RE: L96 -0032: Southcenter Golf /Schoenbachler Boundary Line
Adjustment.
Dear Bob:
As we agreed, I am sending you this letter as written
confirmation of our project discussions to date.
The proposed boundary line adjustment seems to satisfy all City
of Tukwila development standards except for the property line
between Lot A and Lot B, labeled as "N64 deg. 58 min. 28 sec. W
424.78 feet." As we both agree, this relocated line would be
interposed between the ball containment net of a golf driving
range and the anchor which keeps it up. The anchor'is an
integral part of the golf driving range structure.
Location of the lot line in the middle of this structure as
proposed, would create a conflict with the Zoning Code's minimum
five foot, side yard building setback (TMC 18.40.080). The five
foot building setback prohibits structures within five feet of
either side of the property line.' The Department'cannot
approve actions which would be in conflict with adopted
development standards.
The Department disagrees with your attorney's advice that your .
ownership of all existing and proposed legal lots of record makes
the location of structures, relative to building setbacks for
common lot lines, moot. The City regulates land use based on the
legal lot of record, not based on common ownership patterns.

Based on the above, I conclude that the proposed boundary line
adjustment cannot be approved. I have reviewed this conclusion
with the Senior Planner and the Tukwila City Attorney who concur.
We had previously discussed the option of creating an easement
for this anchor on the adjacent property. However, the easement
option does not now seem to be possible in light of the Zoning
Code's specific reference to "lot lines" in its definition of
building setback areas.
At least three other options present themselves:
A. Shift the entire property line at least 10 ft. to the north.
This would allow continued use of the survey stakes now
installed for location purposes, since the lines would be
parallel.
B. Jog the property line around the net anchor. This would
maintain the required setback and minimize the difference in
property area.
C. Move the net anchor sufficiently to provide the minimum
Zoning Code setback with the currently proposed property
line. This would require a. building permit and structural
engineering to validate the new anchor location and design.

A Boundary Line Adjustment (BLA) is the realignment of property lines between parcels.
The purpose of a BLA is to accommodate a minor transfer of land between adjacent, legally -
created lots in order to correct property line or setback encroachments, create better lot
design, or improve access. It is not the purpose of a BLA to create additional building lots.
' A Lot Consolidation is the elimination of property lines and the consolidation of several
parcels or lots into one lot. This is usually done to create a lot with sufficient area and
dimensions to meet minimum requirements for width and area for a building site.
PROCEDURE
Applications are reviewed administratively in approximately 30 working days. If the land
to be platted is in a sensitive area or 'its buffer, then an administrative planned residential
development (?RD) application' is required and can be reviewed concurrently'. with the
adjustment process. When reviewing the application, the Planning, Fire and Public Works
Departments determine whether the proposed lots conform and are developable under the
existing`Zoning Code, have adequate access, and are served with adequate utilities, fire
protection, drainage and water supply. In addition, the proposed legal descriptions are
' ;checked for accuracy.
Following City approval, the approved documents mustbe recorded with the King County
Recorder (296 -1536) in order for the changes to take effect. The filing fee is $26.00 plus $7.00
for the first page and $1.00 for each subsequent page. •
The process for a Lot Consolidation is the same; however, a survey is not required if no
adjustment other than lot line elimination occurs.
The' City of Tukwila makes no representation regarding proposed property line adjust
ments or eliminations other than that the adjustment or ehmination does not create any
additional lot, tract or parcel and that the proposal does not create a non -legal building site
containing insufficient area and dimensions.. •
