O . w.z Staff Report to the L96 -0034 Planning Commission Sprint Spectrum FINDINGS Vicinity /Site Information Project Description The applicant is requesting permit approval to install a Personal Communication Services (PCS) base station facility for wireless communication systems at the subject property. The proposal includes the ground mounting of 5 equipment cabinets. These cabinets will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities to operate radio equipment and two auxiliary cabinets for increased capacity. Two antenna arrays will be mounted on the roof of the apartment building. One array, comprised of 4 antennae, will be at the north end of the building and will measure 27.5 inches (2 1/4 feet) above the roof. The central array, also comprised of 4 antennae, measures 60.34 inches (5 feet) above the roof. A Global Positioning System (GPS) antenna disk, measuring 2" by 4" will be mounted on the rooftop next to an antennae array. The GPS is used for system timing. The ground cabinets and the rooftop antennae will be connected through a cabling system trenched between the cabinets and the building, then mounted onto the north side of the building to the antennae. The cabling will be protected in a covered tray throughout its course on the building. Electrical power to operate the equipment will be provided through existing Seattle City Light service to the apartment complex. Connections between the electrical room and the ground equipment will be made through a 230 foot trench from the building through the parking lot. A twelve (12) foot light pole will also be installed within the proposed 5 foot landscape buffer provided to screen the ground equipment. Telephone services will also be available at the ground cabinets. Applicant will also replace 75 feet of fencing along the side property line. Existing Development The site is currently occupied by the Villa Nelle Apartments, a multi - family complex located within a HDR zone. Surrounding Land Uses There are several multi- family complexes at the north end of the site, fronting S. 144th, including the Riverton View, LaRochelle and Colonial Apartments. These properties are zoned HDR. The south edge is fronted by S. 146th, with the DeCara Apartments, zoned Regional Commercial (RC), across the street. To the 2 z mow_ - U': O 0 co o' J H. These properties are zoned HDR and Neighborhood Commercial Center (NCC), respectively. Topography The terrain is generally flat at the location for the proposed ground - mounted cabinets, however there is a steep grade change approximately 5 feet from the rear property line. The rooftop of the building is also flat, with a mansard -style roof facade. Vegetation There are some existing shrubs where the ground mounted cabinets will be located. Applicant has proposed removing existing to be replaced with evergreens that shield the cabinets and fencing that will be installed around the cabinets. Access Access to the ground equipment will be made through a gated fence around the equipment. Ground equipment will be located to the northwest edge of the existing parking lot. Rooftop antennae will be accessible through an existing door. Alarms will also be included on the ground equipment in case of intruders. ZONING CODE REGULATIONS The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant indicates that the facility "does not emit harmful rays, noxious odors, heat, excessive noise or pollutants ". Applicants also indicated that approximately 24 trips per day would be generated during construction, followed by 1 trip per month for maintenance. Applicants indicated that , antennae are painted to blend in with their surro ding Applicants have also proposed to include fencing and fighting to improve security around their ground equipment, as well as ensuring limited access to the rooftop antennae, via access only through the apartment building. The applicant has also proposed that a five foot landscape buffer be installed around the front and sides of the ground equipment, with the rear of the ground cabinets exposed. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. According to the applicant, 24 trips per day will be generated during the 2 week construction period and following the completion of construction, 1 trip per month for maintenance. To mitigate the project's impact on the existing building and site, the applicant has proposed that the ground equipment will be screened with vegetation. Cabling attached to the building will also be enclosed and painted a color to match the building. All antennae will be painted to blend in with their surroundings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.34. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. When completed, the project will use existing electrical services provided to the apartment complex. The applicant will extend utilities from the electrical room in the basement of the apartment building to the ground equipment. The applicant has secured service from Seattle City Light. The applicant has also secured services from U.S. West for the operation of an on -site telephone services. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is not proposing. a facility that will be shared with any other PCS providers, however the project allows for future expansion of existing ground infrastructure and placement of additional antennae within the existing arrays. The applicant has indicated-t1Ta no similar provider has expressed interest in this project. 4 Staff Report to the L96 -0034 Planning Commission Sprint Spectrum To minimize visual impacts associated with this project, the applicant will paint the rooftop antennae to blend with the surrounding environment. The applicant also indicated they will screen the ground level equipment with evergreens shrubs, to provide year -round coverage. 