to yield to pedestrians. The State Motor Vehicle Department requires vehicles to yield to pedestrians on a shoulder or sidewalk. The sight lines are awkward and will place pedestrians at risk. 3. The application relies on full use of the right -of -way from edge to edge to make a U -turn. While the maneuver is physically possible at this time, when the roadway is upgraded to minor arterial standards with curb, gutter and sidewalk, planter strip, street trees, etc. (in either a three or four - lane configuration), the U -turn movement will become much more awkward. A very wide driveway (wider than normal standards) would be needed to physically make the U -turn. Such a wide driveway and necessary elimination of plantings and street trees to keep the U -turn path viable after street improvements are problematic. The appellant raises two new issues that have not been addressed in previous review of this application. 1. The language of the deed allowing access from engineered station point 20 + 75 West is applicable. The City is not prohibiting access from this parcel, merely requiring that access comply with City Code and sound traffic engineering principles. The City will grant a reasonable and safe access to the parcel. The appellant's traffic engineer, Transportation Consultants Northwest, has submitted a turning movement diagram entitled "Passenger Vehicle Exiting Site" dated 11- 28 -97. This diagram shows that a vehicle exiting the site can make a U -turn across two lanes of traffic and proceed in an easterly direction. Further, the report indicates that there is adequate sight distance to the west for a 40 mile -an -hour approach speed and to the east for a 35 mile -an -hour approach speed. The report concludes to say, "the project site can be safety accessed from South 133rd from the perspective of entering sight distance and from that of turning vehicle path." (emphasis added) The appellant's traffic engineer does not say, "the access is safe." Consider the site line that will be needed for the exiting vehicle to determine whether or not it is safe to make a complete U -turn across two lanes of traffic to proceed easterly. The driver must either turn their head 180 degrees and look back over their shoulder and then see around the curve in the roadway to determine that it is clear of eastbound vehicles. Alternatively, if the driver is not able to turn their neck and field the vision 180 degrees, they will need to use the outside rear view mirror to determine if no vehicles are approaching from the east. The difficulty of physically seeing clearly to the east, coupled from the need to check traffic critically from both directions (east and west) necessitates an atypical and most unlikely action on the part of a driver. In conclusion, the Public Works Department does not believe that the appellant's traffic analysis shows that the access is safe. We recommend that the appeal be denied and that the appellant be given the opportunity to redesign the site so that a vehicle may exit the site with the car oriented perpendicular to the lane of travel, so that a 90 degree turn or field of vision left and right (east and west) can be used to safety check for traffic. Then, and only then, will the Public Works Department concur that the sight distance analysis provides acceptable evidence of a safe access point for this parcel. In a meeting at the City of Tukwila on November 3rd, Brian Shelton expressed a concern for safety, which is certainly valid. Clearly, the content of the traffic report adequately addresses this issue. In conclusion, relief is being sought to allow this piece of property to be modestly developed. Access is not allowed on S.131 st due to the stream designation. Historically the access problem was anticipated during the right of way alignment for S. 133rd. Evidence of this is contained in title information (exhibit' C' ) which grants access from Engineer's Station Point 20 +75 West, obviously this can be considered a legal precedent. If access and parallel parking are not granted by the City of Tukwila then the proposed project will certainly not proceed. Per our last discussion, I am summarizing our findings regarding both entering sight distance and vehicle turning movements at the driveway. Driveway Entering Sight Distance On October 6, 1997, TCN performed a field inspection of the project site to determine the entering sight distance at the proposed driveway. The driver's eye location was set 10' behind the existing painted edge line at the center of the driveway. The available sight lines to the east and west were then measured with the following results: Table 1 Direction of View Available Sight Distance (Ft.) East of the site the roadway widens to three lanes wide to provide an eastbound left turn lane at the adjacent freeway off ramp terminal intersection. The posted speed limit for S. 133`d is 30 MPH. A design speed of 35 MPH is appropriate for this roadway. Site Vehicle Turning Path Due to the constrained nature of the site, vehicle parking on the site is limited to being parallel to the curb and between the building and the ROW. The attached figure shows the site and the adjacent street at a 1" = 20' scale. The vehicle depicted represents a passenger vehicle or light truck. Vehicles entering the site would pull forward to the far end of the building. They could either park at that location or back up to the opposite end of the building depending on their needs. A vehicle legally parked on the site could exit the site to enter S. 133` directly as in a merging maneuver to continue in the same direction the vehicle entered the site. This would be an easy maneuver. For this vehicle to exit the site and travel westbound would be an easy maneuver. However the same vehicle would have to execute the equivalent of a full U -turn to head eastbound on S. 133`d However note this turn would begin on private property and at the point the vehicle crosses the edge line, the vehicle is oriented at right angles to the roadway, in essence making a normal left turn. The full turn can be made easily within the paved street width as shown on the figure. It should be noted that vehicles parked facing east that exit the site to the west will necessarily cross the centerline for a short distance to negotiate this turn. Such vehicles would have to wait for a gap in traffic to complete their turn. However, since the freeway and commercial areas of Tukwila are located east of the site, most traffic entering and exiting the site will be from/to the east. Conclusions The project site can be safely accessed from S. 133` from the perspective of entering sight distance and from that of turning vehicle paths. The buffer as proposed will not result in direct or indirect, short-term or long term adverse impacts to the watercourse. The proposed buffer will provide shade and input of organic debris that will provide uptake nutrients. The plant materials selected will help stabilize the bank adjacent to