Rants, Mayor Department of Community Development Steve Lancaster, Director NOTICE OF DECISION Conditional Use Permit Application L96 -0037 - AT &T Wireless Communications 6100 Southcenter Blvd. On September 26, 1996, The Tukwila Planning Commission held a public hearing on an application for a Conditional Use Permit by Spencer Planning, on behalf of their client AT &T Wireless, for the placement of a Personal Communication System (PCS) Base Station at 6100 Southcenter Blvd. The hearing was an Open Record Hearing, pursuant to TMC 18.108.040 (Type Four Decision Process), as the application was filed after the effective date of the ordinance but before ordinances to implement revisions to R.C.W. 36.70 were adopted by the Tukwila City Council. The proposed facility is comprised of one (1) array of 4 antennae, to be located on the rooftop of the subject building, and a series of electrical and radio cabinets, to be located in a basement room of the building. Please note that this document supersedes the Notice of Decision dated October 3, 1996. FINDINGS Attached is an Amended Staff Report concerning the subject application. This report was prepared October 17, 1996, in support of the Planning Commission's findings at the September 26, 1996 hearing. As indicated in this report, the Planning Commission denied the applicant's request for a Conditional Use Permit. APPEALS The period for administrative appeals on Type Four decisions is 14 days, starting from the issuance of this Notice of Decision. The administrative body hearing this appeal is the City Council. All appeal materials shall be submitted to the City Clerk. Appeal materials shall contain: 1. The name of the appealing party, 2. The proposal includes the installation of radio operating equipment within the existing structure, in an equipment room to be built in the existing building's first floor. The equipment room will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities to operate radio equipment and two auxiliary cabinets for increased capacity. One antenna array, comprise of four individual antennae, will be mounted on the roof of the apartment office building. The array will be located to the southeast portion of the roof, setback 10 feet from the roofline, and will measure 8 feet above the roof. The equipment room and the rooftop antennae will be connected through a cabling system carried from the equipment room, through the building to the rooftop. The cabling will be along the rooftop in a covered tray. Electrical power to operate the equipment will be provided through existing Seattle City Light service to the office building. Telephone services will also be available at the ground cabinets. Existing Development The site is currently occupied by the Centerplex Office Building, a two- building, multi-tenant office complex. Surrounding Land Uses The Cottage Creek apartment complex and a single family house, zoned High Density Residential (HDR) and Office (0), respectively, are located directly north of the subject property, across 62nd Ave., S. Directly to the south is Southcenter Blvd and the I-405 right -of -way. To the east is the Tukwila City Hall, zoned Office (0) and to the west is the second building that comprises the Centerplex complex. Access Access to the equipment room will be made through a locked service door. W W' �i ift — o: .. z�. 0 _', o �. z Staff Report to the L96 -0037 Planning Commission AT &T /Centerplex Building CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant has proposed placing all operating equipment in a room inside the building to limit potential contact with unauthorized individuals. The antennae will be setback from the roofline to reduce what the applicant refers to as "aesthetic impacts" associated with this equipment. There appears to be no health impacts associated with the type of wireless technology the applicant will be using at this site. The operating range, amount of energy the facility will produce and the location of the antennae are all within safety parameters set by the American National Standards Institute (ANSI). Public testimony concerning the impact of the proposed rooftop antennae is included in Attachment G. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. Performance standards that would normally apply to development in this zone, including setback, height restrictions, landscaping or design are not applicable to this proposal. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the PCS system will generate traffic of approximately 24 trips per day during the construction period and, following the completion of construction, 1 trip per month for maintenance. To mitigate the project's impact on the existing building and site, the applicant has proposed that the antennae will be painted to blend in with their surroundings. All radio operating equipment will be internal to the building and will not impact the site design of the existing buildings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 3 z �w u6= UO J =, 1- w 0.. �a. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. When completed, the project will use existing electrical services provided to the office complex. The applicant will extend utilities from the existing electrical room to the new equipment room. The applicant has secured service from Seattle City Light. The applicant has also secured services from U.S. West for the operation of an on -site telephone services. 12.136. