We are prepared to work in good faith toward the completion of an agreement with the City of Tukwila which would address the issues listed below. As we discussed yesterday, this agreement is not a condition of approval of our short plat application. It is unclear what the exact format of the agreement will be and who in the City would need to be involved, but I am sure we can work out the details over time. The issues discussed include: 1. Reservation of the north 34 feet of lot 4 of the proposed short plat for future right of way for the 168th Street extension. 2. Providing a temporary easement over the Puget Sound Power & Light conduit vault, for access over our property to the City of Tukwila Pond Park. This easement would need to provide proper indemnification of the owner of said property. 3. Providing an easement for access to the park along the western boundary of our property. Specifically, we discussed allowing the City to build a trail within the five foot telephone utility easement running the entire north/south length of our western property line. 4. Providing adequate compensation to the owner for the granting of the easements and the R.O.W. dedication referenced in 1, 2 & 3 above. We discussed the concept of accepting the land within the right of way of Corporate Drive North and Corporate Drive South in trade for the items referenced above. There are three basic steps in the short plat approval process: Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved. The final approved short plat must be filed with the King County Department of Records by March 30, 1998, six months from the date of this preliminary approval or the application will expire. The City may grant one six month extension if requested in writing prior to the expiration date. 2. Final Approval The next step is to submit the revised short plat documents. Please review the legal descriptions as noted in red on the attached plans. If possible please include all of the information required by King County on the first page of the plat. If that is not possible complete the enclosed cover sheet. Recording It is your responsibility to record the City approved short plat documents with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. You will need to pay the recording fees and submit your approved original short plat to the King County Department of Records (296-1570). After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand-delivering a copy of the recorded short plat to me. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development.
