Receive staffs "Adoption of Existing Environmental Document," the Environmental Assessment titled "WorldCom Network Systems Northwest Fiber Build Project" Volumes 1 and 2, with three supporting technical documents, as completing SEPA compliance. 2. Authorize the Director to issue a non- exclusive, non- divisible easement to WorldCom for the placement, operation and maintenance of a fiber optic cable over portions of the John Wayne Pioneer Trail - Iron Horse State Park and Olallie State Park. The easement shall be subject to all standard and special terms and conditions deemed necessary by the Director. The Director is further authorized to make such adjustments in the easement and its associated legal description as may be required to accomplish the Commission's grant of authority and as may be deemed necessary for the protection of the public, Parks and Commission. 3. Approve staffs recommended distribution of fee revenue to be received from WorldCom. Explanation in Brief Parks staff have been preparing . an easement agreement to allow WorldCom to install a fiber optic cable along a portion of the John Wayne Pioneer Trail (JWPT) and along an existing roadway in Ol al l i e State Park, should the Commission approve WorldCom's request. WorldCom and its consultant provided Parks staff with the total linear feet of Parks land for which it seeks the easement, and provided the legal description applying to those lands. Parks staff used that calculated distance as provided by WorldCom in negotiating proposed easement terms including total compensation based on the rate of $4.29 per linear foot. When Parks staff completed review of the legal description provided by WorldCom and conducted an on -site, terminus to terminus inspection, it determined the actual mileage of easement requested by WorldCom was substantially (72 %) greater than'WorldCom's consultant had calculated. Parks staff have cross - checked the distance with county records and State Parks deeds, recalculated the compensation package and advised WorldCom of the changes. WorldCom is in agreement with Parks' staff analysis and agrees to pay the corrected amount. This addendum identifies the incorrect values and the corrected ones, and is keyed to the Agenda Item previously cited and distributed. Length and Compensation - Requested Easement The Agenda Item reported the easement requested was to apply to approximately 32 miles of parks land. In fact, the total miles are 54.84 (289,570 linear feet). The compensation for the easement for that distance is therefore $1,242,255 at $4.29 /linear foot. The total compensation to be received in 1996, if approved by the Commission, will then be $1,327,255. These terms would produce an estimated income over a 20 -year period of $2,670,255. Staff would expect to develop proposals for future Commission consideration for expenditure of those funds for Parks purposes. Two issues pertaining to the proposed easement have also been clarified since the Agenda Item was prepared and mailed. WorldCom and AT &T have confirmed that WorldCom wi ll install its own conduit through Snoqualmie Tunnel, as AT &T's is not available to it. WorldCom has agreed to coordinate with AT &T to design new buried cable notice signs to be displayed on AT &T posts. WorldCom will pay for the signs and supply additional signs to AT &T, with AT &T agreeing to maintain the signs and posts. Staff is pleased that this eliminates a potential duplication of signs. Box 42650 • Olympia, Washington 98504 -2650 • (360) 902 -8500 September 6, 1996 TO: Washington State Parks and Recreation Commission FROM: Cleve Pinnix, Director PREPARED BY: Larry Fairleigh, Assistant Director Resources Development SUBJECT: E -8 WorldCom Fiber Optic Easement - Iron Horse State Park - John Wayne Pioneer Trail - Requested Action SUMMARY: On June 20, 1996, representatives of WorldCom Network Services, Incorporated (WorldCom) addressed the Commission following presentation of a staff report on plans to request Commission approval to place WorldCom's fiber optic cable upon portions of state park land. WorldCom's staff and consultants have been actively involved in completing the environmental permit processing to allow for Fall 1996 construction of a cable from Seattle to Salt Lake City, a distance of 876 miles. The proposed cable would be used for voice, data and video communications connecting to a world -wide network. WorldCom requests an easement over some 32 miles of John Wayne Pioneer Trail and a small piece of Olallie State Park. Staff recommends approval of the requested easement. BACKGROUND AND ANALYSIS: On April 2, 1996, WorldCom submitted a request to State Parks for a non - exclusive, non- divisible easement upon the Iron Horse State Park -John Wayne Pioneer Trail (JWPT). That easement, if approved, would permit WorldCom to install a fiber optic cable with a sheath over 3.1.96 miles of the JWPT between Cedar Falls and Ellensburg and another quarter -mile segment along existing roadway in Olallie State Park. The one and three - eighths inch cable will be placed