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is not proposing a facility that will be shared with any other PCS providers, however the project allows for future expansion. To minimize visual impacts associated with this project, the applicant will paint the rooftop antennae to blend with the surrounding environment. As all equipment will be enclosed in a secure room, all related equipment will be out of view. Public testimony concerning the impact of the proposed rooftop antennae is included in Attachment G. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has proposed placing all rooftop antennae 10 feet from the roofline, to minimize the "aesthetic impact" of the antennae. The antennae array on the roof will be painted a color that will help them blend in with their surrounding. Applicant also has placed all of the radio and operating equipment out of public areas and into a secured room. Public testimony concerning the impact of the proposed rooftop antennae is included in Attachment G. CONCLUSIONS Zoning Code regulations concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare... PCS facilities had been found to not emit harmful rays or pollutants. Transportation will be limited during the construction period and will require one trip per month after construction for maintenance. Potentially hazardous operating equipment is inaccessible to the public. . ' ' :. Accordingly, the applicant has failed to meet the standards of this criteria. (2) The proposed criteria shall meet or exceed the performance standards... There are no applicable standards for the project. (3) The proposed development shall be compatible generally with the surrounding... There will be a maximum of 24 trips per day during the two week construction period, followed by one trip per month for scheduled maintenance. The equipment will be in a secured room out of public view. The rooftop antennae will be painted a color to blend with their surroundings. The cabling between the ground equipment and the antennae will be internal to the building. Therefore, all conditions have been satisfied. (4) The proposed use shall be in keeping with the goals and policies... The Planning Commission concludes that the applicant failed to comply with Policy 12.1.36 in the Tukwila Comprehensive Plan, which states that the city shall "Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible ". The Planning Commission found that, in support of the above mentioned decision criteria and policy, that the proposed antennae appeared to "be a detriment to the views and sights of residents located nearby ". Accordingly, the applicant has failed to meet the standards of this criteria. (5) All measures have been taken to minimize the possible adverse impacts... All radio equipment to operate the facility will be contained in a secure room. All rooftop equipment will be setback from the roofline and painted a color to blend with the surroundings. , . _ ' ' : • :. However, the applicants have failed to propose measures that will mitigate the visual impacts associated with the height and grouping of the proposed rooftop antennae, in a manner that will not block or impede the views and sights of the surrounding property owners. At the time of the hearing, the applicant was unsure as to what extent the proposed antennae could be painted. Many z service providers as law enforcement, firefighters, emergency response personnel, and medical professionals rely on wireless service to perform their jobs. Cellular services also enable customers to make "Good Samaritan/911" phone calls to assist themselves and others in need. The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The proposed installation will meet all performance standards that are required in the Office zoned district. The facility does not emit any odor, smoke, dust, heat, vibrations or other airborne pollutants and meets the Tukwila Municipal Code for noise. Only short term noise will be generated by the air conditioning unit during peak use periods, typically during high traffic use. The air conditioning unit and other support equipment will be located inside the office building. Only electrical and telephone services are required for the facility. Antenna placement will be setback ten feet from the edge of the building. Also, AT &T Wireless Services adheres to stringent FCC and FAA rules goveming construction, maintenance and safety of wireless communication equipment. The tower and equipment are subject to regular maintenance and inspection. C. The proposed development shall be. compatible generally with the surrounding land used in terms of traffic and pedestrian circulation, building and site design. The proposed rooftop installation is compatible with surrounding land use in terms of traffic and pedestrian circulation . The need for this facility is the result of high cellular use from the area's population density, large industrial /commercial area and the high traffic use of Interstate Highways 5and405. The facility is designed to create the least impact on the Centerplex Office Building and to be compatible with the existing area buildings. The rooftop placement groups the antennas with other similar building equipment. To further reduce visual impact, the panel antennas are a neutral color (off - white) and the stands are 2" galvanized (silver) pipe. Although studies conducted show galvanized mounts to have the least visual impact, the mounts and antennas can be painted any color requested. There will be no visual impact in the surrounding area from the support equipment. The equipment (back -up battery, radio and HVAC (air conditioning unit) will be housed inside the Centerplex building in an existing office space. E. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The facility location and design were selected, considering topography of the area, engineering restraints of wireless communication technology and the impact on the community. To provide quality service throughout an area; wireless communication systems rely on a series of strategically placed'antennas to•communicate. The signals must be unobstructed to "see" each antenna for a hand off. To further reduce visual impact, the antennas and stands are neutral colors and the support equipment will be located inside the building in an existing office space. Increased cellular use in.this service area is causing delayed transmissions, dropped calls and busy signals for customers. This facility is needed to increase capacity and improve service. The Federal Communications Commission (FCC) mandates that licensees (AT &T) provide thorough coverage within their licensed areas. D. a _. z� �o z �- Ili ill U� 0— :off` ww 1- -' U-1 z' O~ z D PLANNING COMMISSIONJBOARD OF ARCHITECTURAL REVIEW MINUTES SEPTEMBER 26,1996 Mr. Marvin called the work session to order at 6:10 p.m. Members present were Marvin, Meryhew, Malina, Livermore, Stetson and Neiss. Commissioner Gunnels was excused. Representing the staff were Jack Pace, John Jimerson, Michael Jenkins and Sylvia Schnug. Mr. Jimerson reviewed the Subdivision Code and possible revisions. He noted there are four types of approvals which occur with the Subdivision Ordinance. The first is Boundary Lot Adjustments and Lot Consolidations. Short Plats are the creation of four or fewer lots. Subdivision is five lots or more. A Binding Site Improvement Plan is when someone wants to create lease - holds. Mr. Jimerson then reviewed the short plat and subdivision approval process. Mr. Jimerson added that the Short /Subdivision Committee is comprised of the DCD Director, the Fire Chief and the Public Works Director. Mr. Livermore asked why there are two public hearings. He added he thought HB 1724 limited the City to only one public hearing. Mr. Jimerson said that was a good question and he would look into the matter further. Mr. Jimerson continued by saying that approximately 60% of the proposed changes are informational or procedural in nature. Approximately 30% are editing changes. This would possibly include merging this with the Zoning Code. About 10% are changes to the standards. The proposed changes are intended to make the document more user friendly, update state and city law, update the program, and to encourage in -fill development. Another proposal is for a "General Provisions" chapter which would include dedications, survey content and definitions. Mr. Malina said he would like to see the process more user- friendly. Perhaps provide some examples in a packet. Mr. Jimerson noted there are proposed changes per HB 1724 and RCW 58.17. They include updating the list of exemptions (boundary line adjustments, condominiums, binding site improvement plans, etc.); limitations on short plats or subdivisions; defining what a complete application is; considerations for approval. ATTACHMENT G Planning Commission Minutes Page 2 September 26, 1996 Proposed boundary lot adjustment changes include adding a chapter dealing strictly with boundary line adjustments a lot consolidations; new approval criteria; faster review time; lower the required fee; and separate submittal requirements. The next proposed change would be to the improvement process. The required steps to obtain the improvements would be stated in the ordinance. Clearer language is being proposed for improvement agreements and financial guarantees. The last item is phasing of a final plat and procedures for doing that. Proposed changes to the Binding Site Improvement Plan would be to look for a way to make it more valuable. With regard to the Development Standards proposed changes include combining the standards into one chapter; making road widths consistent with the adopted classification system; encourage pedestrian safety; provide stronger language to avoid the cul-de -sacs; inform the surveyors what is wanted in terms of surveys (survey monumentation). With regard to process additions proposed changes include road dedication process; process four installation of public improvements; final short plat approval. With regard to decision criteria, under each approval, have a clear preliminary final step. Narrow the decision criteria to the final steps. The next proposal is to eliminate the APRD process for short plats. It's not very practical to require someone to go through this process when dealing with only four lots or adjusting property lines. There is the potential for forfeiture when creating small tracts. Several things that the PRD addresses are already addressed, such as SAO, SEPA, Tree Permit, etc. Therefore, staff would recommend that the PRD be eliminated as a requirement for short plats and boundary line adjustments. There was consensus by the Commission to not apply the APRD to short plats and boundary line adjustments. The final proposal is to decide the short plat threshold. The major difference in the number of lots is the procedures. Staff would recommend a higher number of lots. Mr. Marvin called for ten minute recess. Mr. Marvin called the public hearing to order at 7:15 p.m. With regard to the minutes of August 29, 1996, Mr. Livermore stated that page 2, the eighth paragraph from the top needed to be changed to read, ... L96 -0037: AT &T Wireless Ms. Stetson did not participate in this public hearing because AT &T is her employer. Mr. Jenkins presented the staff report. He provided a slide presentation of the proposed property. Mr. Jenkins stated that only one antennae is being proposed at this time, although it is designed