Specifically, I have noticed that there are a number of discrepancies between the project approved by the Planning Commission and what has been installed to date. As you will recall, the Planning Commission approved the project based on the assumption that the electrical equipment would be housed inside the building with cabling attached to the rooftop. As you will find in enclosed photograph, the electrical equipment has been placed in a 10 foot metal vault and placed on the landscaping next to the parking lot. Further, the electrical cabling has been placed loose along the east side of the building. On the issue of the antennae, it was my understanding that the antennae would be bracketed to the roofline and not the building. The desired effect was intended to make the antennae as discrete as possible on the facade. As you will see in the enclosed photograph, the bracketing for the antennae are much more pronounced and extensive. While the Planning Commission did not impose a bracket requirement as a specific condition, it was my belief that the intent was to mitigate all visual impact to the extent possible. Further, the antennae have not been painted to match the roofline as was indicated at the time of the hearing. Members present were Commissioners Marvin, Gunnels, Meryhew, Livermore and Stetson. Commissioners Malina and Neiss were excused. Representing the staff were Steve Lancaster, Jack Pace, Michael Jenkins, John Jimerson, and Sylvia Schnug. Mr. Lancaster provided an overview of the proposed 1997 Department of Community Development and Planning Commission budget. John Jimerson provided the staff report regarding the work session on the Subdivision Ordinance. There will no longer be definitions in the Subdivision Code, just referenced in the Zoning Code. A section regarding lot consolidations and boundary line adjustments has been added. A new chapter on Public Improvement Processes has been added. There's a new section on Dedications. Mr. Meryhew stated that in section 17.04.060, page 6, the bottom paragraph A., the last line indicates that drawings should be on mylar. He suggested that it should say the drawings should be on a reproducible material. Mr. Livermore indicated he did not want to see the drawings put on velum because of its life span. Mr. Meryhew suggested they put in "reproducible material with a long life span." Mr. Jimerson continued by saying Chapter 17.08 is a new chapter for boundary line adjustments and lot consolidations. State law exempts boundary line adjustments from most of the planning regulations. The review criteria is significantly more limited from what a short plat requires. There would be instances where a survey would be required to ensure that certain approval criteria are met. The fee for boundary line adjustments is proposed to be reduced from $200 to $50. Mr. Meryhew said on page 9,17.04.080, "Notification of other agencies ", that should be numbered 17.04.070. On page 10, paragraph H., that sentence needs to be re- worded. Mr. Meryhew continued by saying that on page 11, the last paragraph (b), the word "for" needs to be added after the word, "responsible ". Mr. Jimerson continued with short subdivisions. The threshold for what constitutes a short subdivision has been increased from four lots to nine lots. A new section has been created indicating what the applicant needs to submit, when and to whom, for final approval. The extension period would also be increased from six months to one year. State law allows re- platting within the original boundaries of the short plat, as long as they don't exceed the threshold. Staff is proposing this change to be consistent with state law. Mr. Meryhew stated that items J., K., L., and M. should end in a semi - colon. Item 10 on that page should be deleted because it is redundant. Mr. Livermore stated that on item J., an amount in feet be added so they know how far away they want to see these items. Mr. Meryhew noted that on page 19, the section numbering needed to be re -done. He also noted that on page 25, paragraph (4), it was unclear as to whether they were talking about preliminary plat approval or final plat approval. Mr. Meryhew added that on page 33, paragraph (b), the last sentence, "chairman" should be changed to "chair ". Also, on the same page, paragraph (c), the words "King County" should be placed in front of "...Department of Records and Elections... ". Mr. Livermore stated that within the table on page 38, there should be ranges for Access Roads and Collector Arterials in the right -of -way column. Sixty feet of right -of -way for twenty -four feet of pavement seems excessive. It should be consistent. Mr. Meryhew indicated that the ranges shouldn't be minimums. Staff indicated they would review with the Public Works Department the table on page 38. Mr. Meryhew stated that on page 35, paragraph (a) (2), "significant vegetation" was unclear. Parking Code Work Session: Michael Jenkins presented the staff report. He noted that the definition for Shopping center (Mall) planned, in section 18.06.755 should be deleted because the definition Shopping Center, planned in section 18.06.750 provides a reasonable definition for both uses and having both definitions is redundant. The following definitions have been added: General Retail, Bulk Retail, Manufacturing, Warehouse, Restaurant, Office, Theater, and Senior Citizen Housing. The proposed definition for Senior Citizen Housing is designed to include language from state and federal regulations that rule out convalescent, congregate care or other skilled nursing facilities. nIb oYrY'�. z w 0 00 u) 0. He added that on page 3, Section 