This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170 on the
following project and permit approvals. On the review of the Director of the Department of
Community Development, the applicant's request for a 22 foot tall Special Permission Sign at
15455 - 53rd Ave S. was approved. A copy of the requested sign is attached to this Notice of
Decision.

Property owners affected by this decision may request a change in valuation for
property tax purposes notwithstanding any program of revaluation.
h. Administrative appeals for the various permit Types are discussed below.
The period for administrative appeals is 14 days, starting from the issuance of this
Notice of Decision. The administrative body hearing each appeal is shown below. All
appeal materials shall be submitted to the Department of Community Development.
Appeal materials shall contain:
1. The name of the appealing party,
2. The address and phone number of the appealing party, and if the appealing
party is a corporation, association or other group, the address and phone
number of a contact person authorized to received notices on the appealing
party's behalf, and
3. A statement identifying the decision being appealed and the alleged errors in that
decision. The Notice of Appeal shall state specific errors of fact or errors in
application of the law in the decision being appealed, the harm suffered or
anticipated by the appellant, and the relief sought. The scope of an appeal shall
be limited to matters or issues raised in the Notice of Appeal.
Project materials including the application, any staff reports, and other studies related to the
permit(s) are available for inspection at the Tukwila Dept. of Community Development; 6300
Southcenter Blvd.; Suite 100; Tukwila, WA; from Monday through Friday, between 8:30 AM to

Dear Michael
In accordance with the application for sign permit I strongly feel we qualify for ,the freeway
dependent 25% additional height variance. Foster's Furniture is extremely freeway dependent
on our destination location at the northwesternly intersection of 1 -5 and 405. I understand the
intersection carries 300,000 plus vehicles per day. That exposure generates a new customer
base that we could not afford via traditional media advertising. We selected this location
knowing that all retail Southcenter customers would physically and visually be exposed to our
property from the freeway. Also, with our freeway location and proximity to the airport we have
developed a lucrative out of state customer base. If necessary I can supply you with customers
names and addresses who have discovered Fosters because of our freeway location. We have
shipped furniture to Saudia Arabia, Israel; China, Alaska, Hawaii, Arizona, Oregon, California,
etc. The average retail furniture store generates 80% of its business within a seven mile radius
of its location. Less than 1% of our business is derived from that statistic. Foster's Furniture is
a high end retail decorating furniture operation. Our selection is extremely contemporary, very
unique and has a per capita narrow volume customer profile. Consequently, our customer base
is logistically wide. Find enclosed a mailing plan and brochure that we distribute twice a year.
Please note the volume and locations of this mailing list. To facilitate our customer logistically
our ease of access because of 1 -5 and 405 make our location and business successful. From
Everett to the north, from Issaquah to the east and Tacoma from the south, we are within a 35
minute drive or Tess. We are truly dependent on the freeways. They are our partners)
It is imperative we have the sign located at maximum height at the proposed site on our property
to expose and direct customers to Foster's location.

FINDINGS
Vicinity /Site Information
The applicant requests approval of a Special Permission Sign to increase the allowed
height of a freestanding sign for a freeway oriented business. Attachment A shows the
proposed sign for Fosters Furniture at 22 feet. As indicated in Attachment B, the
applicant has proposed a freestanding sign with a setback of 18 feet from the nearest
property line.
Decision Criteria
Tukwila Municipal Code (TMC) 19.32.180 allows for businesses within a 1000 foot
radius from a freeway entry/exit may qualify for an additional 25% increase in allowed
height and sign area. Attachment C indicates that the site is within the freeway
interchange area. Attachment D to this report is a letter from Terry Foster, the owner of
the business, explaining that his business is a freeway oriented business which derives
the majority of its business from outside of the area. As referenced, the applicant is
requesting a 25% increase in allowed sign height. The site plan indicates that the
proposed sign is 18 feet in height and is set 18 feet from all property lines.
CONCLUSIONS
1. Foster's Furniture is within the area defined in TMC 19.32.180 as a freeway oriented
business
2. The requested height of 22 feet is 25% above the allowed 18 foot height, given the
setback from property lines and the height of the building
DECISION
The request for a 25% increase, from 18 feet to 22 feet, for a freeway oriented sign is
approved

Dear Shawn:
After reviewing the application for a twenty -one (21) foot freestanding sign, as
referenced above, there appear to be a few issues that need to be resolved prior
to completing my review. As proposed, the sign appears to be located in an
easement to the City of Tukwila for future road development. Tukwila Municipal
Code (TMC) 19.22.020(c) indicates that "no sign may be placed in or over City
utility rights -of -way or easement areas, except under prior agreement between
the City and the property owner ". Accordingly, the sign may not be located in it's
proposed location, unless permission is secured from hte Public Works Director.
At our site visit, we also discussed the problem with actually locating the property
line. On the site plan, there was a notation suggesting that the east property line
was in a different location than what the property owner understood. In addition,
it would appear that the south property line may be within the fenced area of the
parcel, which would further impact the allowed height of the sign. I would
suggest that a new survey of the parcel be undertaken to pinpoint the actual
property lines, in order to determine exactly where the sign can be located if a 21
foot sign is still being sought by the applicant.