directly in the ground at a minimum burial depth of 3.5 feet. During negotiations with WorldCom, State Parks staff clarified that the easement requested would allow for placement of a 24 strand fiber optic cable, and that the easement would continue until abandonment of the cable by WorldCom. U C-12. ,0E-; w w` —O A; Z: z Iron Horse State Park - JWPT September 6, 1996 Page 2 Parks staff have been concerned about possible adverse construction impacts to the existing American Telephone and Telegraph Company (AT &T) fiber optic cable already in place on JWPT. WorldCom Senior Manager Larry Stalcup assured staff that the company is capable of placing its cable near and parallel to the AT &T fiber optic cable. That location would be as close z to the centerline of the John Wayne Pioneer Trail as possible. Alignment of the fiber optic build rX 2 project is shown on the attached maps. 6 v UO To expedite review in Washington, National Environmental Policy Act (NEPA) compliance is CO being performed by the United States Forest Service (USFS) - Wenatchee National Forest as J ►- "Lead Agency," with assistance from the Bureau of Land Management (BLM). Parks staff have w o been directly involved from the inception of the NEPA Environmental Assessment to assure that it would be sufficiently complete to allow its use as a SEPA document, as permitted in g WAC 197 -11 -600. The consulting firm of David Evans and Associates, Incorporated (DEA), has w a been preparing the Environmental Assessment, permit applications, easements and construction _ drawings directly for WorldCom. z F- O z� LLI During the permit application process, DEA and Parks staff identified 18 state and local "agencies with jurisdiction" in Washington. To expedite the remaining permit approvals and v provide leadership to the SEPA process, Parks staff offered to serve as "Nominal Lead Agency," 0 as permitted in WAC 197 -11 -942 and 944. All state and local agencies with jurisdiction w w concurred and Parks staff were able to provide substantial input to the "preliminary draft" concurred Assessment, which was released by USFS as a public review draft on July 24, 11 z 1996. Staff believe that it addresses all major environmental issues in sufficient detail to meet v co the standards for an environmental checklist and Determination of Nonsignificance (DNS) that r F=. would normally be prepared under SEPA. z Therefore, staff adopted the NEPA Environmental Assessment on August 21, 1996 as the official SEPA document for all state and local agencies with jurisdiction in Washington which had not already taken formal action. The legal notice was published in five newspapers from Seattle to the Tri- Cities. All comments received during the official comment period, which ended August 30, 1996, will be presented to the Commission at the time this action is considered. Therefore, all remaining proprietary and permit approvals can be or are now being considered by all agencies with jurisdiction, in light of the DNS adoption. Construction Schedule: Since the route includes work in Utah, Oregon and Idaho, as well as in Washington, WorldCom opted to begin construction of portions of the project in the other states as soon as the law permitted. A number of proprietary and permit approvals in Washington state have been withheld, pending completion of SEPA. In addition, no work can be done in Marbled Murrelet nesting areas on USFS lands until after September 15, 1996. Iron Horse State Park - JWPT September 6, 1996 Page 3 WorldCom is proceeding with construction of various segments of the line as permits are granted to assure completion of these segments prior to winter. Should the Commission approve z WorldCom's request for placement of the fiber optic cable on the JWPT, construction would 1 z begin immediately upon Commission concurrence. oc Mitigation: o o co o. cn w' WorldCom has devoted nearly ten pages in the Environmental Assessment to various mitigation measures to describe everything from erosion control to archaeological site monitoring. All of N w 0 State Parks staff's concerns related to impacts upon JWPT users have been adequately addressed, 2: in staff's judgement. If the easement is approved by the Commission, some of the impact fees g 7-1 received from WorldCom will be used to employ an on -site State Parks construction monitor for w a all construction on the John Wayne Pioneer Trail. This will give Parks the opportunity to I _ intervene prior to any problems developing. This will also assure State Parks that the project is z F- constructed in conformance with agreed standards. z o w • w Alternate Alignment: o - o —. o !