1) (a) Shared Parking, the examples of apartments and office buildings should be eliminated. The Commission concurred. He also added that the first sentence in that section is unclear and should be re- worded. Also, in the last sentence of that section, the word, "nearest" should be changed to "farthest ". With regard to part (b) of this same section, the amount of reductions needs to be re- worded and he would provide wording suggestions at a later time. Mr. Marvin adjourned the work session and called for a five minute recess. Mr. Marvin opened the public hearing at 7:30 p.m. MR. MERYHEW MOVED TO APPROVE THE MINUTES OF OCTOBER 24,1996. MR. LIVERMORE SECONDED THE MOTION AND THE MOTION WAS UNANIMOUSLY APPROVED. Commissioner Stetson stepped down from hearing the AT &T project since her employer is AT &T. Michael Jenkins presented the staff report. The proposal includes the installation of radio operating equipment within the existing structure. The current application is in response to the denial of the application heard at the September 26th meeting. The antenna is proposed to be located on the south facade of the building in and around the area of the facade that appears to be a mansard roof and painted to blend in. The visual impacts that would be associated with the equipment are mitigated by the placement of the antenna along the south facade, which gives the equipment the appearance of an architectural element to the building. The antenna, as mounted on the facade, will not impact views. It is anticipated that by mounting the antenna along the facade, they will rise above the roof no more than one foot. Staff recommends this conditional use permit be approved. Mr. Livermore asked if the computer enhanced photograph was taken from the lowest point that a residence would see above this, or is it above that? Mr. Jenkins indicated that was approximately at Southcenter Boulevard, so yes, the residents would all be viewing from a higher level. Terri Spencer, Spencer Planning, 1370 Stewart Street, Seattle 98109: The need for this facility is the result of high cellular use in the area. The panel antennae will be attached to the south side of the building. The building is designed with the mansard roof and the antennae will be placed along that border. Ms. Spencer then presented overhead photographs. She added that they concur with the staff report. Mr. Jenkins noted that the first three overheads presented were part of the staff report as Attachment E. The last three were not and will be included upon receipt of copies from a Ms. Spencer. Ms. Lockhart added that cellular towers have been prevalent in the 'L a news lately and she wondered if the City might look into how these antennae are ~ w affecting property values. She also asked what other sites were looked at. Ms. Lockhart Z described a video she brought in that she had taped from her television. z o: w w' Sandra Breslich, Cottage Creek Resident: v o off'. She stated that the new proposal decreases the visual impacts. She asked how far apart W ~ each antennae would be from one another. Amy Kosterlitz, Suite 902, Waterfront Place, Seattle: w Z: o Ms. Kosterlitz said that Tukwila's standards say to minimize visual impacts, to the z ~- extent technically feasible. Here, the visual impacts have been minimized to the greatest extent that is technically feasible. The example of the City of Medina is a different situation entirely. That community is almost entirely residential and there are few existing structures to put antennas on. Tukwila's standards say to put antennas on existing structures as much as possible, and that is what has been done with this proposal. There is no requirement in Tukwila's Code that any user of property search for alternative sites. This approval relates only to the application before the Commission. There is no intent at this time to apply for anything else. Ms. Breslich asked again how far apart each antennae would be from one another. Tom Gordon, AT &T Wireless, 617 Eastlake Ave, Seattle: The standard antennae spacing is four feet. The design is contingent on the antennas being a certain height above the valley floor. Mr. Livermore agreed that it should be approved. He felt that this proposal has more visual impacts than the first one proposed. The first proposed antennas were setback on the roof and below the tree line. This new proposal is going to be more visible to more people. Mr. Marvin said this proposal lessens the visual impacts to the residents. MR. MERYHEW MOVED TO APPROVE L96 -0070: AT &T WIRELESS BASED ON STAFF'S FINDINGS AND CONCLUSIONS. MR. LIVERMORE SECONDED THE MOTION, AND THE MOTION WAS UNANIMOUSLY APPROVED. Mr. Pace indicated that the Hazelnut publication, which was supposed to advertise the hearing for the parking and subdivision amendments, did not get mailed on schedule. The Commission decided to continue the hearing on the parking and subdivision amendments to their January meeting, and directed staff to provide additional public notice. They then decided to re -open the work session on these two items. Mr. Jimerson reviewed the comments received by Mr. Dewey and Barghausen Engineering (John Ellingson) regarding the Subdivision Code changes. Mr. Ellingson suggested changing the word "dedication" to "conveyance" and deleting the words, "to be conveyed" on page 6, part (b). The sentence would read, "...the approving entity may allow the conveyance of certain public improvements to a homeowner's association... ". Staff agrees with this change. He suggested adding the words, "if necessary" to page 7, part (f). Staff agreed. He suggested deleting the words, "deflection angles" and