My second cousin and her husband are involved in a proposal to develop several single- family lots. At the time I learned of this, I informed you and my cousin that I would not become involved in the project, and I delegated my responsibilities relative to this proposal to Jack Pace. Until today I had successfully avoided discussing the proposal with anyone, including my staff. Today, however, my cousin's husband, Mr. Dick Peterson, came by the office and insisted on seeing me. He told the DCD counter staff that he would not leave without tallcing to me. I did speak to Mr. Peterson and his partner in this proposal. The substance of our conversation had to do with their desire to modify their proposal, but their fear that doing so will result in delays to the project. They indicated that at a previous juncture they had requested a "second" pre - application meeting to review some proposed changes, but were dissuaded by staff who felt a second pre -ap would be unnecessary. They wanted the ability to now have another pre -ap or its functional equivalent, but seemed to be concerned that if they requested one, it would be turned down. At several points they attempted to discuss some of the substantive issues associated with their proposal, but I indicated I would not discuss those matters with them. They were not openly critical of staff, and in fact praised the work of both John Emerson and Gary Schulz. • However, reading between the lines it appeared that they were somewhat frustrated with their overall experience to date, and fearful of what might lie in store for them due to their desire to make some changes part way through the process. I took the liberty of suggesting to them that, should they have a complaint about the process or their treatment, they should contact you. I hope this was appropriate. I re- emphasized my intention to not be involved in this matter. I 'have been familiar with the current Foster Ridge site since 1991. The conditions of this site meet the criteria for requiring a PRD Permit. Basically the entire site is a sensitive area. Per the SAO, Chapter 18.45.060 Procedures states "any new residential subdivision, residential short subdivision, residential boundary line adjustment, or multiple family residential proposal which includes a sensitive area or its buffer on the site shall apply for a planned residential development permit ".... (emphasis added) unless the size and complexity of the project does not warrant it. A waiver could be granted pursuant to 18.45.02F.2. The waiver section applies to an agreement for the correct classification of the sensitive areas and that there will be no detrimental impact to the sensitive areas or buffers. Based on this part of the waiver section, the subject proposal would not be exempt from the PRD standards because there is proposed impact to the wetland buffer and significant development of the steep slopes. These could be considered "detrimental impacts ". I also feel it is the physical condition of a site (difficult to develop due to sensitive area constraints) that should be considered for a PRD waiver. The two issues that are still being worked on are the classification of the sensitive areas - wetland and steep slopes, and the amount of impact to the wetland buffer and those slopes that will need to be filled and graded. The purpose of the PRD process is basically to retain open space or sensitive areas in residential developments by permitting greater flexibility in zoning requirements than is normally permitted by the Zoning Code. Because of personal circumstance related to the applicant for this project, the DCD Director could not be involved with the PRD decision. I don't recall being involved in that decision either so this memo represents my interpretation of the Zoning Code. Currently, the application is still incomplete. In order to be a complete application, the following must be submitted to the Planning Division: • An affidavit of ownership from the current property owner, with original signature, and original notary stamp. • A complete submittal for SEPA review. We have prepared a Supplemental Map showing the contours and the proposed site development plan for building pad locations and utility services for each lot (12 copies enclosed). Also enclosed is four (4) copies of the before and after legal descriptions, wetland report by Sheldon & Associates and a soils and geotechnical report done previously by Associated Earth Sciences, Inc. The property was surveyed by Barrett Consulting, Inc. and included locating all trees on site greater than 4" in diameter (list enclosed). Clearing and tree removal on the site will only occur in the areas for roadway, utility and building pad construction. Please note that the geotechnical report indicates that the site is suitable for the proposed development subject to the report recommendations. This project was previously reviewed under pre application PRE94 -032 (Foster Ridge). We had several subsequent meetings and correspondence relative to this earlier submittal.
