This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the following
project and permit approvals. At their October 23, 1997 hearing, the Planning Commission approved the
applicant's request for a Personal Communications System (PCS) Base Station, comprised of 4 rooftop
mounted antennae with ground equipment located internal to the building. The Planning Commission
approved the applicant's request, with the following conditions:
1. Rooftop anntennae must not extend above the 35 foot height limit for this zone
2. The antennae are to be located near the peak of the roof
Attached to this document is the plan that shows the location of the rooftop equipment. Please note that
the plan indicates two rooftop mounted antennae. Upon the request of the applicant at the hearing, and
following deliberations by the Planning Commission, the number of rooftop antennae allowed for this
applicant was increased from two to four.

FINDINGS
VICINITY /SITE INFORMATION
Project Description
The applicant is requesting Planning Commission approval for a Conditional Use
Permit to install a Personal Communication Services (PCS) base station facility at
the subject property. The proposal, represented on Attachments.A and B, show
the proposed location of the antennae on the rooftop of the Econolodge Motel.
Operating equipment to support the antennae will be located in a to be
determined location within the building. The operating equipment consists of a
sealed unit that processes telephone signals and transfers power from utilities to
operate radio equipment. this unit measures approximately 2 feet in height and 6
inches in width and depth. The unit operates off of existing electrical service to
the building and can be plugged into an existing outlet without modifications to
the building's electrical system.
As indicated on Attachment A and B, the base station will be comprised of two
antennae, one each located on the rooftop of the north and south facades. The
antennae, also represented in the photo simulations on Attachment D, will rise
approximately 6 feet and will be bracketed to the roof. The applicant will use an
antennae developed by COMSAT, model PCSD085 -17 -2, asrepresented in
Attachment C.
Existing Development
The site is located at the Econolodge Motel, 13910 Pacific Hwy. S.
Surrounding Land Uses
Immediately to the east of Econolodge are Low Density Residential (LDR) and
High Density Residential (HDR) zones. To the north, south and west of the site
are numerous commercial uses all zoned RC.
Access
The rooftop antennae will be inaccessible to the public. The operating equipment
will be located in a service room, to be determined, which will be inaccessible to
the public.

property or improvements in the vicinity of the proposed use or in the district in which the
subject property is located.

Applicant has proposed placing all operating equipment in a to-be-determined n u.

The existing building appears to be a nonconforming structure for the Regional LI o
Commercial (RC) zone, as the maximum height of the roofline is 37 feet while the z'
allowed height for this zone is 35 feet. The rooftop antennae extends to a total o
height of 38 feet, 2 inches, which is 3 feet, 2 inches above the height limit in this
zoning district. Cellular antennae are not exempt as a rooftop appurtenance
under TMC 18:50.080, as the antennae are a new use at the site and not accessory
to the principal use. Other performance standards relating to setback,
landscaping or design are not applicable to this proposal.
(2) The proposed use shall meet or exceed the performance standards that are required in the
district it will occupy.
(3) The proposed development shall be compatible generally with the surrounding land uses in
terms of traffic and pedestrian circulation, building and site design.
As with similar uses, the PCS system may generate 24 trips per day during its
construction period and, following completion, 1 trip per month for maintenance.
To mitigate the project's impact on the existing building and site, the applicant
has proposed that the only one antennae be placed on each portion of the rooftop
and will be painted to blend in with their surroundings. The applicant has also
indicated that they have chosen the smallest possible system for their coverage
needs at this location, given their concerns about its potential impacts on the
surrounding residential neighborhoods. All exposed electrical wiring related to
the project will be located internally to the building.

