The Project has been completed and has been occupied by the tenant. However, the Road Improvement has not been completed. The reason for the lack of completion is that the State Department of Transportation did not complete its review for some time. When WSDOT completed its review, it allowed the Road Improvement to be completed provided the City of Tukwila approved the design of the Road Improvement. To date, the City has not approved the Road Improvement. In the meantime, traffic from the Project has been entering and exiting the site with no difficulties. This is consistent with the traffic analysis and report prepared for the SEPA review which indicated there would be negligible traffic impacts and no traffic improvements were necessary. D98 -0040. Given the functionality of the current road configuration and the fact that the Road Improvement was a post -SEPA requirement, Opus proposes an alternative approach. Specifically, rather than installing the Road Improvement as originally proposed, Opus suggests that it pay the City the cost of the Road Improvement, $134,000.00. The cost of the Road Improvement is documented on Attachment A to this letter. After receipt of the funds, the City may use that money to construct the Road Improvement or some other transportation project that the City selects in its sole discretion. They have assured us that the proposed substitutions will have a greater survival rate than the plants that were originally approved because they are native to the northwest. Per the terms of our contract with Earth Enterprises they guarantee each of the plants for a period of one year after installation. This should be long enough to determine if the particular plant will survive and insure its replacement. To put it in perspective the substitution includes 47 plants out of a total of 876 plants on the site, or approximately 5% of the total plantings. This quantity of substitution is in the range of changes on any project that are generally caused by plant availability. Your revision request has been approved, however, modifications are recommended. The revised plant schedule was reviewed by planning staff and our Urban Environmentalist, Gary Shulz. His concern with the proposed schedule of native plant substitution is that it may be difficult to achieve the minimum height, scale, and 90% coverage within three years required by the current development codes and shoreline regulations', as the type, size, and number of plants proposed could be more challenging to grow, and further challenged by the current soil conditions of the site. that native plant materials are more challenging to grow successfully than non - native materials. In addition, the current soil is new, replaced during the land altering process, and the quality of the irrigation system is unknown. Therefore, Gary has suggested the following: A. Replace proposed plants with smaller varieties. B. Augment soil to better serve native plant species. C. Provide adequate irrigation system to achieve required caliper in three (3) years, and to provide sufficient maintenance for proper upkeep beyond this time period. At that meeting, it was the consensus agreement among all parties to utilize native plantings to the maximum extent possible. Mr. Warren has since worked with King County staff to establish a plant schedule in this area for this purpose. I understand there are some questions within the City of Tukwila concerning the details of this proposal. I offer the following comments in the hopes this matter can be agreeably resolved, especially in recognition of Mr. Warren's apparent willingness to provide the requested changes; King County is basically acting as an agent for the city in accomplishing the setback levee construction here in connection with federally funded repairs. The County is acting under interlocal agreement with the City through the Green River Flood Control Zone District to accomplish these repairs. Federal funding has been secured in the form of a block grant administered by the Department of Housing and Urban Development. As a condition of the grant, King County has had to demonstrate the project will adequately protect environmental and habitat values in the floodplain areas affected by the project, including the Glacier Project site area. To this end, King County has pledged to establish a mix of native riparian shrub and tree species along the landward toe of the levee. This area overlaps the landscaping plan area administered by the City. To resolve any conflicts here, Mr. Warren agreed to our request to modify the plantings along the easement area. King County in turn reviewed Mr. Warren's landscaping plan in this area and assembled a team consisting of a Landscape Architect, Senior River Engineer, and Senior River Ecologist to substitute native species for those proposed along the levee in the original project landscape plan. For each plant on the original planting plan, a native plant was recommended which was determined by our team review to exhibit similar habits and characteristics, while also restoring the integrity of the native riparian ecosystem. Given the impending listing of Puget Sound Chinook salmon stocks as threatened under the federal Endangered Species Act (ESA), it seems especially important to respect the need to accomplish habitat restoration in association with our river projects, to the maximum extent possible. Quite frankly, alterations to the native plant community may soon be considered a regulated taking of the listed species, and I recommend the City carefully consider any such requirement before mandating establishment of non - native cultivars within the river corridor. Despite the obvious frustrations inherent in this situation for all parties involved, I still believe a.cooperative approach here can set a standard for future interactions as the ESA listing and subsequent decision - making come more fully into play. Together with Mr. Warren's willingness to cooperate in this effort, this gives me some continuing hope concerning outcomes at this particular site.
