Those matters have yet to be resolved and this letter �is a follow up on your failure to comply with local regulations and permit requirements. You were previously provided a deadline for installing trees on your property by December 6, 1996. You have failed to do so. The City has been willing to work with you to resolve this matter over the past ten months. You, however, have exhibited a long history of disregard for the City Codes applicable to removal of trees, disregard for the authority of the City with respect to permitting conditions, and for failure to cooperate with the City on these matters. The code provides for penalties in the amount of $100.00 per day that the violation continues for the first five days and $500.00 per day thereafter. Since March, 1996 you have exhibited such disregard by choosing to ignore a stop work order issued by the City. You have employed dilatory actions by failing to apply for necessary permits when directed to do so by City Planning Staff in a Notice and Order dated March 19, 1996. In fact, it was not until after the attorney for the City sent you a letter dated April 18, 1996 that you came to the City to discuss the permitting requirements. Thereafter, it took you over a month to submit your applications on May 31, 1996. Those applications were incomplete as you had not provided mailing labels. Over a month later, on July 8, 1996, after repeated reminders by the City that the applications were incomplete, you provided the mailing labels. At that time you indicated that you disagreed with the City's assessment on the numbers of trees you had removed from the shoreline. You were invited to produce information establishing the number of trees you claimed were removed but chose not to provide that information. In September, 1996 the City approved the shoreline and tree permits. The tree permit was approved with the condition that you submit a landscape plan for the City's approval and that any trees required to be installed, be planted by October 31, 1996. On October 31, 1996 the trees hadn't been installed. You submitted on that date a sketchy landscape plan for approval. The City on November 13, 1996 approved your landscape plan with conditions. The City extended additional time for you to plant the required trees to December 6, 1996. If the trees were not planted by that date, the matter was to be referred back to the City Attorney's Office. On December 9, 1996 the trees had not been planted. To date the trees have not been planted. You cut down trees in the shoreline without a permit in March, 1996, ten months ago. This matter is now before the City Attorney's Office again. You were strongly admonished in the past for your willful disregard of the City's authority and for your failure to comply with the permitting requirements by letter from the attorney for the City dated April 18, 1996. Since that time you have exhibited the same indifference and disregard. This is abundantly evident from the dilatory manner in which you have addressed these important concerns. Be advised that you no longer have the ability to delay planting of the required trees. You have ten (10) days from the date of this letter to have the trees planted. This deadline was not met, as the plan was not submitted for our review until October 31st. With this letter, the deadline for completing the planting is being extended to December 6, 1996. The planting plan submitted is minimal, therefore its' approval is subject to the following conditions to ensure the requirements of Chapter 18.54 are met: 1. The replacement trees shall meet current American Association of Nurseryman standards for nursery stock (TMC 18.54.130(3)(C)(ii). 2. Planting and maintenance of required replacement trees shall be in accordance with best management practices for landscaping which ensure the trees. Tong -term health and survival (TMC 18.54.130(3)(C)(iii). 3. Removal of existing vegetation and changing of existing grades for planting of the trees shall be kept to the minimum necessary to ensure the survival and well being of the new trees. No existing trees shall be removed to install the new trees without a tree permit unless the tree is exempt, and horizontal separation between existing and new trees shall be sufficient to ensure continued viability of all trees. 4. No trees shall be planted below the top of the river bank. Trees may be planted on the top of the river bank provided the slopes are not disturbed. 5. In lieu of installing the trees by the December 6th deadline, you may submit a financial guarantee to ensure their installation. The guarantee must be in the form of a cash deposit or assignment of account, in the amount of 150% of the cost of completing the work. An estimate of this cost shall be provided by a professional landscaper. If you pursue this option, the trees will have to be installed by March 31, 1997, or else the City will claim the funds and contract to have the trees installed. To reiterate, the deadline for installing the trees or providing a financial guarantee is December 6, 1996. You were previously provided a deadline for installing trees on your property by December 6, 1996. You have failed to do so. The City has been willing to work with you to resolve this matter over the past ten months. You, however, have exhibited a long history of disregard for the City Codes applicable to removal of trees, disregard for the authority of the City with respect to permitting conditions, and failure to cooperate with the City on these matters. Be advised that you no longer have the ability to delay planting of the required trees. You have ten (10) days from the date of this letter to have the trees planted. If the trees are not planted as required, rest assured that you will face legal action initiated by the City. The following information on the subject clearing activities is separated into two sections, on -site observations and zoning code regulation and permit requirements. I am not as familiar with the Civil Violations section (TMC 8.45) but it is referenced in the Tree Regulations and may be used for this situation. On -site Observations On Saturday, 3/2/96, City staff from the sewer /surface water section of Public Works left a message on my home telephone concerning