(4) The proposed use shall be in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan
The following Comprehensive Plan policies govern cellular technology:
12.1.34. Actively coordinate project implementation with individual utilities based
upon Tukwila's Comprehensive Plan and development regulations.
When completed, the project will use'existing electrical services provided to the
motel. The applicant will extend utilities to service the operating equipment,
which will not have to be modified for the facility. The applicant has secured
service from Puget Power.
12.136. Encourage utilities to consolidate facilities and minimize visual impacts of
facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure,
use of existing structures and installation of telephone switching facilities in
buildings compatible with the surrounding area. The applicant is not proposing
a facility that will be shared with any other PCS providers, however the facility is
using an existing structure as opposed to creating a separate monopole or other
support structures for antennae. As previously indicated, the applicant will
paint the antennae to blend with the building and have chosen the smallest
number of antennae to meet their minimum coverage requirements.
5) All measures have been taken to minimize the possible adverse impacts which the proposed
use may have on the area in which it is located.
The applicant has chosen a low profile antennae that is approximately 6 feet in
height, 8 inches in width and 2 inches in depth. Each antennae will be located at
opposite ends of the building and painted a color that will help them blend in
with the rooftop. The current location of the antennae may negatively impact the
surrounding neighborhood due to their visibility. Locating both antennae over
the westerly portion of the building (please see site plan on Attachment A and B)
may reduce the visual impact of the antennae from the surrounding
neighborhood due to the modulation of the roofline and walls of the building.

CONCLUSIONS
Pursuant to Tukwila Municipal Code (TMC) Section 18.108.040, staff hereby makes the
following findings and conclusions under the city's Conditional Use Permit criteria
(TMC 18.64.050).
(1) The proposed use will not be materially detrimental to the public welfare...
Potentially hazardous operating equipment is inaccessible to the public. The associated
technology is within federal safety guidelines. The antennae will be placed painted to
mitigate aesthetic impacts.
(2) The proposed criteria shall meet or exceed the performance standards...
As proposed, the antennae height exceeds the 35 foot height limit in this zone, as this is
a new use for the zone and not accessory to the principal use of the parcel. The
nonconforming height of the existing building does not impact the project as the
building's height will not be altered. There are no other applicable standards for the
project.
(3) The proposed development shall be compatible generally with the surrounding...
Traffic generated during development and operation is minimal. The antennae will be
painted to help screen them from public view. The operating equipment will be
removed from public view and will be inaccessible to the general public. The applicant
has chosen the lowest profile system available to met their coverage needs.
(4) The proposed use shall be in keeping with the goals and policies...
The project will have the necessary electrical services for its operation. The applicant
will not be sharing infrastructure with other providers. Visual impacts to surrounding
are minimized by choice of antennae, physical separation and by painting to match
building. .
(5) All measures have been taken to minimize the possible adverse impacts...
All operating equipment will be located in the building. All antennae will be located on
the rooftop of the building and painted to blend with building materials. Moving the
antennae to the westerly portion of the roofline may mitigate the visual impacts of the
antennae on the surrounding neighborhood.

Dear Mr. Steiding:
Your application, on behalf of your client Western Wireless, for a Conditional Use Permit to
develop a Personal Communication System (PCS) Base Station at Econolodge Motor Inn, 13910
Pacific Hwy. S., has been found to be complete on September 23, 1997 for the purposes of
meeting state mandated time requirements. The project has been assigned to Michael Jenkins
and is tentatively scheduled for a public hearing before the Planning Commission on October 23,
1997 at 7:00 p.m.
The next step is for you to install the notice board on the site within 14 days of the date of this
letter. You received information on how to install the sign with your application packet. If you
need another set of those instructions, you may obtain them at the Department of Community
Development (DCD). Also, you must obtain a laminated copy of the Notice of Application to post
on the board. This notice is also available at DCD. After installing the sign with. the laminated
notice, you need to return the signed Affidavit of Posting to the our office.
This determination of complete application does not preclude the ability of the City to require that
you submit additional plans or information, if in our estimation such information is • necessary to
ensure the project meets the substantive requirements of the City or to complete the review
process. I will be contacting you soon to discuss this project. If you wish to speak to me sooner,

Dear Mr. Jenkins:
Please allow this letter to serve as an inventory for the Western Wireless Conditional Use Permit
to allow the construction of a Personal Communications Service (PCS) facility to be located at the
Econolodge, 13920 Pacific Highway South.
Western proposes to install two (2) bi -polar antennas atop the existing Econolodge roof. The
required radio support equipment will be located within the building. Greater detail of the proposal
may be reviewed in the attached site plan.
The location of this site is ideal because it allows digital wireless coverage for the immediate
citizens of Tukwila, as well as the Pacific Highway South corridor. The area consist of commercial
uses along the highway, backed by residential properties. Western has gone to great extremes to
create a site that has the lowest possible impact on the neighborhood. Views from adjoining land
uses would be minimally obstructed, if at all.

