complete irrigation project at Fort Dent Park, L97 -0059
Dear Ann:
In response to your phone call concerning the above referenced file, on further review
we have again concluded that the determination allowing an exemption for this project is
appropriate. WAC 173.14.040(e) allows an exemption from a substantial development
permit involving "Construction and practices normal or necessary to farming, irrigation
and ranching activities...and the construction and maintenance of irrigation structures
including but not limited to head gates, pumping facilities and irrigation channels." On
further discussions with Roderic Boyd of King County Office of Open Space, the project
involves placement of approximately 20 feet of pipe to complete the hook -up for a water
reuse project at Fort Dent Park. This irrigation facility was originally constructed in
conjunction with the redevelopment of the existing soccer and baseball fields. This
project was originally exempted by Tukwila from SEPA and Shoreline permit
requirements.
In Tight of the current project and its relationship to the previous permitting history, we
believe that this irrigation project is exempt and, accordingly, we will close our files. We
appreciate the concerns you expressed about the scope of the project and the possible
need for a Shoreline Permit from the City of Tukwila.

Re: Request for exemption from Shoreline Management Act for an
Irrigation Project at-Fort Dent Park

Dear Mr. Boyd:
I have reviewed your request for an exemption from the Shoreline Management
Act. I understand that King County is requesting this exemption as the project is
to complete the connection of water re -use piping within the Shoreline setback
area at Fort Dent Park. I also understand that the water re -use program has
been approved by the Department of Ecology for this site.
Based upon my review of your proposal, and through conferring with Pat Brodin
in the Department of Public Works, I have determined that this project is exempt
from the Shoreline Management Act, under WAC 173 -14 -040. Accordingly, no
Shoreline Development Permit from the City of Tukwila, under Tukwila Municipal
Code (TMC) 18.44 is needed. It is my understanding that a Water Meter Permit
from the Department of Public Works may be required. I would encourage you
to contact the Department of Public Works to confirm the need for this or other
permits related to the actual work at Fort Dent.

Exemption.- Shoreline Management Act - Irrigation of Ball Fields at Fort Dent Park
Dear Mr. Pace:
King County wishes to seek an exemption under the above Shoreline Management Act relative
to the connection of the water re -use pipelines within Fort Dent Park. The basis for this request
is the section of the Act which exempts work within the set back area for the purposes of
irrigation.
The attached drawing shows the approximate location of the proposed connections to the
existing pipelines and the ball fields under consideration. The Department of Ecology has
approved the water re -use program as a class A water for irrigation purposes.
I would appreciate a determination at your earliest convenience to enable us to complete our
pre- design and permit process. Should you have any questions please don't hesitate to call me