for future expansion of up to three antennas. The setback from the roofline will help mitigate any of the impacts from the northern side of the site. All radio equipment that will operate the antennae will be located within the building. The applicant has secured service from Puget Power and not Seattle City Light, as indicated in the staff report. This project does not appear to have any harmful rays or pollutants associated with it. The construction period is approximately two weeks, followed by one trip per month for scheduled maintenance. The project is consistent with land use policies. Staff recommends that the Conditional Use Permit be approved. Mr. Livermore asked if the back -up generator is a gas or motor generator? Mr. Jenkins indicated it was a battery generator. He then clarified this will be mounted on an office building, not an apartment building as referenced in the staff report. Mr. Malina asked if the tree shown in one of the slides, would interfere with the antennae. Mr. Jenkins deferred that question to the applicant. Terri and Lorraine Spencer, 9925 N. Davies Rd, Lake Stevens, WA The need for this facility is due to the increased usage of the technology, as well as the proximity to I-405 and I -5. The FCC directs ATT to provide service in the areas where they are licensed. This facility has been designed to create the least impact. The panel antennas are approximately 11.5 inches wide, 52 inches tall and standing on a two -foot stand. They will be a neutral color to blend in as well as possible. This site was selected to meet the needs of this community for cellular use and to also reduce the impact as much as possible on the community. Mr. Livermore asked what kind of air conditioning unit is located in the building. Lorraine Spencer indicated they would use the building's existing air conditioning system. Lorraine Spencer said one of the purposes of locating these antennas on rooftops is so residents would be looking over them. Mr. Malina if the tall tree would interfere with the antennas. Lorraine Spencer said if there was interference, they would find a way to work around it without taking down the tree or topping it off. Trees cart interfere with the transmission of antennas. Gerry Lockhart, Cottage Creek resident: Ms. Lockhart indicated she was concerned with the visual impacts of these antennas. Sandra Bresslich, Cottage Creek resident: Ms. Bresslich indicated that Cottage Creek aie condominiums, not apartments. She added that she was concerned with the aesthetics and visual impacts of this proposal. It will interfere with the views of Mt. Rainier. Phil Farrell, 15350 Southcenter Blvd., Tukwila: Mr. Farrell asked if additional telephone communications would need to be added. He also expressed a concern that this system will interfere with the King County radio system that operates "911 ". King County should work closely with ATT to make sure this system does not interfere with the emergency system. Mr. Jenkins clarified that this application is only for one antennae array. Any future expansion would have to go through the conditional use permit process. Mr. Livermore asked how tall the existing HVAC equipment on the roof is. Mr. Jenkins estimated approximately eight feet. Mr. Malina pointed out that the documentation indicated the height of the rooftop antennae to be 6 feet four inches. He also asked if the'aluminum would be painted. Mr. Jenkins said that issue has never been raised in the research. Mr. Meryhew said he was concerned because of the police department's close proximity to this building. Mr. Jenkins said he could talk to the police department about the issue. Mr. Livermore agreed that issues may arise if the two additional antennas go in later. Lorraine Spencer clarified that the height of the antennae will be six feet four inches. Mr. Meryhew asked if they had alternative sites. Lorraine Spencer said they do not. Mr. Malina expressed a concern that future antennas may be pointed directly at Crystal Ridge Condominiums. Lorraine Spencer said it would provide coverage in that area and along the hillside. Mr. Livermore pointed out that the location of the antennas on the drawing of the north elevation was incorrect. He then asked about any possible interference with the police department's emergency 911 service. Lorraine Spencer indicated she had spoken with the engineers from An' and they are working with King County to make sure there are no interferences. If an interference occurs, ATT will shut down immediately. It should not occur, however, because they are located on a specific band, that they are licensed and approved to operate on. A T -1 will have to be obtained from US West, but no road work will be required. The antennas are placed as close together as they can get without interfering with each other. Sandra Bresslich said that the description in the staff report indicates that the antennae is long, and reflective. However, the applicant indicated it would painted. If it is reflective, will light be bouncing off of it? Lorraine Spencer said the antennae face is gray pvc and can be painted any color. She added she has seen the aluminum backing painted in the past, but couldn't say whether this particular antennae could be painted. It will not rotate and it doesn't catch light. The aluminum surface is a matte finish. Planning Commission Minutes Page 6 September 26, 1996 Mr. Marvin closed the public hearing. He said that the main concern expressed by the speakers is the visual impact. Mr. Meryhew said he thought there would be alternative sites available on that hillside that wouldn't create an impact on other residents