Rants, Mayor Steve Lancaster; Director We received your letter of January 30, 1998 withdrawing your application for a Comprehensive Plan amendment at 5950 Southcenter Boulevard. We have closed out the application and have forwarded the application fee to Leon Grundstein as you requested. If you wish to proceed with a request for a zoning exception for the split zoned lot per TMC' 18.08040, please provide materials which present a clear, convincing rationale for making an adjustment at this point. There is a $200 review fee and no specific application form. Once we have your application materials, we can schedule a date with the Hearing Examiner. Hearings before the Hearing Examiner are a Type III hearing. This will require public notice including: 1)sending notices of the hearing to neighboring residents, businesses and property owners within 500 feet; and 2)posting the property with public information signs. Rebecca, This,Ietter is to formally withdraw our application for a Comprehensive Plan and Zoning Map change for the proposed development at 5950 Southcenter Boulevard. Please return the two application checks made out for a total of $1,400 to Leon . Grundstein at; Gencor Development, 85 S. Washington, Suite 308, Seattle, WA 98104 We have decided to proceed with a request for a Zoning exception for the split zoned lot per TMC 18.08040 under DISTRICTS ESTABLISHED- MAP;. Rules of Interpretation. This . provision allows a special exception to extend the zoning regulations for 50 feet on either side of the interpreted position of a zoning boundary on a split zoned lot. We believe that the intent of this position is to allow flexibility in the development on a lot which is divided by the zoning boundary. We also believe that the extension should be permitted if it allows development which provides a reasonable transition between the two zoning districts and does not negatively impact :the less intensive zone. Therefore the following or similar zoning policies would have to be achieved to permit the zoning extension: 1. The extension of the zoning regulations does not permit the bulk of the development on the more intensive zone to be significantly larger than would otherwise be allowed and /or incompatible with the less intensive zone. 2: The extension of the zoning regulations allows the placement of the development to create a reasonable transition between the two zoning ,districts. 3. . The extension of the zoning regulations does not permit the traffic and parking of the development to negatively impact the Tess intensive zone.