This letter confirms the understanding between C.c. /.4.: /.*-•/ L..; ("Owned and Western Pc
BTA Development Corporation C'Westem") concerning the above property.
Western is interested in leasing a portion of the Property to construct and operate a communications
facility. Owner is the owner of the Property and has the authority to enter into a lease agreement with
Western concerning the portion of the Property that Western seeks to occupy. Owner and Western agree to
enter into good faith negotiations to finalize a lease agreement (or similar agreement) pursuant to which
Owner would grant Western the right to use a portion of the Property to construct and operate a
communications facility.
Owner hereby authorizes Western to conduct certain tests to determine the feasibility of locating a
communications ations facility at the Property and hereby grants Western and its agents a revocable right (the
"Access Right") to enter the Property to perform any reasonable tests that Western deems desirable to
determine the feasibility y of constructing and operating its communications facility upon the Property. Such
feasibility testing to include but not be limited to: 1) radio frequency testing 2) soils testing 3) on -site
feasibility assessment 4) and filing of zoning applications. Owner may revoke the Access Right at any
time by delivering written notice to Western by certified mail, return receipt requested, at the following
address:

This notice will be effective three (3) days after actual receipt by Wes tern, provided, however, that Western
may still enter the Property to remove any equipment it has placed there.
Western agrees to repair any damage to the Property to the extent caused by Western's use of the Access
Right and hold harmless and indemnify Owner for any cost or expenses which may be paid by Owner to
the extent caused by Western's negligence or willful misconduct in connection with any activity by
Western or its agents on the Property pursuant to the Access Right
EACH PARTY ACKNOWLEDGES THAT THE OTHER HAS MADE NO REPRESENTATIONS OR
CO THAT A LEASE AGREEMENT CONCERNING THE PROPERTY WILL BE

TMC 18.64.030
1. The proposed use will not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity of the proposed use or in the district in which the
subject property is situated.
The proposed use will not be detrimental to the public welfare. Actually, wireless communications
have shown to be very beneficial in times of emergency. All materials used will be of the highest
quality available for construction. The diminutive physical size of this installation will have very
little impact on properties in the vicinity.
All potentially harmful equipment will be inaccessible to the public. Western Wireless will operate
its system, per the license, within all applicable Federal safety standards.
2. The proposed use shall meet or exceed the performance standards that are required in the
district it will occupy.
The proposed use will meet all applicable performance standards. All work will be completed by
properly licensed local contractors, who are familiar with local codes and standards.
3. The proposed development shall be compatible generally with the surrounding land uses in
terms of traffic and pedestrian circulation, building and site plan.
The proposed facility on this commercially zoned property will be compatible with surrounding
land uses, would create minimal vehicular traffic, and no additional pedestrian traffic. Access to
the site will be achieved using existing roadways such as Pacific Highway South. Minimal traffic
would be generated during construction. After construction is complete, there would be
approximately one visit per month to the unstaffed facility for routine maintenance. The unstaffed
site will not generate any pedestrian traffic. The antennas will be painted a non -glare color to
complement the existing building. The required radio support mini equipment will be located
inside of the building.
4. The proposed use shall be keeping with the goals and policies of the Comprehensive Land
Use Policy Plan.
The proposed use is intended to provide wireless communications services for the citizens and
businesses of Tukwila. Western proposes to do this by collocating their antenna facility on an
existing structure. This proposal is harmonious with the Comprehensive Plan's intent to
Encourage utilities to consolidate facilities and minimize visual impacts of facilities where
technically feasible. Section 12.1.36. This particular installation does not allow for collocation, nor
are we consolidating our facility with another provider. However, the proposed use does utilize
existing infrastructure.

5. All measures shall be taken to minimize the possible adverse impacts which the proposed use
may have on the area in which it is located.
Western has taken every step possible to minimize any adverse impacts of the proposed use.
Western has revised the design of this particular site numerous sites. The proposed site
represents an effort to produce the lowest impact on surrounding properties. A single omni -type
antenna will be mounted at both ends of the roof, for a total of two (2). The required radio support
equipment will be located inside of the building. This will have an extremely low impact on
surrounding properties. The Econolodge site is the only collocation alternative in this area. A
different site would require the need for a new antenna support structure, such as a monopole.
A list of any permits or decisions applicable to the development process that have been
obtained prior to filing this application, or that are pending before the City or any other
governmental entity.