tree removal east of Interurban Avenue and south of S. 144th Street along Maule Street. I didn't get home in time to help but the message indicated that significant clearing was in progress and a tree had fallen and interrupted electric power in the area. I wasn't sure of the property's actual location. On Monday morning at the office I learned that John Jimmerson, Planner, had previously spoke with the owner of the property. Because the site is adjacent to the Duwamish River, there was a question about the tree removal being in the shoreline zone. I asked John to visit the site with me and we would measure the 200 -foot shoreline zone. When we arrived at the site a remaining clump of trees was being cut in the northwest corner of the property. Most of the site had been cleared and surface graded. Soil and garbage debris were exposed. Wood debris and small limbs with green vegetation were scattered throughout the site. However, the only stumps visible was the clump of big leaf maple trees in the 'northwest. corner. After measuring the 200 -foot Shoreline Zone from close to the Ordinary High Water Mark, it was apparent that these stumps were inside the Shoreline. Most of the remaining trees being cut were greater than 200 feet from the river, outside of the Shoreline. John took a few pictures to document the tree cutting. John and I spoke with Gene Bonomi of Gene's Hauling & Excavating, 228 -4621. He was working on the site last weekend and reported there were many trees inside the 200 -foot Shoreline Zone. Before we left Lou Sanft (owner's son ?) arrived to talk with us. We informed him that a tree permit was necessary for the trees removed in the Shoreline Zone. Also, we told him to contact Public Works because they regulate land altering of areas exceeding 6,000 square feet. Mr. Sanft said he would work with the City to mitigate the situation. This was the first time I had met or talked with Mr. Sanft. Zoning Code Regulations / Permit Requirements The current Tree Regulations Ordinance (TMC 18.54) requires a Tree Permit for tree removal occurring within a sensitive area, sensitive area buffer, or shoreline zone as stated in TMC 18.54.050. As defined, regulated trees are those greater than 4 inches in diameter measured 5 feet above grade, "Significant Tree" TMC 18.54.770. The definition excludes Cottonwood trees. In addition to the work requirements of applicant insurance (TMC 18.54.110) and protection of property (TMC 18.54.160 c.), a security can be required to mitigate damages should they occur as a result of clearing which is not authorized' by a Tree Permit (TMC 18.54.120). The Enforcement section (TMC 18.54.180) of the ordinance refers to TMC 8.45, Civil Violations for helping to remedy a violation. The Enforcement section also allows the DCD Director to post a "Stop Work Order" directing that all vegetation clearing not authorized under a Tree Permit cease immediately. The Remedial Measures subsection (d) states the actions necessary to mitigate the impacts of clearing must be completed within 6 months or within the time period otherwise specified by the Director. On March 21, 1996, you received a Notice and Order from Ross Earnst and Steve Lancaster, the Tukwila Director of Public Works and Director of Community Development, respectively, informing you of numerous violations of the Tukwila Municipal Code relating to your recent tree and vegetation removal activities on the above - referenced properties. A copy of that Notice and Order is enclosed. Because you have not responded to the direction given in that Notice and Order, I have been retained by the City to take appropriate action to secure your compliance. Your recent activities on the above - referenced parcels violate the Tukwila Municipal Code in several respects. First, you failed to obtain a permit under the Land Altering Regulations, Chapter 16.54 of the Tukwila Municipal Code, before commencing any work. Second, you have removed vegetation within an area protected by the City's Shoreline Overlay Zone Regulations, Chapter 18.44 of the Tukwila Municipal Code. Finally, you removed significant trees and understory vegetation without a permit in violation of the City's Tree Regulations, Chapter 18.54 of the Tukwila Municipal Code. These violations are serious and must be corrected by you immediately. In order to cure these Code violations, you must do the following things. First, you must immediately apply for and obtain all required permits and approvals necessary under the above - referenced sections of the Tukwila Municipal Code and any approvals from the State of Washington which are required by those Tukwila Municipal Code sections. Second, those permit applications must contain, and when the permits are issued you must accomplish, remediation measures in order to restore those portions of your properties which are in violation of the Code to an appropriate state. You are hereby notified that unless you apply for all required permits immediately and make all necessary payments within ten (10) days from the date of this letter, the City is prepared to take all necessary legal actions, up to and including the filing of a lawsuit, to force you into compliance. Please understand that the City does not undertake these actions lightly. We cannot, however, continue to allow you to violate the City's Codes within impunity. When you were originally ordered to stop work on March 5, 1996, you did so only for as long as it took the inspectors to leave the site and then recommenced working in violation of the stop work order. When you were given the Notice and Order, you initially inquired about permits, but have taken no steps to file any applications. This indifference to the problem and willful disregard of the City's authority has left the City with no choice but to turn the matter over to me for action. The choice is now yours. He said some of the trees were a hazard and he was concerned they may fall on the buildings on the adjacent lot (GT ?). He asked if a tree permit was necessary. The sensitive areas map did not indicate any slopes or wetlands, so I told him as long as the trees were out of the shoreline zone - 200' from high water mark - that no tree permit was necessary. I believe I also told him that