NOTICE OF DECISION FOR CONDITIONAL USE PERMITS, L96 -0016 & 0018
Dear Mr. Slaybaugh:
As you aware, your request for. Conditional Use Permits (CUP) for
Showalter Middle School and Tukwila Elementary School were approved
by the Planning Commission on May 23, 1996. These permits allow
for installation of one portable building at Showalter for use as
an administrative office and two portable buildings at Tukwila
School for use as classrooms.
The Planning Commission approved both permits with the condition
that the CUP's will expire in ten years, unless new CUP's are
obtained.
The fifteen day appeal period on this decision ends June 7, 1996.

VICINITY AND SITE INFORMATION
FINDINGS
Project Description: The South Central School District proposes to add a portable
building (1792 square feet) to be located on the east side of Showalter Middle
School and north of the existing administrative building. The building will displace
about 2,000 square feet of lawn area and one tree.
Location: The project address is 4640 South 144th Street.
Access and Parking: The school and administrative offices will be served by two
parking lots with 150 parking spaces which will be accessed from S. 144th Street
once completed. Per the approved plans of a previous BAR approval, the existing
access located east of the administrative offices will be replaced by lawn. No new
parking is proposed.
Landscaping: Landscaping consists primarily of lawn area with several large
trees. One 14" tree will be eliminated. The approved BAR landscape plans calls
for new lawn extending east from the administrative offices to the east property
line replacing the asphalt drive. A row of shrubs will be planted along the
property line near the southeast corner of the site.
Surrounding Land Uses and Zoning:
North: SF Residential LDR
South: SF Residential LDR
East: SF Residential LDR
West: Foster High School LDR
Background: The project is located in the Low Density Residential zone (LDR) in
which schools are identified as conditionally permitted uses.
A Determination of Non - Significance was issued for the proposal as no significant
potential adverse impacts were identified.
The Showalter School grounds is presently undergoing significant modification
persuant to a BAR approval granted in 1995.

DECISION CRITERIA
The Planning Commission is guided by the following decision criteria for the
Conditional Use Permit. The applicant's response is contained in Attachment "B ".
Staffs response is provided below:
(A) The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity of the proposed use or
in the district in which the subject property is situated.
The site is separated from other uses on three sides by existing school buildings
and grounds. On the forth side are single family lots located 31 feet to the east
of the proposed building. The homes on those lots are somewhat buffered from
the school site by various accessory buildings.
The new lawn provided with the Showalter remodel will upgrade the transition
beteeen the portable site and the single family homes.
Minimal lighting will be added. The applicant indicated exterior lights will be
placed on the building.
(B) The proposed use shall meet or exceed the performance standards that are
required in the district it will occupy;
There are four pertinent classes of standards in the LDR zone district: minimum
setbacks, maximum floor area ratio, maximum building height and minimum
parking required.

(C) The proposed development shall be compatible generally with the
surrounding land uses in terms of traffic and pedestrian circulation, building and
site design.
The modifications to the site will not change vehicular traffic patterns and
pedestrian circulation beyond the changes to be made as part of the Showalter
remodel.

(D) The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan.
The Comprehensive Plan identifies the site as low density residential. Schools
are considered to be facilities which should support neighborhood quality in
addition to fulfilling their educational role (Page 73).
(E) All measures have been taken to minimize the possible adverse impacts
which the proposed use may have on the area in which it is located.
The proposal will not substantially change the character of the school operations
and its impact on the neighborhood. The portable is in scale with the residential
homes and is setback 31 feet from the nearest property line. Visiblity of the
portable is restricted by existing school buildings. The building will be most visible
from the single family lots to the east where the houses themselves are visually
isolated from the school grounds by the accessory buildings that are behind the
houses.
CONCLUSIONS
General Review Criteria
(A) The proposed use will not be materially detrimental to the public welfare...
The addition is compatible with the area. The building will be in scale with the
single family neighborhood, and will be set back significant distances from
property lines. Lighting should not affect adjacent properties to any significant
degree.
(B) The proposed use shall meet or exceed the performance standards...
The project meets the requirements of the zoning ordinance including setback,
height, floor area ratio and parking.
(C) The proposed development shall be compatible generally with the
surrounding land uses in terms of traffic and pedestrian circulation, building and
site design.
The development is compatible with the existing school facility and the
surrounding residential uses. Nth no increase in staffing, the addition is not
likely to significantly increase traffic, thus having minimal impact on vehicular and
pedestrian circulation in the vicinity.

(D) The proposed use shall be in keeping with the goals and policies of the

The use is identified as Low Density Residential by the Comprehensive Plan.
Schools are considered to be a necessary part of residential neighborhoods.
Consistent with that, they are allowed to locate in the LDR zone with a conditional
use permit.
(E) All measures have been taken to minimize the possible adverse impacts
which the proposed use may have on the area in which it is located.
The SEPA review was completed on May 10, 1996. No probable significant
adverse impacts were identified with this proposal. It is expected that the portable
building will blend in with the existing school operation and will not impact the
neighborhood.
Additional trees can serve to replace the tree to be removed and soften the
appearance of the building from the single family lots.
RECOMMENDATION
Staff recommends the Planning Commission approve the Conditional Use Permit
with one condition:
1. A cluster of three coniferous trees, 6' - 8' in height, shall be planted on the
east side of the portable building to soften its appearance from the
adjacent single family homes.

The City and South Central School District have a working agreement regarding the waiving of
fees for the joint use of facilities. In addition, the City and the District have a mutual interest
in the appropriate and careful utilization of public funds, especially in that the constituency for
both entities is largely the same.
In light of this, it has been determined to be in the best interests of the public to waive permitting
fees for the relocation of three portable buildings on District property. This memorandum shall
serve as authorization to you to waive those fees. That authorization is granted specifically by
Mayor Rants.
Additionally, I will be developing an interlocal agreement regarding the future treatment of
permitting fees relating to activities of the District. We will likely limit any fee collection to
actual dollar costs to the City due to external plan review.