- According to WorldCom executives and the Environmental Assessment, there was one potential w • w alternative to use of the Snoqualmie Tunnel and western end of the JWPT. 2`• . z That alternative would have been to construct in the Burlington Northern Santa Fe Railroad v (, (BNSF) Right -of -Way (ROW) through the Stampede Pass Tunnel down to Maple Valley, then north through Renton to Issaquah and to Seattle. That alternative was rejected by WorldCom for z the following reasons as stated on page 2 -5 in the Environmental Assessment: "This alternative section was eliminated because of the highly political atmosphere and associated uncertainties of the region, the potential impacts to a large number of threatened and endangered species and habitats, the potential cumulative impacts of other ongoing and future projects, and the difficulty of construction related to preserving water quality and future reallocations should BNSF RR reopen the railroad to commercial traffic." Even if this alignment were chosen, WorldCom would still need to use,a portion of the JWPT for which there is no viable alternative identified in the Environmental Assessment. State Parks staff are not aware of any other potential alignments over Snoqualmie Pass, should the State Parks Commission deny use of JWPT. WorldCom executives have informed staff that another route would be located, since the service is needed and substantial investment has already been made on completed segments of the $41 million project. �c:auk!iPor.�it�i.V'r5,c laet'Likr �:.''"ai.:,'L•tituiSiif6°.tii"P: "'y""ii•" +'�•- Iron Horse State Park - JWPT September 6, 1996 Page 4 Compensation : Parks staff have been working closely with WorldCom to develop an adequate mitigation and compensation package. A little history is in order. As a condition of the original fiber optic cable placement, AT &T acquired and deeded to State Parks $1,222,717 worth of old Milwaukee Road Corridor. This was a donation of land in addition to the annual maintenance support contribution, which started at $50,000 per year in 1989. That fee has a consumer price index (CPI) inflator and the 1996 payment was $67,784 for the 58 -mile AT &T corridor on JWPT. Those funds are being used to pay for "...maintenance and operation of Iron Horse State Park...which maintenance and operation benefits AT &T." WorldCom has requested a non - exclusive easement over 31.96 miles of John Wayne Pioneer Trail. Staff have also identified an additional 1,413 feet of roadway at Olallie State Park, which WorldCom believed was owned by the Department of Natural Resources (DNR) or the Washington State Patrol, but which is actually Parks land and which will be needed to complete the installation. 31.96 Miles JWPT - Iron Horse State Park .26 Miles Olallie State Park 32.22 Miles Staff have calculated and negotiated a.proposed compensation package based upon researched market information and the corridor length to be subject to the easement. That negotiated package includes the following provisions: 1. WorldCom has agreed to pay $725,000 for 168,764 linear feet of a ten foot wide easement for the life of this cable along the JWPT and $6,070 for 1,413 linear feet along a roadway across a northerly extension of Olallie State Park as generally described in the original application with the Olallie State Park parcel appended, and including an additional, temporary, ten -foot wide construction easement. 2. State Parks will provide WorldCom an easement ready for execution as soon as possible, subject to Commission action on September 6, 1996 and NEPA/SEPA approval, to be completed on August 30, 1996. 3. WorldCom will have the right to assign the easement to other parties with State Parks' approval, which will not be unreasonably withheld. 4. WorldCom will pay State Parks $45,000 associated with preparing the above easement, a maintenance agreement, and monitoring construction along the trail. $40,000 of the $45,000 payment is associated with researching WorldCom's request for an easement and preparing associated Commission analysis and documentation; i.e., for staff time and related processing expenses. The $5,000 will be non - refundable and non- accountable to z WorldCom if the easement is approved by the Commission. State Parks will Z` refund the $5,000 in the event WorldCom's easement request is not approved by w the Commission. State Parks acknowledges the receipt of a check for $45,000 dated July 11, 1996. In addition, State Parks is in receipt of a letter from o o. WorldCom confirming our understanding of WorldCom's payment of $45,000. 1 w = _! F.. 5. WorldCom agrees to secure an agreement with AT &T, if necessary, to use an N u-, wO existing steel conduit through the Snoqualmie tunnel or to place the WorldCom 2 cable in a similar conduit next to AT &T's cable. g 6. WorldCom must obtain State Parks' agreement on the placement of cables, w crossings on trestles, and site restoration. z 1- O'. z 7. Within reason, WorldCom will move equipment and clear the trail for trail users LLI u on weekends during September and October, 1996. 