PO Box 5269 Lynnwood, WA. 98046 RE: Sleep Train Free Standing Sign Permit (S97 -084) Dear Mr. Albert: DENIED This letter is to inform you that permit application S97 -084, Sleep Train, has been denied. As I discussed with Scott Perret on September 19, 1997, the pole sign on which you requested to place the Sleep Train logo is located on a different parcel than the applicant's store. As such, the proposed sign would be off - premise and illegal in the City of Tukwila as defined in section 19.08.130 of the Tukwila Sign Code. There are no provisions in the code to allow for signs to be located off - premises. You may wish to discuss placing your sign on the existing Houlihan's sign with your landlord as a possible option. Accordingly, the pole sign that was installed without permit must be removed. An inspection of the site will be scheduled for October 7, 1997. Please make arrangements to have the sign removed before that time. If you feel that any relevant facts have been missed or that this determination is in error, this decision is appealable to the Planning Commission pursuant to the terms of Tukwila Municipal Code section 18.108.020. PO Box 5269 Lynnwood, WA. 98046 RE: Sleep Train Sign Permits (S97 -078) Dear Mr. Albert: This letter is to confirm the conversation we had on Thursday, September 11, 1997. As we discussed, the pole sign for "Sleep Train" was installed without permit. To resolve this illegal situation, you were asked visit the Planning Department as soon as possible to apply for a Sign Permit. The pole sign permit was received on September 16, 1997. Initial review of the permit has shown that the existing pole sign is legally nonconforming. As such, the sign can remain in its current form until a change is initiated by the owner. The proposed "Sleep Train" panel would constitute a change in the nonconforming sign and, as such, cannot be approved. Accordingly, the panel that was installed in the existing pole sign should be removed. You may wish to contact the property owner and a Sleep Train representative to discuss your options. The wall sign for "Sleep Train" was also installed prior to Sign Permit issuance. Because a permit application for the wall sign is currently under review in the Planning Department, you will not be required to remove the sign at this time. This action however, does not guarantee the approval of your sign as proposed or as installed. If the application is denied for any reason, you will asked to remove the wall sign. I would also like to request that you submit measured building elevations for the proposed wall sign (S97- 078) as required in the sign application check list. This drawing is necessary to calculate the applicable wall area. This approval would increase the area of the wall sign by 20 %, from an allowed 18.75 square feet to 22.5 square feet. The proposed sign would be located in the east corner of the Parkway Square shopping complex. Attachment "A" shows the proposed sign. The applicant is located in a multi - tenant commercial building and the adjacent tenants have signage similar to that proposed by the applicant. The proposed sign will not detract from the visual nature of the building, and is in scale with surrounding signage. The existing sign cabinet is sized for a 22.5 square foot sign. This is equal to the maximum allowed sign area using the Tukwila Municipal Code (TMC) Section 19.32.140, 50% increase in sign area provision. There is no record of a Special Permission sign application being granted to the previous tenants of the site, yet the correctly sized sign case exists. The applicants have also filed for a freestanding sign permit (S97 -084) which was denied as an off premises sign. The business owner and property management company have both been notified about the status of the freestanding sign. The applicant is not eligible to display a second wall mounted sign (TMC 19.32.140) on the western wall, and there are no other visible walls under the applicant's control. The proposed 22.5 square foot sign will constitute the applicant's only means of on -site advertising. Decision Criteria TMC 19.32.140 (A) allows the permitted sign area to be "increased by 50% for each doubling of the required minimum setback ... but in no case shall the sign area exceed that permitted in TMC 19.32.150 ". TMC 19.32.50 allows up to 6% of the building face associated with the applicants tenant space to be used for signage. The leading edge of the proposed sign is set back approximately 350 feet from Southcenter Parkway. The minimum front yard setback in the TUC zone is 15 feet and the applicable wall area is 375 square feet. The allowed sign area, given the square footage of the tenant wall, is 18.75 square feet. With the increased setback, the applicant is qualified to receive the 6% maximum allowed by Code. The building is setback a sufficient distance to allow the 6% formula to determine the allowed sign area. 2. The allowed sign area, based on the size of the tenant space and the application of the 6% formula, is 22.5 square feet. 3.