in the area. He strongly urged the applicant to consider other sites. z �z Mr. Neiss said there is other equipment there that is projecting higher than this would, -J o' based on the photograph. He said it is hard to say how much of an impact it would co c - have. J = co u_ Mr. Livermore said it will definitely be seen, but he questioned the impact it would w O have. He said he didn't think it would be that bad. In the past, they have taken the g. stance that they will not go overboard in protecting views of the City. • a Mr. Meryhew said in this instance, something is being stuck up there which is not Z = attractive. This is the first of maybe three of these, so it won't get better, it will get p. worse. There are all kinds of higher buildings up there that have the same potential and w w' don't have something looking down on the antennas. U O N Mr. Malina said he has a concern with the potential antennae which is pointing toward ° -' Crystal Ridge Condominiums. He can't see the reasoning for that. v'• . 9 o; Mr. Neiss clarified that those are possibly proposed in the future. The one that they are w z looking at now is facing toward Southcenter Mall. Those other two antennas are not a part of this application. z H Mr. Malina said if they approve one conditional use permit, they will come back and ask for two more. Mr. Marvin said in fairness to the applicant, they need to concentrate on what is actually being proposed now. Mr. Malina said there is confusion on the applicant's part about their north and south elevations. At one time the applicant said the antennae could be painted, now they are saying they're not sure if they can be painted. He added that he thought in infringed on the residents on the hillside and another location should be considered. Mr. Livermore said it will definitely be seen by the residences, but he didn't feel it would be a major blockage of view. There is a need for coverage in this area and he realizes how hard it is to find people that are willing to have an antennae array on their building. They are not that easy to site and this is a reasonable compromise. Mr. Neiss added that the way it is located on the building is more in a line, rather than straight across. So the actual visual impact, depending on which angle you're looking Planning Commission Minutes Page 7 September 26, 1996 at, is actually narrowed down. This line will be more perpendicular than it is horizontal to the building behind it. Mr. Livermore said if there is an HVAC unit with a screen that is much larger than this. The existing tower on that building is atleast eight feet tall. Mr. Meryhew said they can't do anything about existing equipment. They can just prevent additional... Mr. Marvin said the degree of visual impact is questionable, but he sides with Mr. Meryhew because there has not been consideration of an alternative site. Mr. Meryhew said there a number of places on the hillside they could put it. MR. MERYHEW MOVED THAT CONDITIONAL USE PERMIT L96 -0037 BE DENIED. MR. MALINA SECONDED THE MOTION. Mr. Pace asked Mr. Meryhew to indicate the findings and rational for the motion and based upon which criteria is the CUP being denied. MR. MERYHEW ADDED THAT THE REASON FOR THE DENIAL IS BECAUSE THE ADDITION OF THE ANTENNAS APPEARS TO BE A DETRIMENT TO THE VIEWS AND SIGHTS OF RESIDENTS LOCATED NEARBY AND ITS NOT CERTAIN THAT THE APPLICANT HAS REVIEWED OTHER AREAS FOR ALTERNATIVE SITES, WHICH SEEM TO BE PLENTIFUL ON THE HILLSIDE. Mr. Pace asked what criteria that would relate to. MR. MERYHEW SAID IT WOULD BE BASED ON 12.1.36, MINIMIZING VISUAL IMPACTS. THIS PROJECT IS IN CONFLICT OF THAT. THE MOTION WAS PASSED BY A VOTE OF 3 -2, WITH MR. NEISS AND MR. LIVERMORE OPPOSED. Mr. Pace noted that the Notice of Decision would be mailed out. L96 -0029: 52nd Ave Office Building: Mr. Jenkins provided the staff report. He presented slides of the site and surrounding area. The project is well ordered and centered to the site. The project meets parking requirements. The bulk of the parking is underneath and to the rear of the building. The building is consistent with the surrounding built environment through the use of setbacks, massing and horizontal lines. The garage is considered a separate story, therefore the building has three stories total. Garbage /recycling area, stairwells, Planning Commission Minutes Page 8 September 26, 1996 elevator and parking will be contained in the garage level. The rendering looks like a two story building since it drawn from the front of the facade. There is a dominant use of street trees, which is consistent with surrounding area. The applicant is proposing to remove four trees and replacing those with twenty -one trees. Mr. Livermore asked if a garbage truck could get in there. Mr. Jenkins stated that as presented, it complies with space requirements. The specifics of that will be worked out during the issuance of the building permit. Mr. Livermore asked that in the future, those details are addressed. Mr. Jenkins continued by saying that the lighting will consist of wall mounts, a series of bollard lighting, and 25 foot pole lighting. Beige dryvit will be used for the exterior, an anodized metal for windows treatment, and a dark reflective glass for the window treatment. The architect has agreed to revise the glass to make it non - reflective, light and potentially a lighter color that would be more complimentary to the building. The mechanical equipment is screened due to the setback. The use of more reveal lines and a repetition of the theme established by the windows would be preferred to break up the mass of the concrete wall. The