0 O y; O I- 8. WorldCom will pay a first year trail maintenance cost of $40,000 commencing w uj; upon execution of the maintenance agreement referenced in provision 4, supra. • v That cost will be adjusted for inflation by a mutually agreeable method at the —' z. beginning of the second year and each year thereafter that WorldCom operates the w _co U ; above facility. o To recap, then, total compensation of $816,070 is to be received in 1996 when the WorldCom agreements are executed, if authorized by the Commission. Typical calculations for determining compensation on rail -trail or other utility corridors are expressed in terms of dollars per linear foot or per mile. Compensation due State Parks for the negotiated terms presented, expressed in dollars per linear foot, will be: $731,070 Easement Fee /170,177 linear feet = $4.29 /linear foot In addition to the $731,070 Easement Fee are: $40,000 Processing /Administration Fee $ 5,000 Construction Monitoring Fee $40,000 First year's maintenance /operations annual fee; and $1,343 000 Estimated next 19 years' maintenance /operations fees (based on a $40,000 annual fee adjusted for 2.9% CPI- - the average applicable CPI over the past ten years) 11 sqt Iron Horse State Park - JWPT September 6, 1996 Page 6 These provisions result in a total estimated income over a 20 year period of $2.119.070. Staff have researched the fees charged by other public and private land owners for this and similar utility corridors. Staff conclude that the compensation proposed by WorldCom is at the high end of the range of similar cases. Details of the staff work are available to the Commission and other interested parties upon request. Revenue Distribution: The easement requested by WorldCom involves a significant facility already has had and, if approved will have, additional short- and long -term implications for staff resources and trail management needs. The compensation package negotiated and proposed to the Commission will, if approved, generate significant revenue. Staff has evaluated a variety of needs related to this facility and the John Wayne Pioneer Trail and proposes the following distribution of the present and anticipated revenue associated with the recommended easement. 1. Of the $45,000 payment already received: $40,000 To offset staff costs and hire staff to perform work delayed by action on this application. $ 5;000 To hire construction inspector to monitor installation of the cable. 2. Of the $731,070 as compensation payment for the easement: $500,000 To the Parks and Recreation Stewardship Account (PRSA). $231,070 For renovation of the Hyak Bunkhouse to a revenue- producing facility. Any balance not needed for this purpose would be available in PRSA for other park purposes. 3. Of the $40,000 first annual maintenance payment (with proportional distribution of subsequent years' payments, to reflect adjustment for inflation): $20,000 To be available to Iron Horse State Park to improve maintenance along the John Wayne Pioneer Trail. $10,000 To be administered by Puget Sound Region for a "volunteer trails challenge fund" to purchase materials and support volunteer trail efforts on State Parks along the entire Mountains to Sound Greenway corridor. $10,000 To the Parks and Recreation Stewardship Account. Iron Horse State Park - JWPT September 6, 1996 Page 7 Conditions of Easement: The proposed easement shall be subject to the following conditions: (1) That any pipelines or cables to be installed are placed underground unless it is essential that they be above ground. (2) That the control of park gates, roads and lands be retained by the Commission. (3) That the grantee comply with all applicable codes, laws and regulations. (4) That the easement include appropriate indemnification clauses protecting the Commission and staff. (5) That the Director may also include any other terms deemed necessary for the protection of the rail -trail and its visitors. (6) That the Director may take such emergency action as is immediately necessary for the protection of the public health, safety or welfare, including temporarily closing or otherwise limiting access to the corridor, but the grantee's need to protect and maintain its facility shall be accommodated in event of such emergency action to the degree practicable. AUTHORITY: RCW 43.51.040 provides that the Commission shall: "(2) Adopt, promulgate, issue and enforce rules pertaining to the use, care and administration of state parks and parkways." RCW 43.51.060 provides "The commission may:.. . (5) Grant franchise and easements for any legitimate purpose on parks or parkways, for such terms and subject to such conditions and considerations as the commission shall specify ... " RCW 43.51.061 provides: • "Notwithstanding any other provisions of this chapter or any other laws relating to the commission, the commission may delegate to the director of parks and recreation such powers and duties of the commission as they deem proper." (5) Approve and process the sale or exchange of lands or easements if such a sale or z exchange will not adversely affect the recreational potential of the corridor; ... " F z OPTIONS: R 00 u)°. 