5) All measures have been taken to minimize the possible adverse impacts which the proposed Q use may have on the area in which it is located. CONCLUSIONS Zoning Code regulations concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare... PCS facilities had been found to not emit harmful rays or pollutants. Transportation will be limited during 2 week construction period and will require one trip per month after construction for maintenance. Therefore, conditions have been satisfied. (2) The proposed criteria shall meet or exceed the performance standards... As submitted, the landscaping proposed by the applicant does not meet this standard. Further, the ground equipment must be setback 10 feet from the side and the rear property line. A growing number of people are discovering the convenience and safety of utilizing wireless phones and pagers. Sprint Spectrum's system combines paging and short messaging with a portable phone. Wireless services are valued in emergency situations because the wireless infrastructure is less vulnerable to wind weather damage than traditional land -line telecommunications infrastructure (wires and cables supported by poles, strung from pole to pole). Zoning Code Conditional Use Permit Criteria A. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated RESPONSE: The antennas are designed to have minimum visual impact. The antennas are painted a color to blend with the surrounding environment. The antennas add 3 feet 4 inches of height to the building at the northern end, and 6 feet 5 inches to the central part, the minimum height possible as dictated by radio signal coverage requirements. Splint Spectnim proposes to construct a Personal Communication Services (PCS) base station for wireless telecommunication service on O'Hare property, at 3516 South 146th Street, Tukwila, WA 98168. The Villa Nelle Building, an existing three story residential structure, occupies the property. The base station consists of two arrays of roof - mounted antennas and five ground - mounted equipment cabinets. One array is at the north end of the building, the other on the central part of the building. The ground- mounted equipment cabinets are to be located at the northwest corner of the building. The two antenna arrays will have four antennas which are 27.5 tall inches, 6 inches wide and 2 inches deep on the north part, and 60.34 inches tall, 6 inches wide and 2 inches deep on the central part. The north array reaches 36 feet four inches above the rooftop including building height. The central array reaches 39 feet five inches above the rooftop including building height. These two arrays are vertically mounted on the roof at the minimum height that allows them to transmit and receive radio signals. One small Global Positioning System ( "GPS ") antenna disk (2 inches tall by 4 inches in diameter), used for timing purposes, will be mounted on a 1 foot tall bracket on the roof next to one of the antennas. The cabinets are 6 feet tall and screened with landscaping. Total land area devoted to the project is 600 square feet (150 square feet for the equipment cabinets and 350 square feet on the roof for the antenna arrays). The facility transmits radio signals in the 1850 -1970 Megahertz range, and operates at very low power levels (less than 200 watts total). The proposed use operates 24 hours a day. The north array reaches 36 feet 4 inches above the rooftop. and the central array reaches 39 feet 5 inches above the rooftop. These two arrays are vertically mounted on the roof at the minimum height that allows them to transmit and receive radio signals. One small Global Positioning System ( "GPS ") antenna disk (2 inches tall by 4 inches in diameter), used for timing purposes, will be mounted on a 1 foot tall bracket on the roof next to one of the antennas. The cabinets are 6 feet tall and screened with landscaping. Total land area devoted to the project is 600 square feet (150 square feet for the equipment cabinets and 350 square feet on the roof for the antenna arrays). Other similar base station facilities will be located at points throughout Puget Sound. The Sprint Spectrum mobile telecommunications customer is able to move throughout the system with calls passing from one base station to another. The antennas are designed to be as small as possible and to have minimum visual impact. During the week construction period, when hours of construction will be limited to lam to 5pm Monday through Friday, there will be approximately 24 vehicle trips per day. During operation, the facility is unstaffed and inaccessible to the public. The facility does not emit harmful rays, noxious odors, heat, excessive noise or pollutants. Code Compliance Sprint Spectrum's proposal is consistent with the City of Tukwila Municipal Code Section 18.10.040 defining defining the use and requiring a Conditional Use Permit. The proposed use is on property in the LDR Low Density Residential District. Sprint Spectrum Sprint Spectrum is a partnership of Sprint Corporation, Telecommunications, Inc. (TCI), Cox Communications and Comcast Corporation. These partners formed Sprint Spectrum in 1994 to develop and provide nationwide Personal Communications Services (PCS) over a wireless network. In March 1995, Sprint Spectrum obtained licenses from the Federal Communications Commission for the Seattle Major Trading Area and 28 other markets throughout the U.S. to develop this network. The Seattle Major Trading Area includes the western two- thirds of the State of Washington. The Service PCS is an abbreviation for "Personal Communication Services," the newest innovation in wireless communications technology. PCS offers a unique combination of telecommunications services. These base stations each transmit the radio signals in the frequency bands between 1850 and 1970 MHz at