sign is consistent with Zoning Code requirements but the placement should be reconsidered to afford a better view of the signage for the building. As proposed, it would be shielded by the landscaping. Moving it away from the landscaping and to a more public view would improve the use of the sign and the appearance. Staff recommends approval with the following conditions: 1) the signage submitted under TMC 19, Sign Code may be reviewed administratively; 2) submitting new window glass to be reviewed administratively; 3) the south wall be revised to reflect the theme established on the facade. Mr. Jenkins clarified that the rendering provided is for conceptual purposes for the building and may not be accurate as far as landscaping. The parking there is inadequate. The site has almost a 20% slope, almost in the middle of the site. The first issue under consideration was whether reduced requirements for senior citizen housing be established. The recommendation would be to adopt a standard of one space per two dwelling units. - Mr. Livermore agreed that the ratio should be lowered, but one space per two dwelling units is not enough. He suggested one space per unit and a loading space. Mr. Meryhew said he didn't feel comfortable making any decision until they define senior citizen housing. The Commission asked staff to provide definitions and parking thresholds for senior citizen housing. The second issue under consideration is whether cooperative parking strategies be more flexible to account for emerging changes. It clarifies for business the reasonable amount of parking that could be required, and it allows developers options to develop at an appropriate level. With regard to covenant parking, distance may be an issue. When a covenant agreement is entered into, the City would have to be notified if that agreement would be terminated, what solutions will be offered to make up the difference. The third issue under consideration is whether parking for the handicapped should be in the Zoning Code. Staff has recommended that the entire section be deleted and a reference added to the Uniform Building Code. Mr. Livermore said he liked looking at that as part of design review. Mr. Jenkins said it would still be called out on a site plan. The point of the deletion, would be for clarity for the developer. Jack Pace (inaudible). The fourth issue under consideration is should there be an increase in the compact car allowance. Currently we allow a maximum of 30% of required spaces dedicated to compact. In excess of that requirement, we do not currently regulate. Staff is recommending that 40% of compact allowed for all proposed parking. Mr. Meryhew said he would like to see a maximum of 20% compact stalls allowed. The Commission agreed to go with what Kent is doing, 30% compact stalls and have them dispersed throughout the lot. The fifth issue is whether the calculation for parking be based on gross leasable area instead of gross floor area. If we leave it for just the non -public areas, that addresses the retail issue to a degree. Mr. Meryhew said we should be able to define some specific uses that have different requirements. It doesn't have to do with space, it has to do with usage. The Commission agreed to have staff define appropriate uses for a gross leasable area. The last issue is whether an administrative process be established to lower parking requirements under specific circumstances. With the adoption of Ordinance 1768, this is consistent with changes that establish more administrative guidelines to stream -line and clarify decisions. Staff has proposed a two-tier approach that allows administrative review for those requests that are relatively minor, where the request for parking lower than the standard 1 % -20% reduction be reviewed administratively. Mr. Livermore thought hotels, motels, and multi- family should be excluded from this. He added that he would like to see parking requirements for hotels and motels to be one space per unit, and allows a reasonable quantity for staff. Mr. Marvin adjourned the meeting. H r__: O z Staff Report to the L96 -0037 Planning Commission AT &T /Centerplex Building FINDINGS Vicinity /Site Information Project Description The applicant is requesting permit approval to install a Personal Communication Services (PCS) base station facility for wireless communication systems at the subject property. The proposal includes the installation of radio operating equipment within the existing structure, in an equipment room to be built in the existing building's first floor. The equipment room will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities to operate radio equipment and two auxiliary cabinets for increased capacity. One antenna array, comprise of four individual antennae, will be mounted on the roof of the apartment building. The array will be located to the southeast portion of the roof, setback 10 feet from the roofline, and will measure 8 feet above the roof. The equipment room and the rooftop antennae will be connected through a cabling system carried from the equipment room, through the building to the rooftop. The cabling will be along the rooftop in a covered tray. Electrical power to operate the equipment will be provided through existing Seattle City Light service to the office building. Telephone services will also be available at the ground cabinets. Existing Development The site is currently occupied by the Centerplex Office Building, a two- building, multi- tenant office complex. Surrounding Land Uses The Cottage Creek apartment complex and a single family house, zoned High Density Residential (HDR) and Office (0), respectively, are located directly north of the subject property, across 62nd Ave., S. Directly to the south is Southcenter Blvd and the I-405 right -of -way. To the east is the Tukwila City Hall, zoned Office (0) and to the west is the second building that comprises the Centerplex complex. I- -. w 0 U co 0 z Staff Report to the L96 -0037 Planning Commission AT &T /Centerplex Building CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant has proposed placing all operating equipment in a room inside the building to limit potential contact with unauthorized individuals. The antennae will be setback from the roofline to reduce what the applicant refers to as "aesthetic impacts" associated with this equipment. There appears to be no health impacts associated with the type of wireless technology the applicant will be using at this site. The operating range, amount of energy the facility will produce and the location of the antennae are all within safety parameters set by the American National Standards Institute (ANSI). (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. Performance standards that would normally apply to development in this zone, including setback, height restrictions, landscaping or design are not applicable to this proposal. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the PCS system will generate traffic of approximately 24 trips per day during the construction period and, following the completion of construction, 1 trip per month for maintenance. To mitigate the project's impact on the existing building and site, the applicant has proposed that the antennae will be painted to blend in with their surroundings. All radio operating equipment will be internal to the building and will not impact the site design of the existing buildings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 3 Staff Report to the L96 -0037 Planning Commission AT &T /Centerplex Building 12.1.34. Transportation will be limited during the construction period and will require one trip per month after construction for maintenance. Potentially hazardous operating equipment is inaccessible to the public. Therefore, conditions have been satisfied. (2) The proposed criteria shall meet or exceed the performance standards... There will be a maximum of 24 trips per day during the two week construction period, followed by one trip per month for scheduled maintenance. The cabling between the ground equipment and the antennae will be internal to the building. Therefore, all conditions have been satisfied. (4) The proposed use shall be in keeping with the goals and policies... The project is consistent with Land Use Policies 12.1.34 and 12.1.36, respectively. Therefore, conditions have been satisfied. (5) All measures have been taken to minimize the possible adverse impacts... All radio equipment to operate the facility will be contained in a secure room. The rooftop placement of the panel antennas will not be materially detrimental to the public welfare or injurious to the property or improvements to the Pool Centerplex Office Building or in the surrounding area. The antennas will be located on the southeast corner of the roof and will be a minimal addition to the already existing rooftop equipment. The panel antennas are 5' x 11.8" and the stands are 2" galvanized steel pipe. With the stand, the antenna tip height is eight feet. Because wireless communication is "line of sight", the antennas will be visible from the surrounding area. The antennas and their placement were selected to reduce aesthetic impact while meeting engineering requirement of wireless technology to provide quality service in the area. As shown in submittal materials, a significant amount of research has been done with regards to the health and safety issues of wireless technology. The conclusion of the research demonstrates that wireless technology does not pose adverse affects to individuals. This is a new use for an old technology. Wireless services operates on the same frequency as UHF TV did in the 50s and 60s. In fact, public safety is enhanced by use of wireless service. This facility meets all the requirements of the Act. To our knowledge the City of Tukwila has not acted upon the law, so we have included a copy of the SEPA Checklist and supporting documents. If this proposed facility is exempt, please provide written documentation of the decision and notification of process and time frame for the permitting process without SEPA. A new section is added to chapter 43.70 RCW 9 to read as follows: 10 When funds are appropriated for this purpose, the department shall 11 conduct a survey of scientific literature regarding the possible health 12 effects of human exposure to the radio frequency part of the 13 electromagnetic .spectrum (300Hz to 300GHz). The department shall 14 submit the survey results to the legislature, prepare a summary of that P 15 survey, and make the summary available to the public. The department 16 shall update the survey and summary periodically. 17 NEW SECTION. Sec. 7. A new section is added to chapter 43.70 RCW 18 to read as follows: 19 Unless this section is preempted by applicable federal statutes, 20 the department may require that in residential zones or areas, all 21 providers of personal wireless services, as defined in section 1 of 22 this act, provide random test results on power density analysis for the 23 provider's licensed frequencies showing radio frequency levels before 24 and after development of the personal wireless service antenna 25 facilities, following national standards or protocols of the federal 26 communications commission or other federal agencies.
