FINDINGS
,Shoreline Substantial Development Permit (18.44.80)
Any substantial development within 200 feet of any shoreline must receive a shoreline
substantial development permit prior to issuance of any local permits by the City.
The proposed hotel and related development activity will be located at its closest
point approximately 170 feet away from the Ordinary High Water Mark (OHWM) at this
stretch of the Green/Duwamish River. The property line for the parcel is at 130 feet from
the OHWM. The project must comply with Tukwila Shoreline Regulations and is not
within the King County Shoreline Master program. Site plans, survey, crosssections and
elevations showing proximity to the OHWM are attached. Criteria for both general and
specific shoreline regulations follow.

1. The use is in conformance with the regulations of the underlying district ;o ;

At 86 feet, the hotel is within the 115 foot height limit for the zone. The plans also 0;
indicate that the proposed development meets setback, landscaping and minimum parking z
requirements. The applicant must obtain a permit for access and frontal improvements cwi co`.
from the Washington State Department of Transportation (WSDOT). However, approval p 1-
by the Board of Architectural Review is required to ensure that the project meets Design Z
Review criteria (TMC 18.60).
2. The use does not conflict with the goals and policies of the shoreline master
program or the provisions of the Shoreline Act and shoreline regulations:
The parcel for the development is 130 feet away from the OHWM. Parking and
landscaping will be located in the High Impact Environment of the Shoreline Zone. The
footprint for the proposed building and two -story parking garage are over 200 feet away
from the shoreline. The proposed development will include areas where existing
development has occurred. No vegetation will be removed or destroyed in the low
impact environment. Any removal of trees in the High Impact Environment will require
a Tree Permit (TMC 18.54)
3. No structures or accessory facilities shall be located over the river unless such
structures protects or promotes the public interest.

4. There shall be no disruption of existing trees or vegetation within the river
environment unless necessary for public safety or flood control, or if allowed as
part of an approved shoreline substantial development permit.

1 S. Notwithstanding any provisions of the Code to the contrary, removal of any
cottonwood tree within the river environment, or the low impact environment,
which tree is 12 inches or greater in diameter as measured 4.5 feet above grade,
shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations.
No portion of the project is within the Low Impact Environment.
Specific Shoreline Regulations - high impact environment (18.44.150)
This property line for the parcel is 130 feet away from the OHWM, which falls in
the High Impact Zone. The portion of the development area that falls in the High Impact
Zone of the Shoreline Overlay consists of parking and landscape area. The remainder of
the project, including building footprint, falls outside the Shoreline Zone. TMC
18.44.150 states that "all uses allowed in the underlying zoning district shall be allowed
in the high impact environment ". The proposed development, which includes a Hotel
with accessory restaurant, is a permitted use in the TUC. The proposed development
must also be reviewed under Design Review criteria (TMC 18.60) and SEPA. A SEPA
determination for the project was made on November 13, 1997. The hotel and related on-
site development appear to meet development requirements including height, minimum
parking, landscaping and setbacks.

RECOMMENDATION
The city should issue a shoreline permit for this development. The bulk of
impacts related to the proposal will be addressed in the city's SEPA, Conditional Use

on October 8, 1997. Your Design Review and Shoreline Master Permit applications have been
tentatively scheduled for a public hearing before the Board of Architectural review on Thursday,
November 13, 1997, at 7:00 p.m.
Within the next 14 days, you must install a notice board on the site. A notice of complete
application form will be laminated by the Department of Community Development who will
notify you when it is ready to be picked up to post on the board. A copy of information on how
to install the board and laminated notice is included with this letter. After installing the sign and
the laminated notice, you must return a signed Affidavit of Posting to me. You will be
responsible for removing the notice board from the site once your application has been approved
and finalized, and all public notice periods have terminated.
This determination of Complete Application does not preclude the City to request revisions to
your proposal to insure that it meets the substantive requirements of the zoning code and goals of
the Comprehensive Plan. Your application will be routed to appropriate departments for internal
review, and any revision comments made back to you within 21 days of this notice.

Dear Mr. Easter:
As a follow up to our telephone conversation last Tuesday, August 12th regarding your decision
to revise your proposal for CSM Hotel, I am writing to notify you that your SEPA, Shoreline,
and Design Review applications are deemed incomplete as of the date of this letter. Since your
initial application submittal July 1, 1997, repeated requests for revision has not given the City
enough time to review any one proposal for completeness before the end of the 28 day period.
The Notice of Completeness clocks will resume when we receive the new set of revisions. Once

SEPA and Shoreline applications and assign a new Board of Architectural Review hearing date
to your design review proposal.