a very low power (less than 200 watts total). As the Sprint Spectrum customer moves throughout the system using his or her equipment, the call is passed from one base station to another. Each base station site will have four (4) cabinets of radio equipment and one (1) antenna array. The radio cabinet dimensions are approximately 6 feet in height, and 30 inches square. They will be served by standard commercial power and a telephone line. PCS systems will have an omni - directional (whip -- not proposed in this application) or sectored (panel) antenna array depending on the location of the site and the number of anticipated users. Omni sites will generally have 4 "whip" elements approximately 6 feet high and 2 inches in diameter. Sectored sites with panel arrays typically have 12 elements (4 per face in a triangular configuration), each approximately 6 feet long, 6 inches wide and 2 inches deep. Public Benefits Wireless communications services are being utilized throughout the country by emergency service providers, public utilities and maintenance companies, and mobile commercial providers. A growing number of people are discovering the convenience and safety of utilizing wireless phones and pagers. Sprint Spectrum's system combines paging and short messaging with a portable phone. Wireless services are valued in emergency situations. For example, in the recent regional • windstorm, with many phone and power lines down, wireless services provided communication links to ensure safety and assistance where needed. In addition, wireless subscribers have reported countless auto accidents and disabled vehicles, emergency conditions, crime or drunk driving. Site Selection The need for a new base station site is dictated by capacity and coverage requirements. Once the need for a new PCS site in a particular service area has been established, Sprint Spectrum's engineers identify a target district in which to locate the facility. Within the target district, the selection of a specific PCS site location is determined by local topographic and geographic factors. Sprint Spectrum also considers mitigation of the facility's visual impact, compatibility with existing land use and the ability to negotiate a contract with a willing landlord. The height of the antenna array is determined by local topographical factors such as ground elevation, tree canopy, buildings within the area, and mountains. A radio signal must travel unobstructed to be effective. The customer's handset needs to "see" an antenna. In addition, the Federal Aviation Administration (FAA) requirements dictate the height of the antenna mounting structures near or on major airport facilities. Environmental Impact Typical communications facilities consist of computerized radio equipment. These facilities are unmanned and inaccessible to the public. PCS facilities operate at a high frequency with very low power. Radio frequency energy has existed since the beginning of time. The sun emits energy that registers on the frequency spectrum, human beings and animals emit energy, and energy is used as electricity. An environment free of radio frequency energy would be dark, cold and silent. The American National Standards Institute (ANSI) has established a standard for safe levels of radio frequency energy. These standards are designed for 24- hour - per -day, lifetime exposure from conception through adulthood. Thus, they are designed to apply to all: the unborn, young, old, sick, and fit. The development of safety standards examines the entire body of scientific literature. Currently, there are over 10,000 such reports. Over 100 experts work on the committees continuing to evaluate the biological effects of radio frequency energy and electromagnetic fields. "Under the most conservative assumptions of any scientifically recognized standard, the electromagnetic fields associated with PCS base station antennas are many many times below the levels associated with adverse effect, and many many times below the safety standards that have been recommended by the experts in the various published standards. The FCC issues operating licenses in separate frequency bands to prevent interference. The FCC has authorized Sprint Spectrum to use the PCS allocation with handsets transmitting in the 1850 -1865 MHz range and base stations transmitting in the 1930- 1970 MHz range. Find below an example of the types of frequency spectrum users: AM Radio: FM Radio: TV Stations: Cellular and ESMR: Cable TV: PCS: 540 -1600 kHz 88 -108 MHz 54 -806 MHz 800 -900 MHz 50 -500 MHz 1850 -1970 MHz Transmitting and receiving equipment of all kinds is manufactured according to the assigned FCC frequencies. As a result, Sprint Spectrum is not allowed to transmit a signal that could be received by a radio or television set, or other electronic equipment. PCS base stations operate at very low power levels (200 watts or less). In contrast, other broadcast stations such as AM/FM radio or TV operate at up to five million watts. Most electronic equipment is designed with electronic shielding to prevent undesirable radio signals from being picked up by other electronic circuitry. There should not be any problem of interference from properly shielded, maintained and operated equipment. In the unlikely event of interference caused by its PCS system, Sprint Spectrum would take whatever actions necessary to eliminate the problem. In summary, Sprint Spectrum's facility will fulfill a daily need for wireless communication in the area, providing dependable communication links for business, safety and productivity in a commercial zone. The PCS services that the proposed use provides are a public benefit offering families and businesses increased communication options and emergency services at a lower cost while minimizing the impact on the neighborhood.