change "or" after "arcs" to "and" on page 7, part (4). Staff agreed. He noted that on page 8, part (3), "stated" should be changed to "staked ". He suggested changing the word "Auto Cad" to "drafting" on page 8, part (9)(A). The staff and Commission agreed to re -word this section and come back with a suggestion. Mr. Ellingson indicated that on page 73, the definition of "tract ", it is more than a parcel of land proposed for subdivision. Mr. Jimerson said he would research it further and get back to the Commission. Staff and the Commission agreed with that change. With regard to page 37, item 4(D), suggested that the minimum easement width be changed from 30 feet, to 20 feet. Staff and the Commission agreed to get back to this issue. With regard to page 27, Section (2), Mr. Jimerson suggested deleting the first part of the sentence which reads, "Within 15 calendar days of receipt determination of the a complete final plat application. The Commission agreed. With regard to page 35, Section (a)(2), Mr. Jimerson suggested deleting the last sentence in that paragraph. With regard to page 41, Section (4), Mr. Livermore questioned why approved through lots shall be permitted access to only one street. Mr. Jimerson said it was a carry -over from the existing Code and that he would have Public Works look into it. With regard to page 46, Section 17.24.020, the title does not match the title at the top of the page. Mr. Livermore questioned whether "Dangerous Waste" means just solid waste. There are liquids that are defined as dangerous waste as well. Mr. Jimerson said he was hesitant to make the change without looking into it further. With regard to page 48, Section (4), in the middle of the page, the word "Provide" should be added to the beginning of the sentence. MR. MERYHEW MOVED TO CONTINUE THE PUBLIC HEARING ON THE SUBDIVISION CODE UNTIL JANUARY SINCE THERE WAS NO PUBLIC COMMENT. MR. LIVERMORE SECONDED THE MOTION AND THE MOTION WAS UNANIMOUSLY APPROVED. Michael Jenkins continued the work session regarding Parking amendments. With regard to page 4 of the Draft Code Language, Mr. Meryhew suggested deleting the sentence, "Retail customer parking needs must be met on site." in section (c). Staff agreed. The Commission then agreed to delete the whole (c) section on page 4. With regard to the last sentence on page 4, section (3), Mr. Meryhew suggested rewording the sentence to read, "If a variance is sought, the application must be submitted within fourteen (14) days of the signed agreement to terminate and the .••.. z • z JO. Mr. Livermore suggested re -doing the parking dimensions drawing to be more clear With regard to section 18.56.050, Senior Citizen Housing, Mr. Livermore proposed to change 20 units to 15 units. With regard to the same section, hotels and motels, Mr. Livermore suggested adding 1 space for each 20 rooms for employees. The staff and Commission agreed. With regard to the same section, Manufacturing, Mr. Livermore suggested changing the 2,000 square foot requirement to 1,000 square feet. The staff and Commission agreed. With regard to the same section, page 8, Mr. Meryhew suggested combining sections to be more clear. With regard to section 18.56.090, page 9, Mr. Livermore proposed that the following language be added to the end of part (2) "and shall be dispersed." MS. The proposal includes the installation of radio operating equipment within the existing structure, in a room to be built in the existing building's first floor. The equipment room will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities to operate radio equipment and two auxiliary cabinets for increased capacity. Details for the equipment room are not presented here but will be included in the building permit application if the Conditional Use Permit is approved. One antenna array, comprised of four individual antennae, will be mounted on the south facade of the building. The array, as shown in Attachment E, will be located along the south facade on that portion that appears to be the face of a mansard roof. As represented on Attachment E, the antennae will rise approximately 1 foot above the roof top and will measure approximately 54 inches in total height. The details for the antennae also appear on Attachment C and the specifications for each antennae are included in Attachment D. Existing Development The site is currently occupied by the Centerplex Office Building, a two- building, multi-tenant office complex. Surrounding Land Uses The Cottage Creek condominium complex and a single family house, zoned High Density Residential (HDR) and Office (0), respectively, are located directly north of the subject property, across 62nd Ave., S. Directly to the south is Southcenter Blvd and the I-405 right -of -way. To the east is the Tukwila City Hall, zoned Office (0) and to the west is the second building that comprises the Centerplex complex. W W': Z ui U (-12: 0 Staff Report to the L96 -0070 Planning Commission AT &T /Centerplex Building BACKGROUND The current application arises out of a previous Conditional Use Permit application for rooftop cellular antennae at the subject property, file number L96 -0037. The previous application, which included antennae located on the rooftop of the property (Attachment F) was heard before the Planning Commission on September 26, 1996. This proposal, following testimony and consideration by the Planning Commission, was subsequently denied. Both the present and previous applications were submitted by AT &T. The current application is in response to the denial of the application heard at the September 26 hearing. Following the hearing, applicants revised their project to account for testimony and consideration at the September hearing. CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in Zoning Code section 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. Applicant has proposed placing all operating equipment in a room inside the building to limit potential contact with unauthorized individuals. Further, the applicant has proposed placing the antennae on the south facade and painted a color to give the antennae the appearance of an architectural element, in order to mitigate any aesthetic impacts associated with this equipment. As the proposed antennae and related equipment are telecommunications equipment that falls within the safety parameters set by the American National Standards Institute (ANSI), there would appear to be no known health impacts with this proposal. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. Performance standards that would apply to development in this zone, including setback, height restrictions, landscaping or design, are not applicable to this proposal. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the PCS system will generate 24 trips per day during the construction period and, following the completion of construction, 1 trip per month for maintenance. To mitigate the project's impact on the existing building and site, the applicant has proposed that the antennae will be located along the south facade and painted to blend in with their surroundings, thereby taking on the appearance of an 3 Staff Report to the L96 -0070 Planning Commission AT &T /Centerplex Building architectural element. All radio operating equipment will be internal to the building and will not impact the site design of the existing buildings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.34. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. When completed, the project will use existing electrical services provided to the office complex. The applicant will extend utilities from the existing electrical room to the new equipment room. The applicant has secured service from Puget Power. The applicant has also secured services from U.S. West for the operation of an on -site telephone services. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is not proposing a facility that will be shared with any other PCS providers. To minimize visual impacts associated with this project, the applicant will paint the antennae to blend with the surrounding environment and mount them in a manner on the facade to take on the appearance of an architectural element. As all equipment will be enclosed in a secure room, all related equipment will be out of view. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has proposed placing the antennae on the facade to avoid blocking any views of surrounding property owners, who would otherwise have their views impaired by four rooftop antennae measuring approximately 54 inches in height. The antennae array will be painted a color that will help them blend in with the other materials on the facade. Applicant also has placed all of the radio and operating equipment out of public areas and into a secured room. By placing the antennas on the south side exterior wall of the building, residents living north of the building will not be visually impacted. The antennas will extend only one foot above the roof line. Painting the antennas to blend with the shake trim will further reduce any visual impact to pedestrian traffic in the Centerplex parking lot and foot/car traffic along Southcenter Boulevard. Construction of the project will generate minor increased traffic for about one month. Following construction, the facility will require only one vehicle trip per month for maintenance. f City of Tukwila Conditional Use Permit Tukwila Wireless Communication Facility SS 22 Attachment B page 3 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The proposed use supports the Tukwila Comprehensive Land Use Policy Plan as stated in General Policies for non -city -owned utilities. Section 12.1.36: Encourages utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible * Shared towers, poles, antennae, trenches, easements, and substation sites * Use existing structures by cellular communications * Telephone switching facilities enclosed in buildings compatible with the surrounding area The proposed facility utilizes an existing building thereby eliminating the need for a tower or monopole. To further reduce impact, the antennas will be placed on the backside of the building and painted to blend with the exterior of the building. There will be no visual impact in the surrounding area from the support equipment. The equipment (back -up battery, radio and HVAC air conditioning unit) will be housed inside the Centerplex building in a secured office space inaccessible to the public. 5. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The facility location and design were selected, considering topography of the area, engineering restraints of wireless communication technology and impact on the community. To provide quality service throughout an area, wireless communication systems rely on a series of strategically placed antennas to communicate. The signals must be unobstructed to "see" each antenna for a hand off. To further reduce visual impact, the antennas and stands are neutral colors and the support equipment will be located inside the building in an existing office space. Increased cellular use in this service area is causing delayed transmissions, dropped calls and busy signals for customers. This facility is needed to increase capacity and improve service. The Federal Communications Commission (FCC) mandates that licensees (AT &T) provide thorough coverage within their licensed areas. I 01 w •Z: U N` H H O Staff Report to the L96 -0070 Planning Commission AT &T /Centerplex Building FINDINGS Vicinity /Site Information Project Description The applicant is requesting Planning Commission approval for a Conditional Use Permit (Attachment A) to install a Personal Communication Services (PCS) base station facility for wireless communication systems at the subject property. The proposal includes the installation of radio operating equipment within the existing structure, in a room to be built in the existing building's first floor. The equipment room will house a primary radio cabinet for processing signals, a back -up generator, a power cabinet designed to transfer power from utilities to operate radio equipment and two auxiliary cabinets for increased capacity. Details for the equipment room are not presented here but will be included in the building permit application if the Conditional Use Permit is approved. One antenna array, comprised of four individual antennae, will be mounted on the south facade of the building. The array, as shown in Attachment E, will be located along the south facade on that portion that appears to be the face of a mansard roof. As represented on Attachment E, the antennae will rise approximately 1 foot above the roof top and will measure approximately 54 inches in total height. The details for the antennae also appear on Attachment C and the specifications for each antennae are included in Attachment D. Existing Development The site is currently occupied by the Centerplex Office Building, a two- building, multi- tenant office complex. Surrounding Land Uses The Cottage Creek condominium complex and a single family house, zoned High Density Residential (HDR) and Office (0), respectively, are located directly north of the subject property, across 62nd Ave., S. Directly to the south is Southcenter Blvd and the I-405 right -of -way. To the east is the Tukwila City Hall, zoned Office (0) and to the west is the second building that comprises the Centerplex complex. Access Access to the equipment room will be made through a locked service door. 2 • Staff Report to the L96 -0070 Planning Commission AT &T /Centerplex Building BACKGROUND The current application arises out of a previous Conditional Use Permit application for rooftop cellular antennae at the subject property, file number L96 -0037. The previous z application, which included antennae located on the rooftop of the property 11-: (Attachment F) was heard before the Planning Commission on September 26,1996. w rt This proposal, following testimony and consideration by the Planning Commission, 6 m was subsequently denied. Further, the applicant has proposed placing the antennae on the south facade and painted a color z to give the antennae the appearance of an architectural element, in order to o mitigate any aesthetic impacts associated with this equipment. As the proposed z antennae and related equipment are telecommunications equipment that falls within the safety parameters set by the American National Standards Institute (ANSI), there would appear to be no known health impacts with this proposal. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. Performance standards that would apply to development in this zone, including setback, height restrictions, landscaping or design, are not applicable to this proposal. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the PCS system will generate 24 trips per day during the construction period and, following the completion of construction, 1 trip per month for maintenance. All radio operating equipment will be internal to the building and will not impact the site design of the existing buildings. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.34. Actively coordinate project implementation with individual utilities based upon Tukwila's Comprehensive Plan and development regulations. When completed, the project will use existing electrical services provided to the office complex. The applicant will extend utilities from the existing electrical room to the new equipment room. The applicant has secured service from Puget Power. The applicant has also secured services from U.S. West for the operation of an on -site telephone services. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure, use of existing structures and installation of telephone switching facilities in buildings compatible with the surrounding area. The applicant is not proposing a facility that will be shared with any other PCS providers. To minimize visual impacts associated with this project, the applicant will paint the antennae to blend with the surrounding environment and mount them in a manner on the facade to take on the appearance of an architectural element. As all equipment will be enclosed in a secure room, all related equipment will be out of view. 5) All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The applicant has proposed placing the antennae on the facade to avoid blocking any views of surrounding property owners, who would otherwise have their views impaired by four rooftop antennae measuring approximately 54 inches in height. The antennae array will be painted a color that will help them blend in with the other materials on the facade. Applicant also has placed all of the radio and operating equipment out of public areas and into a secured room. Located on the east side of the building's back wall at the roof line, the antennas will be a minimal addition to the already existing shake and shingle trim. The four (4) ALP 9212 -N panel antennas