Dear Bob:
To confirm our recent telephone conversations concerning the above referenced
project, Tukwila Municipal Code 19.32.080 allows signs for commercial uses in
residental zones to be a maximum of five feet high. Due to the immediate
change in grade from the street to where the sign is located, I determined that
the five foot height allowed for the sign would not include the sign base nor any
non - textual /graphic portions. The allowed height for the sign would begin at a
horizontal plane even with the street. I have illustrated the parcel conditions
necessitating the need for additional consideration for your review, including a
dotted line to show the conceptual 'baseline' for the five foot sign area height
limit.
As the height of the actual approved sign area is 3.5 feet, there is an additional
1.5 feet in height that is allowed to stay within the 5 foot height limit. This does
not include the height of the base necessary to meet the grade established at the
level of the road, which I represented in the attached drawing, nor the non -
text/graphic portions of the sign. I hope this clarifies what is allowed for this sign.

FINDINGS
Vicinity/ Site Information
The applicant requests approval of a Special Permission sign application. This approval would
allow the installation of a 28 square foot monument sign in a residential zone. The proposed sign
would be located in the northwest corner of the property along Military Road. Attachments "A"
and `B" show the sign as proposed and its locatio .

The applicant is located in a residential style structure with single family dwelling units on all w O;
four sides. The applicant's proposed sign will not detract from the residential character of the g
neighborhood and is in scale with the site. The applicant has two existing signs which will be
removed prior to installation of the proposed monument sign. The proposed 28 square foot sign i
will constitute the applicant's only means of on -site advertising and will bring the business into _:

compliance with the Tukwila Sign Code. 0

1. TMC 19.32.080 (b) directs that all sign permit applications for Churches or approved 0 N.
conditional uses located in single - family zone must be approved as a Type II decision.

2. The criteria established in TMC 19.32.080 (b) allows an approved conditional uses to display z'
one sign for each street upon which the property fronts. It further permits a maximum of 32 v t
square feet of total signage and a sign height no greater than five feet. The sign must be o �'
located in the landscape area and lit from a concealed source.
CONCLUSIONS
1. The applicant's business is an approved conditional use in the LDR zone. The applicant's
sign permit application should be approved as a Type II decision.
2. The proposed 28 square foot sign is less than the 32 square foot maximum allowed by Code.
3. The proposed sign is located in the landscape area of the property and is no more than five
feet in height.

This notice is to confirm the decision reached by the Director of Community Development on October 4, 1997.
The Director approved the design and location of the proposed sign based on the findings, conclusions and
condition in the staff report dated Oct. 2, 1997.
Project materials including the application, any staff reports, and other studies related to the permit are available
for inspection at the Tukwila Department of Community Development; 6300 Southcenter Boulevard; Suite 100;
Tukwila, WA; from Monday through Friday, between 8:30 AM and 5:00 PM. The project planner is Hans Korve
who may be contacted at 431 -3670 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes
notwithstanding any program of revaluation.
The time period for appeals is 14 days starting from the date of this Notice of Decision. The Directors decision is
appealable to the Planning Commission. Appeal materials shall contain:
1. The name of the appealing party,
2. The address and phone number of the appealing party, and if the appealing party is a corporation, association,
or other group, the address and phone number of a contact person authorized to receive notices on the
appealing party's behalf, and
3. A statement identifying the decision being appealed and the alleged errors in that decision. The Notice of
Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed, the
harm suffered or anticipated by the appellant and the relief sought. The scope of an appeal shall be limited to
matters or issues raised in the Notice of Appeal.