the North property line and absorb water during high water events. The proposed buffer as designed will also reduce erosion and increased surface runoff which could reduce potential damage to the adjacent right of way (131st). The accumulation of sediment will increase on site which will reduce downstream impacts. The proposed buffer will help protect the adjacent watercourse from human and domestic animal disturbance. Lastly the building design reflects a program that concentrates activity away from the buffer, thereby protecting it more than if the building were not built. TMC 18.56.040(5) states: Turning and maneuvering space shall be located entirely on private property unless specifically approved by the Public Works Director and the Board of Architectural Review. The applicant requested a decision from the Director of Public Works, who indicated that he would not allow any deviation from this standard. In his underlying application, the applicant needs a variance from front yard setback and minimum parking requirements for his commercial building, as well as approval from the Director of Community Development of a reduced buffer /setback area from a Type 2 watercourse. Prior to finalizing the staff report and discussing recommendations with the applicant, there are 2 outstanding issues that must be resolved. ACCESS As you know, Steve Lancaster and Ross Earnst visited the site to determine the appropriate access point. The applicant's plan assumes access from S. 133rd, as a WSDOT limited access easement runs only on the easterly portion fronting S. 133rd. The other potential access point, on S. 131st, would require approval by Steve to cross a Type 2 watercourse. In a memo from Joanna Spencer, it was indicated that the City Engineer would only support access on S. 131st due to safety concerns. In discussions with Brian after Steve and Ross's meeting, he is still unwilling to support access on S. 133rd due to limited visibility for cars leaving the parcel. Either solution assumes that all turning movements are made on the property, in support of TMC 18.56.040 (5)(b). BUFFER ENHANCEMENT The applicant has requested that the buffer be reduced from 35 feet to 17.5 feet and that the 10 foot buffer setback be waived. ,While this reduced buffer will not be part of the decision at the time of the hearing, buffer enhancement is important to this project. Its importance turns on where access to the parcel is allowed. If access on S. 131st is the only option, it requires the buffer to be broken and the watercourse crossed. The applicant has submitted a landscaping plan that shows treatment of the buffer, however this has been determined to be substandard by Gary S. and will need to me modified. Needless to say, the outcome of the access issue will be of great import to the enhancement of this buffer. Given the complexity of these two issues, its effect on staffs recommendation, and the impending hearing date, I would like resolution on the access issue by Friday, September 13. I will be on vacation that day, but on my return on Monday it would be helpful if I can come back to a resolution to start framing the staff report. I have reviewed the watercourse aspect of this proposal and have the following comments and recommendations. Comments: The original rating for this segment of Watercourse #15 -1 was a Type 3. I have re- evaluated the rating based on reported fish use, and specifically the presence of salmonids. When using the rating system the presence of fish such as trout or salmon species add points to the overall total and changes the rating to a Type 2 watercourse. Type 2 watercourses have a standard buffer setback of 35 feet measured from the Ordinary High Water Mark in the channel. The Sensitive Areas Ordinance allows up to a 50% buffer reduction with approved enhancements. As we have discussed, the standard minimum buffer would be 17.5 feet. My observations include a dense blackberry and vine maple shrub cover along the drainage on the site. There is no vegetated buffer on the east side because of 131st Place. The drainage channel is currently well- vegetated and provides significant cover for juvenile fish. The buffer could be enhanced with native plantings for improvement. I was not able to determine the exact edge of the 131st Place right -of -way but a portion of the buffer is probably within the right-of- way. Recommendations: A reduced watercourse buffer with an approved enhancement plan is appropriate for this proposal. The DCD Director has determined that the maximum buffer reduction to 17.5 feet can be supported. Waiving the building setback can also be administratively approved. I recommend the crossing be eliminated from the plan, if possible. This crossing would eliminate half of the watercourse habitat on the site and is not consistent with reasonable use criteria found in TMC 18.45.115. In addition, because of the adjacent roadway, there is very limited habitat. The applicant should be referred to those reasonable use criteria provided for the Planning Commission's review. At the time of the pre - application conference, the applicant (Mark Travers) was informed that there could be no access to the property in question along S. 133rd st, due to a limited access easement from WSDOT, in relation to SR 599. According to the applicant, the attached title report indicates that the limited access runs only over a portion of the parcel, which would allow him to have a driveway onto the parcel. I would like you to look at this and let me know if these documents indicate only a partial limited access. If this is the case, can they still proceed with access on S. 133rd or are they still required to have access on S. 131st. As you may remember, this issue is further complicated by a watercourse that runs along .the northern property line, parallel to S. 131st. It appears that this is a Type 2 watercourse, which we would prefer not be crossed for a driveway access. If I could get an answer back from you by Monday, August 18, it would be appreciated. Specifically: 18.30.080 Basic Development Standards C!LI. Reduce setbacks as follows: Front ( S. 133rd, 25 feet required to a proposed 2 feet irregular) and second front yard (S. 131st PL,, 12.5 feet required to zero feet). The 12.5 foot landscape buffer is requested to be reduced to 2 feet with an irregularly shaped landscaped area that is defined by two large triangular areas to the South and East of the proposed building. The required parking for the proposed building Is 1.6 spaces for office space and .41E for the warehouse (storage area) for a total of 2,216 required, based on 416 sq.ft. of warehouse /storage and 747 sq.ft. of office space. Reduce the required parking to 2 spaces. Allow the development to reduce it's setback at the type 3 watercourse, with mitigation to be determined at the time of building permit application. B. Variance Criteria: 1. The intended use does not constitute a special privilege based on use or existing zone.
