You have indicated that this Lot Consolidation is a pre- requisite to my development of the property. 1 expect to be seeking a building permit - perhaps as early as July of this year. This means that I need your approval to develop my property in a way that best serves my purposes, and which I believe will also be to your advantage. As we have discussed, my intention is to build a residence that has its floor at the general level of your existing driveway so as to "front" on S 130th Street. Below this, I intend to have a shop with display and office area in which I would make and sell the golf clubs (putters and chippers) that I've developed. The floor of this shop would be slightly above the elevation of E Marginal Way and would "front" on that street. The south, west and north walls of this shop would be a retaining wall, allowing the area between the structure and the bank to be filled, raising the ground level between us to approximately the same level as your driveway. These plans were originally based on the assumption that our common property line was at or near the top of the bank between us. Although this has proved to be an incorrect assumption, I feel that the development plan I have been pursuing is still the best one. A portion of this filled area would be on your property (which we seem to agree is now a steep, useless and unattractive bank). This would be filled to a level to which we would agree, at my expense. Any topsoil, gravel, pavement, etc on your property would be at your expense. 3. During construction, it may be necessary or desireable to have access to the area to be filled from your driveway. Any damage or undue wear and tear due to equipment on your property would be returned to the original (or better) condition at my expense.
