At their January 22, 1998 hearing, the Planning Commission approved the applicant's request for a Personal Communications System (PCS) Base Station comprised of 6 antennae mounted at a height of 130 feet with accompanying ground equipment, onto an existing Seattle City Light tower. Vicinity /Site Information FINDINGS Project Description The applicant is requesting Conditional Use Permit approval to install a Personal Communication Services (PCS) base station on an existing Seattle City Light lattice tower in Seattle City Light right of way. The applicant is proposing an initial installation of two antennae mounted on three separate arrays for a total of sixantennae The applicant has designed the base station to accommodate four antennae on the three, array, for a .proposed total of . twelve antennae. Associated operating equipment: will be installed at the base of the lattice tower on;a:15::foot by 16 foot concrete pad. The operating equipment will be housed in cabinets affixed to the concrete pad. This equipment will be enclosed by a. gated and locked chamlink fence, accessed by a gate and equipped with privacy slats. To protect the equipment, a 10 foot high canopy will cover the entire concrete slab area. Ground cabinets will be used for processing and transmitting calls. Existing Development The site is currently in use as a Seattle City Light Utility right of way, adjacent to the US Post Office Distribution Center on West Marginal Place South. Surrounding Land Uses The site is located in the Manufacturing Industrial Center /Heavy (MIC /H) zone. Properties adjacent to this site are all zoned Manufacturing Industrial Center /Heavy (MIC /H). To the east of the site is the United States Postal Distribution Center and to the north is the Riverfront Technical Park, a two -story office building. To the west and the south of the site is SR 599. BACKGROUND The. MIC /H zone has a building height standard of 125 foot maximum under. TMC 18.38.080. The existing Seattle City Light lattice tower has a height of 140 feet; which does conform to the height regulations in this zone. However, as the proposed location of the antennae at a maximum height of. 130 feet does not alter the nonconforming aspect of the structure, under 18.70.050, nonconforming . structures, the antennae may be located below the apex of the tower. Staff Report to the L97 -0073 Planning Commission GTE Wireless -10710 West Marginal Place S. CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. The applicant has included a site plan (Attachment A) and elevations of the structure (Attachment Bithat show the proposed location of the antennae and its ntounting'in relation.to the site Attachment C is a' photosiinulation of the type of antennae and Mounting that will be used for this 'site. site. •The photograph. is presented'as a representation ornly'to show how other antennae mounting on these facilities have been implemented. The proposed antennae and related equipment are telecommunications equipment that fall within the safety parameters set by the American National Standards Institute (ANSI). All `operating equipment will be located: under the tower and covered by a canopy and `enclosed in:a:area fenced with chain link. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. e.antennae will be a maximum height of 130 feet in a zone where the height maximum is125 feet As referenced, the proposed location of the antennae does not alter'the nonconforming height of thelattice tower. No other development standards apply to this project. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the PCS system will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance, with no other impacts to pedestrian or transportation movements anticipated. The facility is compatible with surrounding development as it is located on an existing utility tower. The site is also located in an industrial zone. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 4 Staff Report to the • L97 -0073 Planning Commission GTE Wireless -10710 West Marginal Place S. 12.1.34. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. The applicant has secured the right to use the Seattle City Light tower and its right -of -way for this base station. A copy of an agreement between Seattle City Light and the applicant to proceed with this application is included as Attachment D., The applicant will secure telephone and electrical services. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant has secured the right to locate on an existing tower instead of erecting a monopole or other support structure, as referenced in Attachment D. To minimize visual impacts of the antennae, the antennae are being mounted on the tower and the ground equipment are screened behind a secured fence. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has proposed the location of the antennae on an existing utility tower, in a utility right of way. The existing tower provides both a support structure and partial screening of the antennae. The operating equipment are located under the lattice tower behind a secured and covered gated and canopied area. Attachment E is a letter dated January 6, 1998 by William Short and Marjorie Short, 10803 - 26th Ave S., Seattle, Washington. This letter expresses concerns about receiving notice of the proposed development and the level of noise generated by cellular facilities. Attachment F is a copy of an Affidavit of Distribution, indicating that the Short's were mailed the Notice of Applicationon December .19,1997. -- No letters from this mailing were returned. The; citys noise ordinance (TMC 8.22) requires that any noise generated in an industrial zone and received in a residential zone within the city limits cannot exceed 60 .dB(A). The maximum noise allowed when received within an industrial zone is 70 dB(A). In discussions between staff and the applicant following receipt of this letter, the applicant indicated that fans included in the ground equipment are the only component that produces any significant noise, at a range of up to 50 - 55 dB(A), and only at times when the ground equipment requires cooling due to excessive heat. CONCLUSIONS The Planning Commission, pursuant to Tukwila Municipal Code (TMC) Section 18.108.040, hereby makes the following findings and conclusions under the city's Conditional Use Permit criteria (TMC 18.64.050) (1) The proposed use will not be materially detrimental to the public welfare... Potentially hazardous operating equipment is inaccessible to the public. The associated technology is within federal safety guidelines. The antennae will be placed on an existing utility tower in a utility right of way. The antennae will appear to be part of the 'existing tower and will not substantially. alter