1. This will allow WorldCom the required access for w = construction, operation and maintenance of a fiber optic cable along 31.96 miles cn u of J.WPT and about a quarter mile of roadway in Olallie State Park. WorldCom would be required to locate another corridor to connect its line on either side of Snoqualmie or Stampede Pass. State Parks staff worked closely with USFS staff to assure that state and local agencies would have the ability to adopt the NEPA document to satisfy compliance with SEPA. This was accomplished and a comprehensive Environmental Assessment was distributed to the public on July 24, 1996. Prior to this proposed action before the Commission, some jurisdictions had already performed SEPA analysis for their particular action, but no comprehensive SEPA document was done by any state or local jurisdiction. In an effort to consolidate and expedite the SEPA adoption process and with concurrence of all other SEPA agencies with jurisdiction, State Parks assumed Lead Agency status on August 21, 1996. Public Notice was published in five newspapers from Seattle to the Tri- Cities. Therefore, all local and state agencies are now able to use the State Parks' Adoption Notice to satisfy future SEPA compliance. This effort minimized duplication. The seven day comment period ended on August 30, 1996. All comments received will be presented as an addendum to this report. PROJECT DESCRIPTION: The project involves installation of a fiber optic communications cable in the City of Tukwila. The proposed route will follow the Burlington Northern Railroad/Union Pacific Railroad right -of -way from where the railroad crosses the northern Seattle/Tukwila boundary to the Black River Junction, then the the route will follow the old BNRR grade heading east and will exit Tukwila at the eastern border with Renton. The cable will be placed in a trench approximately 2 feet wide by 3.5 feet deep and buried. Buried access vaults will also be placed periodically along the line.. 2. POLICIES OF THE SMA/SMP: The site is within the jurisdiction of Tukwila's Shoreline Master Plan and is consistent with the relevant goals and policies of the SMP. 3. SHORELINE REGULATIONS: Following are the relevant review criteria as contained in the Shoreline Overlay Zone: General Shoreline Regulations: (1) The use is in conformance with the regulations of the underlying zone district; Response: Communications lines are allowed in all districts. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit; Response: Minimal disruption of vegetation is expected during construction. The project has demonstrated compliance with Tukwila's Sensitive Areas Ordinance. The project involves installation of a fiber optic communications cable in the City of Tukwila. The area of disturbance will be approximately 2 feet wide and 3.5 feet deep. The proposed route will follow the Burlington Northern Railroad (RR) right -of -way from where the railroad crosses the northern Seattle/Tukwila boundary, in Section 3, Township 23N, Range 4E, to the Black River Junction in Section 14, Township 23N, Range 5E. where the proposed route will follow the old BNRR grade heading east and will exit Tukwila where the RR exits, at the eastern border with Renton (S14, T23N, R4E). Under this proposal, cable installation will come within 200 feet of the eastern shoreline of the Green River at 4 locations in S12, T23, R4E. The proposed project will not cause unreasonable adverse effects on the environment and will not interfere with the public use of public shorelines, for several reasons: 1. Cable installation will disturb a relatively small area of corridor, approx. 2 ft. wide by 3.5 ft. deep, and the cable will be buried after installation; 2. The cable will be hung from a new support structure across the East Fork of Issaquah Creek. This project is compatible with the general purpose and intent of the Shoreline Master Program because it provides a beneficial service (improved communications capabilities) while causing no disturbance to the shoreline and no substantial detrimental effect to the public interest. Attached are prints of the aerial photos used to establish the fiber optic cable route which may be compared with the location of the existing wetlands. No construction is planned to occur outside of the railroad right of way, hence no non -right of way buffer area is being altered by the proposed construction. Wetland Approaches Wetland #1 - The fiber optic cable is located on the railroad right of way as shown on drawing 1 -19. It is no closer than 20 to 30' from the edge of the vegetation which approaches the right of way. The wetland is designated Type 2 and an appropriate buffer would be 50 feet wide. The cable is to be buried 3.5' below surface, and the trench backfilled with the original material. It presents no impact to the wetland. Wetland #2 - The fiber optic cable is located on the railroad right of way as shown on drawing 1 -20. It is no closer than 20 to 30' from the edge of the vegetation which approaches the right of way, and inspection of the City of Tukwila shows the edge of the wetland to be 40' beyond the edge of the right of way at point of closest approach. The wetland is designated as Type 2 and appropriate buffer would be 50 feet wide. The cable is to be buried 3.5' below surface, and the trench backfilled with the original material and presents no impact to the wetland.