are 52 "x 11.4" x 11.4 ". (Attachment C) They will be hung from the top by braces bolted to the roof and attached at the bottom to the side of the building The antennas will extend one (1) foot above the roof line and be painted the same color as the shingles to blend with the building. Support equipment (back -up battery, radio and HVAC (air conditioning unit) will be housed inside the Centerplex building in an existing office space. The office space will be secured and accessible only to authorized personnel. The antennas and support equipment for this project were selected and placed to reduce aesthetic impact to the office building and surrounding community while meeting engineering requirements of wireless technology to provide quality service in the area. AT &T Wireless Services adheres to strict safety and construction standards set by the Federal Communication Commission and will meet all City of Tukwila construction and safety standards. As shown in submittal materials, a significant amount of research has been done with regards to the health and safety issues of wireless technology. The conclusion of the research demonstrates that wireless technology does not pose adverse affects to individuals. This is a new use for an old technology. Wireless services operates on the same frequency as UHF TV did in the 50s and 60s. (See enclosed health and safety materials.) In fact, public safety is enhanced by the use of wireless service. Many service providers as law enforcement, firefighters, emergency response personnel, and medical professionals rely on wireless service to perform their jobs. By placing the antennas on the south side exterior wall of the building, residents living north of the building will not be visually impacted. The antennas will extend only one foot above the roof line. Painting the antennas to blend with the shake trim will further reduce any visual impact to pedestrian traffic in the Centerplex parking lot and foot/car traffic along Southcenter Boulevard. Construction of the project will generate minor increased traffic for about one month. Following construction, the facility will require only one vehicle trip per month for maintenance. Section 12.1.36: Encourages utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible * Shared towers, poles, antennae, trenches, easements, and substation sites * Use existing structures by cellular communications * Telephone switching facilities enclosed in buildings compatible with the surrounding area The proposed facility utilizes an existing building thereby eliminating the need for a tower or monopole. To further reduce impact, the antennas will be placed on the backside of the building and painted to blend with the exterior of the building. There will be no visual impact in the surrounding area from the support equipment. The equipment (back -up battery, radio and HVAC air conditioning unit) will be housed inside the Centerplex building in a secured office space inaccessible to the public. 5. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. The facility location and design were selected, considering topography of the area, engineering restraints of wireless communication technology and impact on the community. To provide quality service throughout an area, wireless communication systems rely on a series of strategically placed antennas to communicate. The signals must be unobstructed to "see" each antenna for a hand off. To further reduce visual impact, the antennas and stands are neutral colors and the support equipment will be located inside the building in an existing office space. Increased cellular use in this service area is causing delayed transmissions, dropped calls and busy signals for customers. This facility is needed to increase capacity and improve service. The Federal Communications Commission (FCC) mandates that licensees (AT &T) provide thorough coverage within their licensed areas. This site will provide needed capacity to ensure continuing quality service and availability of telecommunication for customers. Please find attached a copy of the bill signed into law on March 30, 1996. New Section 2 reads as follows: (1) Decisions pertaining to applications to site personal wireless service facilities are not subject to the requirements of RCW 43.21C.030 (2) (c), if those facilities meet the following requirements: (a) (i) The facility to be sited is a microcell and is to be attached to an existing structure that is not a residence or school and does not contain a residence or a school; or (ii) the facility includes personal wireless service antennas, other that a microcell, and is to be attached to an existing structure that is not a residence or school and existing structure is located in a commercial, industrial, manufacturing, forest or agricultural zone; or (iii) the siting project involves constructing a personal wireless service tower less than sixty feet in height that is located in a commercial, industrial, manufacturing, forest or agricultural zone; and (b) The project is not in a designated environmentally sensitive area; and (c) The project does not consist of a series of actions: (I) some of which are not categorically exempt; or (ii) that together may have a probable significant adverse environmental impact. This facility meets all the requirements of the Act. To our knowledge the City of Tukwila has not acted upon the law, so we have included a copy of the SEPA Checklist and supporting documents. If this proposed facility is exempt, please provide written documentation of the decision and notification of process and time frame for the permitting process without SEPA.