any public views, a(2) The proposed criteria shall meet or exceed the performance standards... The location of the'antenna is allowed under TMC 18.70, nonconforming lots, structures and uses,; as it does . not increase the non - conforming height of the .tower. There are no other applicable standards for the project. (3) The proposed development shall be compatible generally with the surrounding... Traffic generated during development and operation is minimal. The ground equipment will be screened from public view. The project is located in an industrial zone and is compatible and consistent with other industrial uses. The antennae are located on an existing utility tower in a utility right of way and will not substantially alter public views. (4) The proposed use shall be in keeping with the goals and policies... The project will have the necessary electrical and telephone services for its operation. ; The applicant will be sharing infrastructure with an existing utility. Visual impacts to surrounding properties are minimized by locating on the existing utility tower. (5) All measures have been taken to minimize the possible adverse impacts... All ground operating equipment will be contained in a secured and screened area. The antennae will be located on an existing utility tower and will appear to be a part of that tower. The noise generated by the facility will be less than the maximum allowed e within an industrial zone, under the city's noise ordinance (TMC 8.22). Staff recommends that the Conditional Use Permit be approved. The study area extends from the site location to the nearest property line. The purpose of this report is to document the extent and impact of the acoustical change due to the additional equipment installed at the facility. This report contains data on the existing and predicted noise environments, impact criteria., an evaluation of the data as they relate to the criteria, and recommendations for improvement if appropriate. The existing noise environment at the proposed site is peunarily the result of the vehicular traffic along 4th Avenue NE and the existing cellular station. A- weighted sound level measurements were made during the day of November 18, 1997 to document the contribution of the communications facility. Sound level measurements were taken using a Larson -Davis 2900 real -time spectrum analyzer at the residential property line west of the facility. This was the nearest residential property to the facility site at approximately 95 feet. This value is based on the `worst case" of sound propagation with the sound measurement from the side of the enclosure, while the blower is operating at high speed without the noise hood installed. A sound level of 45.0 dBA at the adjacent property line is within the noise runitations of 57 dBA during the day and 47 dBA between the hours of 10:00 pm and 7:00 am established by the State of Washington. GTE is currently designing its network in the King County and Tukwila areas to establish telephone service and provide wireless capacity to its subscribers. This proposal describes the scope of the proposed project by providing specific information regarding the project location, zoning, specifications, and required services. It is GTE's desire to work with the City of Tukwila to ensure that our project is consistent with local ordinances and zoning regulations while providing the PCS coverage that is critical for emergency, business and personal use. Project Goals The goal of the GTE PCS Roxbury (WA0158) facility proposal is to provide PCS coverage for personal and emergency purposes for the areas immediately surrounding the project site, including portions of Interstate 5, SR 99, E. Z 0 W W; LI U= 0 ~; 1 • GENERAL PROJECT DESCRIPTION Project Overview The applicant proposes to install a wireless communications facility on a portion of the property located on 10710 E. Marginal Way South. The applicant, GTE Wireless, proposes to lease approximately 250 square feet on the property. The lease area would be developed with two equipment cabinets which house radio equipment and batteries. In addition, three (3) antenna arrays are proposed to be mounted on an existing Seattle City Light Power tower. Each array is composed of four (4) antennas, for a total of twelve (12) antennas. GTE is in the process of securing a lease that would allow for construction and maintenance of these facilities, necessary utility connections, and provisions for access to the site. Facility Specifications • Radio Equipment Cabinets - Two cabinets are proposed for this project. Each cabinet contains radio equipment and batteries and measures approximately eight feet (8') long by two and one half feet (2.5') wide by six (6') ft tall. The cabinets will be mounted beneath the Seattle City Light tower. • Antennas - Three (3) arrays of four (4) antennas are proposed to be mounted on the pole which is attached to the side of the building. Each antenna is roughly five feet (5') long and six to eight inches (6- 8 ") wide. Please see the plan elevations for further information. Mounting Structure - The antennas will be attached to the existing lattice power tower. Fencing - The equipment cabinets will be screened with a six foot (6') high chainlink fence topped with three (3) strands of barbed wire. The area will be accessed through a man gate, and the fence will be equipped with vinyl privacy slats to minimize visibility of the cabinets. Facility Maintenance - The facility is generally serviced once a month by one to two employees to the site for an average four (4) hour maintenance check. This check is typically for preventative maintenance purposes. In the event of a problem, a crew is dispatched to the site immediately. The applicant has submitted an application for a Conditional Use Permit to be reviewed by the City planning staff. Existing Use The subject area is adjacent to the US Post Office distribution center on E. Marginal Way S. The subject property contains a Seattle City Light tower. Access /Circulation The project site area would be accessed from 27th Place behind the Post Office. No additional roads will need to be constructed. Visual and Environmental Resources Because of the line of sight nature of wireless communications, antennas are often visible to surrounding communities. However, the proposed antennas will be mounted on an existing utility structure, and appear to be part of the structure. Surrounding residents are accustomed to viewing the structure as a power and utility pole. The ancillary addition of antennas will not substantially alter any public viewsheds. Site Selection This site was chosen because it represented the best available option for technical, leasing and zoning requirements.