if any trees were in the right -of -way (Maule), he would need permission from Public Works to cut them down. This conversation was based on generalities. In no way did I tell him that he was exempt from permits. I only gave him the parameters for when a permit is or is not required. We did not have a map showing location of the trees he was speaking of. March 4, 1996: Louie called me first thing in the morning, saying that his contractor had been told by the City to stop cutting. He was surprised because I had told him no permit was required when he came in in January. He reiterated the need to cut down the trees as they may fall on the adjacent building. When I asked who from the City told him to stop work and why, he did not know. Later he called and said it was John Howat, but he did not know the reason. I called, John. Since he was out I spoke to Ted Freemire. Ted said John had told them to stop because they may be violating Planning regulations. I called Louie again. He said he had several trees still to be cut, and since the contractor's equipment was on the site now, he wanted to finish the job. He asked me for the a go -ahead to finish the job. After receiving his fax, I drove to the site to discover that the site had been disturbed much more that I had understood. Rather than removal of a few trees, it appeared as though the entire site had been cleared of vegetation. The entire site, save a cluster of trees at the northwest corner and a line of trees and shrubs along the top of the river bank and one lone black cottonwood had been cleared. Louie came into the office for an answer. I indicated that based on my site visit I thought trees had been removed within 200' of the shoreline and that he needed to submit a tree permit application. I reviewed the application requirements and gave him a copy of the replacement tree schedule. I reviewed the situation with Jack Pace and we agreed that since the remaining trees were further than 200' from the shoreline, that they were not subject to a tree permit and that we would authorize removal. We also agreed that a tree permit for the trees already removed in the shoreline zone would be necessary. I contacted Louie at some point and told him that he could remove any tree beyond 200 feet. The plan he submitted showed all but the Black Cottonwood as being further than 200 feet from the shoreline. Later that afternoon, Gary Schulz and I visited the site (about 2:30). We measured the distance to trees that were in process of being cut. A cluster of about 4 trees that was significantly cut before we arrived (apparantly on Saturday) measured about 175' from the high water mark. Two poplars beyond were about the 200' mark. There were several poplars even further away. We talked with Louie Sanft and told him (again) that he may cut down the trees beyond the 200 foot line and added that the black cottonwood in the middle of the site is also exempt, but that he would have to apply for a tree permit for the non - exempt trees that had already been removed. On plans he would need to show the 200' line and the location and estimated size of any trees that were removed. We would exempt one of the trees as hazardous that he and the hauling contractor said was rotted in the center. We told him that the work requires a land clearing permit from Public Works as it exceeded 6,000 sq. ft. and suggested he talk to PW. Louie agreed that he would submit a tree permit application and that he understood replacement trees would have to be provided. March 5, 1996 After Public Works told the crew to stop work today, Steve Lancaster and I discussed the matter with Doug Micheau and came to a common understanding that that the trees that were further than 200' from the shoreline were not subject to a tree permit. I called Louie and told him that they could be removed. As I indicated to you, based on our records and the site plan you submitted, the trees located at the NW corner of your property on Maule Avenue (north of GT development) are more than 200' from the shoreline and therefore may be removed without a tree permit. This does not include the remaining maple of the cluster that was largely removed on Saturday, nor does it include the two poplars that were removed earlier today. Based on aerial photographs and our discussions, it is clear that there have been several significant trees located within 200 feet of the shoreline that have been removed. You will need to submit a tree permit application, the $25 fee, and a site plan which identifies location, size and species of trees with diameter of 4" or greater that were removed. The site plan needs to also provide location, species and size of the replacement trees to be planted, the number of which is based on the replacement schedule I gave you this morning. The hazardous tree should also be identified on the site plan and labeled as such. Because it would have been exempt from a tree permit as a hazard, we will not require that replacement trees be provided for it. But as you know, the aerial photographs he used were dated fr.`om 1986 and they did not allow him to clearly identify the species and size of the trees. You seemed to question the accuracy of this estimate. f hope I made it clear to you that it was just an estimate, and that we don't have better information to confirm nor deny that estimate. Again, because of this dearth of information, it is appropriate to apply the canopy method. I conveyed to you that we will review any additional information you provide that may help us accurately determine the number, size and species of trees removed from the shoreline zone. If this information can be provided and we are satisfied of its accuracy, then we will be able to use the tree replacement table rather than the canopy method. Give this discrepancy and that we cannot precisely identify after the fact the number, size, and species of the trees removed, DCD has determined the tree canopy cover approach is appropriate to determine the number of replacement trees required (TMC 18.54.140 (b) . This approach requires that you provide a minimum canopy cover of 20' of the site. Each tree planted is considered to cover 314 square feet. (Thus, site area in square feet x .2/314 = number' of trees required).
